A RESOLUTION APPROVING THE SUBMISSION OF THE "FY 2011
COMMUNITY SERVICES BLOCK GRANT (CSBG)" GRANT APPLICATION
TO THE ADMINISTRATION FOR CHILDREN AND FAMILIES
WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of
American Indians with Constitutional authority under the Act of June 18,
1934 and the Oklahoma Indian Welfare Act of June 26, 1936, (49 Stat.
1967); and
WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in
Tribal tradition, derived from a history of organized self-government since
time immemorial, and recognized by treaties with the United States and in
the Constitution of the United States; and
WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution
provides for a separation of powers of the Tribal government by the
reservation and delegation of specific powers to other entities of the Tribal
government; and, except for these specific limitations, all other general
powers of government are embodied in the Legislature's authority "to
enact legislation, transact business, and otherwise speak and act on behalf
of the Citizen Potawatomi Nation in all matters on which the Nation is
empowered to act now or in the future"; and
WHEREAS, the Citizen Potawatomi Nation P.L. 102-477 Program (Employment and
Training/Social Services) assists low income Native American
households, who are otherwise ineligible for 477 program funds, with fuel
costs through vouchers to FireLake Convenience Store, or other
emergency needs such as utility payments, or medical related needs; and

WHEREAS, if funded, the Citizen Potawatomi Nation will receive an estimated
$3,541.00 in a Community Services Block Grant (CSBG) to deliver such
assistance.
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE
CITIZEN POTAWATOMI NATION that a resolution supporting the submission of the
FY 2011 Community Services Block Grant (CSBG) application to the Administration for
Children and Families, IS HEREBY APPROVED.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that by act of this resolution
and consistent with the separation of powers defined in the Constitution, if awarded, an
appropriation in the amount of $ 3,541.00 from the FY 2011 CSBG fund (or other
applicable accounts) for the implementation, negotiation, operation, enforcement,
procurement, settlement and/or completion of this contract, compact, regulation or
agreement by the Tribal Chairman or his designate IS HEREBY AUTHORIZED.

CITIZEN POTAWATOMI NATION that a resolution supporting the submission of the
FY 2011 Lower Income and Energy Assistance Program (LIHEAP) grant application to
the Administration for Children and Families, IS HEREBY APPROVED.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that by act of this resolution
and consistent with the separation of powers defined in the Constitution, if awarded, an
appropriation in the amount of $77,777.00 from the FY 2011 LIHEAP fund (or other
applicable accounts) for the implementation, negotiation, operation, enforcement,
procurement, settlement and/or completion of this contract, compact, regulation or

WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of
American Indians with Constitutional authority under the Act of June 18,
1934 and the Oklahoma Indian Welfare Act of June 26, 1936, (49 Stat.
1967); and
WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in
Tribal tradition, derived from a history of organized self-government since
time immemorial, and recognized by treaties with the United States and in
the Constitution of the United States; and
WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution
provides for a separation of powers of the Tribal government by the
reservation and delegation of specific powers to other entities of the Tribal
government; and, except for these specific limitations, all other general
powers of government are embodied in the Legislature's authority "to
enact legislation, transact business, and otherwise speak and act on behalf
of the Citizen Potawatomi Nation in all matters on which the Nation is
empowered to act now or in the future"; and
WHEREAS, the Citizen Potawatomi Nation desires to enter into a grant agreement with
the Indian Health Service for the fourteenth-year for approximately
$626,735.00 to continue its Special Diabetes Program; and

