WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma share, with other groups of Potawatomis, in awards made by the Indian Claims Commission in Dockets 128, 309, 310, 15P, 29N, 306, 308, 151, 29G, 216, 15L, 291, 15D, 29B, 311, 338, 15E, 29C, 15C, 29A, 71, 29D, and 29E; and WHEREAS, the Business Committee of the Citizen Band Potawatomi Indians of Oklahoma, meeting on August 28 , 1979, agreed by majority vote to accept any division that would give the Tribe 1,718 share or more; and WHEREAS, the Bureau of Indian Affairs has determined that the funds shall be divided as follows: 1. Citizen Band - 1, 718/3523 2. Prairie Band - 809/3523 3. Hannahville Indian Community - 457/3523 4. Forest County Potawatomi Community - 273/3523 5. Scattered living descendents of other bands - 267-3523; and WHEREAS, the Business Committee of the Tribe, on behalf of the Citizen Band Potawatomi Indians of Oklahoma, hereby accepts the proposed division as outlined above; NOW THEREFORE, BE IT RESOLVED that the following Plan is hereby adopted pursuant to Public Law 93-134 (87 Stat. 466, 467, and 468) enacted October 19, 1973, and that the Secretary of the Interior, or his designee, is hereby requested to review this plan and to authorize a Hearing of Record according to Part 60; Title 25 of the Code of Federal Regulations. PLAN I. Seventy percent (70%) of the funds awarded to the Citizen Band Potawatomi Indians of Oklahoma (hereinafter referred to as ""Tribe"") from Dockets 128, 309, 310, 15P, 29N, 306, 308, 15I, 29G, 216, 15L, 29I, 15D, 29B, 311, 338, 15E, 29C, 15C, 29A, 71, 29D, and 29E, together with the interest accrued on said 70% will be distributed on a per capita basis to eligible members of the Citizen Band Potawatomis. Tribal rolls will be updated to insure eligibility of all members submitted for the per capita payment. The Tribe, under the direction of the Business Committee, will prepare a payment roll, subject to the approval of the Secretary of the Interior, or his designee, of all persons who meet the eligibility requirements of the Tribal Constitution, as amended, and who are living as of midnight on the date of approval of this Plan. A person shall have thirty (30) calendar days from the date of approval of this Plan to complete enrollment for participation in this per capita payment. The per capita shares of living competent adults shall be paid directly to them. The per capita shares of legal incompetent adults, and persons under the legal disability, shall be placed in individual Indian money (IIM) accounts and handled under 25 CFR 104.5. The per capita shares of deceased individual beneficiaries shall be determined and distributed in accordance with 43 CFR, Part 4, Subpart D. Minor's per capita shares, including all investment income accruing thereto, shall be retained in individually segregated IIM accounts and shall not be disbursed until the minor attains the age of eighteen (18) years, or the minor's shares, including all investment income, shall be placed in a private trust as approved by the Secretary of the Interior. Those cases wherein a minor would reach the age of eighteen (18) within six (6) months after establishment of such a trust, such funds shall instead be retained in an IIM account. Upon reaching the age of eighteen (18), unless under a legal disability, the beneficiary shall be entitled to withdraw the per capita share and accrued investment income thereon as provided in 25 CFR 104.3. If a beneficiary is under a legal disability upon attaining the age of eighteen (18), the per capita share and accrued investment income thereon shall be handled pursuant to 25 CFR 104.5. All per capita shares which remain unclaimed with the Federal government shall be held in trust for a full six (6) years, as provided by the Act of September 22, 1961 (75 Stat. 584). After this period of time the unclaimed shares, enhanced by investment at the highest available interest rate, will revert to the Tribe. Upon reverting to the Tribe, these shares plus the interest they have earned, will be added to the funds identified in Part II of this Plan. The annual interest from these unclaimed shares will thereafter be utilized as other interest earned. Programming this Plan consists of placing thirty percent (30%) of the total awards, plus any invested interest accrued in the following manner: II. Building Maintenance Trust Plan One million dollars ($1,000,000.00) shall be placed with the Secretary of the Interior in a non-revocable trust, invested at the highest interest available. The interest earned shall he available to the Tribe to conduct a Building Maintenance Program to be used for in trust or non-trust maintenance, public utilities, reconstruction, beautification, repair and remodeling. Twenty-five thousand dollars ($25,000.00) is requested for initial operating expenses. Interest money is to be drawn down every six (6) months. Monies