A RESOLUTION CONCURRING WITH THE BUREAU OF INDIAN AFFAIRS (BIA) SHAWNEE
AGENCY 'S EFFORTS TO REPROGRAM FUNDS TO BE USED BY THE TRIBES TO CONTRACT
UNDER P.L. 93-638 AND OTHER CONTRACTS.
WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma is a
federally recognized tribe of American Indians with
constitutional authority under the Indian Reorganization Act
of 1934 and the Thomas-Rogers Act of 1936; and
WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma, the
largest of the Potawatomi Indian Tribes, has, through a
continuation of Potawatomi history of organized self government
since time immemorial, sovereign powers inherent in tribal
tradition and recognized by treaties with the United States
and in the United States Constitution; and
WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma
Constitution and By-Laws provide that the Business Committee
of the Tribe shall be granted the power to act on behalf of
the Tribe in all matters except those relating to claims of
treaties with the United States; and
WHEREAS, the Shawnee Agency Tribes chose to place contractable funds in
line items other than P.L. 93-638 line items due to the rumor
that Congress intended to phase out 638 contracts; and
WHEREAS, Congress chose not to phase out 638 contracts; and
WHEREAS, the Tribes can use the funds from these other line items, if
they are reprogrammed; and
WHEREAS, a portion of the funds will be used to supplement the Citizen
Band Potawatomi Consolidated Tribal Program and Tribal Courts
Contracts; and
WHEREAS, these funds are needed by the Tribes; and
WHEREAS, the reprogramming of the funds are in the best interest of the
Tribes;
NOW
THEREFORE, BE IT RESOLVED, that the Business Committee of the Citizen Band
Potawatomi Indian Tribe of Oklahoma concurs with the BIA Shawnee Agency's
efforts to reprogram funds to be used by the Tribes to contract under P .L.
93-638 and other contracts.

A RESOLUTION REQUESTING TO CONTRACT LAW ENFORCEMENT FUNDS ON BEHALF OF THE
CITIZEN BAND POTAWATOMI INDIAN TRIBE OF OKLAHOMA UNDER P.L. 93-638.
WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma is a
federally recognized tribe of American Indians with
constitutional authority under the Indian Reorganization Act
of 1934 and the Thomas-Rogers Act of 1936; and
WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma, the
largest of the Potawatomi Indian Tribes, has, through a

since time immemorial, sovereign powers inherent in tribal
tradition and recognized by treaties with the United States
and in the United States Constitution; and
WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma

of the Tribe shall be granted the power to act on behalf of
the Tribe in all matters except those relating to claims of
treaties with the United States; and
WHEREAS, the Business Committee of the Citizen Band Potawatomi Indian
Tribe of Oklahoma has implemented a Tribal Law Enforcement
Program; and
WHEREAS, BIA contract funds are earmarked and available to tribes
to support law enforcement in the Shawnee Agency; and
WHEREAS, the Business Committee of the Citizen Band Potawatomi Indian
Tribe of Oklahoma intends to contract Law Enforcement funds
on behalf of the tribe; and
WHEREAS, tribal resolutions have been duly passed and submitted by
the respective tribes to convey the contracting and administration
to the Citizen Band Potawatomi Tribe; and
WHEREAS, the Tribal Administrator of the Citizen Band Potawatomi Indian
Tribe of Oklahoma is authorized to negotiate , make amendments,
modify, and execute the contract in a prudent manner; and
WHEREAS, the contract shall begin on August 1, 1988, and shall be in
effect for a period of two ( 2 ) months or until there is an
agreement by the BIA and the contractor to close out and/or
terminate the contract;
NOW
THEREFORE, BE IT RESOLVED, that the Business Committee of the Citizen Band
Potawatomi Indian Tribe of Oklahoma hereby submits a request to contract
Law Enforcement funds on behalf of the Citizen Band Potawatomi Indian
Tribe of Oklahoma. These funds shall be contracted under the guidelines
of the Indian Self-Determination and Education Assistance Act, P.L.
93-638. The amount of funds to be contracted shall represent or be equal
to a pro rato share of the law enforcement funds allocated to the Shawnee
Agency.

