A RESOLUTION FOR THE CITIZEN BAND POTAWATOMI INDIANS OF OKLAHOMA TO APPLY
FOR FUNDS IN PURSUANT TO TITLE VI OF THE OLDER AMERICANS ACT FOR FISCAL
YEAR 1981.
WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma is interested in
the future development of Tribal capabilities for operations of
social services and nutrition services for the benefit of tribal
members who are 60 years or older, and
WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma is a federally
recognized tribe of American Indians under authority granted
by the Indian Recognition Act of 1934, and
WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma is eligible for
grant applications under Title VI of the Older American Act, and
WHEREAS, Linda Coventon, Director of Health Planning, is authorized to
coordinate grant development and can be reached at telephone
number (405) 275-3121, and
WHEREAS, Administration on Aging is requested to send copies of all
correspondence to John Schoemann, Tribal Administrator, and to
Linda Coventon, Director of Health Planning, and
WHEREAS, these authorities will remain in effect until such time as the
Business Committee chooses to withdraw said authorization, and
to approve them by resolution, and
WHEREAS, the Business Committee reserves the right to review the grant
document thereto prior to signature by designated persons.
NOW THEREFORE BE IT RESOLVED that the Business Committee of the Citizen
Band Potawatomi Indians of Oklahoma wishes to make grant application
to the Administration on Aging for Title VI of the Older American
Act Funds.

assume liability and responsibility of full and prompt payment of any mortgage, loan,
and/or other fund source vehicle entered into by the Tribal Administrator acting as

A RESOLUTION TO CONTRACT THE SPECIAL SUPPLEMENTAL FOOD PROGRAM FOR WOMEN,
INFANTS, AND CHILDREN UNDER PUBLIC LAW 95-627 FOR FISCAL YEAR 1981.
WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma have operated a
successful WIC Program in fiscal years previous, and,
WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma elect to contract
through the Regional and National USDA-FNS offices, and,
WHEREAS, John Schoemann is hereby authorized to negotiate this contract and
any amendments thereto, and,
WHEREAS, Wanita R. Clifford is the tribal official authorized to execute the
grant contract or any amendments thereto, and,
WHEREAS, the final grant contract will be reviewed and approved by the
Business Committee, and,
WHEREAS, the authorities granted by this resolution shall be continuing through
the contract term, and,
WHEREAS, the proposed start date of the contract shall be 10-1-80, and,
WHEREAS, the term of the contract shall be 12 months.
NOW THEREFORE BE IT RESOLVED that the Citizen Band Potawatomi Indians of
Oklahoma will contract funds through Regional and National USDA-FNS offices
for WIC.

September 16, 1980, there being a quorum present;

WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma have made
known their desire to change their Constitution and By-Laws;
and,
WHEREAS, the Business Committee concurs with their Constitution and
By-Laws submitted by the Constitution Revision Committee;
NOW,
THEREFORE, BE IT RESOLVED, that the Business Committee of the Citizen
Band Potawatomi Indians of Oklahoma, do hereby request the
Bureau of Indian Affairs to call for a referendum election on
the revised tribal Constitution and By-Laws.

WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma, is interested
in further development of Tribal capabilities for self-deter-
mination in the management and improvement of their health de-
livery system for the benefit of all tribal members, and;
WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma is fully aware
of its options of contracts and grants, and hereby chooses to
submit a Health Planning Grant Application for FY 80 under the
authority of P.L. 93-638, Indian Health Services Health Manage-
ment Development Program, and;
WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma is a federally
recognized tribe of American Indians under authority granted
by the Indian Recognition Act of 1934, and;
WHEREAS, a resolution duly adopted by the Citizen Band Potawatomi Indians

Indian Health Service, authorizing John Schoemann, Tribal Ad-
ministrator, to acquire funding for the Health Planning Program
under P.L. 93-638 grant authority, and;
WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma is eligible for
consideration of grant and contract applications under P.L.
93-638 Health Management and Development funds, and;
WHEREAS, there is a need to: study the existing Health Programs, identi-
fy needs, and develop Health Implementation Plans to assist in
improving the health delivery system, and;
WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma hereby makes
known their intent to make application for a grant to develop
management capabilities pursuant to the provisions of P.L.
93-638 through Health Planning and Evaluation Projects, and;
WHEREAS, the proposed and requested commencement date for the grant is
December 1, 1980, through November 30, 1981, and;
WHEREAS, the proposed term of the grant document is twelve (12) months,
and;
WHEREAS, Jacqueline Farley, Health Planner, is authorized to coor-

gram checks and payments for purchase, and;

