Description85-1: SUMMARY: Resolution submitting a budget and guidelines for the expenditure of the ""set aside"" funds in the amount of 30% of the final claims by the CBP Indians against the U.S. Government. TRANSCRIPTION: General Council POT#85-1 RESOLUTION CITIZEN BAND POTAWATOMI INDIANS OF OKLAHOMA A RESOLUTION submitting a budget and guidelines for the expenditure of the "" set aside"" funds in the amount of 30% of the final claims by the Citizen Band Potawatomi Indians against the United States Govenrnment. WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma is a federally recognized tribe of American Indians under authority of the Oklahoma Indian Welfare Act of 1936; AND WHEREAS, the Citizen Band Potawatomi Business Committee is duly authorized to act on behalf of the Tribe by authority of the Tribal Constitution and By-Laws; AND the General Council has the authority to act on issues relating to claims and treaties WHEREAS, the General Council met on the 25th day of August, 1984 and established a budget and guidelines for the expenditure of the ""30% set aside"" funds, and a quorum being present, AND WHEREAS, whereas, the attached budget and guidelines are submitted for approval of the Secretary of the Interior as soon as possible, NOW THEREFORE, BE IT RESOLVED, That the attached budget and guidelines are submitted pursuant to the instructions of the General Council Meeting of august 25, 1984. CERTIFICATION We, the undersigned members of the Business Committee of the Citizen Band Potawatomi Tribe of Oklahoma do hereby certify that the attached budget and guidelines are a true and exact copy of those adapted by a vote of 35 to 32 on the 25th day of August at a meeting of the General Council of the Citizen Band Potawatomi Indians of Oklahoma held at the Ship She Wano Building, Potawatomi Tribal Grounds. 85-107: SUMMARY: Resolution authorizing Leon Bruno, Chairman to sign operation contracts with Maranatha Baptist Church of Shawnee, Oklahoma to secure the land necessary so as to allow construction of the low rent elderly housing project by Absentee Shawnee housing authority. TRANSCRIPTION: RESOLUTION POT# 85-107 CITIZEN BAND POTAWATOMI INDIANS OF OKLAHOMA A RESOLUTION AUTHORIZING LEON BRUNO, CHAIRMAN TO SIGN OPERATION CONTRACTS WITH MARANATHA BAPTIST CHURCH OF SHAWNEE, OKLAHOMA TO SECURE THE LAND NECESSARY SO AS TO ALLOW CONSTRUCTION OF THE LOW RENT ELDERLY HOUSING PROJECT BY ABSENTEE SHAWNEE HOUSING AUTHORITY. WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma is a federally recognized tribe of American Indians under authority of the Oklahoma Indian Welfare Act of 1936 and the General council is the governing body; AND WHEREAS, the Citizen Band Potawatomi Business Committee has authority to act in behalf of the Tribe as authorized in the Tribal Constitution and By-Laws; AND WHEREAS, the Citizen Band Potawtomi Business Committee has authorized Robert Leon Bruno, Chairman of the Business Committee to sign all contracts pertaining to purchase of land from the Maranatha Baptist Church; NOW THEREFORE, BE IT RESOLVED, that Robert Leon Bruno, Tribal Chairman of the Citizen Band Potawatomi Indians of Oklahoma shall be authorized to act in behalf of the Tribe to enter into the contracts to acquire land from the Maranatha Baptist Church for the Elderly Housing Project to be built by the Absentee Shawnee Housing Authority. 85-108: SUMMARY: Resolution authorizing to purchase five acres of land from the Maranatha Baptist Church. TRANSCRIPTION: RESOLUTION POT # 85-108 CITIZEN BAND POTAWATOMI INDIANS OF OKLAHOMA A RESOLUTION AUTHORIZING TO PURCHASE FIVE ACRES OF LAND FROM THE MARANATHA BAPTIST CHURCH, LEGAL DESCRIPTION AS FOLLOWS: Tract of land located in the SE of the SW, Section 31, Township 10 North Range 4 East, of the Indian Meridian in the Pottawatomi County commencing at the SW corner of said SE/4 SW/4, then east, a distance of 40 ft., thence north 01 , 48 minutes east, a distance of 1,320 ft., thence east, a distance of 437.8 ft., to the direct point of beginning. Thence, south 9 , 34 minutes, 27 seconds east, a distance of 126.7 ft., thence, south, a distance of 275.91 ft., thence south 37 , 44 minutes, 20 seconds east, a distance of 480.43 ft., thence north 12 , 30 minutes east, a