RESOLUTION # 00-01
A RESOLUTION AUTHORIZING DAVID McCULLOUGH TO REPRESENT THE TRIBE
IN NEGOTIATIONS RESOLVING LITIGATION BROUGHT BY JOHN RYALS OVER
TAXATION BY THE STATE OF OKLAHOMA OF FUEL SOLD TO AND BY TRIBES
OPERATING IN THE STATE OF OKLAHOMA
WHEREAS, the Citizen Potawatomi Nation is a federally recognized tribe of American Indians
with constitutional authority under the Thomas-Rogers Oklahoma Indian Welfare
Act of June 26, 1936 (40 Stat. 1967); and
WHEREAS, the Citizen Potawatomi Nation, the largest of the Potawatomi Indian Tribes, has,
through a continuation of Potawatomi history and organized self government
since time immemorial, sovereign powers inherent in tribal tradition and
recognized by treaties with the United States and in the United States
Constitution; and
WHEREAS, the Citizen Potawatomi Nation Constitution and By-Laws provide that the
Business Committee is empowered to enact legislation, transact business, and
otherwise speak or act on behalf of the Citizen Potawatomi nation in all maters [as shown on original] on which the Tribe is empowered to act now or in the future; and
WHEREAS, John Ryals, an enrolled member of the Citizen Potawatomi Nation, has sued the
Oklahoma Tax Commission asserting that House Bill 2208, a bill imposing a tax
on motor fuel wholesalers, enacted in response to the United States Supreme
Court's decision in Oklahoma Tax Commission v. Chickasaw Nation, 515 U.S.
450 (1995) conflicts with Oklahoma constitutional law to the detriment of Indian
tribal members; and
WHEREAS, the District Court for Oklahoma County dismissed the suit by Ryals for lack of
standing and other reasons; and
WHEREAS, the Court of Civil Appeals (Division No. 1) for the State of Oklahoma has entered
decision reversing and remanding the dismissal order holding that the contracts
with Indian tribes authorized by HB 2208 "do not pass constitutional muster" in
Case Number 92,775; and

CITIZEN POTAWATOMI NATION
WHEREAS, the tribe has not entered in to the contract authorized by HB 2208, but is presently
selling motor fuel; and
WHEREAS, Ryals has expressed an interest in settling the litigation in a way that would
require non-contracting, fuel selling tribes to enter compacts with the State of
Oklahoma; and
WHEREAS, the tribe is interested in a compact with the State of Oklahoma for the purpose of
allowing the tribe to purchase and sell fuel that has not been taxed by the State of
Oklahoma and is willing to agree to impose a tax on its subsequent fuel sales
equal to or greater than the fuel tax imposed by the State of Oklahoma; NOW
THEREFORE BE IT RESOLVED that David McCullough, an attorney with the law firm of
Michael Minnis & Associates, P.C., who is the attorney of record for Ryals in said litigation, is
hereby authorized to represent the tribe during negotiations with the State of Oklahoma and the
Oklahoma Tax Commission in attempting to settle the litigation initiated by John Ryals
including negotiating a compact with the State of Oklahoma to resolve fuel taxation issues for

WHEREAS, the Citizen Potawatomi Nation, the largest of the Potawatomi Indian Tribes, has,
through a continuation of Potawatomi history and organized self government
since time immemorial, sovereign powers inherent in tribal tradition and
recognized by treaties with the United States and in the United States
Constitution; and
WHEREAS, the Citizen Potawatomi Nation Constitution and By-Laws provide that the

WHEREAS, pursuant to a Global Settlement Agreement between the 50 states and 5 territories
of the United States and the American tobacco companies, the states and
territories will be reimbursed billions of dollars spent in Medicare expenses for
diseases caused by smoking tobacco and tobacco use. The settlement funds will
also pay for health related programs such as smoking cessation programs; and
WHEREAS, Indian Nations have been excluded from the Global Settlement Agreement.
Therefore, Indian Nations, as sovereign governmental entities, can bring lawsuits
against tobacco companies just as the states have done; and

