TRANSCRIPTION: POTT-63-1 CITIZEN BAND OF POTAWATOMI INDIANS OF OKLAHOMA SHAWNEE AREA FIELD OFFICE SPECIAL BUSINESS COMMITTEE MEETING August 16, 1962 RESOLUTION WHEREAS: The Citizen Band of Potawatomi Indians of Oklahoma claim that the Shawnee Indian Sanatorium property and the land surrounding the Sanatorium belongs to the Tribe as this is a part of the Oklahoma Reservation bought by the Tribe from the United States Government, and WHEREAS: It is the desire of the Citizen Band of Potawatomi Indians of Oklahoma to form a corporation under Oklahoma State Law with those Tribes in the Shawnee Area Field Office area that are interested, and WHEREAS: It is the intent of the Citizen Band of Potawatomi Indians to lease these facilities to the Tribal corporation, provided that said corporation is formed within six (6)months after acquisition of the land by the Tribe, so that said corporation may convert said facilities to an Old Folks Home and said facilities shall be maintained in a suitable condition by the Tribal corporation from any funds which said corporation shall receive, and WHEREAS: It will be an advantage to the Indians of this area to have an Old Folks Home, and WHEREAS: The Citizen Potawatomi Tribe has no income of its own and no prospects for an income the remaining land, approximately 200 acres, will be needed by the Tribe for income so that the Citizen Potawatomi Tribe can support their share of the Old Folks Home, and WHEREAS: There is some equipment such as beds, chairs, desks, files, mattresses and bed linens which can be used in the future operation, this equipment shall not be disposed of by the United States Public Health Service, and POTT-63-1 WHEREAS: It is the desire that this land be conveyed to the Citizen Band of Potawatomi Indians of Oklahoma in a trust status so that adequate control of responsibility and leasing can be maintained. THEREFORE BE IT RESOLVED: That the Secretary of the Interior is hereby requested to initiate legislation for conveyance of the following described land, surface and minerals , to the United States In Trust For The Citizen Band of Potawatomi Indians of Oklahoma for the above purposes . SE of NW, & NE of SW, & NW of SE, & SW of NE, & SE of NE, & NE of NE, Section 31, Township 10 North, Range 4 East of the Indian Meridian, Pottawatomie County, State of Oklahoma, containing 240 acres, more or less, except therefrom 3.06 acres for the Quaker Mission, and except therefrom that part lying West of Highway #18. 63-3: 2/1/1963: SUMMARY: Absentee Shawnee Indian Tribe and the Citizen Band of Potawatomi Indians of Oklahoma are organized under the Act of June 26, 1936 TRANSCRIPTION: CITIZEN BAND OF POTAWATOMI INDIANS OF OKLAHOMA SHAWNEE AREA FIELD OFFICE REGULAR BUSINESS COMMITTEE MEETING February 1, 1963 RESOLUTION WHEREAS: The Absentee Shawnee Indian Tribe and the Citizen Band of Potawatomi Indians of Oklahoma are organized under the Act of June 26, 1936, and WHEREAS: The Absentee Shawnee Indian Tribe and the Citizen Band of Potawatomi Indians of Oklahoma entered into an agreement on the 2nd day of January 1963 for the division of the former Shawnee Indian Agency lands and the former Shawnee Indian Sanatorium buildings and lands between the two above­ mentioned Indian tribes, now BE IT THEREFORE RESOLVED that the attached agreement entered into by the Absentee Shawnee Indian Tribe and the Citizen Band of Potawatomi Indians is hereby accepted by the official govern­ ing body of the Citizen Band of Potawatomi Indians of Oklahoma, and BE IT FURTHER RESOLVED that the necessary action be taken by the Bureau of Indian Affairs , Secretary of the Interior and the Congress of the United States to officially complete the division and transfer of the lands and buildings as agreed upon by the two tribes. C E R T I F I C A T I 0 N Adopted in a regular meeting of the Citizen Band of Potawatomi Indians Business Committee on this 1st day of February 1963 and there being a quorum present, the vote being 4 for, and none against. Signed Dan Nadeau, Chairman and Bernard Herr, Secretary-Treasurer. 