WHEREAS, in Fiscal Year 2011, the Citizen Potawatomi Nation proposes to continue
its Diabetic Program aimed at diabetic prevention and education and
primary, secondary, and tertiary diabetic services for the Native American
community; and
WHEREAS, the Citizen Potawatomi Nation is not required to provide matching or in-
kind donations to receive the funds.
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE
CITIZEN POTAWATOMI NATION that a resolution authorizing and supporting the
"Citizen Potawatomi Nation's Fiscal Year 2011 Diabetes Grant — Year 14" proposal to
the Indian Health Service under the Special Diabetes Program for Indians IS HEREBY
APPROVED.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that by act of this resolution
and consistent with the separation of powers defined in the Constitution, it awarded, an
appropriation of federal funds of $626,735.00 from the Indian Health Service fund (or
other applicable accounts) for the implementation, negotiation, operation, enforcement,
procurement, settlement, and or completion of this contract, compact, regulation or
agreement by the Tribal Chairman or his designate IS HEREBY AUTHORIZED.

the Constitution of the United States; and
WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution

WHEREAS, the Citizen Potawatomi Nation will receive an estimated $1,000 for
Beneficiary Outreach and Assistance through Medicare Part D, the Low

NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE
CITIZEN POTAWATOMI NATION that a resolution approving the application for
MIPPA beneficiary outreach and assistance grant funds IS HEREBY APPROVED.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that by act of this resolution
and consistent with the separation of powers defined in the Constitution, if awarded, an
appropriation up to $ 1,000 from the FY10 TITLE VI Outreach fund (or other applicable
accounts) for the implementation, negotiation, operation, enforcement, procurement,
settlement, and or completion of this contract, compact, regulation or agreement by the
Tribal Chairman or his designate IS HEREBY AUTHORIZED.

basic transit service based on the need as evidenced from the increasing number of
transportation requests; and
WHEREAS, the Citizen Potawatomi Nation's proposed Tribal Transit system will include: (1) on-
demand local transportation to and from the Citizen Potawatomi Nation Health Clinic;
(2) on-demand transportation of local Citizen Potawatomi Nation Health Clinic
patients to and from their out-of-town medical appointments; 3) expansion of
transportation services to McLoud, Harrah, Newalla, Eastern side of Choctaw and

WHEREAS, the Indian Health Service is accepting applications for FY 2010 competitive
cooperative agreement funding directed at Healthy Heart and Diabetes
Prevention Initiatives; and
WHEREAS, the Citizen Potawatomi Nation has implemented a community directed diabetes
program for fourteen years and provides care for approximately 550 Native
Americans age 18 and over who have been diagnosed with diabetes; and
WHEREAS, the Citizen Potawatomi Nation proposes to provide a Healthy Heart Program
aimed at cardiovascular disease risk reduction in Native Americans with diabetes
through intensive activities including case management, disease management,
and self-management education; and

WHEREAS, the Citizen Potawatomi Nation also proposes less intensive community
awareness activities such as health fairs, exercise challenges, and competitions

$324,300 annually for a 2 year project period with no matching funds or in-kind
services required.

Potawatomi Nation's Fiscal Year 2010 Competitive Diabetes Healthy Heart Initiative Application

11,000 square foot grocery store, in McLoud, Oklahoma; and
WHEREAS, the FireLake Express 2 Grocery Store will meet an essential community development need
by providing economic development, jobs and convenient access to groceries and related
products; and
WHEREAS, a public survey has been published and a public meeting will be held to solicit comments
from Tribal and community members regarding the proposed community development
pursuant to citizen participation requirements as set forth in 24 CFR 1003.604; and

WHEREAS, the FireLake Express 2 Grocery Store project will be constructed following applicable
standards and guidelines from the Building Officials and Code Administrators (BOCA),

WHEREAS, the project period for the proposed grocery store construction project is two years, with
total project cost of $ 1,100,000 of which $800,000 (or 73%) is the Federal share, and
$300,000 (or 27%) is Tribal leverage; and
WHEREAS, Tribal leverage will consist of $130,000 cash, in addition to land valued at $45,000 and
parking lot valued at $125,000.