WHEREAS, Citizen Potawatomi Nation Business Committee has suffered loss and injury by
diverting limited funds available for health services to treatment and care of
patients afflicted with lung cancer and other respiratory diseases caused by the use
of smoking and smokeless tobacco; and
WHEREAS, the tobacco companies have targeted Native Americans, in particular Native
American youth, including the Citizen Potawatomi Nation and its youth, with
their advertising campaigns. As a result, more Native Americans, especially the
youth, are smoking or using smokeless tobacco than the general population in the
United States; and
WHEREAS, the Citizen Potawatomi Nation Business Committee has the duty and obligation to
protect and preserve the health, welfare, and safety of its members, and to seek
redress for their injury or injury to the Citizen Potawatomi Nation; and
WHEREAS, the Branch Law (hereinafter referred to as "Attorneys") [as shown on original], propose to represent the Citizen Potawatomi Nation against the tobacco companies; and
WHEREAS, the Attorneys possess the expertise, resources and financial capability to bring a
lawsuit on behalf of the Citizen Potawatomi Nation against the tobacco
companies. The Branch Law Firm has represented the State of New Mexico in
litigation against the tobacco companies and secured a settlement of over $1.168
billion; and
WHEREAS, time is of the essence because the United States Congress is likely to place a
moratorium on further litigation against the tobacco companies; and
WHEREAS, it is in the best interest of the Citizen Potawatomi Nation that the Attorneys be
retained immediately to litigate a claim on behalf of the Citizen Potawatomi
Nation against the tobacco companies and to authorize the Chairman of the
Citizen Potawatomi Nation to finalize the Professional Services Contract for
Tobacco Litigation, attached hereto and incorporated herein as Exhibit "A", and
to execute the same for and on behalf of the Citizen Potawatomi Nation; NOW

WHEREAS, the Citizen Potawatomi Nation Constitution and By-Laws provide that the Business Committee is empowered to enact legislation, transact business, and otherwise speak or act on behalf of the Citizen Potawatomi Nation in all matters on which the Tribe is empowered to act now or in the future; and
WHEREAS, the Citizen Potawatomi Nation is a Member of the Indian Government in Good Standing of the National Congress of American Indians and meets all requirements for Tribal membership, pursuant to Article II, Section IIA of the Constitution of the National Congress of American Indians (NCAI); NOW

FROM THE KNIGHT FAMILY, ESTABLISHING A SINKING FUND AND MAKING A LIMITED

WHEREAS, the Citizen Potawatomi Nation is a federally recognized tribe of American Indians with constitutional authority under the Thomas-Rogers Oklahoma Indian Welfare Act of June 26,
1936, (40 Stat. 1967); and
WHEREAS, the Citizen Potawatomi Nation, the largest of the Potawatomi Indian Tribes, has, through a continuation of Potawatomi history and organized self government since time immemorial,
sovereign powers inherent in tribal tradition and recognized by treaties with the United
States and in the United States Constitution; and
WHEREAS, the Citizen Potawatomi Nation Constitution and By-Laws provide that the Business Committee is empowered to enact legislation, transact business, and otherwise speak or act
on behalf of the Citizen Potawatomi Nation in all matters on which the Tribe is empowered
to act now or in the future; and
WHEREAS, the Tribal Business Committee, previously has determined that it is in the best interests of the Nation to: (a) purchase the Knight Family land, under the terms of a contract For Purchase
and Sale of Real Estate dated June 4th, 1999; (b) Pay to the Knight Family at closing
$320,000 dollars; and (c) finance One Million Two Hundred Eighty Thousand Dollars under
a Loan and Note as provided herein; and
WHEREAS, the Business Committee has reviewed various alternatives, including, but not limited to,
paying off the entire balance of the purchase, or financing through a financial institution or
financing through a Promissory Note, Loan Agreement and Loan Documents from the
Knight Family as Lender, and has determined that it is in the best interest of the Nation to
finance the Knight Family land purchase by borrowing from the Knight Family ("Knight
Family"), as further defined in the Loan Agreement, with payments as follows:
a. The loan will bear interest at the rate of 10.00% and be repaid in interest only in monthly
Installments of $10,666.66 for One Hundred Nineteen payments (119), and then one final
payment of principal and interest on November 1, 2009; and
b. Repayment and performance of the Loan will be secured by a first priority perfected
collateral interest in a Sinking Fund to be established at the time of Closing with an initial
deposit from the Nation's funds in the amount of $800,000. These funds come from reserves
that otherwise would be invested to obtain the highest return under the Nation's Investment
Management Policy, as approved by the Secretary of the Interior; and
c. Repayment and performance of the Loan and Note will also be a general obligation of the
Nation.