63-4: 6/29/1963: SUMMARY: Annual Council Meeting-Resolution authorizing that 10% of the present claim funds in the United States Treasury and 10% of all future claims funds received be set aside for programing by the Citizen Band of Potawatomi Indians of Oklahoma. TRANSCRIPTION: POTT-63-4 CITIZEN BAND OF POTAWATOMI INDIANS OF OKLAHOMA SHAWNEE INDIAN AGENCY ANNUAL COUNCIL MEEPING June 29, 1963 RESOLUTION A RESOLUTION: AUTHORIZING THAT 10% OF THE PRESENT CLAIM FUNDS IN THE UNITED STATES TREASURY AND 10% OF ALL FUTURE CLAIMS FUNDS RECEIVED BE SET ASIDE FOR PROGRAMING BY THE CITIZEN BAND OF POTAWATOMI INDIANS OF OKLAHOMA. WHEREAS: The Congress of the United States has stipulated that claim funds should be utilized as much as possible for programing by individual Tribes and WHEREAS. The present policy of the Bureau of Indian Affairs and the Secretary of the Interior is to require programing a part of all claims funds received, prior to approval of per capita Payments of the balance of the funds, and WHEREAS: The Business Committee of the Citizen Band or Potawatomi Indians of Oklahoma has requested from the Bureau of Indian Affairs that 186 acres of the old Shawnee Indian Sanatorium lands be conveyed to the Tribe, and sudh[sic] legislation was introduced in Congress by Congressman Tom Steed, and WHEREAS: Justification for the acquisition of the foregoing lands was the development of the 186 acres for the social and economic improvement of the Citizen Band of Potawatomi Indians of Oklahoma, and funds for this purpose will be needed in the development of these lands, and WHEREAS: It is proposed that as sufficient funds accumulate in the reserve to be established by this resolution, an educational program would be established which could benefit the eligible children of tribal members regardless of their residence. NOW THEREFORE BE IT RESOLVED: That 10% of tribal funds now in the United States Treasury shall be set aside for programing, and BE IT FURTHER RESOLVED: That 10% of all funds received from future claims settlements shall be set aside and retained in the United States Treasury for programing purposes of the Citizen Band of Potawatomi Indians of Oklahoma. We hereby certify that the foregoing Resolution was duly adopted by a vote of 42 for and 12 against, of the Council, there being a quorum present at the meeting. Dan Nadeau, Chairman Bernard Heer, Secretary 63-5: 6/29/1963: SUMMARY: Annual Council Meeting-Resolution to set forth the manner in which funds to the credit of the Citizen Band of Potawatomi Indians of Oklahoma, derived from claim payment docket 71-A are to be utilized by the said Tribe in accordance with public law 87-205, adopted by the 87th Congress under Date of September 6, 1961 (75 Stat. 474) said funds being appropriated by the Act of September 8, 1960 (74 Stat. 830). Resolution reiterates and reaffirms Resolution 62-4. TRANSCRIPTION: POTT-63-5 CITIZEN BAND OF POTAWATONI INDIANS OF OKLAHOMA SHAWNEE INDIAN AGENCY ANNUAL COUNCIL MEETING June 29, 1963 RESOLUTION A RESOLUTION TO SET FORTH THE MANNER IN WHICH FUNDS TO THE CREDIT OF THE CITIZEN BAND OF POTAWATOMI INDIANS OF OKLAHOMA, DERIVED EROM CLAIM PAYMENT DOCKET 71-A ARE TO BE UTILIZED BY THE SAID TRIBE IN ACCORDANCE WITH PUBLIC LAW 87-205, ADOPTED BY THE 87th CONGRESS UNDER DATE OF SEPTEMBER 6, 1961 (75 Stat. 474) SAID FUNDS BEING APPROPRIATED BY THE ACT OF SEPTEMBER 8, 1960 (74 Stat. 830) WHEREAS: This Resolution reiterates and reaffirms Resolution Pott-62-4 adopted under date of September 14, 1961, and WHEREAS: An amount of $15,900.00 shall be retained in the Treasury of the United States to the credit of the Tribe and shall be used by the Business Committee of said Tribe for operating expense, for the Community House and for the Roll, and WHEREAS: 10% of the claim funds shall be set aside in accordance with Resolution Pott-63-4 for programing, and WHEREAS: The balance of the funds to the credit of the Citizen Band of Potawatomi Indians of Oklahoma, after deduction of the foregoing, shall be paid per capita to members of said Tribe under the following procedures: 1. The Roll for the purpose of this payment shall be closed as of midnight June 29, 1963. 