TRANSCRIPTION: RESOLUTION POT# 86-166 CITIZEN BAND POTAWATOMI INDIANS OF OKLAHOMA A RESOLUTION ADOPTING ADMINISTRATIVE PROCEDURES ALLOWING DR. FRANCIS LEVIER TO FUNCTION AS TRIBAL ADMINISTRATOR GIVING HIM FULL AUTHORITY TO MAKE NECESSARY PERSONNEL CHANGES AND SUSPENDING THE CURRENT PERSONNEL POLICIES. WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma is a federally recognized Tribe of American Indians under authority of the Oklahoma Indian Welfare Act of 1936; and WHEREAS, the Citizen Band Potawatomi Business Committee is duly authorized to act on behalf of the Tribe by authority of the Tribal Constitution and By-Laws; and WHEREAS, Article 4, Section 3 of the Tribal Constitution provides authority to establish ""appropriate administrative agencies of the tribe""; and WHEREAS, immediate personnel and policy changes are needed to perform the goals, objectives, and functions of the tribal government; now THEREFORE, BE IT RESOLVED, that Dr. Francis Levier is appointed to act as Tribal Administrator with current salary levels retained, Kenneth Peltier is appointed to coordinate the finance department with Dr. Levier and Finley and Cook CPA's; all present personnel policies are repealed which inhibits immediate necessary personnel changes. TRANSCRIPTION: RESOLUTION POT# 86-167 CITIZEN BAND POTAWATOMI INDIANS OF OKLAHOMA A RESOLUTION AUTHORIZING PER DIEM PAYMENT FOR GRIEVANCE COMMITTEE MEETINGS ON AN AS NEEDED BASIS. WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma is a federally recognized Tribe of American Indians under authority of the Oklahoma Indian Welfare Act of 1936; and WHEREAS, the Citizen Band Potawatomi Business Committee is duly authorized to act on behalf of the Tribe by authority of the Tribal Constitution and By-Laws; and WHEREAS, the Business Committee of the Citizen Band Potawatomi Tribe recognizes the duly elected officials of the Grievance Committee as valuable executives of the tribal judicial branch; now THEREFORE, BE IT RESOLVED, that per diem payments for Grievance Committee meetings will be made to individual Grievance Committee members on an as needed basis. TRANSCRIPTION: RESOLUTION POT# 86-168 CITIZEN BAND POTAWATOMI INDIANS A RESOLUTION APPOINTING BOB F. DAVIS, BUSINESS COMMITTEE MEMBER, TO THE PROSTHESIS COMMITTEE AND REMOVING A PRESENT MEMBER. WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma is a federally recognized tribe of American Indians under authority of the Oklahoma Indian Welfare Act of 1936; AND WHEREAS, the Citizen Band Potawatomi Business Committee has authority to act on behalf of the Tribe as authorized in the Tribal Constitution and By-Laws; AND WHEREAS, the Business Committee desires that Mr. Bob F. 86-169: SUMMARY: Resolution to contract the special supplemental food program for Women, Infants and Children under Public Law 95-627 for FY86. TRANSCRIPTION: RESOLUTION POT# 86-169 CITIZEN BAND POTAWATOMI INDIANS OF OKLAHOMA A RESOLUTION TO CONTRACT THE SPECIAL SUPPLEMENTAL FOOD PROGRAM FOR WOMEN, INFANTS, AND CHILDREN UNDER PUBLIC LAW 95-627 FOR FISCAL YEAR 1986. WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma is a federally recognized tribe of American Indians under authority of the Oklahoma Indian Welfare Act of 1936; AND WHEREAS, the Citizen Band Potawatomi Business Committee is duly authorized to act on behalf of the Tribe by authority of the Tribal Constitution and By-Laws; AND WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma have operated a successful WIC Program in fiscal years previous; AND WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma elect to contract through Regional and National USDA-FNS offices; AND WHEREAS, Francis Levier is hereby authorized to negotiate this contract and any amendments thereto; AND WHEREAS, John A. Barrett, Jr. is the tribal official authorized to execute the grant contract or an amendments thereto; AND WHEREAS, the final grant contract will be reviewed and approved by the Business Committee; AND WHEREAS, the authorities granted by this resolution shall be continuing through the contract term; AND WHEREAS, the proposed start date of the contract shall be October 