Finding AidResolutions not made available due to enrollment: Pott-62-3, Pott-62-8, Pott-62-9 62-4: 9/14/1961: SUMMARY: Special Business Committee Meeting: Resolution to set forth the manner in which funds to the credit of the Citizen Band of Potawatomi Indians of Oklahoma, derived from claims payment docket 71-A are to be utilized by the said Tribe in accordance with Public Law 87-2-5, adopted by the 87th Congress under date of September 6, 1961 (75 Stat. 474) said funds being appropriated by the Act of September 8, 1960 (74 Stat 830) TRANSCRIPTION: Pott-62-4 CITIZEN BAND OF POTAWATOMI INDIANS OF OKLAHOMA SHAWNEE AREA FIELD OFFICE SPECIAL BUSINESS COMMITTEE MEETING September 14. 1961 RESOLUTION A RESOLUTION TO SET FORTH THE MANNER IN WHICH FUNDS TO THE CREDIT OF THE CITIZEN BAND OF POTAWATOMI INDIANS OF OKLAHOMA, DERIVED FROM CLAIMS PAYMENT DOCKET 71-A ARE TO BE UTILIZED BY THE SAID TRIBE IN ACCORDANCE WITH PUBLIC LAW 87-205, ADOPTED BY THE 87TH CONGRESS UNDER DATE OF SEPTEMBER 6, 1961 (75 Stat. 474) SAID FUNDS BEING APPROPRIATED BY THE ACT OF SEPTEMBER 8, 1960 (74 Stat 830) WHEREAS: An amount of $I5,900.00 shall be retained in the Treasury of the United States to the credit of the Tribe and shall be used by the Business Committee of said Tribe for operating expense, for the Community order at (illegible) for the Roll, and Lee Burnett (illegible, possible “report”) The balance of the funds to the credit of the Citizen (Ink bleed “a loud speaker”) Potawatomi Indians of Oklahoma, after deduction of the foregoing $15,900.00, shall be paid per capita to members of said Tribe under the The (Ink bleed illegible word) procedures: 1. The Roll for the purpose of this payment shall be closed as of midnight September 15, 1961. (pencil writing reads June 29, 1963) 2. The Roll prepared by Bernard Heer, showing the membership of the Band shall be available for inspection at his home, 1909 North Louisa Street, Shawnee, Oklahoma, for a period of 60 days, from September 15, 1961. Any person born prior to September 15, 1961 whose name does not appear on the membership roll must by midnight November 14, (illegible writing above “November” 14), 1961 file an application in writing to have his name included on the Roll. Such application must be filed with Mr. Bernard Heer, 1909 North Loyisa Street, Shawnee, Oklahoma and must be accompanied by a birth certificate to or other evidence of entitle- ment to membership, acceptable to the Business Committee. If a person is a minor, or otherwise unable to act in his own behalf, the parent, guardian, next of kin, or the person responsible for his care may file an application on his behalf. No person born after September 15, 1961 and no person known to be enrolled as a member of anther Tribe or Band of Indians shall be eligible to have his name placed on the Roll for the purpose of sharing in the distribution of the judgement fund. 3. Mr. Bernard Heer is hereby authorized to act for the Band in determining whether applicants meet the membership requirements set out in the Tribal Constitution and shall have not to exceed 30 days from November 14,1961 to review and pass on all applications for enrollment. If the applicant is determined to meet the requirements for enrollment, his name shall be entered on the Roll. The applicant shall be notified by postaI card that his application for enrollment has been approved. If the determination made by Mr. Bernard Heer is adverse, the applicant shall be notified of such decision in writing by certified mail, return receipt re Pott-62-4 Page 2 requested, and shall be given full explanation of the reasons his application was rejected and shall be told of his privilege of appeal within 30 days from date of receipt of rejection notice, to the Secretary of the Interior from the decision of the Business Committee. 