RESOLUTION
A Resolution for the Citizen Band Potawatomi Indians of Oklahoma
to enter into a contractual agreement with the Oklahoma City Area Indian
Health Service to exercise our right to govern, plan, administer, manage
and operate the total USPHS Shawnee Indian Health Center under the con-
tracting authority of PL 93-638.
WHEREAS, the Business Committee is authorized by Tribal Constitution
and By-Laws to act on behalf of the Citizen Band Potawatomi
Indians of Oklahoma, and;
WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma is fully aware
of its options of contracts and grants under the authorities
of PL 93-638 or Buy Indian, and hereby chooses to exercise our
rights to contract under the authority of PL 93-638, and;
WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma is a federally
recognized Indian Tribe and has a Constitution and By-Laws as
approved by the Secretary of the Interior, and;
WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma is a legal con-
tracting entity eligible for contracting under PL 93-638, and;
WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma has previously
been successful in administering Tribal Health Programs, and;
WHEREAS, this Notice of Intent to contract is submitted under the contracting
authority provided in PL 93-638 as of July 15, 1981,
and;
WHEREAS, the Tribal Administrator, Citizen Band Potawatomi Indians of
Oklahoma, Route 5, Box 151, Shawnee, OK 74801, (405) 275-3121,
is authorized to represent the Citizen Band Potawatomi Indians
of Oklahoma in the initial process of program transfer plans, and;
WHEREAS, Indian Health Service shall send copies of all communications to
the Five Tribal designees as stated in the individual Tribal Resolutions,
and;
WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma realizes that
the transfer of a total service will require careful study,
analysis and systematic planning technical assistance from IPLS
is requested, and;
WHEREAS, these authorities will remain in effect until such time as
the Business Committee chooses to withdraw said authorization,
and to approve them by resolution, and;
NOW THEREFORE BE IT RESOLVED that the Business Committee of the Citizen
Band Potawatomi Indians of Oklahoma will begin the orderly transfer of
the total USPHS Shawnee Indian Health Center functions, authorities and
responsibilities.

A RESOLUTION TO CONTRACT THE SPECIAL SUPPLEMENTAL FOOD PROGRAM FOR WOMEN,
INFANTS, AND CHILDREN UNDER PUBLIC LAW 95-627 FOR FISCAL YEAR 1982.
WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma have operated a
successful WIC Program in fiscal years previous, and,
WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma elect to contract
through Regional and National USDA-FNS offices, and,
WHEREAS, John Schoemann is hereby authorized to negotiate this contract and
any amendments thereto, and,
WHEREAS, Bill Burch is the tribal official authorized to execute the grant
contract or any amendments thereto, and,
WHEREAS, the final grant contract will be reviewed and approved by the
Business Committee, and
WHEREAS, the authorities granted by this resolution shall be continuing through
the contract term, and,
WHEREAS, the proposed start date of the contract shall be 10-1-81, and,
WHEREAS, the term of the contract shall be 12 months.
NOW THEREFORE BE IT RESOLVED that the Citizen Band Potawatomi Indians of
Oklahoma will contract funds through Regional and National USDA-FNS offices
for WIC.

A RESOLUTION TO REPORT NON-COMPLIANCE WITH 25 CFR 271.23 BY THE ANADARKO AREA OFFICE,
BUREAU OF INDIAN AFFAIRS.
WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma are a federally recognized
Tribe of American Indians under authority granted by the Oklahoma Indian
Welfare Act of 1936; and
WHEREAS, the Citizen Band Potawatomi Business Committee has authority to act in
behalf of the Tribe as authorized in the Tribal Constitution and By-Laws;
and
WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma elected to contract Indian
Action Program services through the Shawnee Agency Bureau of Indian Affairs
on June 25, 1981; and
WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma are cognizant of P.L.93-
638 contracting regulations promulgated by 25 CFR 271; and
WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma understand that P.L.93-
638 contracting regulations found in 25 CFR 271 are applicable to both
the Contractor, real and prospective, and the Bureau of Indian Affairs;
and
WHEREAS, it may be demonstrated that the Anadarko Area Office Bureau of Indian
Affairs failed to comply with 25 CFR 271.23 in this Tribe's efforts to
obtain a P.L.93-638 Indian Action Program contract for FY82;
NOW
THEREFORE BE IT RESOLVED that the Citizen Band Potawatomi Indians of Oklahoma report
the above referenced non-compliance with 25 CFR 271.23 by the Anadarko Area Office
to Mr. Ken Smith, Assistant Secretary - Indian Affairs for corrective action.

A RESOLUTION TO SPONSOR A POTAWATOMI ROOM IN THE BREMEN HISTORICAL SOCIETY IN
TINLEY PARK, TOWNSHIP OF BREMEN, COUNTY OF COOK, STATE OF ILLINOIS.
WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma are a federally
recognized Tribe of American Indians under authority granted by the Oklahoma
Indian Welfare Act of 1936, and
WHEREAS, the Citizen Band Potawatomi Business Committee has authority to
act in behalf of the Tribe as authorized in the Tribal Constitution and By-
Laws, and
WHEREAS, many of the members of the Citizen Band Potawatomi Indians of Oklahoma
can trace their ancestry back to the Potawatomi Indians who were removed
from the northern Illinois area between the years 1833-1840;
WHEREAS, those Potawatomi residents before 1840 did know and contribute to
what became the Bremen Township Geographical Area;
WHEREAS, the knowledge of the Potawatomi Indians can contribute significantly
to the relation of a more complete picture of the history of the Bremen Township
Geographical Area;
THEREFORE BE IT RESOLVED that the Business Committee of the Citizen Band Potawatomi
Indians of Oklahoma do recommend the sponsorship of a Potawatomi Room
to present the Native American portion of the history of the Bremen Township
Geographical Area for the Bremen Historical Society.