distance of 430 ft., thence west, a distance of 594.2 ft., to point of beginning, contains 6.93 acres exactly inclusive of 100% of the mineral rights. WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma is a federally recognized Tribe of American Indians under authority of the Oklahoma Indian Welfare Act of 1936; and the General council is the governing body; AND WHEREAS, the Citizen Band Potawatomi Business Committee has authority to act in behalf of the Tribe as authorized in the Tribal Constitution and By-Laws; AND WHEREAS, the purchase of the land shall be in keeping with all contracts approved by Steve Parker, authorized attorney for the Tribe; AND WHEREAS, the purchase price of the approximately 6.93 acres of land shall not exceed $52,500.00; AND WHEREAS, the land is to be placed in trust with Bureau of Indian Affairs; AND WHEREAS, this land is needed for and will be used for a senior citizen housing project; AND WHEREAS, this land is located within the exterior boundaries of the former reservation area; AND WHEREAS, the land will be purchased with funds from the Absentee Shawnee Housing Authority; AND WHEREAS, the Tribe requests that an appraisal be made of the property to be purchased to be conducted by the Bureau of Indian Affairs; AND WHEREAS, Robert Leon Bruno, Tribal Chairman has been authorized by the Business Committee to enter into the purchase contract pursuant to this matter; NOW THEREFORE BE IT RESOLVED, that Robert Leon Bruno, Tribal Chairman shall be authorized to act in behalf of the Tribe to purchase the land and 100% of the mineral rights, so stated in the above legal description for the predetermined amount of $52,500.00 and to complete the transaction upon completion of the appraisal by the BIA. TRANSCRIPTION: RESOLUTION POT# 85-110 CITIZEN BAND POTAWATOMI INDIANS OF OKLAHOMA A RESOLUTION APPROVING AN ATTORNEY CONTRACT WITH STEVE PARKER, ATTORNEY AT LAW AUTHORIZED THROUGH GENERAL COUNCIL RESOLUTION POT# 80-39 PASSED JUNE 28, 1980 AND RESOLUTION POT# 82-46 PASSED JUNE 26, 1982. 85-116: SUMMARY: Resolution to allow CBP Indians of Oklahoma community health representative program to apply for and administer funds for an infant-child car seat loan program through the BIA. TRANSCRIPTION: RESOLUTION POT# 85-116 CITIZEN BAND POTAWATOMI INDIANS OF OKLAHOMA A RESOLUTION TO ALLOW CITIZEN BAND POTAWATOMI INDIANS OF OKLAHOMA COMMUNITY HEALTH REPRESENTATIVE PROGRAM TO APPLY FOR AND ADMINISTER FUNDS FOR AN INFANT-CHILD CAR SEAT LOAN PROGRAM THROUGH THE BUREAU OF INDIAN AFFAIRS. WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma is a federally recognized Tribe of American Indians under authority of the Oklahoma Indian Welfare Act of 1936; and the General Council is the governing body; AND WHEREAS, the Citizen Band Potawatomi Business Committee has authority to act in behalf of the Tribe as authorized in the Tribal Constitution and By-Laws; AND WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma recognizes the fact that Indian children are at greater risk than the general population to die in auto accidents as indicated in the Oklahoma Health Statistics for 1982; AND WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma Community Health Representative Program, under the auspices of the Citizen Band Potawatomi Indians of Oklahoma, recognizes the need for community education of the potential health hazards associated with children riding unrestrained in automobiles; AND WHEREAS, the results of a survey conducted during the month of February, 1984, resulted with the following: 1. 123 families responded 2. 74.3% did not have or use car seats for their children 3. 87.8% stated that if made available they would use the child restraints. 4. 77.1% of the surveyed families had yearly incomes of less than $10,000.00 BE IT RESOLVED, that the Citizen Band Potawatomi Indians of Oklahoma Community Health Representative Program exist to assist the local Indian population in their effort to optimize their health; AND BE IT FURTHER RESOLVED, that the Citizen Band Potawatomi Indians of Oklahoma Community Health Representative Program be authorized to apply for and administer funds to be used to provide community education on children in automobiles; AND BE IT FURTHER RESOLVED, That grant funds will also be used to provide proper child safety restraint equipment on a loan basis to community members in need of such equipment. 