CITIZEN BAND OF POTAWATOMI INDIANS OF OKLAHOMA
REGULAR BUSINESS COMMITTEE MEETING
SHAWNEE, OKLAHOMA
October 27, 1976
A RESOLUTION ON THE ADMINISTRATION OF THE ON-THE-JOB TRAINING CONTRACT.
WHEREAS, Central Tribes of the Shawnee Area Inc., is a non-profit-inter-Tribal
organization created to ""promote the common welfare of our people,"" and,
FURTHER, that Central Tribes of the Shawnee Area Inc., is an inter-Tribal
organization within the meaning of the rules and regulations of Public
Law 93-638.
NOW THEREFORE BE IT RESOLVED: That Central Tribes of the Shawnee Area, Inc., -
CETA Program negotiate and execute a contract with the Bureau of Indian Affairs
for the On-The-Job Training Program which serves the area of the Shawnee Agency,
subject to the following provisions:
(1) The contract application shall be reviewed by the Tribal
Business Committee, prior to submission, any amendment being
in writing and attached to the application.
(2) Copies of all correspondence relating to this contract be sent to:
Citizen Band of Potawatomi Indians of Oklahoma
Route 5, Box 151, Shawnee, Oklahoma 74801
and Central Tribes of the Shawnee Area Inc., - CETA Program,
P.O. Box 2427, University Station, Shawnee, OK 74802.
(3) The term of the contract shall be for one year, renewable
annually.
(4) The contract shall commence as soon as possible, but not less
than 120 days after the date of this resolution.

A RESOLUTION TO CONTRACT WITH MS. JUDITH MICHENER FOR THE WRITING OF PART TWO OF
THE POTAWATOMI DRAMA “KINAN CHIKOTE”, OUR FIRE, FOR FISCAL YEAR ’77.
WHEREAS, the Citizen Band of Potawatomi Indians of Oklahoma are desirous of the
writing of part two of the Potawatomi drama ""Kinan Chikote"", Our Fire, to be
produced in conjunction with the annual Pow-Wow and General Council Meeting in
June of ‘77, and,
WHEREAS, Ms. Michener is desirous of writing part two of the drama and agrees to
assume responsibility for the completion of the final written script of this
drama, and,
WHEREAS, Ms. Michener agrees to allow the Tribal Historian, Priscilla Sherard,
and the Potawatomi Historical Committee to have final approval of the completed
script before the script becomes official for the purpose of this drama, and,
WHEREAS, the Citizen Band of Potawatomi Indians of Oklahoma agree to coordinate
with Ms. Michener during the course of her writing of the script, and,
WHEREAS, Ms. Michener will commence writing of the script on November 1, and will
be paid at the rate of $250.00 per month on November 30, and December 30, and,
WHEREAS, this contract is to acknowledge that these monies are being used in
conjunction with potential other monies designed to complete the writing and full
production of this drama, and that Ms. Michener will be paid for subsequent
services as per these other contracts, and,
WHEREAS, Ms. Michener will assume full responsibility for the research, typing,
and reproduction of copies of the script as needed by the Historical Committee and
participants in the drama, and,
WHEREAS, this contract is entered into in good faith by both parties.
NOW THEREFORE BE IT RESOLVED: That the Citizen Band of Potawatomi Indians of
Oklahoma will contract with Ms. Michener for the writing of part two of the
Potawatomi Drama.

November 8, 1976
A RESOLUTION ADOPTING A PLAN FOR THE USE OF CERTAIN FUNDS AWARDED
BY THE INDIAN CLAIMS COMMISSION.
WHEREAS, the Citizen Band of Potawatomi Indians of Oklahoma share,
with four other groups of Potawatomis, in awards made by the Indian
Claims Commission in Dockets 15-K, 29-J, 217, 15-M, 29-K, and 146,
and,
WHEREAS, the General Council of the Citizen Band of Potawatomi
Indians of Oklahoma in its Annual General Council Meeting on June 28,
1975, agreed by resolution Pott-75-25 to accept any division that
would give the Tribe 1,482 shares or more, but requested that the
Bureau do additional research and make a final certification to the
Tribe, and,
WHEREAS, the Commissioner of Indian Affairs in his memorandum of
December 31, 1975, to the Area Directors of the Anadarko and
Minneapolis Areas proposed that the funds be divided as follows:
1. Citizen Band 1,718/3,523
2. Prairie Band 809/3,523
3. Hannahville Indian Community 457/3,523
4. Forest County Potawatomi Community 272/3,523