PURSUANT TO POTT. RESOLUTION #81-32.
WHEREAS; the Citizen Band Potawatomi Indians of Oklahoma share, with other
groups of Potawatomis, in awards made by the Indian Claims Commission
in Dockets 128, 309, 310, 15P, 29N, 306, 308, 15I, 29G, 216,
15L, 29I, 15D, 29B, 311, 338, 15E, 29C, 29A, 71, 29D, and 29E; and
WHEREAS; the Business Committee of the Citizen Band Potawatomi Indians of
Oklahoma, meeting on June 8, 1981, agreed by majority vote to
accept any division that would give the Tribe 1,718 share or
more; and
WHEREAS; the Bureau of Indian Affairs has determined that the funds shall be
divided as follows:
1. Citizen Band - 1,718/3523
2. Prairie Band - 809/3523
3. Hannahville Indian Community - 457/3523
4. Forest County Community - 457/3523
5. Scattered living descendents of other bands -
267/3523; and
WHEREAS; the Business Committee of the Tribe, on behalf of the Citizen Band
Potawatomi Indians of Oklahoma, hereby accepts the proposed division
as outlined above; and
WHEREAS; the Bureau of Indian Affairs has requested clarification of certain
terms found in POTT. Resolution #81-32; and
WHEREAS; the Bureau of Indian Affairs has requested additional information
pursuant to POTT. Resolution #81-32; and
WHEREAS; this Resolution neither rescinds nor amends in any way POTT. Resolution
81-32; now
THEREFORE, BE IT RESOLVED that the following definitions and additional information
be viewed by the Bureau of Indian Affairs and the Secretary of Interior
as addenda to POTT. Resolution #81-32.
The Acquisition, Development, and Maintenance Program is a single program which
utilizes three (3) terms to describe the activities and/or actions to be undertaken
by the Tribe in accomplishing the Program. These terms are defined below:
ACQUISITION - The term ""ACQUISITION"", as used in context with the
Program, shall be those actions and/or activities undertaken
by the Tribe to acquire, to get, or to come to have as it's
own real estate (land), including the buildings or improvements
on such real estate, and, when possible and feasible, it's natural
assets such as minerals, water, and so forth. Such real
estate acquisition activities may take place by the Tribe
with the ultimate goals of having such acquired real estate
placed in Trust status for the Tribe; or having such acquired
real estate remain in fee title of the Tribe.
DEVELOPMENT - The term ""DEVELOPMENT"", as used in context with
the Program, shall be those activities and/or actions undertaken
by the Tribe to in some way cause growth, building up,
expansion, strengthening, increased effectiveness, or other
evolutionary process toward the progress of the Tribe economically,
and/or socially , and/or governmentally.
MAINTENANCE - The term ""MAINTENANCE"", as used in context with
the Program, shall be those activities and/or actions undertaken
by the Tribe to keep in good repair or condition any/
all property, real and other, which is owned by the Tribe
in Trust or in fee.
The Acquisition, Development, and Maintenance Program is designed with a single
thought in mind - to provide maximum benefits to our Tribal members.
The Tribal Council, by establishing a 30% set-aside, acknowledged the certainty
that most recipients of per capita payments will utilize such payments to alleviate
short range problems with little or no thought given to long range
plans or situations regarding their futures. Simply stated, the vast majority
of recipients will find themselves in the same basic difficult situation after
usage of their payment as they were prior to the payment.
To attempt to counteract this situation, the Tribe desires to implement a long
range plan, utilizing the 30% set-aside and/or it's earned interest, to benefit
tribal members by acquiring additional tribal land base; developing it's assets;
and/or maintaining it's property in a state of good repair.
By utilizing the designated funds in such a manner as to achieve economic
stability, and ultimately economic growth, the Tribe will be less dependent
upon dwindling federal support.
For example, the Tribe anticipates a portion of the 30% set-aside to provide
operating capital for a tribally owned, public daily fee golf course which is
currently under construction upon Tribal Trust property. It if is assumed that
a total of $250,000.00 of the 30% set-aside is to be used for this purpose, the
Tribe has demonstrated to both the Bureau of Indian Affairs and to the Department
of Housing and Urban Development that a return of approximately $1,156,000.00
may be expected over a 20 year life of the project. Such demonstrative data is
based upon professional pro forma data obtained through Bureau of Indian Affairs'
Commercial Enterprise Development contracts. Such net return on investment would
be channeled back into the Acquisition, Development, and Maintenance Program,
as well as into supplemental programs to decrease the adverse impact of federal
budget reductions in the areas of health, education, housing, employment, tribal
operations, and so forth.
It should be noted that the above example is not designed to limit the Tribe's
usage of said funds, but rather is shown in an attempt to demonstrate the long
range plans for continuance of the Tribe as a viable entity that is not entirely
dependent upon federal dollars.
It should be further noted that there is no particular percentage division
on funds for a given activity and/or action undertaken by the Tribe within
the Acquisition, Development, and Maintenance Program. Each proposed project
will be judged according to it's individual merits and funds allocated to
that project accordingly.
Locations of projects within the purview of the Acquisition, Development,
and Maintenance Program will be determined by the Business Committee using
sound business practices. The first priority of locations of projects will
be within and/or near the historic boundaries of the Citizen Band Potawatomi
Reservation: PROVIDED, this priority shall neither limit nor restrict activit-
ies and/or actions under the Acquisition, Development, and Maintenance Program
to any given area.
The Acquisition, Development, and Maintenance Program is not designed to adher
to any given timeframe. Such funds are to be utilized on an as needed basis
dependent upon the nature of the proposed project viewed in context with the
need(s) of the Tribe for the acquisition, development, and/or maintenance of
that particular project.
Since the Acquisition, Development, and Maintenance Program may encompass any
number of diverse projects, guidelines for utilization of funds will be developed
by the Business Committee to fulfill the given need(s) of the Tribe.
Developed guidelines will be within the scope and purpose of the Acquisition,
Development, and Maintenance Program; will contain detailed budgetary information
concerning administrative, implementation, and/or execution costs; will
establish projected timeframes for objective accomplishments; will, when
applicable, describe specifically the site of the proposed project; and, when
applicable, describe proposed usage of net revenue derived from the project.
Such developed guidelines will be subject to approval of the General Council
and the Secretary of the Interior.