85-120: SUMMARY: Resolution requesting the BIA to enter into a law enforcement contract with the CBP Indians of Oklahoma in FY85. TRANSCRIPTION: ATTACHMENT #1 RESOLUTION POT# 85-120 CITIZEN BAND POTAWATOMI INDIANS OF OKLAHOMA A RESOLUTION REQUESTING THE BUREAU OF INDIAN AFFAIRS TO ENTER INTO A LAW ENFORCEMENT CONTRACT WITH THE CITIZEN BAND POTAWATOMI INDIANS OF OKLAHOMA IN FISCAL YEAR 1985. WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma is a federally recognized tribe of American Indians under authority of the Oklahoma Indian Welfare Act of 1936; AND WHEREAS, the Citizen Band Potawatomi Business Committee is duly authorized to act on behalf of the Tribe by authority of the Tribal Constitution and By-Laws; AND WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma desires to up-grade its' existing police department through utilization of Law Enforcement funds available to it through the Bureau; AND WHEREAS, it is the goal of the Tribe to provide those services necessary to bring the health standards of all Tribal members equal to that of the general population; AND WHEREAS, the Citizen Band Potawatomi Tribal Administrator is hereby authorized to negotiate this contract and any amendments thereto; AND WHEREAS, the Tribal Chairman is hereby authorized to execute this contract and any amendments thereto; AND WHEREAS, the authorities granted by this Resolution shall be continuing throughout the term of such awarded contract; AND WHEREAS, the Business Committee has reviewed this contract and shall review any revisions thereto; PROVIDED, such review shall not require further Business Committee action and in no way reduces the execution power granted the Tribal Chairman above; AND WHEREAS, the proposed date for commencement of this Law Enforcement Contract shall be March 17, 1985; NOW THEREFORE, BE IT RESOLVED, that the Citizen Band Potawatomi Indians of Oklahoma request that the Bureau of Indian Affairs enter into a Law Enforcement Contract to provide the specified services to our Tribe in fiscal year 1985. WHEREAS, The Citizen Band Potawatomi Indians of Oklahoma is a federally recognized Tribe of American Indians under authority of the Oklahoma Indian Welfare Act of 1936; and WHEREAS, The Citizen Band Potawatomi Business Committee is duly authorized to act on behalf of the Tribe by authority of the Tribal Constitution and By-Laws; and WHEREAS, additional changes in the proposed Constitution, other than those adopted in Pott Resolution 85-124, are needed, to wit: 1. The first sentence Article 12- Election, section (a) shall be changed to read- ""The Chairman, vice-Chairman, Secretary/- Treasurer, two Councilmen, and members of the Grievance Committee shall be elected for a two year term of office and until their successors be qualified and installed in office, by a majority vote at an election to be conducted by secret ballot, with absentee voting, on the date of the annual Citizen Band Potawatomi Indian Council meeting.” 2. A new second sentence shall be added to Article 12-Election, section (a) - ""All elections shall be conducted pursuant to an election ordinance adopted by appropriate legislation of the Citizen Band Business Committee."" 3. The third sentence of Article 13 - Meetings of the Council, section (a) shall be changed by deleting the words ""However, decisions on the issues discussed, and"" and by capitalizing the word ""Any"" which shall be the beginning of the sentence. 4. Article 13 - Meetings of the Council, section (d) shall be changed in its entirety to read - ""The principal object of the special meeting must be stated in the call for same and may include the words ""and for the discussion of other business that may be presented."" Unless these words are added, no other business can be discussed except for the object stated in the call. Any actions taken with respect to the authority reserved to the Council by this Consitution shall be made only by a subsequent election held in accordance with, and within the time specified in, the election ordinance, which election shall be open to all members of the Council."" 