from the accrued interest is to be drawn down by resolution, with an approved expenditure budget to specify payment. This Plan is to remain in force as long as the Citizen Band Potawatomi Indians of Oklahoma are a federally recognized tribe. III. Land Acquisition and Development Plan Remaining balance shall be held by the Citizen Band Potawatomi Indians of Oklahoma to be invested at the highest rate available to conduct a Land Acquisition and Development Program to be used to acquire real estate and properties in the name of the Tribe. Said real estate and properties can be administered in either a trust or a non-trust status. These funds can be used to purchase property, construct buildings, purchase equipment, place equity capital to support industry proposed or existing on tribally owned lands or properties. To safeguard this investment of these funds, the following format as set forth by these principals and procedures will be adhered to: A. These funds will be invested in financial institutions as interest bearing accounts by instruction from the Business Committee. B. Financial institutions will be required to place collateral to an A Bond or better government agency, municipal or treasury notes for the excess over the FDIC limit insurance. C. The Business Committee shall have the responsibility for establishing the investment rate and terms. D. Any investment of these funds shall be supported with an appraisal by a certified appraiser for the properties or land to be purchased. E. If investment is to be considered as new construction, bids from three (3) contractors will be taken under the approval of the American Institute of Architects (AIA) format. F. All buildings constructed shall be accompanied by a three (3) year proforma and a feasibility study. G. Any plan requiring investment of funds shall be submitted thirty (30) days prior to the final decision of the Business Committee. H. The Business Committee shall have the power to borrow against investments between maturity to provide acquisition funds. I. The rate on these borrowings shall not exceed one percent (1%) above the rate of return on investments. J. These funds will be audited annually by an independent certified accountant. K. The aforementioned annual audit shall be submitted to the Business Committee within the first quarter of each fiscal year. The report shall be read by the Business Committee and subjects and requirements shall be duly noted and supported by prudent business decisions for directions and compliance. L. A copy of this report and correctives shall be submitted to the Secretary of the Interior annually. BE IT FURTHER RESOLVED that from the date of approval of this Plan, Part III will be in effect for five (5) years. At that time, Part III is subject to revision and change by the General Council of the Citizen Band Potawatomi Indians of Oklahoma, if they see fit to resubmit a new plan and make the necessary revisions. BE IT FURTHER RESOLVED that the initial drawdown of Plan III funds shall be deposited for safeguard with the Federal National Bank and Trust Co., Shawnee, Oklahoma, for further action and/or usage by the Tribe. WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma were awarded a settle- ment in Indian Claims Commission 96, and, WHEREAS, Public Law 91-401 provided that the funds so awarded could be used for any purpose proposed by the tribe and approved by the Secretary of the Interior, and, WHEREAS, by Resolution Pott. 69-10, the tribe proposed to set aside $10,000.00 of the claim for administrative and clerical expenses in updating the tribal rolls, with the balance of the funds to be paid out on a per capita basis to those tribal members alive and enrolled as of the date the President signed the distribution legislation, which was September 16, 1970, and, WHEREAS, by letter dated December 21, 1970, the Acting Commissioner of the Bureau of Indian Affairs approved the tribe's distribution plan, and, WHEREAS, the $10,000.00 was advanced in two equal payments to the tribe, and, WHEREAS, the per capita payment was effective September 1, 1971, and, WHEREAS, under Public Law 87-283, 75 Stat. 584, a tribal member is allowed six (6) years from the date of the authorizing letter to come forth and claim his share, and, WHEREAS, the six (6) years expired on December 21, 1976, and, WHEREAS, there were two hundred and twenty-nine (229) persons, list attached, that neither the tribe nor the Shawnee Agency were ever able to locate, and, WHEREAS, the Business Committee of the Citizen Band Potawatomi Indians of Oklahoma by its endorsement of this General Council Resolution, states that the following efforts were made to locate the above one hundred ninety-one (191) persons; 1. Published a list of tribal members in tribal newsletter March, 1974 and June, 1977, 2. Announcement at all Council Meetings, 1972, 1973, 1974, 1975, 1976, 1977, 3.