2. The Roll prepared by Bernard Heer, showing the membership of the Band shall be available for inspection at his home, 1909 North Louisa Street, Shawnee, Oklahoma, for a period of 60 days, from June 29, 1963. Any person born prior to June 29, 1963 whose name does not appear on the membership roll must by midnight August 29, 1963 file an application in writing to have his name included on the Roll. Such application must be filed with Mr. Bernard Heer, 1909 North Louisa Street, Shawnee, Oklahoma and must be accompanied by a birth certificate or other evidence of entitlement to membership, acceptable to the Business Committee. If a person is a minor, or otherwise unable to act in his own behalf, the parent, guardian, next of kin, or the person responsible for his care may file an application on his behalf. No person born after June 29, 1963 and no person known to be enrolled as a member of another Tribe or Band of Indians shall be eligible to have his name placed on the Roll for the purpose of sharing in the distribution of the judgment fund, —1- POTT-63-5 3. Mr. Bernard Heer is hereby authorized to act for the Band in determining whether applicants meet the membership requirements set out in the Tribal Constitution and shall have not to exceed 30 days from August 29, 1963 to review and pass on all applications for enrollment. If the applicant is determined to meet the requirements for enrollment, his name shall be entered on the roll. The applicant shall be notified by postal card that his application for enrollment has been approved If the determination made by Mr. Bernard Heer is adverse, the applicant shall be notified of such decision in writing by certified mail, return receipt requested, and shall be given full explanation of the reasons his application was rejected and shall be told of his privilege of appeal within 30 days from date of receipt of rejection notice, to the Secretary of the Interior from the decision of the business committee. 4. Appeals must be in writing addressed to the Secretary of the Interior and mailed to the Area Field Representative, Shawnee Indian Agency, Shawnee, Oklahoma within 30 days from the date of receipt of the rejection notice. The appellant may submit with his appeal any supporting evidence not previously furnished. The decision of the Secretary on an appeal shall be final and conclusive and the appellant shall be given written notice of the decision. If upon review of the evidence submitted by the appellant the Secretary of the Interior determines that he has established his right to enrollment the appellant shall be notified and the business committee shall enter his name on the payment roll. 5. Upon completion of action on all applications and upon notice from the Secretary that all appeals have been determined, the roll shall be completed, approved, and reviewed by the business committee and shall be certified as containing the names of those persons entitled to be enrolled by the Chairman of the business committee and shall be transmitted in triplicate to the Shawnee Area Field Representative who shall forward it to the Area Director. 6. Each person whose name appears on the approved roll shall receive an equal share of the judgment fund. The shares of adult persons whose addresses are known shall be paid directly to them. The paternal parent, if living with and providing for, otherwise 'the maternal parent, if living with and providing for, or the legal guardian shall be paid the shares due all minor children, provided, in broken homes where the children do not reside With either of their natural parents and where no legal guardian has been appointed, their shares shall be deposited to their IIM account and shall be disbursed according to departmental regulations. The determination as required by this section shall be made by the business committee. The shares of those persons whose whereabouts is unknown shall remain in the Regional Disbursing Office and these shares may be paid to individuals upon their request, or whenever their addresses are known, provided, however, that if the individuals have not claimed their share within six years after date of payment these funds shall revert back to the Citizen Band of Potawatomi Indians of Oklahoma. POTT-63-5 7. Should persons determined eligible to participate in this distribution die before actual distribution is made then their share shall be paid to their heirs or devises as might be determined by departmental regulations. In the event no heirs are located within a period of 12 months from the date of determination the funds so due shall revert to the Citizen Band Tribal account, to be used along with other funds for financing Tribal expenses. 