WHEREAS, the Business Committee of the Tribe, on behalf of the Tribe
and under authority contained in resolution Pott-75-25,
hereby accepts the proposed division as outlined above.
NOW THEREFORE BE IT RESOLVED: That, the following plan is hereby
adopted pursuant to Public Law 93-134 (87 Stat. 466, 467, and 468)
enacted October 19, 1973, and that the Secretary of the Interior, or
his designated representative, is hereby requested to review this plan
and to authorize a Hearing of Record according to Part 60 to Title 25
of the Code of Federal Regulations.
PLAN
I. Eighty percent (80%) of the funds awarded to the Citizen Band of
Potawatomi Indians of Oklahoma from Dockets 15-K, 29-J, 217, 15-M, 29-K,
and 146, together with the interest accrued on said 80%, minus attorney
fees and litigation expenses, will be distributed on a per capita basis
to eligible members of the Tribe. Tribal rolls will be updated to in-
sure the eligibility of all members submitted for the per capita payment.
The Tribe will prepare a payment roll, subject to the approval of
the Secretary of the Interior or his designated representative, of
all persons who meet the eligibility requirements of the Tribal
Constitution, as amended, and who are living as of midnight on the
date of approval of this plan. A person shall have forty-five (45)
calendar days from the date of approval of this plan to complete
his enrollment.
The per capita shares of living competent adults shall be paid
directly to them. The per capita shares of legal incompetent
adults, and persons under other legal disability, shall be placed
in individual Indian money (IIM) accounts and handled under 25 CFR
104.5.
The per capita shares of deceased individual beneficiaries shall be
determined and distributed in accordance with 43 CFR, Part 4, Subpart D.
Minors' per capita shares, including all investment income accruing
thereto, shall be retained in individually segregated IIM accounts
and shall not be disbursed until the minor attains the age of
eighteen years, or the minors' shares, including all investment
income, shall be placed in a private trust as approved by the
Secretary. In those cases wherein a minor would reach the age of
eighteen within six months after establishment of a trust, such
funds shall instead be retained in an IIM account. Upon reaching
the age of eighteen, unless under a legal disability, the beneficiary
shall be entitled to withdraw the per capita share and accrued
investment income thereon as provided in 25 CFR 104.3. If a bene-
ficiary is under a legal disability upon attaining the age of
eighteen, the per capita share and accrued investment income thereon
shall be handled pursuant to 25 CFR 104.5.
All per capita shares which remain unclaimed with the Federal
Government shall be held in trust for a full six years, as provided
by the Act of September 22, 1961, (75 Stat. 584). After this period
of time the unclaimed shares, enhanced by investment, will revert to
the Citizen Band of Potawatomi Indians of Oklahoma. Upon reverting
to the Tribe, these shares plus the interest they have earned, will
be added to the perpetual trust funds identified in Part II of this
plan. The annual interest from these unclaimed shares will there-
after be fed into the college scholarship program.
II. The Program aspects of this plan consists of placing twenty
percent (20%) of the total awards, together with any investment
income accrued, over $36,000, in a perpetual trust to earn the
highest rate of interest available. The $36,000 held out will be
advanced to the Tribe by the Secretary of the Interior, upon the
submission of a budget, so the program can be implemented as soon
as possible. The income from this trust will be used as follows:
A. Fifty percent (50%) of the annual income from the
trust will be used for the acquisition of Prosthetics
appliance for Tribal members who through loss of limbs,
bone diseases, or other causes have been rendered incapable
of serving themselves, or of ambulation without
the use of artificial limbs, braces, or other appropriate
substitutes for missing or disabled parts.
B. Fifty percent (50%) of the annual income from the
trust will be used as a college scholarship fund for
members of the Citizen Band of Potawatomi Indians who
have the potential to succeed as college students. The
percentage of the annual investment income for this
program will be increased when the unclaimed shares,
aforementioned, are eventually added to the perpetual
trust.
BE IT FURTHER RESOLVED: That, the Business Committee of the Tribe
will develop policies, procedures, and administrative guidelines,
subject to the approval of the General Council, for the implement-
ation of Part II of the above plan, and,
BE IT FURTHER RESOLVED: That, if after a few years of operation
of the Plan it is found that the funding levels between the two
programs needs to be adjusted; or if it is found that there is a
surplus of funds that could be used to add other educational,
health, or welfare programs; the Business Committee is hereby
authorized to propose such adjustments, subject to the approval
of the General Council and the Secretary of the Interior. However,
the principal amount, from which the programs are funded, will not
be diminished.

WHEREAS, the Citizen Band of Potawatomi Indians of Oklahoma share, with
four other groups of Potawatomis, in awards made by the Indian Claims
Commission in Dockets 15-K, 20-J, 217, 15-M, 29-K, and 146, and,
WHEREAS, the General Council of the Citizen Band of Potawatomi Indians
of Oklahoma in its Annual General Council Meeting on June 29, 1975,
agreed by resolution Pott-75-25 to accept any division that would give
the Tribe 1,482 shares or more, but requested that the Bureau do
additional research and make a final certification to the Tribe, and,
WHEREAS, the Commissioner of Indian Affairs in his memorandum of December
31, 1975, to the Area Directors of the Anadarko and Minneapolis Areas

Court and Juvenile System reflect a great need for an alternative school
program to assist with the high Indian student drop-out, truancy, and
expulsion rate, along with Indian students who have recently been adjudicated
by the court and are not yet ready to be placed in the conventional
classroom setting, and,

other Indian youth leaders and organizations, and,
WHEREAS, there is need to establish special academic classrooms and