WHEREAS, as to the Sinking Fund created, the Trust Department of the First National Bank & Trust
Company of Shawnee, Oklahoma will act as Custodian for the Sinking Fund. Linsco/Private
Ledger will act as Financial Advisor to the Sinking Fund, and the Nation and the Knight's
both have agreed to ranges and initial allocation of the monies within the Sinking Fund; and
WHEREAS, as a condition to making the financing possible, the Knight Family requires the Nation to
make a limited waiver of sovereign immunity with respect to its obligations under its
agreements with the Knight Family; and requires the Nation to agree to the use of the laws of
the State of Oklahoma for loan enforcement; and
WHEREAS, the Loan and the Note will be issued under the tax exempt status of interest conferred upon the Nation under the Internal Revenue Code Section 7871 and Internal Revenue Code Section 103
(a) Borrower agrees that if at anytime during the term of the Note when Borrower is making such
interest payments to Lender that any Court of competent jurisdiction renders a decision that such
interest payments would not be tax free to the Lender, or if the Internal Revenue Service or the
Oklahoma Tax Commission should deny the Lender that said interest payments are tax free and
require Lender to include the same as taxable income, Borrower agrees to additionally pay such
amount annually to Lender as would provide Lender with a tax position equivalent to the same
being tax free as intended by the parties hereto; NOW
THEREFORE BE IT RESOLVED
Section 1. The Tribal Business Committee, for and in consideration of the Loan and the
covenants contained in the other Loan Documents as hereinafter defined, and in order to
satisfy one of the conditions required by the Knight Family for financing the loan initially
made to purchase the Knight Family land, and entering into the other transactions
contemplated by this Resolution, and to provide a source of funds for the payment of this
financed loan, does hereby adopt this Resolution, with the understanding and agreement that
the grants of authority and power and the directions, approvals, waivers, consents. [as shown on original] covenants and representations contained in this Resolution are, and shall continue to be, valid and enforceable against the Nation upon execution and approval and that the Knight Family has
the right to rely on the same in financing the Knight Family land purchase loan; and
Section 2. The Nation hereby further authorizes borrowing up to a principal amount of
$1,280,000 from the Knight Family for the purpose of financing the loan used to purchase
the Knight Family land; and
Section 3. The Chairman of the Nation, John A. Barrett, Jr., or his duly appointed successor
("Chairman"), is hereby directed, authorized and empowered, for and in the name of, and on
behalf of the Nation, to borrow from the Knight Family sums of money not to exceed
$1,280,000 in principal amount pursuant to the Loan Agreement ("Loan Agreement") by and
between Knight Family and the Nation, and to execute for and in the name of, and on behalf
of the Nation:
a. The loan agreement; and
b. A promissory note in the total principal amount of $1,280,000 payable to the Knight
Family evidencing a sum borrowed by the Nation from the Knight Family and bearing such
interest and upon such terms and conditions as shall be required by the Knight Family
("Note"); and