WHEREAS, the Shawnee Service Unit Indian Health Clinic has developed
specialty clinics in the areas of high-risk OB, Cardiac,
Internal Medicine, Diabetes, Urology, Orthopedics, ENT-audiology,
Opthalmolohy, Pediatrics, Dental, Podiatry, Psychiatry, OB-
Gynecology, Dermatology and Family Planning in an effort to better
meet the health needs of the Indian people, and
WHEREAS, Ada Hospital is presently offering specialty care, which is not
providing service at the same level of care or above the level
the Shawnee Service Unit Indian Health Clinic offers, and,
WHEREAS, removal of local in-hospital funding from Shawnee Service
Unit Indian Health Clinic would endanger the presently
offered specialty services. Thus preventing development
of additional specialty services to meet the health needs, and
WHEREAS, there is not action plan provided for transporting to the
Ada Hospital, and,
WHEREAS, there is not action plan for emergency accident care, and,
NOW THEREFORE BE IT RESOLVED, that the Business Committee of the
Citizen Band Potawatomi Indians of Oklahoma believes the
quality of health care available to them will be severely
damaged by any transfer of contract health funds for in-
hospital or any other service unit or facility. Consequently,
we wish to protest such a move of funds at this time or any
future time.

business and otherwise speak or act on behalf of the Tribe in all
matters on which the Tribe is enpowered to act; and,
WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma Business Committee
has the responsibility of protecting the health, security, and general

INDIAN CLAIMS COMMISSION.
WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma share, with other
groups of Potawatomis, in awards made by the Indian Claims Commission
in Dockets 128, 309, 310, 15P, 29N, 306, 308, 15I, 29G, 216, 15L,
29I, 15D, 29B, 311, 338, 15E, 29C, 15C, 29A, 71, 29D, and 29E; and
WHEREAS, the Business Committee of the Citizen Band Potawatomi Indians of
Oklahoma, meeting on March 18, 1981, agreed by
majority vote to accept any division that would give the Tribe
1,718 share or more; and
WHEREAS, the Bureau of Indian Affairs has determined that the funds shall
be divided as follows:

3. Hannahville Indian Community - 457/3523
4. Forest County Potawatomi Cummunity - 273/3523

WHEREAS, the Business Committee of the Tribe, on behalf of the Citizen Band
Potawatomi Indians of Oklahoma, hereby accepts the proposed division
as outlined above:

THEREFORE, BE IT RESOLVED that the following Plan is hereby adopted pursuant
to Public Law 93-134 (87 Stat. 466, 467, and 468) enacted October 19,
1973, and that the Secretary of the Interior, or his designee, is
hereby requested to review this plan and to authorize a Hearing of
Record according to Part 60; Title 25 of the code of Federal
Regulations.
PLAN
1. Seventy percent (70%) of the funds awarded to the Citizen Band Potawatomi
Indians of Oklahoma (hereinafter referred to as “Tribe”) from Dockets 128,
309, 310, 15P, 29N, 306, 308, 15I, 29G, 216, 15L, 29I, 15D, 29B, 311, 338,
15E, 29C, 15C, 29A, 71, 29D, 29E, together with the interest accrued
on said 70% will be distributed on a per capita basis to eligible members
of the Citizen Band Potawatomis. Tribal rolls will be updated to insure
eligibility of all members submitted for the per capita payment.
The Tribe, under the direction of the Business Committee, will prepare a
payment roll, subject to the approval of the Secretary of the Interior, or
his designee, of all persons who meet the eligibility requirements of the
Tribal Constitution, as amended, and who are living as of midnight on the
date of approval of this Plan. A person shall have thirty (30) calender
days from the date of approval of this Plan to complete enrollment for
participation in this per capita payment.
The per capita shares of living competent adults shall be paid directly to
them. The per capita shares of legal incompetent adults, and persons under
the legal disability, shall be placed in individual Indian money (IIM)
accounts and handled under 25 CFR 104.5.
The per capita shares of deceased individual beneficiaries shall be determined
and distributed in accordance with 43 CFR, Part 4, Subpart D.
Minor's per capita shares, including all investment income accuring thereto,
shall be retained in individually segregated IIM accounts and shall not be
disbursed until the minor attains the age of eighteen (18) years, or the
minor's shares, including all investment income, shall be placed in a private
trust as approved by the Secretary of the Interior. Those cases wherein a
minor would reach the age of eighteen (18) within six (6) months after
establishment of such a trust, such funds shall instead be retained in an
IIM account. Upon reaching the age of eighteen (18), unless under a legal
disability, the beneficiary shall be entitled to withdraw the per capita
share and accrued investment income thereon as provided in 25 CFR 104.3.
If a beneficiary is under a legal disability upon attaining the age of
eighteen (18), the per capita share and accrued investment income thereon
shall be handled pursuant to 25 CFR 104.5.
All per capita shares which remain unclaimed with the Federal government
shall be held in trust for a full six (6) years, as provided by the Act
of September 22, 1961 (75 Stat. 584). After this period of time the unclaimed
shares, enhanced by investment at the highest available interest rate, will
revert to the Tribe. Upon reverting to the Tribe, these shares plus the
interest they have earned, will be added to the funds identified in Part 11
of this Plan. The annual interest from these unclaimed shares will thereafter
be utilized as other interest earned.
Programming this Plan consists of placing thirty (30) percent of the total
awards, plus any invested interest accrued in the following manner:
11. Building Maintenance Trust Plan
One million dollars ($1,000,000.00) shall be placed with the Secretary of the
Interior in a non-revocable trust, invested at the highest interest available.
The interest earned shall be available to the Tribe to conduct a Building
Maintenance Program to be used for in trust or non-trust maintenance, public
utilities, reconstruction, beautification, repair and remodeling.
Twenty-five thousand dollars ($25,000.00) is requested for initial operating
expenses. Interest money is to be drawn down every six (6) months. Monies
from the accrued interest is to be drawn down by resolution, with a approved
expenditure budget to specify payment. This Plan in to remain in force for
a thirty (30) year period and is subject to revision and change by the
General Council of the Citizen Band Potawatomi Indians of Oklahoma, if they
see fit to resubmit a new plan and make the necessary revisions.
111. Land Acquisition and Development Plan
Remaining balance shall be held by the Federal National Bank of Shawnee,
Oklahoma to be invested at the highest rate available to conduct a Land
Acquisition and Development Program to be used to acquire real estate and
properties in the name of the Tribe. Said real estate properties can be
administered in either a trust or a non-trust status. These funds can
be used to purchase property, construct buildings, purchase equipment,
place equity capital to support industry proposed or existing on tribally
owned lands or properties. To safeguard this investment of these funds,
the following format as set forth by these principals and procedures will
be adhered to:
A. These funds will be invested in financial institutions as interest
bearing accounts by instruction from the Business Committee.
B. Financial institutions will be required to place collateral to an
A Bond or better government agency, municipal or treasury notes for
the excess over the FDIC limit insurance.
C. The Business Committee shall have the responsibility for establishing
the investment rate and terms.
D. Any investment of these funds shall be supported with a appraisal by
a certified appraiser for the properties or land to be purchased.
E. If investment is to be considered as new construction, bids from three
(3) contractors will be taken under the approval of the American
Institute of Architects (AIA) format.
F. All buildings constructed shall be accompanied by a three (3) year
proforma and a feasibility study.
G. Any plan requiring investments of funds shall be submitted thirty
(30) days prior to the final decision of the Business Committee.
H. The Business Committee shall have the power to borrow against
investments between maturity to provide acquisition funds.
I. The rate on these borrowings shall not exceed one percent (1%) above
the rate of return on investments.
J. These funds will be audited annually by an independent certified
accountant.
K. The aforementioned annual audit shall be submitted to the Business
within the first quarter of each fiscal year. The report shall be
read by the Business Committee and subjects and requirements shall
be duly noted and supported by prudent business decisions for directions
and compliance.
L. A copy of this report and correctives shall be submitted to the
Secretary of the Interior annually.
BE IT FURTHER RESOLVED that from the date of approval of this Plan, Part 111
will be in effect for five (5) years. At that time, Part 111 is subject
to revision and change by the General Council of the Citizen Band Potawatomi
Indians of Oklahoma, if they see fit to resubmit a new plan and make the
necessary revisions.
BE IT FURTHER RESOLVED that the initial drawdown of Plan 111 funds shall
be deposited in a trust account at the Federal National Bank, Shawnee,
Oklahoma for further action and/or usage by the Tribe.