constitutional authority under the Indian Reorganization Act

WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma has
established a judicial system with the authority to act in all
cases involving juveniles; and
WHEREAS, it is in the best interest of the Citizen Band Potawatomi
Indian Tribe of Oklahoma that all child custody proceedings
involving Potawatomi children proceed through the tribal court
system; and
WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma also
recognizes that in some cases the best interests of a child
may be that the child remain in the state court system so the
child may receive specialized treatment not available from the
tribe; and
WHEREAS, the Attorney General of the tribal court is empowered to
represent the tribe in all child custody proceedings in tribal
court;
NOW
THEREFORE, BE IT RESOLVED, that the Business Committee of the Citizen Band

Potawatomi Indian Tribe of Oklahoma hereby directs the tribal Attorney
General to intervene in all state court proceedings involving Potawatomi
children for the purpose of transferring the child custody proceedings to
the tribal court if same is in the best interest of the child;
FURTHER, BE IT RESOLVED, that should the Attorney General, after
conferring with the tribal social workers, conclude that the best interest
of the child would be served if the proceeding remained in the state
courts, the Attorney General shall make an appropriate recommendation to
the Business Committee;
FURTHER, BE IT RESOLVED, that should the Attorney General's recommendation
not to intervene be accepted by the Business Committee, the Attorney
General is directed to file an appropriate pleading in the state court
proceeding indicating that the tribe specifically declines its right to
intervene and transfer.

of the Tribe shall be granted the power to act on behalf of
the Tribe in all matters except those relating to claims of
treaties with the United States; and
WHEREAS, the Citizen Band Potawatomi Business Committee has approved
to guarantee the loan for improvements to the Mission Hill
Hospital; and
WHEREAS, the processing of the loan has moved forward; and
WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma sees the
improvements to be in the best interest of the Tribe and the
local community;

Inc. of Albuquerque, New Mexico as its financial advisor
and agent in the placement and selection of funds; and
WHEREAS, the Tribe desires to purchase Government National Mortgage
Association (GNMA’s) bonds with average lives of 7 - 12 years,
and have all interest reinvested in short term instruments.
WHEREAS, the Tribe will advise the BIA monthly on its desire for the
reinvestment of the principal payments from the bonds; and
WHEREAS, the Tribe desires to invest up to $500,000 in principal for
the purchase of the bonds with the investment staged in over a
6 week period, with roughly one third of the amount purchased
every two weeks; and
WHEREAS, the Tribe will give verbal instructions to the BIA when it
has determined the best time, price, and security it wishes
to purchase, but will always make the purchases on a ""delivery
versus payment"" basis to allow the BIA time to make funds
available for the purchases; and
WHEREAS, the Business Committee of the Citizen Band Potawatomi Indian
Tribe of Oklahoma is aware that the Tribe will have absolutely
no contact with the funds, but will simply direct the Bureau of
Indian Affairs as to the investments which the Tribe desires;

WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma is
a federally-recognized tribe of American Indians
organized under the authority of the Oklahoma Indian
Welfare Act of 1936; and
WHEREAS, the Citizen Band Potawatomi Business Committee is duly
authorized to act on behalf of the tribe by authority of
the Tribal Constitution and By-Laws; and
WHEREAS, federal law (25 U.S.C. §§ 81, 503 and 25 C.F.R. 89.7-
89.26) requires that certain contracts be approved by the
Secretary of the Interior, and the Tribal Constitution
(art. 7, §2) requires that all contracts with attorneys
be approved by the Secretary of the Interior when
required by federal law; and
WHEREAS, under paragraph 4 on page 2 of the ""General Counsel
Contract"" (June 24, 1987) which is endorsed with
Secretarial approval, the General Counsel is specifically
authorized to employ other attorneys subject to approval
by the tribe's Business Committee and by an authorized
representative of the Secretary of the Interior; and
WHEREAS, the tribe needs legal representation in the Washington,
D.C. area from attorneys with expertise in Indian
administrative law particularly including the calling of
Secretarial Elections; and
WHEREAS, to provide this service, the tribe has instructed the
tribal general counsel to employ Doyle & Savit -- a firm
previously hired by the tribe as a consultant on related
matters -- Suite 1000, 919 18th Street, N.W., Washington,
D.C. 20006 (202/659-4240) effective September 12, 1988;
and
WHEREAS, this employment shall be subject to the following
conditions:
1. The bills from Doyle & Savit for this employment
shall not exceed a total of $5,000.00 unless a
greater amount is hereafter duly authorized;
2. This employment is for the sole and exclusive
purpose of assisting the tribe in pursuing administrative
and other remedies for the failure of

the Bureau of Indian Affairs to call and confirm a
Secretarial Election to amend the Constitutional
provision relating to enrollment of tribal members;
3. The bills for these services shall be forwarded to
the tribal attorney at the end of each month for
forwarding to the tribe for payment as part of the
General Counsel's monthly bill;
4. Neither the tribe nor the Government is to owe any
additional compensation in excess of the amount
billed to the General Counsel or in excess of the
limits on his compensation; and
5. The Business Committee Chairman and/or the Tribal
Administrator shall be responsible for providing
Doyle & Savit with the instructions on how to
proceed;