4. Appeals must be in writing addressed to the Secretary of the Interior and mailed to the Area Field Representative, Shawnee Area Field Office, Shawnee, Oklahoma within 30 days from the date of receipt of the rejection notice. The appellant may submit with his appeal any supporting evidence not previously furnished. The decision of the Sec- retary on an appeal shall be final and conclusive and the appellant shall be given written notice of the decision. If upon review of the evidence submitted by the appellant the Secretary of the Interior deter- mines that he has established his right to enrollment for appellant shall be notified and the Business Committee shall enter his name on the payment roll. 5. Upon completion of action on all applications and upon notice from the Secretary that all appeals have been determined, the Roll shall be completed, approved, and reviewed by the Business Committee and shall be certified as containing the names of those persons entitled to be en- rolled, by the Chairman of the Business Committee and shall be transmitted in triplicate to the Shawnee Area Field Representative who shall forward it to the Area Director. 6. Each person whose names appears on the approved Roll shall receive an equal share of the judgement fund. The shares of adult persons whose addresses are known shall be paid directly to them. The paternal parent, if living with and providing for, otherwise the maternal parent, if living with and providing for, or the legal guardian shall be paid the shares due all minor children, provided, in broken homes where the child- ren do not reside with either of their natural parents and where no legal guardian has been appointed, their shares shall be deposited to their IIM account and shall be disbursed according to departmental regulations. The determination as required by this section shall be made by the Business Committee. The shares of those persons whose whereabouts is unknown shall remain in the Regional Disbursing Office and these shares may be paid to individuals upon their request, or whenever their addresses are known, provided, however, that if the individuals have not been located within a period of three years from the actual date of distribution, such funds shall be deposited in the United States Treasury to the credit of the miscellaneous receipt symbol “148881 unclaimed moneys of individuals whose whereabouts are unknown”, supported by a list of the persons and their respective shares. Should persons determined eligible to participate in this distribution die before actual distribution is made then their share shall be paid to their heirs or devises as might be determined by departmental regulations. In the event no heirs are located within a period of 12 months from the date of determination the funds so due shall revert to the Potawatomi Tribal account, to be used along with other funds for financing Tribal expenses. 8. All persons known by the Shawnee Area Field Office Representative (“Indian Agency” written in pencil above Area Field Office) (Illegible) the Tribal Officials to have been declared legally incompetent prior (illegible) the date of distribution shall have their money placed in an IIM account (illegible) be disbursed according to departmental regulations, or distribution may (illegible) made to paternal parent, maternal parent or legal guardian if they be (illegible possibly “known”) 9. No person known to be enrolled on any other Tribal Roll shall be entitled to share in this per capita payment. NOW THEREFORE BE IT RESOLVED: That the Secretary of Interior is (illegible) requested to approve the foregoing stipulations and authorize the expenditure of these funds as set forth. TRANSCRIPTION: Pott-62-5 CITIZEN BAND OF POTAWATOMI INDIANS OF OKLAHOMA Pott-62-5 SHAWNEE AREA FIELD OFFICE SPECIAL BUSINESS COMMITTEE MEETING September 14, 1961 RESOLUTION (ILLEGIBLE) RESOLUTION REQUESTING $15,900.00 FOR OPERATING EXPENSES OF THE CITIZEN BAND OF POTAWATOMI INDIANS OF OKLAHOMA TRIBE WHEREAS: The Business Committee of the Citizen Band of Potawatomi Indians of Oklahoma has adopted Resolution Pott-62-4 requesting that monies be set aside from the surplus land claim Docket 71-A for the use of the Business Committee for operating expense, maintaining the Tribal Roll and the Community House, and