1, 1985; AND WHEREAS, the term of the contract shall be 12 months; NOW THEREFORE, BE IT RESOLVED, that the Citizen Band Potawatomi Indians of Oklahoma will contract funds through Regional and National USDA-FNS offices for WIC. 86-170: SUMMARY: Resolution to support a joint Indian Child Welfare Act Program between the CBP Indians of Oklahoma and the Iowa Tribe of Oklahoma and defining procedural guidelines for administering same. TRANSCRIPTION: RESOLUTION POT# 86-170 CITIZEN BAND POTAWATOMI INDIANS OF OKLAHOMA A RESOLUTION TO SUPPORT A JOINT INDIAN CHILD WELFARE ACT PROGRAM BETWEEN THE CITIZEN BAND POTAWATOMI INDIANS OF OKLAHOMA AND THE IOWA TRIBE OF OKLAHOMA AND DEFINING PROCEDURAL GUIDELINES FOR ADMINISTERING SAME. WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma is a federally recognized Tribe of American Indians under authority of the Oklahoma Indian Welfare Act of 1936; and WHEREAS, the Citizen Band Potawatomi Business Committee has authority to act in behalf of the Tribe as authorized in the Tribal Constitution and By-Laws; and WHEREAS, the Iowa Tribe of Oklahoma is authorized to submit a proposal on behalf of the Citizen Band Potawatomi Tribe to provide services under the Indian Child Welfare grant commencing August 1, 1985 and operating for an 11 month period; and WHEREAS, the agreement between the Iowa Tribe and the Potawatomi Tribe provides for all administrative funds in the grant to accrue to the Iowa Tribe and all direct funds to be administered by the Potawatomi Tribe for the cost of the on-going ICWA director, Mozella Larney; and WHEREAS, Ken Cadaret, Potawatomi Tribe Health Services Director is directed by the Business Committee to supervise program personnel and control the expenditure of funds for direct costs to the satisfaction of the Iowa Tribe and the BIA under the beforementioned agreement; now THEREFORE, BE IT RESOLVED, that the Joint ICWA program for the Iowa Tribe of Oklahoma and the Citizen Band Potawatomi Indian Tribe of Oklahoma is hereby authorized and shall be administered under an agreement between both tribes in which administrative funds are to be controlled by the Iowa Tribe and direct program funds for staff costs are administered under the direction of Ken Cadaret of the Citizen Band Potawatomi Tribe. 86-171: SUMMARY: Resolution requesting the BIA to enter into a Consolidated Tribal Governmental Program contract with the CBP Indians of Oklahoma in FY86. TRANSCRIPTION: RESOLUTION POT# 86-171 CITIZEN BAND POTAWATOMI INDIANS OF OKLAHOMA A RESOLUTION REQUESTING THE BUREAU OF INDIAN AFFAIRS TO ENTER INTO A CONSOLIDATED TRIBAL GOVERNMENTAL PROGRAM CONTRACT WITH THE CITIZEN BAND POTAWATOMI INDIANS OF OKLAHOMA IN FISCAL YEAR 1986. WHEREAS, The Citizen Band Potawatomi Indians of Oklahoma is a federally recognized Tribe of American Indians under authority of the Oklahoma Indian Welfare Act of 1936; and WHEREAS, The Citizen Band Potawatomi Business Committee is duly authorized to act on behalf of the Tribe by authority of the Tribal Constitution and By-Laws; and WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma, is authorized to request that the Bureau of Indian Affairs combine: (1) FY-86 Housing Improvement Program (2) FY-86 Self-Determination Grant, and, (3) FY-86 Roads Maintenance, into a Consolidated Tribal Governmental Program Contract; and WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma desire to operate a Consolidated Tribal Governmental Program to provide Tribal Government Development, and Housing Improvement Program; and WHEREAS, the Citizen Band Potawatomi Tribal Administrator is hereby authorized to negotiate this contract and any amendments there to; and WHEREAS, the Tribal Chairman is hereby empowered to execute this contract and any amendments thereto; and WHEREAS, the authorities granted by this Resolution shall be for the 12 month term of the proposed FY-86 contract or until said authorization is withdrawn by Resolution of the Business Committee; and WHEREAS, the Business Committee members reserve the right to review the contract document and any amendments thereto prior to signature by designated person; and WHEREAS, the proposed term of this Consolidated Tribal Governmental Program shall be from October 1, 1985 through and including September 30, 1986; NOW THEREFORE, BE IT RESOLVED, that the Citizen Band Potawatomi Indians of Oklahoma request that the Bureau of Indian Affairs administratively adjust FY-86 funds available to this Tribe in, (1) Housing Improvement, (2) Self-Determination Grant, and, (3) Road Maintenance, into a Consolidated Tribal Governmental Program contract to provide the specified services to our Tribe in Fiscal year 1986. 