THEREFORE BE IT RESOLVED that the following plan, as written by the Secretary
of the Interior, is hereby adopted pursuant to Public Law 93-134 (87 Stat.
466, 467, and 468) enacted October 19, 1973, and that the Secretary of the
Interior or his designee, is hereby requested to authorize a Hearing of
Record according to Part 60; Title 25 of the Code of Federal Regulations.
PROPOSED SECRETARIAL PIAN FOR HEARING OF RECORD
Citizen Band Potawatomi, Oklahoma
FOR THE USE AND DISTRIBUTION OF CERTAIN JUDGEMENT FUNDS TO BE APPORTIONED TO
THE CITIZEN BAND POTAWATOMI, OKLAHOMA.
The judgement funds, including the interest and investment income accruing
thereon, apportioned to the Citizen Band Potawatomi, shall be used and distributed
as provided herein.
Per Capita Aspect
The Secretary of the Interior (hereinafter ""Secretary"") shall make a per
capita distribution of seventy (70) per cent of such funds, including
all interest and investment income accrued, in a sum as equal as possible,
to each enrollee of the Citizen Band Potawatomi born on or prior to and
living on the effective date of this plan. The membership roll of the
Citizen Band shall be brought current under existing tribal procedures.
Any amount remaining after the per capita payment to the enrollees shall
revert to the Tribe for use in the program aspect of this plan.
Programming Aspects
Thirty (30) per cent of the funds apportioned to the Tribe, including the
interest and investment income accrued, shall be held and continued to be
invested by the Secretary pursuant to the provisions in 25 USC 162a until
further plans and budgets for the use of such funds have been developed
and approved as provided herein. There shall be established a long-range
Tribal Acquisition, Development, and Maintenance Program, to include the
acquisition of additional lands to build upon the Tribal land base, the
development of the Tribe's assets, and to provide for the maintenance and
care of the Tribal property.
The Tribe shall develop detailed program guidelines and procedures and
budgetary plans for the administration and utilization of such funds, which
shall be subject to approval by the General Council and the Secretary. The
Tribe shall plan the use of the interest and investment income accrued first
for the program.
Initially, the Acquisiiton, Development, and Maintenance Program shall be
established for a ten (10) year period. Once the plan becomes effective,
and subject to the approval of the appropriate guidelines, procedures and
budget plan, there shall be made available from the interest account to
the Business Committee $500,000.00 to commence implementation of the program.
Thereafter, funds shall be withdrawn from investment only as currently
needed under 25 CFR 60.11.
For program purposes, the following definitions are applicable:

Implementation of the program shall be subject to the explanation and
description as provided in Tribal Business Committee Resolution No.
82-6, adopted on September 23, 1981.
At the end of the 10 year period, the Citizen Band Potawatomi General
Council shall have the opportunity to evaluate tribal needs as concerns
the remaining balance in the program account, and any changes proposed
by the General Council shall be subject to approval by the Secretary.
General Provisions
The per capita shares of livng competent adults shall be paid directly to
them. Shares of deceased individual beneficiaries shall be determined and
distributed in accordance with 42 CFR, Part 4, subpart D. Shares of legal
incompetents shall be handled pursuant to 25 CFR 104.5. Shares of minors
shall be handled pursuant to 25 CFR 60.10(a) and (b) (1), and 104,4.
None of the funds distributed per capita or made available under the programming
aspects of this plan shall be subject to Federal or State income taxes, and
the per capita payments shall not be considered as income or resources when
determining the extent of eligibility for assistance under the Social Security
Act.

WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma was awarded certain
claims by the Indian Claims Commission; and,
WHEREAS, Resolution POTT#81-32 provides that the Citizen Band Potawatomi
Indians of Oklahoma woud per capita 70 per centum of the awarded
funds; and,
WHEREAS, the 30 per centum of awarded funds are to be utilized for the purposes
established within the Acquisition, Development and Maintenance
Program; and,
WHEREAS, Administrative Guidelines must be established to govern expenditures
pursuant to the operation of the Acquisition, Development and
Maintenance Program,
NOW,
THEREFORE BE IT RESOLVED that the following Administrative Guidelines are
hereby adopted to govern expenditures pursuant to the operation of the
Acquisition, Development and Maintenance Program.
I .
ALLOWABLE ACTIVITIES
The Acquisition, Development and Maintenance Program is a single program under
which three (3) types of activities may be undertaken by the Tribe.
A. ACQUISITION ACTIVITIES - The Tribe may utilize Program funds
to undertake those actions and/or activities necessary to acquire, to get,
or to come to have as it's own real estate, and, when possible and feasible,
it's natural assets such as minerals, water, and so forth. Further, the
Tribe's utilization of Program funds in unsuccessful attempts of activities
under this part shall be considered allowable; for example, it is conceivable
that the Tribe might not be successful in bidding for land auctioned, but
expenses for appraisals and the like may have been incurred by the Tribe
pursuant to bid preparation. In such instances, any cost(s) related directly
to such an attempted transaction would be considered allowable Acquisition
activity(ies) cost(s). Further, interest charges, escrow account costs,
and the like shall be considered allowable.
B. DEVELOPMENT ACTIVITIES - The Tribe may utilize Program funds to
undertake those actions and/or activities necessary to, in some way, cause
growth, building up, expansion, strengthening, increased effectiveness, or
other evolutionary process toward the progress of the Tribe economically,
and/or socially, and/or governmentally. Allowable Development activities may
include, but shall not be limited to, the provision of capital, personnel,
supplies, material, and/or facilities necessary to carry out a given Development
activity.
C. MAINTENANCE ACTIVITIES - The Tribe may utilize Program funds
to undertake those actions and/or activities necessary to keep in good repair
or condition any and/or all of the Tribe's property, real and other, owned
in Trust or in fee. Allowable Maintenance activities may include, but shall

