Finding Aid POTT-61-9 CITIZEN BAND OF POTAWATOMI INDIANS OF OKLAHOMA SHAWNEE AREA FIELD OFFICE SPECIAL BUSINESS COMMITTEE MEETING February 16, 1961 RESOLUTION A RESOLUTION AMENDING THE CONSTITUTION OF THE CITIZEN BAND OF POTAWATOMI INDIANS OF OKLAHOMA ARTICLE II TO SPECIFY A DEGREE OF BLOOD WHEREAS: Many complaints have been received from various Tribal members about the number of individuals who are being placed on the Roll of the Citizen Band of Potawatomi Indians, and WHEREAS: Many complaints have been received because of the number of persons who are being placed on the Tribal Roll who are of practically no Potawatomi Indian blood, and WHEREAS: It is the desire of the Tribe to place a limitation as to the degree of blood to be eligible for enrollment of the Citizen Band of Potawatomi Indians of Oklahoma Tribe, and WHEREAS: It has been determined by the Business Committee that 1/8 th degree Potawatomi Indian blood should be established as being required for eligibility for enrollment in the Citizen Band of Potawatomi Indians of Oklahoma. NOW THEREFORE BE IT RESOLVED: That Article II of the tribal constitution of the Citizen Band of Potawatomi Indians of Oklahoma shall be amended as follows: Section 1. The membership of the Citizen Band of Potawatomi Indians of Oklahoma shall consist of the following persons: (a) All persons of Indian blood who were bona fide members of the Citizen Band of Potawatomi Indians of Oklahoma and who were enrolled or were entitled to be enrolled on the official census roll of the Band as of January 1, 1937. (b) Each child born since the date of said roll and prior to the effective date of Amendment IV, each of whose parents was a member of the Tribe. (c) Each child of Citizen Band of Potawatomi blood born prior to the effective date of Amendment IV of a marriage between a member of the Tribe and any other person. (d) Each child who is of one-eighth or more Citizen Band of Potawatomi Indian blood born on or after the effective date of Amendment IV, each of whose parents is a member of the Tribe. POTT-61-9 Page 2 (e) Each child of one-eighth or more Citizen Band of Potawatomi Indian blood who on or after the effective date of Amendment IV is born of a marriage between a member of the Tribe and any other person. Section 2. As used in Section 1, the term "a member of the Tribe" means a member of the Tribe at the time of the child’s birth, or, in the case of a posthumous child of a deceased parent, a member of the Tribe at the time of such parent’s death. Section 3. The burden of proof as to quantum of Citizen Band of Potawatomi blood will be on the claimant for enrollment in each case. Section 4. The Council shall have power to prescribe rules and regulations, subject to the approval of the Secretary of the Interior, covering future membership including adoptions and the loss of membership. BE IT FURTHER RESOLVED: That the foregoing proposed amendment be presented to the Citizen Band of Potawatomi eligible voters in a referendum vote authorized by the Secretary of the Interior in accordance with the authority contained in Article XI of the Constitution of the Potawatomi Tribe of Oklahoma. CERTIFICATION We hereby certify that the foregoing Resolution was duly adopted by a vote of 4 in favor and none voting against, there being a quorum of the Business Committee present at a Special Business Committee Meeting held February 16, 1961. Chairman Secretary CITIZEN BAND OF POTAWATOMI INDIANS OF OKLAHOMA POTT-61-10 SHAWNEE AREA FIELD OFFICE SPECIAL BUSINESS COMMITTEE MEETING February 16, 1961 RESOLUTION A RESOLUTION REQUESTING AN ACT OF CONGRESS TO CONVEY CERTAIN LAND FROM THE CITIZEN BAND OF POTAWATOMI INDIANS OF OKLAHOMA TRIBE TO THE ORIGINAL OWNERS OR THEIR HEIRS. WHEREAS: The Southern Potawatomi Community House has been sold, and WHEREAS: The Citizen Band of Potawatomi Indians Tribe no longer has any use for the land from which the Community House was moved, and it is the disire of the members of the Citizen Band of Potawatomi Indians of Oklahoma that this land be returned to the individual, or his heirs, who donated this land for Tribal use, and WHEREAS: There is no authority by which the Tribe may convey this land in accordance with their desire, NOW THEREFORE, BE IT RESOLVED: That the Secretary, or his authorized representative, is hereby authorized and requested to cause the necessary legislation to be enacted by Congress so that the following described land will be conveyed to the "United States in Trust for" the present owners: To the Heirs of George Shawdah (Shawdoh), the E/2 SE SE SE NE, Sec. 7-6N-5E, 1.25 acres, SURFACE ONLY, allotment of Mary Acton, CP-80 CERTIFICATION We hereby certify that the foregoing Resolution was duly adopted by a vote of 4 in favor and none voting against, there bing a quorum of the Business Committee present at a Special Business Committee Meeting held February 16, 1961. Chairman Secretary POTT-61-11 CITIZEN BAND OF POTAWATOMI INDIANS OF OKLAHOMA SHAWNEE AREA FIELD OFFICE SPECIAL BUSINESS COMMITTEE MEETING May 11, 1961 RESOLUTION A RESOLUTION ACCEPTING THE REDRAFTED AMENDMENT TO THE CONSTITUTION AND BY LAWS. WHEREAS: A Special Business Committee meeting was held on May 11, 1961 to review the amendment as redrafted by the Bureau of Indian Affairs and set forth in their letter of April 24, 1961, and WHEREAS: The redrafted amendment to Article II, Sections 1, 2, 3, and 4 has been approved by the Assistant Secretary of the Interior,, John A. Carver, Jr., and WHEREAS: The Business Committee in Special Meeting discussed the proposed amendment and after discussion accepted the amendment. NOW THEREFORE BE IT RESOLVED: That the redrafted amendment to Article II, Sections 1, 2, 3, and 4 is accepted by the Business Committee of the Citizen Band of Potawatomi Indians of Oklahoma. BE IT FURTHER RESOLVED: That this amendment to the Constitution and By Laws shall be presented at the Annual Council Meeting of the Citizen Band of Potawatomi Indians of Oklahoma for ratification or rejection in accordance with the Constitution and By Laws, to be held on June 29, 1961 at 1 P.M. in the Citizen Band Community House south of Shawnee, Oklahoma. CERTIFICATION We hereby certify that the foregoing Resolution was duly adopted by a vote of 5 in favor and none voting against, there being a quorum of the Business Committee present at a Special Business Committee Meeting held May 11, 1961.