C. A collateral assignment of the Sinking Fund ("Collateral Assignment of Sinking Fund and
Security Agreement") from the Nation to the Knight Family in which the Nation assigns to
Knight Family as security for repayment and as a method of servicing the Loan the Sinking
Fund established with First National Bank and Trust Company of Shawnee, Oklahoma as
Custodian; and
d. Financing statement ("Financing Statement") evidencing the Collateral Assignment
of the Sinking Fund; and
e. Sinking Fund Agreement; and
f. All other documents now or at any time hereafter required by the Bank to consummate
and secure the Loans and other transactions contemplated by this Resolution and the Loan
Agreement; and
g. All the documents described in subparagraphs (a) through (e) and any other documents
executed by the Nation in connection with the Loan which are collectively referred to herein
as the "Loan Documents".
Section 4. The Chairman is hereby further directed to execute all documents necessary to
create the Sinking Fund which will serve as collateral for the underlying loan; and
Section 5. The Custodian and Financial Advisor shall select money managers to manage the
Sinking Fund sub-accounts in accordance with the ranges and amounts set forth in Exhibit A
attached hereto; and
Section 6. The Chairman is hereby further directed, authorized and empowered, to execute
all documents necessary to:
a. Establish the Sinking Fund, the Custodial Agreement with First National Bank and Trust
Company of Shawnee, Oklahoma and enter into a contract with Linsco/Private Ledger to act
as Financial Advisor to the Sinking Fund; and
b. Pay agreed upon costs and expenses of this transaction.
Section 7. The Chairman is hereby further directed, authorized and empowered to:
a. Execute any and all renewals, amendments, modifications, rearrangements or
extensions of and substitutions for the Loan Document, with additional authorization from
the Business Committee, and
b. Do such additional acts and to execute such additional documents, agreements and
instruments as may be necessary or desirable to satisfy the requirements of the Knight
Family or First National Bank and Trust Company of Shawnee, Oklahoma, with respect to
the transactions contemplated by this Resolution; and
Section 8. All actions heretofore or hereafter taken by the Business Committee, the
Chairman or any other agent or employee of the Nation, necessary for or approving the
transactions contemplated by this Resolution are hereby ratified, approved and confirmed.
The Nation affirms and confirms that it has not in the calendar year 1999, and will not prior
to December 31, 1999, issue or cause to be issued more than Five Million Dollars
($5,000,000.00) in tax-exempt obligations; and

Section 9. The Nation will not hereafter convey, sell, pledge, assign, mortgage, grant a
security interest in or otherwise dispose of or encumber, all or any part of its rights or

any person or entity except the Knight Family; and
Section 10. The Nation hereby waives its right of sovereign or tribal immunity from suit
which it may enjoy, to the extent described in its agreements with the Knight Family.
Specifically, to allow suit in the United States District Court for the Western District of
Oklahoma, or Oklahoma State Court, in the event that the Federal Court does not assume
jurisdiction, for enforcement of the Loan Documents; and
Section 11. The Nation, to the extent possible under existing federal law agrees that its
rights and obligations with regard to the agreements between the Nation and the Knight
Family can be determined by applying the law of the State of Oklahoma; and
Section 12. This Resolution and every part hereof is effective and in full force and effect
until:
a. The Loan, including all principal, interest, penalties, costs and fees related thereto, has
been paid in full; and
b. The Nation has performed all the terms and conditions of the Loan Documents; and
c. The Knight Family acknowledges such payment and performance in writing to the
Nation.

develop a database of existing summaries and inventories, request photographs of cultural
objects, analyze trends and collection concentrations, and produce a final report of
findings and a recommended repatriation plan of action; and

Americans in an effort to provide affordable, safe and sanitary housing; and

WHEREAS, the Citizen Potawatomi Nation recognizes that those Native Americans that
qualify for NAHASDA assistance are the most financially needy while those
that purchase a home without assistance are less in need of financial

eligibility of new homes or newly purchased homes which receive NAHASDA
down payment offset funds" and absent clear guidance these housing units are
not currently eligible for IHS housing support assistance; and
WHEREAS, the Citizen Potawatomi Nation believes that this IHS administrative policy
results in undue financial burden and discrimination against those Native
Americans who can least afford it by allowing PL 86-121 assistance for those
who can afford to purchase a home without NAHASDA assistance while
denying like services to those who have received even minimal NAHASDA
assistance such as a down payment offset funds; NOW
THEREFORE BE IT RESOLVED, that the Business Committee of the Citizen Potawatomi
Nation strongly opposes the Indian Health Service administrative policy that prohibits Public Law 86-
121 assistance for housing units purchased with minimal NAHASDA funding such as down payment
offsets and strongly supports the provision of IHS housing support services for those Native