WHEREAS: The money for Claim Docket 71-A has been appropriated by (ILLEGIBLE) and Distribution of the money has been approved by Congress (ILLEGIBLE) date of September 6, 1961 (75 Stat. 474), and WHEREAS: The previous estimate of funds required for handling the Tribal affairs in connection with the Tribal distribution of the per capita (ILLEGIBLE) has proven to be far inadequate, and WHEREAS: The Business Committee of the Citizen Band of Potawatomi Indians of Oklahoma is in need of money for operating expenses, the Tribal (ILLEGIBLE) and Community House for a period of 5 years: Business Committee per diem for 5 years $3,500.00 (regular, special and meetings with Bureau Officials) Secretarial assistance and material records For per capita voucher preparation $6,400.00 Office supplies for 5 years $2,000.00 Community House, modernize and repairs $4,000.00 Total $15,900.00 NOW THEREFORE BE IT RESOLVED: That the Area Director is hereby authorized and request that $15,900.00 be set aside from the claim money above described for the use of the Citizen Band of Potawatomi of Oklahoma for a 5 year period as stipulated above. TRANSCRIPTION: Pott-62-6 CITIZEN BAND OF POTAWATOMI INDIANS OF OKLAHOMA POTT-62-6 SHAWNEE AREA FIELD OFFICE SPECIAL BUSINESS COMMITTEE MEETING October 9, 1961 RESOLUTION A RESOLUTION REQUESTING FUNDS FOR FISCAL YFAR 1962 FOR OPERATING EXPENSES FOR POTAWATOMI OF OKLAHOMA BUSINESS COMMITTEE WHEREAS: Resolution Pott-62-5, adopted under date of September 14 1961 requested $15,900.00 be set aside from the recently approved claims monies for expenses of the Business Committee for five years, and WHEREAS: There is only a balance of $554.22 remaining to the Tribe in local depository, and WHEREAS: The Business Committee is now working in preparation of a second per capita payment voucher and additional secretarial assistance is required to enroll all new eligible applicants, and (ILLEGIBLE) WHEREAS: The $4000.00 requested in the five year budget for repairs and and protection of the Community House are needed immediately. Dan Nadeau, Chairman Bernard Heer, Secretary 62-10: 3/15/1962: SUMMARY: Resolution to take into trust certain land previously conveyed to the Citizen Band of Potawatomi Indians of Oklahoma by Congress of the United States TRANSCRIPTION: POTT-62-10 POTT-62-10 CITIZEN BAND OF POTAWATOMI INDIANS OF OKLAHOMA SHAWNEE AREA FIELD OFFICE REGULAR BUSINESS COMMITTEE MEETING March 15, 1962 RESOLUTION A RESOLUTION TO TAKE INTO TRUST CERTAIN LAND PREVIOUSLY CONVEYED TO THE CITIZEN BAND OF POTAWATOMI INDIANS OF OKLAHOMA BY CONGRESS OF THE UNITED STATES WHEREAS: Land described as Lot 1 (northwest quarter of northwest quarter) and north half of Lot 2 (north half of southwest quarter of northwest quarter) and the part of the north half of the southeast quarter of the northwest quarter lying west of the east right-of-way line of Oklahoma State Highway Numbered 18, all in Section 31, Township 10 North, Range 4 East of the Indian meridian, in Pottawatomie County, Oklahoma consisting of 57.99 acres was conveyed to the Citizen Band of Potawatomi Indians of Oklahoma for tribal use by act of Congress on September 13, 1960 (74 Stat. 903), and WHEREAS: It is the desire of the members of the Citizen Band of Potawatomi Indians of Oklahoma that this land be taken into a trust status for the following purposes: 1. This would protect the tribe from the possibility of future unscruplous business committee members from selling this land and utilizing the funds therefrom for benefit other than the Tribe. 2. Placing the land in trust would circumvent possibility of tribal members selling their undivided interest in the tribal holdings to unscrupulous non Indians. A Federal Court case is now pending where this actually happened with another Tribe in Oklahoma. 