THEREFORE BE IT RESOLVED, that the Business Committee of the
Citizen Band Potawatomi Indian Tribe of Oklahoma hereby approves
the General Counsel to employ the law firm of Doyle & Savit as

tribal trust land; and
WHEREAS, the Business Committee feels that the offer is a fair and
equitable rate; and
WHEREAS, the Business Committee hereby approves an Oil and Gas Lease
(in accordance with the 1982 Mineral Development Act) with
Arbor Petroleum Corp., Oklahoma City, Oklahoma, covering
a 40-acre tract of tribal trust land described above, for a
period of three (3) years to commence on the date of approval

WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma
is a federally-recognized tribe of Ameriacan Indians
organized under the authority of the Oklahoma Indian
Welfare Act of 1936; and
WHEREAS, the Business Committee of the Citizen Band
Potawatomi Indian Tribe is duly authorized to act on
behalf of the tribe by and through the authority of
the Tribal Constitution and By-laws; and
WHEREAS, the Business Committee is negotiating to purchase
stock in the First Oklahoma Bank, N.A., Shawnee; and
WHEREAS, the said agreement for purchase and sale of stock
requires the tribe to provide a resolution
authorizing a limited consent to be sued; and

best interests of the tribe to authorize a limited

installed in office.
ARTICLE 7 - BUSINESS COMMITTEE

1. There shall be a Business Committee which shall consist of the
Executive Officers as provided in Article 6 and two Councilmen who shall
serve for four year terms and until their successors be qualified and
installed in office.
ARTICLE 12 – ELECTIONS
Section
1. The Chairman, Vice-Chairman, Secretary/Treasurer and two
Councilmen shall be elected for a four year term of office and until their
successors be qualified and installed in office by a majority vote at an
election to be conducted by secret ballot, with absentee voting, on the
date of the annual Citizen Band Potawatomi Indian Council meeting. All
elections shall be conducted pursuant to an election ordinance adopted by
appropriate legislation of the Citizen Band Business Committee. At the

time of their election they shall be: a member of the Citizen Band
Potawatomi Indian Council, not less than twenty-one (21) years of age,
reside within the Counties Pottawatomie, Seminole, Pontotoc, McClain,
Oklahoma, Lincoln, Cleveland, or Okfuskee, State of Oklahoma, and not have
been convicted of a felony or other crime involving moral turpitude in any
court of competent jurisdiction within ten (10) years previous to the date
of the election, unless pardoned.
Section 3. In order to provide for staggered terms of office, in the next
regular election, following the adoption of this amendment, the Councilman
#2 position shall be filled in 1989 for a two (2) year term to 1991, and
thereafter for four (4) year terms; the Councilman #1 position shall be
filled in 1989 for a three (3) year term to 1992, and thereafter for four
(4) year terms; in 1989 and thereafter the Chairman's position shall be
filled for four (4) year terms; and in 1990 and thereafter, the
Vice-Chairman and Secretary/Treasurer positions shall be filled for four
(4) year terms. The Grievance Committee members shall continue to be
elected for two year terms of office in the same sequence as in effect at
the time this amendment is adopted.
WHEREAS, the ninety (90) day deadline for the Superintendent to conduct
the Secretarial Election is April 4, 1989; and
WHEREAS, the Anadarko Area Director has sufficient time to authorize
a Secretarial Election to be held in conjunction with the
Secretarial Election authorized by the Acting Assistant
Secretary - Indian Affairs on January 4, 1989; NOW
THEREFORE, BE IT RESOLVED, that the Business Committee of the Citizen Band

WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma is a
federally recognized tribe of American Indians with
constitutional authority under the Indian Reorganization Act
of 1934 and the Thomas-Rogers Act of 1936; and
WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma, the
largest of the Potawatomi Indian Tribes, has, through a
continuation of Potawatomi history and organized self government
since time immemorial, sovereign powers inherent in tribal
tradition and recognized by treaties with the United States
and in the United States Constitution; and
WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma
Constitution and By-Laws provide that the Business Committee
of the Tribe shall be granted the power to act on behalf of
the Tribe in all matters except those relating to claims of
treaties with the United States; and
WHEREAS, the Business Committee has appointed John A. Barrett, Jr. to
represent the Committee on the Board of Directors of the
First Oklahoma Bank; and
WHEREAS, the responsibility of the Board of Directors entails casing
votes of all shares of the Tribe; and
WHEREAS, John A . Barrett, Jr. must be authorized to vote the shares of
the proxy in order to vote for the Tribe;

WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma is
a federally-recognized tribe of American Indians
organized under the authority of the Oklahoma Indian
Welfare Act of 1936; and
WHEREAS, the Citizen Band Potawatomi Business Committee is duly
authorized to act on behalf of the tribe by authority of
the Tribal Constitution and By-Laws; and
WHEREAS, federal law (25 U.S.C. §§ 81, 503 and 25 C.F.R. 89.7-
89.26) requires that certain contracts be approved by the
Secretary of the Interior, and the Tribal Constitution
(art. 7, §2) requires that all contracts with attorneys
be approved by the Secretary of the Interior when
required by federal law; and
WHEREAS, under paragraph 4 on page 2 of the ""General Counsel
Contract"" (June 24, 1987) which is endorsed with
Secretarial approval, the General Counsel is specifically
authorized to employ other attorneys subject to approval
by the tribe's Business Committee and by an authorized
representative of the Secretary of the Interior; and
WHEREAS, the tribe required legal representation in the Washington,
D.C. area from attorneys with expertise in Indian
administrative law particularly including the calling of
Secretarial Elections; and
WHEREAS, to provide this service, the tribe adopted Resolution Pot
#89-21 which instructed the tribal general counsel to
employ Doyle & Savit, Suite 1000, 919 18th Street, N.W.,
Washington, D.C. 20006 (202/659-4240) effective
September 12, 1988; and
WHEREAS, this employment was subject to a condition that the bills
from Doyle & Savit for this employment shall not exceed
a total of $5,000.00 unless a greater amount is thereafter
duly authorized;
WHEREAS, during this employment Doyle & Savit performed services
which have merited additional compensation which is
reflected on the attached bill;
WHEREAS, Doyle & Savit should be duly authorized to receive
payment for these services;

THEREFORE BE IT RESOLVED, that the Business Committee of the
Citizen Band Potawatomi Indian Tribe of Oklahoma hereby duly
authorizes the General Counsel to pay the law firm of Doyle & Savit
as special counsel the sum of $3,380.75 in excess of the $5,000
limit on said firm's initial employment under Pot #89-21. The
general counsel shall include the attached bill for special counsel
as an item of compensation in the general attorney's monthly bills
to the tribe and when the general counsel has been paid by the
tribe for said bill, the general counsel is directed to remit the
said amount to the special counsel.

WHEREAS, though the change was requested by Central Office, the
Solicitor, Scott Keep, has determined that Secretarial
authorization at the Central Office level is required; and
WHEREAS, though the Citizen Band Potawatomi Business Committee has
already submitted a resolution to request the change, the
Business Committee is complying with Scott Keep's request;
and
WHEREAS, the Citizen Band Potawatomi Business Committee pursuant to
Keep's letter, hereby amends all previous resolutions dealing
with this constitutional revision; and

A RESOLUTION AUTHORIZING JOHN A. BARRETT, JR. TO ACT FOR AND ON BEHALF OF
THE CITIZEN BAND POTAWATOMI INDIAN TRIBE OF OKLAHOMA IN SIGNING THE
ATTORNEY CONTRACT.
WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma is a
federally recognized tribe of American Indians with
constitutional authority under the Indian Reorganization Act
of 1934 and the Thomas-Rogers Act of 1936; and
WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma, the
largest of the Potawatomi Indian Tribes, has, through a
continuation of Potawatomi history and organized self government
since time immemorial, sovereign powers inherent in tribal
tradition and recognized by treaties with the United States
and in the United States Constitution; and
WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma
Constitution and By-Laws provide that the Business Committee
of the Tribe shall be granted the power to act on behalf of
the Tribe in all matters except those relating to claims of
treaties with the United States; and
WHEREAS, the continued service of Tribal Attorney Michael Minnis and
Associates is necessary; and
WHEREAS, the service of Michael Minnis and Associates has been
tremendous; and
WHEREAS, law suits that have been continued throughout the years are
still in progress; and
WHEREAS, Michael Minnis and Associates is familiar with the operations
of the Tribe;