Service, which included health care services that were provided by the Shawnee
Service Unit, which served the counties of Oklahoma, Cleveland, Lincoln,
Pottawatomie, and Payne; and

WHEREAS, the Citizen Potawatomi Nation feels that it has an interest in the Oklahoma City
Urban Clinic due to that clinic's past relationship as a "sub-division" of the former
Shawnee Service Unit, the proximity of the clinic to the Citizen Potawatomi Nation
Health Complex, and the number of patients served by the Nation from the
Oklahoma City area; and
WHEREAS, the Citizen Potawatomi Nation is currently providing services to patients that reside
in the Oklahoma City area and is concerned that the rising patient load being served
by the CPN Clinic from people residing in Oklahoma City will continue on an
upward trend while the Nation's Indian Health Service Compact budget will, for the
most part, remain the same; and
WHEREAS, this upward trend would leave the CPN without recourse to secure additional
funding to serve the increased Oklahoma City area patient load because the
language proposed in the current version of the Indian Health Care Improvement
Act, P.L. 94-437 prohibits tribal governments from contracting or compacting the
Oklahoma City Urban Clinic; NOW
THEREFORE BE IT RESOLVED, that the Business Committee of the Citizen Potawatomi
Nation urges the Congress of the United States to include the following language
for inclusion in the legislation known as the Reauthorization of the Indian Health
Care Improvement Act, P.L. 94-437:
Section 512: (a) (1) "Notwithstanding any other provision of law, the Oklahoma
City Clinic demonstration project shall be treated as a service unit in the allocation
of resources and coordination of care and shall be subject to the provisions of the
Indian Self-Determination and Education Assistance Act for the term of such
project due to the fact that the Oklahoma City Urban Clinic is located within the
former Shawnee Service Unit and functions as a sub-division thereof. The
Secretary shall provide assistance to such project in the development of resources
and equipment and facility needs."

the project notifying the public of the funding source; and

OF ESTABLISHING AND IMPLEMENTING A COMMUNITY BUSINESS
DEVELOPMENT AND FINANCING PROJECT
WHEREAS, the Citizen Potawatomi Nation is a federally recognized tribe of American
Indians with constitutional authority under the Thomas-Rogers Oklahoma
Indian Welfare Act of June 26, 1936, (40 Stat. 1967); and
WHEREAS, the Citizen Potawatomi Nation, the largest of the Potawatomi Indian Tribes,
has, through a continuation of Potawatomi history and organized self
government since time immemorial, sovereign powers inherent in tribal
tradition and recognized by treaties with the United States and in the United
States Constitution; and
WHEREAS, the Citizen Potawatomi Nation Constitution and By-Laws provide that the
Business Committee is empowered to enact legislation, transact business, and
otherwise speak or act on behalf of the Citizen Potawatomi Nation in all
matters on which the Tribe is empowered to act now or in the future; and
WHEREAS, the Citizen Potawatomi Nation certifies the tribal community has provided
input into the development and planning of this project as evidenced by
regularly scheduled Business Committee Meetings, an open public meeting
held on January 18, 2000, and regional councils held once each year in nine
regions through the United States, including Colorado, Oregon, Southern
California, Northern California, North Texas, South Texas, Missouri, Arizona,
and Kansas; and
WHEREAS, The Citizen Potawatomi Nation, through community input and planning, has
placed a high priority on economic development in order to attain and
maintain a strong and diversified tribal economy and to ensure self-sufficiency
through a stable tribal tax base; and

