CITIZEN BAND POTAWATOMI INDIANS OF OKLAHOMA
A RESOLUTION submitting a budget and guidelines for the expenditure of the "" set
aside"" funds in the amount of 30% of the final claims by the
Citizen Band Potawatomi Indians against the United States Govenrnment.
WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma is a federally
recognized tribe of American Indians under authority of the
Oklahoma Indian Welfare Act of 1936;
AND
WHEREAS, the Citizen Band Potawatomi Business Committee is duly
authorized to act on behalf of the Tribe by authority
of the Tribal Constitution and By-Laws;
AND the General Council
has the authority to act on issues relating to claims and treaties
WHEREAS, the General Council met on the 25th day of August, 1984 and
established a budget and guidelines for the expenditure of the
""30% set aside"" funds, and a quorum being present,
AND
WHEREAS, whereas, the attached budget and guidelines are submitted for
approval of the Secretary of the Interior as soon as possible,
NOW
THEREFORE, BE IT RESOLVED,
That the attached budget and guidelines are submitted pursuant to
the instructions of the General Council Meeting of august 25, 1984.
CERTIFICATION
We, the undersigned members of the Business Committee of the Citizen Band
Potawatomi Tribe of Oklahoma do hereby certify that the attached budget and
guidelines are a true and exact copy of those adapted by a vote of 35 to 32 on
the 25th day of August at a meeting of the General Council of the Citizen Band
Potawatomi Indians of Oklahoma held at the Ship She Wano Building, Potawatomi
Tribal Grounds.

Citizen Band Potawatomi Indians of Oklahoma shall be authorized to act
in behalf of the Tribe to enter into the contracts to acquire land from
the Maranatha Baptist Church for the Elderly Housing Project to be built
by the Absentee Shawnee Housing Authority.

A RESOLUTION AUTHORIZING TO PURCHASE FIVE ACRES OF LAND FROM THE
MARANATHA BAPTIST CHURCH, LEGAL DESCRIPTION AS FOLLOWS:
Tract of land located in the SE of the SW, Section 31,
Township 10 North Range 4 East, of the Indian Meridian in
the Pottawatomi County commencing at the SW corner of said
SE/4 SW/4, then east, a distance of 40 ft., thence north
01 , 48 minutes east, a distance of 1,320 ft., thence east,
a distance of 437.8 ft., to the direct point of beginning.
Thence, south 9 , 34 minutes, 27 seconds east, a distance of
126.7 ft., thence, south, a distance of 275.91 ft., thence
south 37 , 44 minutes, 20 seconds east, a distance of
480.43 ft., thence north 12 , 30 minutes east, a distance
of 430 ft., thence west, a distance of 594.2 ft., to point
of beginning, contains 6.93 acres exactly inclusive of 100%
of the mineral rights.
WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma is
a federally recognized Tribe of American Indians
under authority of the Oklahoma Indian Welfare Act
of 1936; and the General council is the governing

WHEREAS, the Citizen Band Potawatomi Business Committee has
authority to act in behalf of the Tribe as authorized
in the Tribal Constitution and By-Laws;
AND
WHEREAS, the purchase of the land shall be in keeping with
all contracts approved by Steve Parker, authorized
attorney for the Tribe;
AND
WHEREAS, the purchase price of the approximately 6.93
acres of land shall not exceed $52,500.00;
AND
WHEREAS, the land is to be placed in trust with Bureau of
Indian Affairs;
AND
WHEREAS, this land is needed for and will be used for a
senior citizen housing project;
AND
WHEREAS, this land is located within the exterior boundaries
of the former reservation area;
AND
WHEREAS, the land will be purchased with funds from the
Absentee Shawnee Housing Authority;
AND
WHEREAS, the Tribe requests that an appraisal be made of
the property to be purchased to be conducted by the
Bureau of Indian Affairs; AND
WHEREAS, Robert Leon Bruno, Tribal Chairman has been authorized
by the Business Committee to enter into the
purchase contract pursuant to this matter;

WHEREAS: the Citizen Band Potawatomi Indians of Oklahoma is a
Federally recognized tribe of American Indians organized
under the authority of the Oklahoma Indian Welfare Act of

AND
WHEREAS: the Citizen Band Potawatomi Business Committee is empowered
to speak and act in all matters on behalf of the Tribe
except those relating to claims and treaties;
AND
WHEREAS: funds in the amount of $748.00 plus interest are available
from the B.I.A on receipt of a resolution and tribal
purchase order and these funds are the property of the tribe,

THEREFORE BE IT RESOLVED, that the Citizen Band Potawatomi Indian
Tribe of Oklahoma requests the release of the above mentioned funds
for use in the tribal museum.