86-174: SUMMARY: Resolution setting the service area population for the CBP Indians of Oklahoma's HIP population regulations. TRANSCRIPTION: RESOLUTION POT# 86-174 CITIZEN BAND POTAWATOMI INDIANS OF OKLAHOMA A RESOLUTION SETTING THE SERVICE AREA POPULATION FOR THE CITIZEN BAND POTAWATOMI INDIANS OF OKLAHOMA'S HIP POPULATION AND REGULATIONS. WHEREAS, The Citizen Band Potawatomi Indians of Oklahoma is a federally recognized Tribe of American Indians under authority of the Oklahoma Indian Welfare Act of 1936; and WHEREAS, The Citizen Band Potawatomi Business Committee is duly authorized to act on behalf of the Tribe by authority of the Tribal Constitution and By-Laws; and WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma desire to contract HIP funds for FY86; and WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma have determined that the number of HIP Homes in the service area is 951 homes; and WHEREAS, the need exists for specific income guidelines which is to be set at: $12,000 per household and $1,000 for each dependent as maximum levels; and WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma choose to use the city codes or State Building Codes, whichever is appropriate; and WHEREAS, a selection and prioritization system for HIP assistance as required by federal code. The system will include all Indian persons in the service areas as follows: 1. Individuals over 65 years of age; 2. Individuals on fixed incomes and/or who are handicapped; 3. Households with minor dependents; and 4. others; now THEREFORE, BE IT RESOLVED, that the Tribe requests that funding for FY86 be contracted to the Citizen Band Potawatomi Indians of Oklahoma from the Bureau of Indian Affairs to serve the 951 homes in the service area of the Tribe. 86-175: SUMMARY: Resolution reaffirming the jurisdictional boundaries of the Citizen Band Potawatomi Indians of Oklahoma. TRANSCRIPTION: RESOLUTION POT# 86-175 CITIZEN BAND POTAWATOMI INDIANS OF OKLAHOMA A RESOLUTION REAFFIRMING THE JURISDICTIONAL BOUNDARIES OF THE CITIZEN BAND POTAWATOMI INDIANS OF OKLAHOMA. WHEREAS, The Citizen Band Potawatomi Indians of Oklahoma is a federally recognized Tribe of American Indians under authority of the Oklahoma Indian Welfare Act of 1936; and WHEREAS, The Citizen Band Potawatomi Business Committee is duly authorized to act on behalf of the Tribe by authority of the Tribal Constitution and By-Laws; and WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma sold their land in Kansas through the 1867 Treaty; and WHEREAS, the Treaty of 1868 with the United States was ratified on July 25, 1968; and WHEREAS, the Treaty of 1867, Article 2 provides for the Citizen Band Potawatomi Indians of Oklahoma to purchase reservation lands in Oklahoma Territory; and WHEREAS, the north boundaries of the reservation was described as being south of the North Canadian River; and WHEREAS, the south boundaries of the reservation was described as being north of the South Canadian River; and WHEREAS, the west boundaries of the reservation was described as east of the Indian Meridian; and WHEREAS, the east boundary of the reservation was described as west of the Seminole County line; and WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma Business Committee has maintained these boundaries as the jurisdiction of the Tribe; now THEREFORE, BE IT RESOLVED, that the Business Committee of the Citizen Band Potawatomi Indians of Oklahoma reaffirm the traditional boundaries as the jurisdictional boundaries of the Tribe in all business or other dealings. WHEREAS, The Citizen Band Potawatomi Indians of Oklahoma is a federally