WHEREAS, the Citizen Potawatomi Nation has determined the creation of a Community
Development Corporation (CDC) is necessary to attract Indian businesses,
assist them to develop and maintain business management skills, and prepare
them to secure financing; and
WHEREAS, the Citizen Potawatomi Nation recognizes that access to capital is a
fundamental problem in Indian business development and therefore, commits
the assistance of the First National Bank in the certification of the Community
Development Corporation as a Community Development Financial Institution
(CDFI); and
WHEREAS, the Citizen Potawatomi Nation through the First National Bank will provide
$250,000 in venture capital and debt and equity financing to the Community
Development Financial Institution to establish a revolving loan fund for
qualifying Indian businesses; and
WHEREAS, the Citizen Potawatomi Nation commits to twenty percent matching funds as
required by the Administration for Native Americans and as documented in
the application; NOW
THEREFORE BE IT RESOLVED, that the Business Committee of the Citizen Potawatomi
Nation hereby authorizes the submission of an application to the Administration of Native Americans
for the purpose of establishing a Community Business Development and Financing Project.

FORCE.
WHEREAS, the Citizen Potawatomi Nation is a federally recognized tribe of American
Indians with the constitutional authority under the Thomas-Rogers
Oklahoma Indian Welfare Act of June 26, 1936, (40 Stat. 1967); and
WHEREAS, the Citizen Potawatomi Nation, the largest of the Potawatomi Indian
Tribes, has, through a continuation of Potawatomi history and organized
self government since time immemorial, sovereign powers inherent in
tribal tradition and recognized by treaties with the United States and in the
United States Constitution; and
WHEREAS, the Citizen Potawatomi Nation Constitution and By-Laws provide that the
Business Committee is empowered to enact legislation, transact business,
and otherwise speak or act on behalf of the Citizen Potawatomi Nation in

WHEREAS, NCAI has instituted a national task force on reporting and accountability
that will develop a consistent national reporting instrument that documents
program data, unmet tribal needs for direct service, and P.L. 93-638
contracting and Self-Governance compacting tribes; and
WHEREAS, although Self-Governance tribes are not required to submit reports
throughout the year, wisdom dictates that it is to the mutual benefit of the
tribes to submit data to support the annual Self-Governance budgets; and
WHEREAS, the Citizen Potawatomi Nation Self-Governance staff have been actively
involved in development of the current Self-Governance national reporting
form; and

WHEREAS, data collection is a critical piece of many legislative initiatives and it has
the potential to both benefit tribes greatly by increasing tribal budgets and
to damage tribes if data is not properly aggregated and kept confidential;

WHEREAS, the BIA, with input from the NCAI task force on Reporting and
Accountability, will develop a national reporting instrument that the tribes
will use to submit data; and
WHEREAS, it is in the best interest of the Citizen Potawatomi Nation to be directly
involved with the NCAI national task force on reporting and
accountability to protect the interests of the Citizen Potawatomi Nation;

THEREFORE BE IT RESOLVED, that the Citizen Potawatomi Nation hereby
appoints Chairman John A. Barrett, Jr. to serve on the NCAI task force on reporting and
accountability.
BE IT FURTHER RESOLVED, that the Citizen Potawatomi Nation hereby appoints
Office of Self-Governance staff, Rhonda Butcher and Carol L. Nuttle to serve as official
Citizen Potawatomi Nation representatives to the NCAI reporting and accountability task
force in the absence of the Chairman.

sentences and be released back into society to offend again because the root
cause of their behavior, substance abuse, has not been addressed; and
WHEREAS, the high incidence of crimes that directly involve alcohol and drugs is
intolerable and unacceptable to the Citizen Potawatomi Nation; and
WHEREAS, to combat this, the Citizen Potawatomi Nation is submitting an application to
the U.S. Department of Justice, Office of Justice Programs to develop and
implement a Drug Court that will include a specialized system for treating
and rehabilitating defendants convicted of alcohol and drug related offences;
and

continued judicial supervision until the program is successfully completed or

country each year with the incidence of child abuse and neglect in Indian
Country continuing to rise at an alarming rate; and
WHEREAS, the effects of child abuse are felt by whole communities, and need to be
addressed by the entire community; and