A RESOLUTION AMENDING THE PROPOSED CONSTITUTION REVISION SUBMITTED
TO THE SECRETARY OF THE INTERIOR DATED APRIL 27, 1984.
WHEREAS, The Citizen Band Potawatomi Indians of Oklahoma is a
federally recognized Tribe of American Indians under
authority of the Oklahoma Indian Welfare Act of 1936;
and
WHEREAS, The Citizen Band Potawatomi Business Committee is duly
authorized to act on behalf of the Tribe by authority
of the Tribal Constitution and By-Laws; and
WHEREAS, additional changes in the proposed Constitution, other
than those adopted in Pott Resolution 85-124, are
needed, to wit:
1. The first sentence Article 12- Election, section
(a) shall be
changed to read- ""The Chairman, vice-Chairman, Secretary/-
Treasurer, two Councilmen, and members of the Grievance Committee
shall be elected for a two year term of office and until their
successors be qualified and installed in office, by a majority
vote at an election to be conducted by secret ballot, with
absentee voting, on the date of the annual Citizen Band
Potawatomi Indian Council meeting.”
2. A new second sentence shall be added to Article 12-Election,
section
(a) - ""All elections shall be conducted pursuant to an
election ordinance adopted by appropriate legislation of the
Citizen Band Business Committee.""
3. The third sentence of Article 13 - Meetings of the Council,
section
(a) shall be changed by deleting the words ""However,
decisions on the issues discussed, and"" and by capitalizing the
word ""Any"" which shall be the beginning of the sentence.
4. Article 13 - Meetings of the Council, section
(d) shall be
changed in its entirety to read - ""The principal object of the
special meeting must be stated in the call for same and may
include the words ""and for the discussion of other business that
may be presented."" Unless these words are added, no other
business can be discussed except for the object stated in the
call. Any actions taken with respect to the authority reserved
to the Council by this Consitution shall be made only by a
subsequent election held in accordance with, and within the time
specified in, the election ordinance, which election shall be
open to all members of the Council.""
5. Article 13 - Meetings of the Council, section
(g) shall be
changed by placing a period after the word Council in the next to
last line and deleting the words ""which the Council voted to
place upon the ballot.""
6. Article 17 - Quorum -(In order to be consistent throughout
the Constitution, Section 1 shall be called
(a) and Section 2
shall be called (b) Two new sentences shall be added at the end
of the existing section
(b) -""Should a quorum not be achieved at
a duly-called meeting of the Council, the Business Committee may
initiate an election on any agenda items which require action by
the Council under the authority reserved to it by this
Constitution. Such election shall be conducted pursuant to the
provisions of the election ordinance.”
7. Article 15 – Vacancies - A new sentence shall be added at the
end of this Article. “During the period in which the vice-chairman
serves as chairman under these circumstances, the vice-chairman’s
office shall not be considered vacant and he/she shall
return to serve the unexpired portion of his/her own term of
office (if any) upon election and installation of a chairman.”

WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma are a
federally recognized Tribe of American Indians under
authority granted by the Oklahoma Indian Welfare Act
of 1936, and
WHEREAS, the Citizen Band Potawatomi Business Committee has
authority to act in behalf of the Tribe as authorized
in the Tribal Constitution and By-laws, and
WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma desires
to strengthen its capacity in tribal government by improving
and maintaining tribal programs and activities,
and
WHEREAS, the Tribal Administrator, is hereby granted authority
to negotiate with Bureau any items pursant to this
grant and any amendments, thereto, and
WHEREAS, the Tribal Chairperson is hereby authorized to execute
this grant and any amendments thereto, and
WHEREAS, the Tribe has received verbal support for this grant
from local authorities and private individuals interested
in the welfare of Indian children and their families,