not be limited to, the provision of personnel, supplies, material, and/or
facilities to carry out a given Maintenance activity.
II. METHOD OF DRAWDOWN
The Tribe shall initiate Acquisition, Development and Maintenance Program
drawdowns on a semi-annual basis.
Each Acquisition, Development and Maintenance Program drawdown shall be in
the form of a Business Committee Resolution and shall contain a Budget which
stipulates the proposed usage of Program funds and the amount of Program funds
necessary to perform the given activity(ies).
III. FISCAL ACCOUNTABILITY
The financial management system of the Tribe is a Level I system, as rated
by the Bureau of Indian Affairs, and will include the maintenance of accurate,
complete and current records of all financial transactions for:
1. analyzing and allocating expenses.
2. assuring fiscal financial control.
3. provide management with financial data for decision making.
The Citizen Band Potawatomi Indians of Oklahoma has in place the following
financial standards:
1. A system of records capable of identifying the source of
funds.
2. Internal control procedures to ensure that funds are used
Properly.
3. A system for disclosing and reporting transactions.
4. A system for analyzing expenditures in relation to budget.
5. A system for determining allowability and allocability.
6. Documentation of all transactions recorded.
IV. REPORTS AND MONITORING
The Tribe shall constantly monitor the performance of the activity(ies) to
assure that adequate progress is being made toward achieving the goals and
objectives of the Tribe.
The Tribe shall report annually to both the General Council and to the
Bureau of Indian Affairs on all Acquisition, Development and Maintenance
Program data necessary to monitor the program. Such data may be reviewed
at the Tribal complex by any such authorized Department of Interior official
during normal working hours.

to the Tribal Administrator, and to Title VI Director, and;
WHEREAS, these authorities will remain in effect until such time as the
Business Committee chooses to withdraw said authorizations by subsequent
resolution, and;
WHEREAS, the Business Committee reserves the right to review the grant
document thereto prior to signature by designated persons.
NOW THEREFORE BE IT RESOLVED that the Business Committee of the Citizen
Band Potawatomi Indians of Oklahoma wishes to make grant app-
lication to the Administrator on Aging for Title VI of the
Older American Act Funds.

WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma Business Committee,
as the governing body of the Citizen Band Potawatomi Indians of
Oklahoma, is charged by the Tribal Constitution and By-Laws to
transact business and otherwise speak or act in behalf of the
Tribe in all matters on which the Tribe is empowered to act, save
and except those expressly prohibited by Tribal Constitution
and By-Laws; and
WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma Business Committee
has the responsibility of protecting the health, security, and
general welfare of the Tribe and its' members; and
WHEREAS, the state of Oklahoma is without jurisdiction on Tribal Trust
lands of the Citizen Band Potawatomi Indians of Oklahoma to
regulate and control racing, pari-mutuel betting, and other
related activities operated by the Tribe or by others upon
such Tribal Trust lands; and
WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma Business Committee
deems it essential to the health, security, and general welfare of
the Citizen Band Potawatomi Indians of Oklahoma and its' members
to enact a comprehensive racing and pari-mutuel betting ordinance
relating to conduct and operation of such racing and pari-mutuel
betting upon Tribal Trust lands of the Citizen Band Potawatomi
Indians of Oklahoma;

promulgate the following ordinance entitled ""The Citizen Band
Potawatomi Indians of Oklahoma Racing and Pari-Mutuel Betting
Regulations"".
THE CITIZEN BAND POTAWATOMI INDIANS OF OKLAHOMA RACING AND PARI-MUTUEL BETTING
REGULATIONS
2-1 - TITLE AND PURPOSE
2-1-1 - This document shall be known as the ""Citizen Band Potawatomi Indians
of Oklahoma Racing and Pari-Mutuel Betting Regulations"". These Regulations
are enacted to regulate the conduct and operation of racing and pari-mutuel
betting upon Tribal Trust lands of the Citizen Band Potawatomi Indians of
Oklahoma, and to generate revenue to fund such needed tribal programs and
services as may be deemed appropriate by the Tribe.