WHEREAS, effective child abuse prevention programs succeed because of
partnerships created among social service agencies, schools, religious and
civic organizations, law enforcement agencies, and the business
community; and
WHEREAS, youth-serving prevention programs offer positive alternatives for young
people and encourage youth to develop strong ties to their community;
and
WHEREAS, all citizens should become aware of the negative effects of child abuse and
its prevention within the community, and become involved in supporting
parents to raise their children in a safe, nurturing environment; NOW
THEREFORE BE IT RESOLVED, that the Business Committee does hereby proclaim
April as Child Abuse Prevention Month in the Citizen Potawatomi Nation
and call upon its community and tribal programs, with their limited
resources, to continue to provide prevention and intervention services to
abused and neglected children and to increase their participation in our
efforts to prevent child abuse, thereby strengthening the community in
which we live.

WHEREAS, the Citizen Potawatomi Nation, the largest of the Potawatomi Indian
Tribes, has, through a continuation of Potawatomi history and organized
self government since time immemorial, sovereign powers inherent in
tribal tradition and recognized by treaties with the United States and in the
United States Constitution; and
WHEREAS, the Citizen Potawatomi Nation Constitution and By-Laws provide that the
Business Committee is empowered to enact legislation, transact business,
and other wise speak or act on behalf of the Citizen Potawatomi Nation in
all matters on which the Tribe is empowered to act now or in the future;
and
WHEREAS, The Citizen Potawatomi Nation is submitting an application to the U.S.
Department of Housing and Urban Development (HUD) under the Indian
Community Development Block Grant Program (ICDBG) for the
construction of a Child Development Center; and
WHEREAS, the Citizen Potawatomi Nation wishes to adopt the attached operation and
maintenance plan and budget for the maintenance and upkeep of the new
tribal Child Development Center; and

WHEREAS, the Citizen Potawatomi Nation hereby adopts the attached maintenance
and operation plan to provide personnel, building and grounds
maintenance, housekeeping and insurance for the Child Development
Center; and
WHEREAS, the Citizen Potawatomi Nation hereby commits funds in the amount of
$136,416 to provide maintenance and operation of the Child Development
Center
WHEREAS, the U.S. Department of Housing and Urban Development awards funding
for facilities such as the Child Care Development Center in the amount of
$750,000 under the FY-2000 Indian Community Development Block
Grant Program; NOW
THEREFORE BE IT RESOLVED, that the Business Committee of the Citizen
Potawatomi Nation adopts the attached Child Development Center
Maintenance and Operation Plan to satisfy the application requirements of
the Indian Community Development Block Grant.

OFFICE OF JUSTICE PROGRAMS, OFFICE OF JUVENILE JUSTICE AND
DELINQUENCY PREVENTION, FOR A TRIBAL YOUTH PROGRAM GRANT.
WHEREAS, the Citizen Potawatomi Nation is a federally recognized tribe of American Indians
with constitutional authority under the Thomas-Rogers Oklahoma Indian Welfare
Act of June 26, 1936, (40 Stat. 1967); and
WHEREAS, the Citizen Potawatomi Nation, the largest of the Potawatomi Indian Tribes, has,
through a continuation of Potawatomi history and organized self government since
time immemorial, sovereign powers inherent in tribal tradition and recognized by
treaties with the United States and in the United States Constitution; and

and unacceptable to the Citizen Potawatomi Nation; and
WHEREAS, to combat this, the Citizen Potawatomi Nation is submitting an application to the
U.S. Department of Justice, Office of Justice Programs, Office of Juvenile Justice
and Delinquency Prevention, Tribal Youth Program to develop and implement a
Tribal Youth Program that will include a specialized system for the prevention of
crime and delinquency both by and against tribal youth, provide prevention and
intervention programs; and