recognized Tribe of American Indians under authority of the Oklahoma Indian Welfare Act of 1936; and WHEREAS, The Citizen Band Potawatomi Business Committee is duly authorized to act on behalf of the Tribe by authority of the Tribal Constitution and By-Laws; and WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma, is interested in the further development of tribal capabilities for operations of health services for the benefit of all tribal members; and WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma is fully aware of its options of contracts and hereby chooses to implement a Community Health Representative Program Contract for FY 86 under the authority of P.L. 93-638; and WHEREAS, the Citizen Band Potawatomi Tribal Administrator is eligible for consideration of grant and contract applications under P.L. 93-638 funds; and WHEREAS, there is a need to provide home health services, health education services, health maintenance services, disease control services, and emergency Medical services program; and WHEREAS, the proposed and requested commencement date for the executed contract is October 1, 1985 through September 30, 1986; and WHEREAS, the proposed term of the contract document is twelve (12) months; and WHEREAS, these authorities will remain in effect until such time as the Business Committee chooses to withdraw said authorizations, and by subsequent resolution; and WHEREAS, the Business Committee reserves the right to review the contract document and any amendments thereto prior to signature by designated person; now THEREFORE, BE IT RESOLVED, that the Business Committee of the Citizen Band Potawatomi Indians of Oklahoma wishes to make application to the Oklahoma City Area Indian Health Service for P.L. 93-638 funds to contract for the Community Health Representative Program. WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma is a federally recognized Tribe of American Indians under authority of the Oklahoma Indian Welfare Act of 1936; and WHEREAS, the Citizen Band Potawatomi Business Committee has authority to act in behalf of the Tribe as authorized in the Tribal Constitution and By-Laws; and WHEREAS, the Business Committee of the Citizen Band Potawatomi Indian Tribe of Oklahoma has asked its tribal attorney to investigate the activities of former Tribal Administrator John D. Schoemann in connection with his operation of the tribal bingo program from 1980 through 1983, in connection with his sale to the tribe of 16.26 acres in August of 1983 for the USDA commodity food program, and in connection with his purchase of golf clubs in the Spring of 1983; and WHEREAS, the tribal attorney has now reported to the Business Committee that in all three operations Mr. Schoemann violated his fiduciary duty as Tribal Administrator and violated federal statutory and regulatory law and tribal law, and should be made to account for the funds received; and WHEREAS, the tribal attorney has recommended that the Business Committee bring suit to force Mr. Schoemann to account for the monies received on these three activities and to return the money to the tribe; now THEREFORE, BE IT RESOLVED, that the Business Committee of the Citizen Band Potawatomi Indians of Oklahoma hereby authorize Michael Minnis, tribal attorney, to bring suit in an appropriate forum against John Schoemann and others to require an accounting from Mr. Schoemann when he was Tribal Administrator and a return of all funds improperly retained by Mr. Schoemann and others in violation of Mr. Schoemann's fiduciary duty to the tribe and in violation of federal statutory and regulatory law and tribal law and do all other matters and conduct other investigations as may be necessary to bring and fully prosecute this suit; and BE IT FURTHER RESOLVED that this authority shall remain in effect for however long is necessary to fully prosecute this litigation. WHEREAS, the Business Committee of the Citizen Band Potawatomi of Oklahoma have received a request for payment of one of the tribal members who was wrongfully listed as deceased prior to the 1978 payment, and WHEREAS, the error took place during the updating of