For purposes of Title VI Nutrition and Social Services of the
Older Americans Act, we resolve that the Kickapoo Tribe of Oklahoma
may represent our tribal members who reside within the
Kickapoo Tribe of Oklahoma tribal land boundaries from September
30, 1981 through September 30, 1982.
It will be made known to the Potawatomi Tribal members that do
participate in the Title VI program with the Kickapoo Tribe of
Oklahoma that they are not eligible to receive services under
both Title III and Title VI, as set forth by Section 1328.39 (b).

A RESOLUTION ADOPTING A PLAN FOR THE USE OF CERTAIN FUNDS AWARDED BY
THE INDIAN CLAIMS COMMISSION.
WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma share, with
other groups of Potawatomis, in awards made by the Indian
Claims Commission in Dockets 128, 309, 310, 15P, 29N, 306,
308, 15I, 29G, 2I6, 15L, 29I, 15D, 29B, 311, 338, 15E, 29C,
29A, 71, 29D, and 29E; and
WHEREAS, the Business Committee of the Citizen Band Potawatomi Indians
of Oklahoma, meeting on June 8, 1981, agreed by majority vote
to accept any division that would give the Tribe 1,718 shares
or more; and
WHEREAS, the Bureau of Indian Affairs has determined that the funds
shall be divided as follows
1. Citizen Band - 1,718/3523
2. Prairie Band - 809/3523
3. Hannahville Indian Community - 457/3523
4. Forest County Community - 273/3523
5. Scattered living descendents of other bands -
267/3523; and
WHEREAS, the Business Committee of the Tribe, on behalf of the Citizen
Band Potawatomi Indians of Oklahoma hereby accepts the
proposed division as outlined above:

THEREFORE BE IT RESOLVED that the following plan is hereby adopted
pursuant to Public Law 93-134 (87 Stat. 466, 467, and 468)
enacted October 19, 1973, and that the Secretary of the
Interior or his designee, is hereby requested to review
this plan and to authorize a Hearing of Record according
to Part 60; Title 25 of the code of Federal Regulations.
I. Seventy percent (70%) of the funds awarded to the Citizen
Band Potawatomi Indians of Oklahoma ( hereinafter referred
to as ""Tribe"") from Dockets 128, 309, 310, 15P, 29N, 306,
308, 15I, 29G, 216, 15L, 29I, 15D, 29B, 311, 338, 15E, 29C,
15C, 29A, 71, 29D, 29E, together with the interest accrued
on said 70% will be distributed on a per capita basis to
eligible members of the Citizen Band Potawatomis. Tribal
rolls will be updated to insure eligibility of all members
submitted for the per capita payment.
The Tribe, under the direction of the Business Committee, will prepare
a payment roll, subject to the approval of the Secretary of the Interior,
or his designee, of all persons who meet the eligibility requirements
of the Tribal Constitution, as amended, and who are living as of midnight
on the date of approval of this plan. A person shall have thirty
(30) calendar days from the date of this plan to complete enrollment
for participation in this per capita payment.
The per capita shares of living competent adults shall be paid directly
to them. The per capita share of legal incompetent adults, and persons
under the legal disability, shall be placed in individual Indian money
accounts (IIM) and handled under 25 CFR 104.5.
The per capita shares of deceased individual beneficiaries shall be
determined and distributed in accordance with 43 CFR, Part 4, Subpart
D.
Minor's per capita shares, including all investments income accruing
thereto, shall be retained in individually segregated IIM accounts and
shall not be dispersed until the minor attains the age of (18). Upon
reaching the age of eighteen (18), unless under a legal disability,
the beneficiary shall be entitled to withdraw the per capita share
and accrued investment income thereon as provided in 25 CFR 104.3.
If a beneficiary is under a legal disability upon attaining the age of
eighteen (18) , the per capita share and accrued investment income thereon
shall be handled pursuant to 25 CFR 104.5.
All per capita shares which remain unclaimed with the Federal
government shall be held in trust for a full six (6) years, as provided
by the Act of September 22 1961 (75 Stat. 584). After this period
of time the unclaimed shares, enhanced by investment at the highest
available interest rate, will revert to the Tribe. Upon reverting to
the Tribe, these shares plus the interest they have earned, will be
added to the funds identified in Part II of this Plan. The annual interest
from these unclaimed shares will thereafter be utilized as other interest
earned.
Programming this plan consists of placing thirty (30) percent of the total
awards, plus any invested interest accrued in the following manner:
II. Acquisition, Development and Maintenance Program
Thirty percent (30%) of the funds awarded to the Citizen Band Potawatomi
Indians of Oklahoma (hereinafter referred to as the ""Tribe"") from Dockets
128,309, 310, 15P, 29N, 306, 308, 15I, 29G, 216, 15L, 291, 15D, 29B, 311,
338, 15E, 29C, 15C, 29A, 71, 29D, and 29E, together with the interest
accrued on said 30% will be utilized to implement and execute the
Acquisition, Development and Maintenance plan, hereinafter described.
The program aspects of this plan consists of placint 30% of the total
awards together with any investment income accrued over $500,000.00
in a program trust that shall be placed with the Secretary of the
Interior to bear the highest interest available.
The $500,000.00 held out will be advanced to the Tribe by the Secretary
of the Interior upon the submission of a budget so the Plan can be implemented
as soon as possible.
The interest so earned, and/or principle, shall be available to the
Tribe to conduct an Acquisition, Development and Maintenance Program
applicable to trust and/or non-trust properties real and other, with
all cost that might be incurred in the implementation and execution
of the Acquisition, Development and Maintenance Program for tribal
properties or non-tribal properties beneficial to the Tribe considered
allowable. Said interest earned will be utilized first. Principle
amount will only be drawn down as needed after the interest on said
plan has been utilized.
Draw downs will be by Business Committee resolution on an as needed
basis and expenditure budgets to be approved by Anadarko Area Director.
BE IT FURTHER RESOLVED that after a ten (10) year period this plan
may be modified or redesigned to meet the needs of the Tribe with approval
of the General Council and the Andadarko Area Director.