WHEREAS, Section 5 of the Indian Reorganization Act of June 18, 1934 (48 Stat. 985; 25 USC 465)
provides authority for the Fee-to-Trust acquisition; and
WHEREAS, the property is ON-reservation or within the former reservation boundaries of the Citizen
Potawatomi Nation, legally described in Attachment A; and is within Pottawatomie
County, Assessor's Parcel ID Number 0000-35-011-002-0-013-00 Section 35 Township

supportive services to Indian elders under Part A and Native American Caregiver
Support services under Part C for a three year project period of April 1, 2011 to
March 31, 2014; and
WHEREAS, the Citizen Potawatomi Nation recognizes the need for Title VI grant funds to
provide care to Native American elders and Native American elder caregivers
and has participated in the Title VI Program Part A for the past 29 years, since
1981, and Part C for the past 10 years as one of the first grantees in 2000; and

WHEREAS, the goal of both of these programs is to increase home and community based
services to older Native Americans, which respond to local needs and are

Potawatomi Nation will provide nutritional and supportive services including
congregate and home-delivered meals, information, and transportation, as well as
caregiver support services including support groups, referrals, information,
assistance, and respite care.

including material purchasing and installation of the digital displays in the Main
Exhibition Hall; and while cost sharing is not required, the Citizen Potawatomi Nation

the Fire project.

variety of specified purposes as outlined in eight "Purpose Areas". The Citizen
Potawatomi Nation is eligible for, and desires to apply for, funding under four of the
eight Purpose Areas: Purpose Area 1, 2, 3 and 4; and
WHEREAS, the Citizen Potawatomi Nation is experiencing an increased need for enhanced law
enforcement and justice services within the tribal community for several reasons: 1)
implementation of several provisions of the Tribal Law and Order Act of 2010 including,
but not limited to, expanded sentencing opportunities; 2) construction of an additional
health clinic, a family fun center and a youth services facility and 3) offender reentry
support needs; and
WHEREAS, Purpose Area 1 - "Public Safety and Community Policing". The Citizen Potawatomi
Nation is proposing the addition of police vehicles with equipment and supplies for the
Tribal Police department at an estimated cost of $450,000 with no match required; and

WHEREAS, Purpose Area 3 - "Justice Systems and Alcohol and Substance Abuse". The Citizen
Potawatomi Nation is proposing an Offender Reentry Program to be associated with the
CPN Employee and Training department at an estimated cost of $500,000; and
WHEREAS, Purpose Area 4 - "Corrections and Correctional Alternatives". The Citizen Potawatomi
Nation is proposing a strategic planning grant to determine the feasibility of constructing

APPLICATION FOR FUNDING UNDER THE FISCAL YEAR 2012 CHILD CARE
DEVELOPMENT FUND OFFERED THROUGH THE UNITED STATES
DEPARTMENT OF HEALTH AND HUMAN SERVICES THROUGH THE BUREAU OF
INDIAN AFFAIRS 477 PROGRAM.
WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of American
Indians with Constitutional authority under the Act of June 18, 1934 and the
Oklahoma Indian Welfare Act of June 26, 1936, (49 Stat. 1967); and
WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in Tribal
tradition, derived from a history of organized self-government since time
immemorial, and recognized by treaties with the United States and in the
Constitution of the United States; and
WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution provides for a
separation of powers of the Tribal government by the reservation and delegation
of specific powers to other entities of the Tribal government; and, except for
these specific limitations, all other general powers of government are embodied
in the Legislature's authority "to enact legislation, transact business, and
otherwise speak and act on behalf of the Citizen Potawatomi Nation in all matters
on which the Nation is empowered to act now or in the future"; and
WHEREAS, there exists a continuing need to provide center-based, voucher, and after school
program child care services for Native American children under the age of 13, as
evidenced by the child count of the Citizen Potawatomi Nation tribal service area
being 12,396; and
WHEREAS, the Citizen Potawatomi Nation tribal service area encompasses the children whose
parents reside or work within the boundaries of the declared tribal service area,
being defined as Pottawatomie County, Cleveland County, Oklahoma County,
and areas adjacent to the eight Potawatomi District Offices; and