the Tribal Roll, and WHEREAS, the Shawnee Agency of the Bureau of Indian Affairs has also expressed that as many as sixty other persons were wrongfully listed as deceased, and WHEREAS, the Tribal members are still alive, and are still eligible to receive the payment, and WHEREAS, the Business Committee feels that it would be an injustice to not allow each qualified person to receive their per capita payment. Prior to the submission of its application, the governing body of the applicant has followed traditional means of citizen involvement which has included the following: (1) Furnished members information concerning amounts of funds available for proposed community development and housing activities and the range of activities that may be undertaken; (2) Held one or more meetings to obtain the views of members on community development and housing needs. Meetings have been scheduled in ways and at times that allowed participation by members; (3) Developed and published or posted the community development statement in a manner as to afford effected members an opportunity to examine its contents and to submit comments; and (4) Afforded members an opportunity to review and comment on the applicant's performance under any active community development block grant. II. WHEREAS, the Citizen Band Potawatomi Tribe HIP will use the building code set by the 1986 State and Federal handbook, and CFR 25 standards. WHEREAS, the Citizen Band Potawatomi Tribe HIP will service the area set forth by the Shawnee Agency; boundaries are from the North Canadian River to the north and the South Canadian River to the south, and east to the Pottawatomie County line, and west to 6 1/2 miles past the Pottawatomie County line. WHEREAS, the Citizen Band Potawatomi Business Committee will serve as the selectors and determine which applicants require top priority. TRANSCRIPTION: RESOLUTION POT# 86-252 CITIZEN BAND POTAWATOMI INDIANS OF OKLAHOMA A RESOLUTION REQUESTING THE CITIZEN BAND POTAWATOMI INDIANS OF OKLAHOMA TO ENTER INTO A CONTRACTUAL AGREEMENT WITH THE INDIAN HEALTH SERVICE, OKLAHOMA CITY AREA, TO PROVIDE FOR P.L. 93-638 INDIAN SELF-DETERMINATION CONTINUATION FUNDS TO BE USED FOR THE COMMUNITY HEALTH REPRESENTATIVE PROGRAM FOR FISCAL YEAR 1987. WHEREAS, The Citizen Band Potawatomi Indians of Oklahoma is a federally recognized Tribe of American Indians under authority of the Oklahoma Indian Welfare Act of 1936; and WHEREAS, The Citizen Band Potawatomi Business Committee is duly authorized to act on behalf of the Tribe by authority of the Tribal Constitution and By-Laws; and WHEREAS, The Citizen Band Potawatomi Indians of Oklahoma, is interested in the further development of tribal capabilities for operations of health services for the benefit of all tribal members; and WHEREAS, The Citizen Band Potawatomi Indians of Oklahoma is fully aware of its options of contracts and hereby chooses to implement a Community Health Representative Program Contract for FY-87 under the authority of P.L. 93-638; and WHEREAS, The Citizen Band Potawatomi Tribal Administrator is eligible for consideration of grant and contract applications under P.L. 93-638 Funds; and WHEREAS, There is a need to provide home health services, health education services, health maintenance services, disease control services, and emergency Medical services program; and WHEREAS, The proposed and requested commencement date for the executed contract is November 1, 1986 through October 31, 1987; and WHEREAS, The proposed term of the contract document is twelve (12) months; and WHEREAS, These authorities will remain in effect until such time as the Business Committee chooses to withdraw said authorizations, and by subsequent resolution; and WHEREAS, The Business Committee reserves the right to review the contract document and any amendments thereto prior to signature by designated person; now THEREFORE, BE IT RESOLVED, that the Business Committee of the Citizen Band Potawatomi Indians of Oklahoma wishes to make application to the Oklahoma City Area Indian Health Service for P.L. 93-638 funds to contract for the Community Health Representative Program.