DEFINITIONS
2-2-1 - Unless otherwise required by context, the following words and phrases
shall have the designated meanings:
1.) ""Tribe"" shall mean the Citizen Band Potawatomi Indians of
Oklahoma, Route 5, Box 151, Shawnee, OK 74801.
2.) ""Business Committee"" shall mean the Citizen Band Potawatomi
Indians of Oklahoma Business Committee as constituted by
Article V of the Tribal Constitution and By-Laws.
3. ) ""Tribal Trust Lands"" shall mean the lands and waters lying
within boundaries of the property described below:

The northeast quarter northeast quarter, southeast quarter northeast quarter,
southwest quarter northeast quarter section 31, township 10 north, range 4
east, Indian Meridian, Pottawatomie County, Oklahoma, containing 120.00 acres
more or less.
Tract Numbered 2
That part of the northwest quarter southeast quarter section 31, township 10
north, range 4 east, Indian Meridian, Pottawatomie County, Oklahoma, described
as: Beginning at the southwest corner of said northwest quarter southeast
quarter; thence east 1,320 feet; thence north 1,320 feet; thence west 1,320
feet to the center of said section; thence south 167 feet; thence east 183 feet
to the intersection with the west line of the Atchison, Topeka, and Santa Fe
Railroad right-of-way; thence southwesterly along the west right-of-way line
a distance of 856 feet to the intersection with a point in the west line
of the northwest quarter southeast quarter, said point being 983 feet south
of the center section 31; thence south along the west line of the northwest

167 feet; thence west 1,302 feet to the intersection with the west line
right-of-way of Oklahoma State Highway Numbered 18; thence northeasterly
along the west right-of-way a distance of 167 feet to the north line of
said northeast quarter southwest quarter; thence east along said north line
a distance of 1,297.4 feet to the point of beginning; containing 4.678 acres,
more or less.

described as: Beginning at the southeast corner of said northeast quarter
southwest quarter; thence north along the east line of said northeast quarter
southwest quarter a distance of 337 feet to the intersection with the west
right-of-way line of the Atchison, Topeka, and Santa Fe Railroad right-of-
way; thence southwesterly along said west right-of-way line a distance of
367 feet to the intersection with the south line of said northeast quarter
southwest quarter; thence east along the south line a distance of 129 feet
to the point of beginning; containing .498 acre, more or less.