5. Article 13 - Meetings of the Council, section (g) shall be changed by placing a period after the word Council in the next to last line and deleting the words ""which the Council voted to place upon the ballot."" 6. Article 17 - Quorum -(In order to be consistent throughout the Constitution, Section 1 shall be called (a) and Section 2 shall be called (b) Two new sentences shall be added at the end of the existing section (b) -""Should a quorum not be achieved at a duly-called meeting of the Council, the Business Committee may initiate an election on any agenda items which require action by the Council under the authority reserved to it by this Constitution. Such election shall be conducted pursuant to the provisions of the election ordinance.” 7. Lujan of the Court of Indian Offenses has recommended that a Constitutional Amendment would be necessary to allow the more than 800 absentee ballots cast in the last election to be valid; and WHEREAS, it is the wish of the Business Committee that this amendment be in effect for the election of June, 1985 to allow greater participation in the election and provide additional constitutional authority for the present Election Ordinance; and WHEREAS, this amendment would need to be in effect, if approved by a vote of the Tribe, by May 1, 1985; NOW THEREFORE, BE IT RESOLVED, that the Business Committee of the Citizen Band Potawatomi Indian Tribe of Oklahoma approve and submit the attached amendment to Article VII of the Tribal Constitution and By-Laws to the designated representatives of the Secretary of the Interior for their approval and, further, request a Secretarial Election on this Amendment to be completed before May 1, 1985. TRANSCRIPTION: RESOLUTION POTT# 85-145 CITIZEN BAND POTAWATOMI INDIANS OF OKLAHOMA A RESOLUTION Amending Citizen Band Potawatomi Ordinance #84-3 General Revenue and Taxation Act of 1984, pursuant to Article 7 of the Constitution of April 27, 1984, for the Citizen Band Potawatomi Indian Tribe of Oklahoma as certified on May 22, 1984; And WHEREAS, The Citizen Band Potawatomi Indian of Oklahoma is a Federally Recognized Tribe of American Indians organized under the Authority of the Oklahoma Indian Welfare Act of 1936; and the Business Committee of the Citizen Band Potawatomi Indians of Oklahoma is empowered to enact legislation; And WHEREAS, The stated purpose of Citizen BAnd Potawatomi Ordinance #84-3 is to provide simple, fair, staightforward and efficient procedures; and the levy of certain taxes including a Tobacco Tax; And WHEREAS, The present legal Tobacco Tax as stated in Section 202 and 203 of Chapter Two in Ordinance #84-3 is unfair and would be detrimental to present Tribal Economic Enterprise, thereby going against the purpose and intent of Citizen Band Potawatomi Ordinance #84-3; Now THEREFORE, BE IT RESOLVED That the Business Committee of the Citizen Band Potawatomi Indian Tribe of Oklahoma hereby amends Citizen Band Potawatomi Ordinance #84-3 Section 202 to read: There is hereby levied upon the sale, use, gift, possession or consumption of cigarettes within the Tribal Jurisdiction a tax of two cents (.02) for each package of cigarettes containing twenty (20) cigarettes or less. On any individual package containing more than twenty (20) cigarettes there is hereby levied a tax of two cents (.02) plus an additional two cents (.02) for each additional twenty (20) cigarettes or fraction thereof. And Section 203 to read: There is hereby levied upon the sale, use, gift, possession, or consumption of Tobacco Products within the Tribal Jurisdiction a Tax of two cents (.02) for each separate individual package of Tobacco product. These Ammendments to be in Immediate Effect. 