THEREFORE, BE IT RESOLVED, that the Business Committee of the Citizen Band
Potawatomi Indian Tribe of Oklahoma authorizes John A. Barrett, Jr. to act

A RESOLUTION APPROVING A RECOMMENDATION BY THE ELECTION COMMITTEE FOR A
RULE ON ABSENTEE BALLOT REQUESTS FOR THE JUNE 24, 1989 ELECTION.
WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma is a
federally recognized tribe of American Indians with
constitutional authority under the Indian Reorganization Act
of 1934 and the Thomas-Rogers Act of 1936; and
WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma, the
largest of the Potawatomi Indian Tribes, has, through a
continuation of Potawatomi history and organized self government
since time immemorial, sovereign powers inherent in tribal
tradition and recognized by treaties with the United States
and in the United States Constitution; and
WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma
Constitution and By-Laws provide that the Business Committee
of the Tribe shall be granted the power to act on behalf of
the Tribe in all matters except those relating to claims of
treaties with the United States; and
WHEREAS, the members of the Tribe on April 3, 1989 voted to amend
the Tribal Constitution by enlarging the enrollment criteria;
and
WHEREAS, the results of this election were not effective until certified
by the Department of the Interior through the Bureau of Indian
Affairs; and
WHEREAS, the Department of the Interior through the Bureau of Indian
Affairs certified the election results on May 5, 1989; and
WHEREAS, requests for absentee ballots must be received by the Election
Committee on or before June 4, 1989; and
WHEREAS, the Business Committee recognizes that many potential members
of the Tribe eligible to vote because of the change in the
Constitution are physically unable to come to the tribal grounds
to vote; and
WHEREAS, the Business Committee recognizes that those eligible under the
Tribal Constitution as amended may not receive a tribal roll

number in sufficient time to make a written request for an
absentee ballot; and
WHEREAS, all enrolled members as of May 30, 1969 of eighteen (18) years
of age or older are eligible to vote in the June 24, 1989
election; and
WHEREAS, the Business Committee does not wish that any member of the
Tribe, including newly-enrolled members, be deprived of their
right to vote; and
WHEREAS, the Citizen Band Potawatomi Election Committee has recommended
the adoption of a rule for absentee ballot requests that it be
allowed to waive the requirement in S8-102 of the election
ordinance that a request for an absentee ballot ""include the""
""roll number of the person making the request"" when the
Election Committee determines that the requester is a tribal
member eligible to vote in this election; and
WHEREAS, the Business Committee of the Citizen Band Potawatomi Indian
Tribe of Oklahoma has determined that the recommended rule is
necessary and proper for the conduct of tribal elections;
NOW
THEREFORE, BE IT RESOLVED, that the Business Committee of the Citizen Band
Potawatomi Indian Tribe of Oklahoma approves the recommendation of the
Election Committee for a rule on absentee ballot requests for the June 24,
1989 election and adopts the following rule for said election:
Rule
The Election Committee shall waive the requirement
in S8-102 of the election ordinance that a request for an
absentee ballot ""include the"" ""roll number of the person
making the request"" when the Election Committee determines
that the requester is a tribal member eligible to vote in
this election. To each person requesting an absentee ballot
who is sent an absentee ballot under this waiver, the
Election Committee shall amend the application in the
appropriate place in red ink by inserting the roll number of
the requester and placing, to the upper right of the insertion,
the initials of the person on the Election Committee
who made the insertion and confirmed that the requester was
an enrolled member eligible to vote.

A RESOLUTION FORMALLY ADOPTING AN AMENDMENT TO THE 1987 ELECTION ORDINANCE
OF THE CITIZEN BAND POTAWATOMI INDIAN TRIBE OF OKLAHOMA.
WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma is a
federally recognized tribe of American Indians with
constitutional authority under the Indian Reorganization Act
of 1934 and the Thomas-Rogers Act of 1936; and
WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma, the
largest of the Potawatomi Indian Tribes, has, through a
continuation of Potawatomi history and organized self government
since time immemorial, sovereign powers inherent in tribal
tradition and recognized by treaties with the United States
and in the United States Constitution; and
WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma

Tribe of Oklahoma has determined that the amendment is necessary
and proper for the conduct of tribal elections;

THEREFORE, BE IT RESOLVED, that the Business Committee of the Citizen Band
Potawatomi Indian Tribe of Oklahoma enacts the attached amendment to
S8-102 of the tribal election ordinance.