WHEREAS, The Act States in Chapter One, Section 102:
""The members of the Potawatomi Tax Commission shall
consist of the Secretary/Treasurer, the Tribal Administrator,
the Director of the Tribal Accounting Depart-
ment, and two (2) additional members who shall be appointed
by, and serve at the pleasure of the Business
Committee. Neither an appointment nor a removal of an

WHEREAS, Judge Philip J. Lujan of the Court of Indian Offenses
has recommended that a Constitutional Amendment would
be necessary to allow the more than 800 absentee
ballots cast in the last election to be valid; and
WHEREAS, it is the wish of the Business Committee that this
amendment be in effect for the election of June,
1985 to allow greater participation in the election
and provide additional constitutional authority for
the present Election Ordinance; and
WHEREAS, this amendment would need to be in effect, if approved
by a vote of the Tribe, by May 1, 1985;

for each additional twenty (20) cigarettes or fraction thereof. And Section 203
to read: There is hereby levied upon the sale, use, gift, possession, or consumption
of Tobacco Products within the Tribal Jurisdiction a Tax of two cents (.02) for
each separate individual package of Tobacco product.

monies, and monies that will be deposited in the Tribal

returned to the Prosthetics Account to provide tribal services
under this program. Also, that at all times, sufficient funds
will be maintained in the Prosthetics Account to provide
anticipated services to Tribal members.

WHEREAS, the Citizen Band Potawatomi Business Committee is duly
authorized to act on behalf of the Tribe as authorized
in the Tribal Constitution and By-Laws;
AND
WHEREAS, the Citizen Band Potawatomi Tribe has been designated
by the USDA as an Indian Tribal Organization (ITO)
eligible to administer a Commodity Foods Distribution
Program;

WHEREAS, the Citizen Band Potawatomi Tribe is located within the
State of Oklahoma and therefore, within USDA's Region
VI program responsibility;

Tribe's capacity to deliver services and standardize the
management of FDPIR's in the State of Oklahoma the Citizen Band

1. The promotion of tribal self-sufficiency in accordance
with President Reagan's policy statement of 1980.
2. The support of tribal economic and business development
in order to provide monetary capability needed to enhance
self-sufficency.
3. The U.S. Department of Agriculture (USDA) regulation,
particularly part 253.9 be interpreted to mean that a
""compelling justification"" consist of a statement by
the Tribal Treasurer and Chairman regarding the use of
Tribal funds, both Enterprise and trust income, be
adequate justification with no other documentation
necessary.
4. The Oklahoma Indian Affairs Commission exercise their
statutory authority to appoint an advisory committee
whose make-up will be all current and future USDA
recognized ITO's. Such committees express function is
to create a tribally chartered Distributing Agency
Organization and to execute a contract for the administration,
therefore, with the appropriate federal
agency.
5. The Citizen Band Potawatomi Tribe instructs the
Advisory Committee to analyze the existing statutes
and regulations and such analysis be presented to the
Citizen Band Potawatomi Business Committee for the purpose
of review and action by the Citizen Band Potawtomi
Tribe, prior to submission of any state-wide requests
for programmatic changes to the U.S. Congress.

Section 102 to read:
The members of the Potawatomi Tax Commission shall consist of (5)
members who shall be appointed by, and serve at the pleasure of
the Business Committee. Neither an appointment nor a removal of
a member of the Tax Commission shall be of any force or effect
until a written resolution reflecting such appointment or
removal has been filed for record in the official Tribal records
maintained by the Secretary-Treasurer's office. The Business
Committee shall designate the Chairman of the Tax Commission
from among the members of the Commission.

and
WHEREAS, The Citizen Band Potawatomi Business Committee is duly
authorized to act on behalf of the Tribe by authority
of the Tribal Constitution and By-Laws; and
WHEREAS, a resolution duly adopted by the Citizen Band
Potawatomi Indian Tribe of Oklahoma, addressed to the
Area Director, Anadarko Area Office, and authorizing

the full and maximum authorities, powers, rights and
responsibilities available under its sovereign status
as a governmental body; and
WHEREAS, to promote, nurture and encourage a continued interest
in the heritage, culture and arts of our Tribe; and
WHEREAS, the proposed and requested commencement date for the
executed document is October 1, 1985; and
WHEREAS, the proposed period of the grant project is 12 months;

authorized to conduct negotiations; and