3. Supervision of the Government on long term business leases and other business matters relative to this land is a desirable. NOW THEREFORE BE IT RESOLVED: That the Commissioner of Indian Affairs is hereby requested to introduce action so as to cause the above described land to be taken into trust status with the title running to United States of America in Trust for the Citizen Band of Potawatomi Indians of Oklahoma. CERTIFICATION We hereby certify that the foregoing Resolution was duly adopted by a vote of 5 in favor and None voting against, there being a quorum of Business Committee present at a Regular Business Committee Meeting held March 15, 1962. Dan Nadeau, Chairman Bernard Heer, Secretary 62-11: 4/18/1962: SUMMARY: Resolution pertaining to designation of key tracts for use in economic development programing for the Citizen Band of Potawatomi Indians of Oklahoma TRANSCRIPTION: POTT-62-11 POTT-62-11 CITIZEN BAND OF POTATOMI INDIANS OF OKLAHOMA SHAWNEE AREA FIELD OFFICE SPECIAL BUSINESS COMMITTEE MEETING April 18, 1962 RESOLUTION A RESOLUTION PERTAINING TO DESIGNATION OF KEY TRACTS FOR USE IN ECONOMIC DEVELOPMENT PROGRAMING FOR THE CITIZEN BAND OF POTAWATOMI INDIANS OF OKLAHOMA WHEREAS: The Business Committee of the Citizen Band of Potawatomi Indians of Oklahoma has reviewed the location of all allotted lands remaining in trust or restricted status, and WHEREAS: It is the opinion of the Business Committee that the following described lands should be designated as key tracts: 1. The old Sanatorium lands located one and a quarter mile South of Shawnee, Oklahoma, which are presently owned by the government, containing approximately 194 acres. 2. The land described as N½ of Lot 3 of the SW¼ of Section 31, Township 10 North, Range 4 East, containing approximately 19.51 acres. NOW THEREFORE BE IT RESOLVED: That the above described tracts of land be designated as key tracts in connection with the Socio-Economic Development Program for the Citizen Band of Potawatomi Indians of Oklahoma since these tracts are strategically located for development for the benefit of the Tribe. CERTIFICATION We hereby certify that the foregoing Resolution was duly adopted by a vote of 5 in favor and None voting against, there being a quorum of the Business Committee present at a Special Business Committee Meeting held April 18, 1962. Dan Nadeau, Chairman Bernard Heer, Secretary 62-12: 5/16/1962: SUMMARY: Resolution requesting funds for operating expenses for the business committee of the Citizen Band of Potawatomi Indians of Oklahoma for the Balance of Fiscal Year 1962 and for Fiscal Year 1963 TRANSCRIPTION: POTT-62-12 POTT-62-12 CITIZEN BAND OF POTAWATOMI INDIANS OF OKLAHOMA SHAWNEE AREA FIELD OFFICE SPECIAL BUSINESS COMMITTEE MEETING May 16, 1962 RESOLUTION A RESOLUTION REQUESTING FUNDS FOR OPERATING EXPENSES FOR THE BUSINESS COMMITTEE OF THE CITIZEN BAND OF POTAWATOMI INDIANS OF OKLAHOMA FOR THE BALANCE Of FISCAL YEAR 1962 AND FOR FISCAL YEAR 1963 WHEREAS: Resolution Pott-62-5, adopted under date of September 14, 1961, requested $15,900.00 be set aside from the approved claim monies for expenses of the Business Committee for five years, and WHEREAS: Resolution Pott-62-6 was adopted under date of October 9, 1961 requesting $8,300.00 for operating expenses for fiscal year 1962, and WHEREAS: The funds requested in Pott-62-6 was never approved and were never received by the Business Committee, and WHEREAS: There is now only a balance of $281.68 remaining in a local deposi- tory for the Tribe, and all surface leasing monies received for the 60 acres of Tribal land have also been utilized for operating ex- penses, and WHEREAS: It is necessary that additional funds be made available for per diem, secretarial assistance and office supplies and repairs to the Community House, and WHEREAS: There is much work yet to be done to review and enroll all new applications made for enrollment since the 1960 per capita payment. NOW THEREFORE BE IT RESOLVED That the budget for the balance of fiscal year 1962 and for fiscal year 1963 will be as follows: Per Diem - - - - - $ 700.00 Secretarial assistance and material for voucher - - $3,200.00 Office supplies - - - $ 400.00 Community House (repairs and protection) - - $4,000.00 Total - - $8,300.00 AND BE IT FURTHER RESOLVED That the Area Director is requested