8. All persons known by the Shawnee Area Field Representative or tribal officials to have been declared legally incompetent prior to the date of distribution shall have their money placed in an IIM account to be disbursed according to department regulations, or distribution may be made to paternal parent, maternal parent or legal guardian if they be be known. 9. No person known to be enrolled on any other Tribal Roll shall be entitled to share in this per capita payment. NOW THEREFORE BE IT RESOLVED: That the Secretary of Interior is hereby requested to approve the foregoing stipulations and authorize the expenditure of these funds as set forth. CERTIFICATION We hereby certify that the foregoing Resolution was duly adopted by a unanimous vote of the Council, there being a quorum present at the meeting. TRANSCRIPTION: POTT-63-6 CITIZEN BAND OF POTAWATOMI INDIANS OF OKLAHOMA SHAWNEE INDIAN AGENCY ANNUAL COUNCIL MEETING June 29, 1963 RESOUTION A RESOLUTION REQUESTING $15,900.00 FOR OPERATING EXPENSES OF THE CITIZEN BAND OF POTAWATOMI INDIANS OF OKLAHOMA TRIBE WHEREAS: This Resolution reiterates and reaffirms Resolution Pott-62-5 adopted under date of September 14, 1961, and WHEREAS: The Business Committee of the Citizen Band of Potawatomi Indians of Oklahoma has adopted Resolution Pott-63-5 requesting that monies be set aside from the surplus land claim Docket 71-A for the use of the Business Committee for operating expense, maintaining the Tribal Roll and the Community House, and WHEREAS: The money for Claim Docket 71-A has been appropriated by Congress and distribution of the money has been approved by Congress under date of September 6, 1961 (75 Stat. 474), and WHEREAS: The previous estimate of funds required for handling the Tribal affairs in connection with the Tribal distribution of the per capita funds has proven to be far inadequate, and WHEREAS: The Business Committee of the Citizen Band of Potawatomi Indians of Oklahoma is in need of money for operating expense, the Tribal Roll and Community House for a period of 5 years: Business Committee per diem for 5 years . • • $3,500.00 (Regular, spec ial and meetings With Bureau Officials) Secretarial assistance, material, records for per capita voucher preparation . • . . $6,400.00 Office supplies for 5 years . • . • . $2,000.00 Community House, modernize and repairs , • , $4,000.00 Total $ 15,900.00 NOW THEREFORE BE IT RESOLVED: That the Area Director is hereby authorized To request that $15,900.00 be set aside from the claims money above described for the use of the Citizen Band of Potawatomi of Oklahoma for a 5 year period as stipulated above. 63-7: 6/29/1963: SUMMARY: Resolution requesting fund for operating expenses for the Business Committee of the Citizen Band of Potawatomi Indians of Oklahoma for Fiscal Year 1964 TRANSCRIPTION: POTT-63-7 CITIZEN BAND OF POTAWATOMI INDIANS OF OKLAHOMA SHAWNEE INDIAN AGENCY ANNUAL COUNCIL MEETING June 29 1963 RESOLUTION A RESOLUTION REQUESTING FUNDS FOR OPERATING EXPENSES FOR THE BUSINESS COMMITTEE OF THE CITIZEN BAND OF POTAWATOMI INDIANS OF OKLAHOMA FOR FISCAL YEAR 1964 WHEREAS: Resolution Pott-63-6 was adopted under date of June 29, 1963, requested $15,900.00 be set aside from the approved claims monies for expenses of the Business Committee for five years, and WHEREAS: Pott-63-5 reaffirms the request of the Council that these funds be made available for the operation of the Business Committee, and WHEREAS: It is necessary that additional funds be made available for per diem, secretarial assistance, office supplies and repairs to the Community House, and WHEREAS: There is much work yet to be done to review and enroll all new applications made for enrollment since the 1960 per capita payment. NOW THEREFORE BE IT RESOLVED THAT: The budget for fiscal year 1964 be as follows: Per Diem • . . . . $ 700.00 Secretarial assistance and material for voucher . . . $3,200.00 Office supplies . , . . $400.00 Community House (repairs and protection) . . . , $4,000.00 Total . . $8,300.00 AND BE IT FURTHER RESOLVED THAT: The Area Director is requested to approve this budget in the amount set forth above and that these funds be made available at the earliest possible date from claims funds available in the United States Treasury which were derived from the land claim Docket 71-A, and these funds to be deposited in a local depository for the use of the Business Committee.