The reserved mineral deposits, including the right to prospect for and
remove the same, in and under lands described as the south half of lot 2
(southwest quarter northwest quarter), and that part of the southwest quar-
ter southeast quarter northwest quarter lying west of the centerline of
Oklahoma State Highway Numbered 18 and adjacent to the south half of said
lot 2, all in section 31, township 10 north, range 4 east, Indian Meridian,
Pottawatomie County, Oklahoma, containing 19.87 acres, more or less, which
lands were previously conveyed to Pottawatomie County, Oklahoma, by quitclaim
deed dated December 17, 1959, pursuant to the Act of June 4, 1953 (67 Stat.)
71; 25 USC 293a), said deed appearing of record in Pottawatomie County,
Oklahoma, in deed book 174 at page 367 of the land records of said county.
Tract Numbered 7
That part of lot 1 (northwest quarter of northwest quarter) and north
half of lot 2 (north half of southwest quarter of northwest quarter, and
the part of the north half of the southeast quarter of the northwest quar-
ter lying west of the east right-of-way line of Oklahoma State Highway
Numbered 18, all in section 31, township 10 north, range 4 east, Indian
Meridian, Pottawatomie County, Oklahoma, containing 57.99 acres, more or
less.
4. ) ""Member"" shall mean any person whose name appears on the
official roll of the Citizen Band Potawatomi Indians of
Oklahoma.
5. ) ""Race"" shall mean a competition of speed in running by
mounted horses that may be weighted appropriately.
6. ) ""Pari-Mutuel"" shall mean a system of betting on races
in which those backing the winners divide, in proportion
to their wagers, the total amount bet, minus a percentage
for the track operators, taxes, and so forth.
7. ) ""Race Track"" shall mean a course(s) prepared for the racing
of horses.
8. ) ""Race Meeting or Meet"" shall mean a given number of races,
sanctioned by the Tribal Racing Commission, during a given
time period.
2-3 - TRIBAL RACING COMMISSION, CREATION, MEMBERS, ETC.
2-3-1 - A Tribal Racing Commission is created and is vested with powers and
duties in this part, and all other powers necessary and proper to enable it
to execute fully and effectively all the purposes of this part. The Tribal
Racing Commission shall consist of five (5) persons, four of whom shall be
appointed by the Citizen Band Potawatomi Indians of Oklahoma Business Com-
mittee. The fifth member, and the chairman of the Tribal Racing Commission,
shall be the Chairman of the Citizen Band Potawatomi Indians of Oklahoma
Business Committee. Other than the Chairman of the Tribal Racing Commission,
whose term shall coincide with the term of Chairman of the Citizen Band Potawatomi
Indians of Oklahoma Business Committee, each member of the Tribal
Racing Commission shall be a resident of the state for five years next pre-
ceding their appointment, and who is a qualified Tribal elector not less than
twenty-five years of age. The Commissioners shall select from among their
number, a Secretary. The Secretary shall keep a record of all proceedings of
the Tribal Racing Commission and shall preserve all books, maps, documents,
papers, and records entrusted to the care of, or generated by, the Tribal
Racing Commission. The incumbent Tribal Administrator shall be ex-officio
Treasurer of the Tribal Racing Commission. The Tribal Racing Commission
shall semi-annually make a full report to the Business Committee. A
majority of the Tribal Racing Commission shall constitute a quorum for all
purposes.
2-3-2 - The Tribal Racing Commission may, at its' discretion, employ an
attorney and such assistants and employees as may be deemed necessary by
that body at such compensation as the Tribal Racing Commission may prescribe.
2-3-3 - Each commissioner shall take a Tribal Constitutional oath of office
and shall give bond to the Business Committee of the Tribe with personal or
corporate surety to be approved by the Treasurer in the amount of five
thousand dollars ($5,000.00), conditioned that he will faithfully and honestly
perform the duties of his office with such premium on the bond above mentioned
paid by the Tribal Racing Commission. The Tribal Racing Commission shall
maintain an office in the Citizen Band Potawatomi Tribal Complex and such
branch offices as may be necessary.
2-3-4 - Beginning in 1982, the terms of office of the members, other than
the Chairman, shall be four years beginning in each instance with the first
Monday in August and ending on the last Sunday preceding the first Monday
in August four years thereafter in each instance.
2-4 - THE POWERS AND DUTIES OF THE TRIBAL RACING COMMISSION
2-4-1 - The Tribal Racing Commission shall carry out the provisions of this
part and supervise and check the making of pari-mutuel pools and the redis-
tribution therefrom.
2-4-2 - The Tribal Racing Commission shall make rules and regulations for
the control, supervision, and direction for the holding, conducting, and
operating of all race tracks, race meets, and/or races held on Tribal Trust
lands.
2-4-3 - The Tribal Racing Commission shall establish the exact location where
races may be held upon Tribal Trust lands.
2-4-4 - The Tribal Racing Commission shall establish the kind of racing to be
conducted and whom may conduct such races upon Tribal Trust lands.
2-5 - RECORDS OF DIVISION
2-5-1 - All books, records, maps, documents, and papers in the care of, or
generated by or for, the Tribal Racing Commission shall at all times be open
for the personal inspection of any member of the Citizen Band Potawatomi
Indians of Oklahoma Business Committee, or any such officer or investigative
body or person so empowered by the Citizen Band Potawatomi Indians of Oklahoma
Business Committee.
2-5-2 - Any member of the Tribal Racing Commission who violates
2-5-1 above
shall be subject to removal from office by majority vote of the Citizen
Band Potawatomi Indians of Oklahoma Business Committee.
2-6 - COMPENSATION OF MEMBERS AND EMPLOYEES OF THE TRIBAL RACING COMMISSION.
2-6-1 - The compensation of each member of the Tribal Racing Commission shall
be one thousand two hundred dollars ($1,200.00) annually, together with documented
and approved traveling expenses as provided by Tribal Travel Regula-
tions. Such compensation and travel expenses are to be paid out of funds in
the hands of the Treasurer to the credit of the Tribal Racing Commission.
2-6-2 - The Tribal Racing Commission may hire personnel to assist it in the
proper performance of its' tasks. Such personnel shall be paid salaries
or wages and such fringe benefits as may be applicable, commensurate with
the position held.
2-6-3 - All obligations and debts, including compensation and traveling expenses
of the Commissioners and/or employees of the Tribal Racing Commission,
shall be paid wholly out of funds deposited with the Treasurer under provi-
sions of these Regulations. It is expressly declared that the Tribe, shall
not at any time or under any circumstances, be or become liable to any person
for any expense incurred or debts owing by the Tribal Racing Commission or
any member, agent, servant, or employee of the Tribal Racing Commission.
2-6-4 - No money shall be paid out by the Treasurer for salaries or expenses
of the Tribal Racing Commission except upon voucher of the Tribal Racing Com-
mission signed by the Chairman of the Tribal Racing Commission and counter signed
by the Secretary of the Tribal Racing Commission, which voucher shall
exhibit in detail the items or services for which such money is paid.
2-7 - OCCUPATIONAL LICENSE TAX TO BE PAID BY EMPLOYEES; DENIAL AND REVOCATION
OF LICENSE.
2-7-1 - All persons employed as direct support for any race track upon Tribal
Trust lands shall pay an occupational license tax, with such occupational tax
to be payable for each specified job performed. The scheduled license fees
are as follows:
a.) Contractual concessionaires, 5% of gross sales.
b.) Professional persons such as owners, trainers, veterina
rians, doctors, nurses, officials and supervisors of
all departments, twenty-five dollars ($25.00) per annum
or any portion thereof.
c.) Jockeys, apprentice jockeys, jockey agents or managers,
twenty-five dollars ($25.00) per annum or portion thereof.
d.) Gate keepers, announcers, ushers, starters, owners and/or
sellers of racing forms or bulletins, machine attendants,
track managers, concession employees, grooms, exercise
boys, hot walkers, miscellaneous stable help, platers and
all others not specifically provided, ten dollars ($10.00)
per annum or portion thereof.
2 - 7 - 2 - The Tribal Racing Commission may deny or revoke any license where
the holder thereof has violated the rules and regulations of this part
or such regulation or rule duly sanctioned by the Tribal Racing Commission.
2 - 8 - METHOD OF BOOKKEEPING PRESCRIBED.
2 - 8 - 1 - All activities under these Regulations shall have so kept books and
records as to clearly show the total number of admissions and the total
amount of money contributed to each and every pari-mutuel pool on each race
separately and the amount of money received daily from admission fees, and
within one hundred twenty (120) days after the first day of January of each
year, shall submit to the Business Committee, through the Tribal Racing Com-
mission, directly or indirectly, a detailed financial annual audit performed
by certified public accountant licensed to practice in the state of Oklahoma.
2-9 - PARI-MUTUEL POOL AUTHORIZED WITHIN TRACK ENCLOSURE; COMMISSION, BREAKS,
ETC.
2-9-1 - The sale of tickets or other evidences showing an interest in or a
contribution to a pari-mutuel pool is hereby permitted within the enclosure
of any horse race track sanctioned by the Tribal Racing Commission upon Tribal
Trust lands, but not elsewhere upon Tribal Trust lands. The sale and purchase
of tickets or other evidences showing an interest in or a contribution to pari-
mutuel pools conducted upon Tribal Trust lands shall be under the supervision of
the Tribal Racing Commission and shall be done subject to such regulations as
the Tribal Racing Commission shall from time to time prescribe.
2-9-2 - The commission on a pari-mutuel pool on each and every horse race sanc-
tioned by the Tribal Racing Commission may be at any given rate; PROVIDED, such
rate shall in no event exceed seventeen percent (17%) of the amount contributed
thereto.
2-9-3 - After deducting such commission as described in
2-9-2 above, and the
""breaks"" (hereinafter described), a pari-mutuel pool shall be redistributed
to the contributors.
2-9-4 - No distribution of a pari-mutuel pool shall be made of the odd cents of
any sum otherwise distributable, which odd cents shall be known as the ""breaks"".
2-9-5 - The ""breaks"" shall be known as the difference between the amount con-
tributed to a pari-mutuel pool and the total of the commissions and sums redis-
tributed to the contributors.
2-9-6 - No person or group or corporation shall directly or indirectly purchase
pari-mutuel tickets or participate in the purchase of any part of a pari-mutuel
pool for another for hire or for any gratuity and no person shall purchase any
part of a pari-mutuel pool through another, wherein he gives or pays directly or
indirectly such other person anything of value.
2-9-7 - All revenues generated by this Part and Part 2-7, after approved oper-
ating expenses are deducted, shall be deposited through the Tribal Racing Com-
mission to the General Account of the Citizen Band Potawatomi Indians of Oklahoma
for utilization.
2-10 - PARI-MUTUEL POOLS OF LESS THAN $400,000.00 DAILY; LICENSE FEE.
2-10-1 - Any duly sanctioned horse (running) race track having a pari-mutuel
pool of less than four hundred thousand dollars ($400,000.00) per day shall, in
lieu of the payment of such commission stipulated by 2-9, be permitted to operate
the sale of pari-mutuel pools on the basis of a fixed daily license fee which is
hereby fixed according to the following schedule:

All such funds generated shall be deposited per 2-9-5.
2-11 - TAX ON BREAKS; DISTRIBUTION.
2-11-1 - A tax is hereby levied upon every pari-mutuel pool conducted upon Tribal
Trust lands equal to the sum of the ""breaks"", which is the difference between:
a.) the total amount contributed to a pool; and
b.) the total of the commissions and the sums actually redistributed
to the contributors, which tax shall be known as the ""breaks tax"".
2 - 11 - 2 - The tax hereby levied shall be paid at the time and places promulgated
by the Tribal Racing Commission for the payment of other funds
generated by percentage of a given pari-mutuel pool.
2 - 11 - 3 - The breaks tax hereby levied on pari-mutuel pools conducted upon
Tribal Trust lands shall be deposited by the Treasurer into, and it shall
become and be made a part of, the Tribal Racing Commission Operational
Account;
PROVIDED, that twenty-five percent (25%) of such revenues generated
by the breaks tax shall be utilized for the payment of breeder's awards as
follows: each race track operating upon Tribal Trust lands shall, within
thirty days after the expiration of such meeting, pay to the breeder of
each Oklahoma bred horse winning an overnight race at such meeting a sum
equal to ten percent (10%) over and above the announced gross purse, or one
hundred dollars ($100.00), whichever is greater, and said award so paid shall
not in any case be deducted from the amount of the purse, nor shall it be
required when the purse includes an award to the breeder equal to or greater
than the amount above specified;
AND PROVIDED, there shall be no breeder's
award required in any stake race or races exclusively for Oklahoma breds;
AND PROVIDED, that in order for the breeder of an Oklahoma bred to be eligible
for such award, such breeder shall have met such registry requirements as may
be set by the Tribal Racing Commission:
AND FURTHER PROVIDED, that the blanace
of the proceeds from said breaks tax and fifty percent (50%) of net commissions
shall be distributed by tracks for the payment of purses as approved by the
Tribal Racing Commission.
2 - 11 - 4 - No contract or agreement shall be valid or enforceable which requires
or provides for any track to distribute in purses a percentage of their indi-
vidual pari-mutuel handle in a manner different than that herein provided.
2-12 - ESCHEAT TO THE TRIBE OF ABANDONED INTEREST IN OR CONTRIBUTION TO PARIMUTUEL
POOLS.
2-12-1 - It is hereby declared to be the policy of the Tribe to possess all
unclaimed and abandoned interest in or contribution to any pari-mutuel pool
conducted upon Tribal Trust lands for the benefit of the people of the Tribe,
and this part shall be liberally construed to accomplish such purpose.
2-12-2 - All money or other property represented by any unclaimed, uncashed,
or abandoned pari-mutuel ticket which has remained in the custody of or under
the control of any track upon Tribal Trust lands for a period of one year
from the date said pari-mutuel ticket was issued, when the rightful owner or
owners thereof, have made no claim or demand for such money or other property
within the aforesaid period of time, is hereby declared to have escheated to
or to escheat to, and to have become the property of the Tribe.
2-13 - PERMITS AND LICENSES NOT ASSIGNABLE.
2-13-1 - No permit nor any license under this Part shall be transferrable or
assignable without written approval and consent of the Tribal Racing Commis-
sion.
2-14 - CONNIVING TO PREARRANGE RESULT OF A RACE; STIMULATING OR DEPRESSING
A HORSE OR HORSES.
2-14-1 - Any attempt to prearrange or predetermine the outcome of any race by
conniving with any owner, jockey, groom, or other person connected with or
associated or interested in any stable or by attempting to stimulate or depress
a horse is expressly forbidden.
2-15 - HOLD HARMLESS CLAUSE.
2-15-1 - The Tribe is hereby held harmless from any action which may be undertaken
by or against the Tribal Racing Commission. In no circumstance shall
any funds, other than those generated under these Regulations, be disbursed
from the General Account or from any other tribal resource unless specifi-
cally approved and consented to by majority vote of the Citizen Band Potawa-
tomi Indians of Oklahoma Business Committee; further, the Tribe shall under
no circumstances be held liable for any indebtedness, however incurred, of
the Tribal Racing Commission, its' members, agents, servants, employees, or
any other person or persons associated with such body.
2-16 - TRANSMISSION OF RACING INFORMATION FOR ILLEGAL GAMBLING PURPOSES.
2-16-1 - No person shall transmit or communicate to another or receive or
secure by means whatsoever the results, changing odds, track conditions,
jockey changes, or any other information relating to any horse race from any
track upon Tribal Trust lands, between the period of time beginning one hour
prior to the first race of any day and ending thirty minutes after the
posting of the official results of each race as to that particular race, except
that the foregoing limitations shall not apply to the results of the
last race of each day's meet. Provided, however, that the Tribal Racing Com-
mission may, by rule, permit the immediate transmission by radio, television,
or press wire of any pertinent information concerning not more than four
feature races each week; provided further, that the foregoing limitation of
four feature races per week shall not apply to so-called ""name stake races""
which if broadcast or televised, the Tribal Racing Commission may permit at its'
discretion.
2-16-2 - No person shall transmit by any means whatsoever racing information
to any other person, or to relay the same to any other person by word of mouth,
by signal, or by use of telephone, telegraph, radio, or any other means when
such information is knowingly used or intended to be used for illegal gambling
purposes, or in furtherance of such gambling.
2-16-3 - This section shall be deemed an exercise of the Tribe’s authority for
the protection of the general welfare, health, peace, safety, and morals of
the people of the Citizen Band Potawatomi Indians of Oklahoma and all provisions
herein shall be liberally construed for the accomplishment of this purpose.