to approve this budget in the amount set forth above and that these funds be made available at the earliest possible date from claims funds available in the United States Treasure which were derived from the land claim Docket 71-A, and these funds to be deposited in a local depository for the use of the Business Committee, and BE IT FURTHER RESOLVED That the Secretary of the Interior authorize the release of these funds irregardless of the suit now pending in the Federal Court of Kansas as filed by members of the Prairie Band of Potawatomi of Kansas, as these funds are separate and apart from the funds to which the Prairie Band are entitled. Furthermore unless these funds are made available the maintance of the Citizen Band Tribal Roll in a current status will be drastically curtailed if not stopped completely. R.R., thence Southwesterly along said right-of-way a distance of 1452 feet, thence West 597 feet to the point of beginning and containing 39.2 acres more or less. ALSO, Beginning at a point 58 feet East of the Northeast corner of the Southeast Quarter (SE/4) of the Northwest Quarter (NW/4) of Sec. 31-1ON-4E, thence South 191.5 feet, thence East 626 feet, thence North 191.5 feet, thence West 632 feet to the point of beginning and containing 2.77 acres, more or less; making a total of 41.97 acres, more or less usually referred to as the Shawnee Indian Sanatorium now being used by the Indian Branch of the United States Public Health Service, and WHEREREAS: There are various rumors that the United States Public Health Service on or about the 1st day of July, 1962 will abandon this property, and WHEREAS: It is also rumored that the United States Public Health Service will convey the Shawnee Indian Sanatorium to other person or persons, and POTT-62-13 WHEREAS: The land described as: SE of NW, & NE of SW, & NW of SE, & SW of NE, & SE of NE, & NE of NE, Section 31, Township 10 North, Range 4 East of the Indian Meridian, Pottawatomie County, State of Oklahoma, 240 acres, more or less, Less a tract of land on which the government issued a patent in fee to the Trustees of the Friends of Indians Affairs for 3.06 acres in the SW corner of the NE SW, more particularly described as: Commencing at a point 20 chains South and 11 chains West of the Center of Sec. 31-10N-4E, thence West 9 chains, North 3.34 chains, thence East 9 chains, thence South 3.34 chains, to point of beginning – 3.06 acres, has been declared surplus by the Bureau of Indian Affairs, and WHEREAS: The Citizen Band of Potawatomi Indians of Oklahoma claim that the Shawnee Indian Sanatorium property and the land surrounding the Sanatorium belongs to the Tribe, as this is a part of the Okla- homa Reservation bought by the Tribe from the United States Government, and WHEREAS: The Treaty of February 27, 1867, as amended, provided for the purchase of the Oklahoma Reservation from Tribal Funds held in trust by the United States Government, the amount paid being $119,790.75, and WHEREAS: In 1870 the Secretary of the Interior approved the land selected for the Oklahoma Reservation which was described as: The land between the Canadian River and the North Fork of said river and bounded on the East by the West line of the Seminole lands & extending west, from said boundary line, to embrace nine hundred square miles. NOW THEREFORE BE IT RESOLVED: That The Congress of the United States is hereby requested to enact legislation to convey land described as SE of NW, & NE of SW, & NW of SE, & SW of NE, & SE of NE, & NE of NE, Section 31, Township 10 North, Range 4 East of the Indian Meridian, Pottawatomie County, State of Oklahoma, containing 240 acres, more or less, to The United States of America In Trust for The Citizen Band of Potawatomi Indians of Oklahoma. Less the 3.06 acres on which the government issued a patent in fee. CERTIFICATION We hereby certify that the foregoing Resolution was duly adopted by a vote of 4 in favor and None voting against, there being a quorum of the Business Committee present at a Special Business Committee Meeting held May 21, 1962.