recognized Tribe of American Indians under authority granted by
the Oklahoma Indian Welfare Act of 1936; and
WHEREAS, the Citizen Band Potawatomi Business Committee has authority to
act in behalf of the Tribe as authorized in the Tribal Constitution
and By-Laws; and
WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma desires to strengthen
it's capacity in tribal government by improving and maintaining
tribal programs, activities, and properties; and
WHEREAS, the Tribal Administrator is hereby authorized to negotiate with
the Bureau any items pursuant to this grant and any amendments
thereto; and
WHEREAS, the Tribal Chairperson is hereby authorized to execute this grant
and any amendments thereto; and
WHEREAS, the expiration date of this Resolution shall be September 30,
1982; and
WHEREAS, the proposed start date of this grant shall be October 1, 1981; and
WHEREAS, the proposed term of this grant shall be twelve (12) months; and
WHEREAS, this Resolution grants authority to extend the FY82 grant past
September 30, 1982, should such extension be necessary;

WHEREAS, the Citizen Band Potawatomi Business Committee has authority to

WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma were awarded a claim
and the monies were distributed to their tribal members;

contract Home Improvement Program services through the
Shawnee Agency Bureau of Indian Affairs for FY82; and

WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma, is interested
in further development of Tribal capabilities for self-determination
in the management and improvement of their health delivery
system for the benefit of all tribal members, and;
WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma is fully aware
of its options of contracts and grants, and hereby chooses to
submit a Health Planning Grant Application for FY 82, under
the authority of P.L. 93-638, Indian Health Services Health
Management Program, and;
WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma is a federally
recognized tribe of American Indians under authority grant by
the Indian Recognition Act of 1934, and;
WHEREAS, a resolution duly adopted by the Citizen Band Potawatomi Indians
of Oklahoma addressed to the Area Director, Oklahoma City Area
Office, Indian Health Service, authorizing John Schoemann, Tribal
Administrator, to acquire funding for the Health Planning Program
under P.L. 93-638 grant authority, and;
WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma is eligible for
consideration of grant and contract applications under P.L. 93-638
Health Management Program funds, and:
WHEREAS, there is a need to study existing Health Programs, identify needs
and develop Health Management plans to assist in improving the
health delivery system, and;

WHEREAS, Indian Health Service is requested to send copies of all correspondence
and contracts to John Schoemann, Tribal Administrator, and
to Jacqueline Farley, Health Director, and;
WHEREAS, these authorities will remain in effect until such time as the
Business Committee chooses to withdraw said authorization, and to
approve them by resolution, and;
WHEREAS, the Business Committee reserves the right to review the grant
document and any ammendments thereto prior to signature by designated
persons.
NOW THEREFORE BE IT PESOLVED that the Business Committee of the Citizen Band
Potawatomi Indians of Oklahoma, wishes to make an application to the Oklahoma
City Area Indian Health Service for P.L. 93-638 Health Management Program