2-17-1 - No person shall be admitted to any race track upon Tribal Trust lands
who has in his/her possession or control any transmitting device or equipment
capable of transmitting or communicating any information whatsoever to another
person unless such person shall have written approval and consent of the Tribal
Racing Commission on his/her person at all times.
2-17-2 - This section shall not apply to the possession or control of any telephone,
telegraph, radio, or television facilities sanctioned and/or installed
by permission of the Tribal Racing Commission.
2-18 - PURSES.
2-18-1 - All purses, other than those previously addressed in these Regulations,
shall be sanctioned and set on an as needed basis by action of the Tribal Racing
Commission.

WHEREAS, the Tribe requested by Resolution No. 82-16, dated 12-3-81
that the Bureau of Indian Affairs include two tracts of land on the
next Oil and Gas Lease Sale, and
WHEREAS, the above described tract of land was included on an Oil and Gas Lease
Sale held on January 28, 1982, and
WHEREAS, Baker Street, Inc., 2904 Parklawn Drive of Midwest City, Oklahoma,
submitted a bid of $11,679.00 for the above described tract of land,
and,
WHEREAS, the Business Committee feels that the bid submitted is a fair and
equitable rate , and
WEHREAS, the Business Committee hereby approves an Oil and Gas Lease with

WHEREAS, adoption of a tribal housing rehabilitation plan is mandatory for participation

the administrative capabilities to contract with federal agencies, and

Drivers, Medical Resource Specialists, and Otitis Media program to

WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma do not receive an
equitable allocation of the resources designated for the Five Tribes
through the resource allocation mechanism of five (5) positions of the
defunct Shawnee Service Unit Advisory Board being administered by the
Community Health Merger.
WHEREAS, the Tribal Administrator has authorization to act on behalf of the
Citizen Band Potawatomi Indians of Oklahoma,
NOW THEREFORE BE IT RESOLVED THAT the Citizen Band Potawatomi Tribe of Oklahoma
be assigned one CHR Position (an equitable share of the Resource Allocation
Mechanism) from the five positions administered by the Community Health Merger
with all funds and entitlements thereto effective June 1, 1982.

Committee's efforts to design and develop the planning, governance, administration,
management and operation of comprehensive health and social services
and facilities for Indian people.
WHEREAS, the Business Committee is authorized by Tribal Constitution and
By-Laws to act on behalf of the Citizen Band Potawatomi Indians
of Oklahoma, and;
WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma is a federally
recognized Indian Tribe and has a Constitution and By-Laws as
approved by the Secretary of the Interior, and;
WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma recognizes the
Kickapoo Tribe of Oklahoma having a Tribal Constitution and
By-Laws as approved by the Secretary of the Interior, and the
capability and experience to contract under the authority of
P.L. 93-638 with proper authorization by resolution from participating
Tribes, and;
WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma is a legal contracting
entity eligible for contracting under P.L. 93-638, and;
WHEREAS, the Kickapoo Tribe of Oklahoma is a legal contracting entity
eligible for contracting under P.L. 93-638, and;
WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma is fully aware of
its options of contracts and grants under the authorities of
P.L. 93-638 or Buy Indian, and hereby chooses to exercise our
rights to authorize the Kickapoo Tribe of Oklahoma to contract
under the authority of P.L. 93-638, and;
WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma is a duly authorized
representative designated and acting on the Tribe's behalf
to serve as liaison and voting member of the officially recognized
P.L. 93-638 Planning Committee, and;
WHEREAS, a tremendous amount of consideration, planning and development has
been invested in the establishment of the P.L. 93-638 Planning
Committee as the official legally authorized representative of all
participating Indian tribes on collective health matters, and;
WHEREAS, the potential for future funding possibilities for comprehensive
medical and social services and facilities to serve Indian people
is greatly enhanced by the advisory, supervisory and operational
efforts of one duly authorized voice representing all participating
Tribes, and;
WHEREAS, a concerted and deliberate planning effort must be undertaked to
thoroughly design and structure such comprehensive medical and
social services and facilities,
NOW THEREFORE BE IT RESOLVED that the Business Committee of the Citizen
Band Potawatomi Indians of Oklahoma hereby authorizes the Kickapoo Tribe
of Oklahoma to function as fiscal agent under authority of P.L. 93-638