WHEREAS, a Pecan Enterprise Program would be more economically feasible with
increasing the project by an additional 40 acres of pecan development, and,
WHEREAS, there is tribal trust land now available for the purpose of pecan
grove development, and,
WHEREAS, a three year plan of operations has been written for the purpose of
further development of the original 40 acres of pecan groves and the
additional 40 acres of pecan grove, toward a Pecan Enterprise Program.

recognized Band and eligible for all programs and services provided by the
Bureau of Indian Affairs, and,
WHEREAS, the Citizen Band of Potawatomi Indians is authorized under PL 93-
638 to receive a grant for the purpose of strengthening tribal government.
NOW THEREFORE BE IT RESOLVED THAT:
1. The Citizen Band of Potawatomi hereby approves the hiring of Beverly I.
Hughes, Secretary-Treasurer of the Potawatomi Business Committee, to the
position of Personnel Director for the Citizen Band of Potawatomi Indians
at a salary of $8,000.00 per annum.
2. Beverly I. Hughes will serve as Personnel Director under PL 93-638 grant
program, 8:00 to 5:00 p.m., Monday through Friday. She will serve as
Tribal Secretary-Treasurer after 5:00 p.m. Monday through Friday and at
all duly called meetings of the Potawatomi Business Committee as prescribed
in the Constitution.
3. As Personnel Director, Mrs. Hughes will be charged with maintaining complete
personnel records on all employees to include: application for employment;
evaluations from any source regarding the employee's performance; leave
records; employment history; current job description; performance standards
and job evaluations; disciplinary record; training experience and educational
achievements; records of awards; letters of appreciation or commendation;
medical statement relative to employee's fitness, mentally and physically, to
carry out assignments. Beverly I. Hughes is additionally charged with updating
tribal rolls; tracing lineage of potential new members; filing all
pertinent data such as birth certificates, relinquishment, etc; submitting
data to the Business Committee for approval or disapproval; notification of
approval or disapproval to applicants; assignment of roll number; and any
other technicalities involved in enrollment or maintenance of tribal rolls.
The Personnel Director will supervise one assistant.
4. Beverly I. Hughes will abstain from voting on any actions by the Business
Committee directly or indirectly effecting the Potawatomi grant program
under PL 93-638.
BE IT FURTHER RESOLVED THAT: the Citizen Band of Potawatomi Indians of Oklahoma
requests the Bureau of Indian Affairs to approve the request for hiring of the
Tribal Government officer under Part 272, 5276.16, Part II, C9 of the Code of

WHEREAS for the past four years Indian Action Programs have effectively trained
Indian people in various trades and occupations, and
WHEREAS, a high rate of unemployment among Indian people has been partially
alleviated by training Indian people through Indian Action Programs, and
WHEREAS, sixty Indian Action Programs were funded in FY 1977, and have a need
for ongoing programs, and
WHEREAS, at least twenty-four more Indian Tribes and Indian Tribal Organizations
have the need for Indian Action Programs, and

WHEREAS, the Business Committee of the Citizen Band of Potawatomi Indians
of Oklahoma find that a group insurance program for the tribal office
employees in needed and beneficial, and,
WHEREAS, the cost of providing this group insurance program for the
employee will come out of the contract or grant under which said
employee is paid from, and,
WHEREAS, this coverage will be provided for the employee and if the
employee wants coverage for their dependents, then the burden of the
cost will be upon the employee and will be treated as a payroll
deduction, and,
WHEREAS, the Business Committee hereby authorized the Tribal Chairman
to contact and contract the company with the maximum benefits or coverage
at most reasonable cost.
NOW THEREFORE BE IT RESOLVED: That the Business Committee of the Citizen
Band of Potawatomi Indians of Oklahoma give authorization to the Chairman
to contact and contract a total insurance program for the tribal office
employees at net cost to the Tribe and that it be implemented as soon as

owner of land, herein, legally described as: NW/4 NW/4 Section 31-1ON-4E and
NW/4 NE/4 Section 31-1ON-4E, Pottawatomie County, Oklahoma, and,
WHEREAS, Arco Pipe Line Company is the legal owner of a 6 inch welded steel
pipe line, installed on and extending across Potawatomi land, and,
WHEREAS, the present right-of-way lease contract for said line expires May 19,
1977 and a fifty year renewal lease is desired by Arco, and,
WHEREAS, the Citizen Band of Potawatomi concurs in the leasing of a right-of-way
for the pipe line, which is fifty feet wide, and angles across Potawatomi
land for in excess of one mile.
NOW THEREFORE BE IT RESOLVED that the Citizen Band of Potawatomi agrees to lease
a right-of-way fifty feet wide and in excess of one mile in length, across
Potawatomi land, for the appraisal price per rod determined by a Bureau of Indian
Affairs Appraiser. This lease will extend for a period of fifty years from the
date of contract execution.