85-146: SUMMARY: Resolution to allow for the investment of excess monies that are currently in the Tribal Prosthetics Account. TRANSCRIPTION: RESOLUTION POT# 85-146 CITIZEN BAND POTAWATOMI INDIANS OF OKLAHOMA A RESOLUTION TO ALLOW FOR THE INVESTMENT OF EXCESS MONIES THAT ARE CURRENTLY IN THE TRIBAL PROSTHETICS ACCOUNT. WHEREAS, The Citizen Band Potawatomi Indians of Oklahoma is a federally recognized Tribe of American Indians under authority of the Oklahoma Indian Welfare Act of 1936; and WHEREAS, The Citizen Band Potawatomi Business Committee is duly authorized to act on behalf of the Tribe by authority of the Tribal Constitution and By-Laws; and WHEREAS, the amount of $120,454.51 is currently in the Potawatomi Tribal Prosthetics Account, said money is accumulating minimul interest of 5%; and WHEREAS, the monies, if managed properly, could be earning up to 7% more interest and still be readily available for use by tribal members for prosthetic purposes; and WHEREAS, it is the responsibility of the Tribal Administration to develop methods by which tribal funds can be managed so as to provide maximum effective services to tribal members;NOW THEREFORE, BE IT RESOLVED, that the Potawatomi Tribal Business Manager be allowed to invest a portion of current Prosthetic monies, and monies that will be deposited in the Tribal Prosthetics Account, into totally insured, short-term, high yield investment programs. Interest earned from said investments to be returned to the Prosthetics Account to provide tribal services under this program. Also, that at all times, sufficient funds will be maintained in the Prosthetics Account to provide anticipated services to Tribal members. WHEREAS, The need exist to provide a more profitable method of deriving revenue to support Tribal Governmental programs, and WHEREAS, The Business Committee of the Citizen Band Potawatomi Indians of Oklahoma has entered into a management agreement with Enterprise Management Consultants to operate a bingo facility on tribal trust land, and WHEREAS, A need exist for authorization by ordinance or resolution from the Citizen Band Potawatomi Indians Business Committee for Enterprise Management to operate a series of games to include bingo, instant bingo, and gaming table bingo; NOW THEREFORE, BE IT RESOLVED, that the Citizen Band Potawatomi Indians of Oklahoma by the authority of this resoloution, authorize Enterprise Management Consultants, Inc., as their agents to operate a series of games known as bingo, instant bingo and gaming table bingo which are defined as a series of games in which participants purchase one or more cards or tickets which are marked off overtly or covertly into squares or other geometric patterns or letters or symbols with each space or pattern being designated by number, letter, symbol or internal variants of numbers, letters, or symbols or any combination thereof, or games played upon a patterned table containing geometric patterns or numbers or letters or symbols or any combination thereof, so that before, as, or after the operator of such game announces numbers, letters or symbols or combinations thereof that are winners the players may cover or uncover or discover winning patterns or numbers or letters or symbols on their cards or tickets or upon the gaming table and be paid their winnings, or any other game of chance which is not in violation of the Federal laws of the United States or the Citizen Band Potawatomi Tribe of Oklahoma. TRANSCRIPTION: RESOLUTION POT#85-149 CITIZEN BAND POTAWATOMI INDIANS OF OKLAHOMA A RESOLUTION TO ACCEPT THE FOLLOWING GUIDELINES FOR THE HOME IMPROVEMENT PROGRAM OF THE CITIZEN BAND POTAWATOMI INDIANS OF OKLAHOMA. WHEREAS, the income guidelines for the Citizen Band Potawatomi Tribe Home Improvement Program are as follows: $12,000 per year for head of household and $1,000 for each dependent. WHEREAS, the Citizen Band Potawatomi Tribe HIP will use the building code set by the 1985 State and Federal handbook. WHEREAS, the Citizen Band Potawatomi Tribe HIP will service the area set forth by the Shawnee Agency; boundaries are from the North Canadian River to the north and the South Canadian River to the south, and east to the Pottawatomie County line, and west to 6 1/2 miles past the Pottawatomie County line. WHEREAS, the Citizen Band Potawatomi Business Committee will serve as the selectors and determine which applicants require top priority. WHEREAS, the Citizen Band Potawatomi Business Committee, as of this date, will use the application developed by the Horton Agency as this application meets our requirements. THEREFORE, BE IT RESOLVED, that the Business Committee of the Citizen Band Potawatomi Tribe of Oklahoma accepts the above guidelines for the Home Improvement Program of the Citizen Band Potawatomi Indians of Oklahoma.