WHEREAS, the Department of Health and Human Services through the Bureau of Indian
Affairs "477 Program" provides grants for the ongoing support of center-based,
voucher, and after school program child care services estimated to be
$1,866,554.00 as provided by the CCDF Day Care Funds; and
WHEREAS, the center-based, voucher and after school program will provide Native American
families with quality day care facilities in which to leave their children.
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN
POTAWATOMI NATION that a resolution authorizing the Citizen Potawatomi Nation's
"Center-based, Voucher and After School Program Child Care Services" application for funding
under the Fiscal Year 2012 Child Care Development Funds IS HEREBY APPROVED.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that by act of this resolution and
consistent with the separation of powers defined in the Constitution, if awarded, an appropriation
of $1,866,554.00 from the CCDF Day Care Funds FY 2012 (or other applicable accounts) for the
implementation, negotiation, operation, enforcement, procurement, settlement, and or completion
of this contract, compact, regulation or agreement by the Tribal Chairman or his designate IS
HEREBY AUTHORIZED.

WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of American

Education, General Assistance, and Johnson O'Malley programs as well as the
Department of Labor Workforce Investment Act; and
WHEREAS, Congress has enacted Public Law 102-477 which allows Tribes to voluntarily
consolidate various Employment Training and related programs; and
WHEREAS, Public Law 102-477 permits the consolidation of funding received for these
programs and allows greater flexibility in the development, coordination and
operation of said programs; and

WHEREAS, funding for the 477 Program is formula driven and appropriated annually by the
Federal Agencies (DOL, BIA, and DHHS) and is estimated, based on FY2011
actual funding, to be approximately $2,600,300.
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN
POTAWATOMI NATION that a resolution consolidating these Employment and Training and
related programs and authorizing them to be administered in accordance with the Nation's 102-
477 plan, IS HEREBY APPROVED.

HEALTH SERVICE FUNDED PROGRAMS OF THE CITIZEN POTAWATOMI NATION
HEALTH SYSTEM.
WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of American Indians with

Act of June 26, 1936, (49 Stat. 1967); and
WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in Tribal tradition,

recognized by treaties with the United States and in the Constitution of the United States;
and
WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution provides for a

WHEREAS, the Citizen Potawatomi Nation administers Indian Health Service Programs as a tribally
operated service unit (previously known as the Shawnee Service Unit) in central
Oklahoma under a Title V Compact ("the Compact") and Multi-Year Funding Agreement
through the Indian Self-Determination and Education Assistance Act with the
Department of Health and Human Services in accordance with federal law, and
WHEREAS, under the terms of the Patient Protection and Affordable Care Act enacted on March 23,
2010 and Section 813 of the Indian Health Care Improvement Act included therein, the
governing body of the Citizen Potawatomi Nation is authorized to determine the
conditions under which limited health services may be provided to persons who are not
"eligible beneficiaries" of the Indian Health Service but are "tribal community
beneficiaries" as non-Indian Citizen Potawatomi spouses and tribal employees residing
within the local Tribal Community. This determination was made after consideration of
the extra clinic facility capacity and whether the provision of such services will result in a
denial or diminution of services to eligible Indians and under the condition that IHS
ineligible persons shall be liable for payment of the health services provided, and

WHEREAS, after careful consideration, the Legislature of the Citizen Potawatomi Nation has
determined that the provision of limited health and wellness services to its "tribal
community beneficiaries" will not result in a denial or diminution of services to Indian
beneficiaries, provided such limited services are provided on a fee-for-service basis
resulting in reimbursement in an amount not less that the actual costs of providing such
services as provided by federal law, and
WHEREAS, whenever significant evidence is presented to the Legislature of the Citizen Potawatomi
Nation that services to a particular type of tribal community beneficiaries will result in a
diminution of services to Indian beneficiaries, the Legislature is authorized to suspend the
delivery of such services, the facility to which the suspension applies, and the duration of
the suspension, and
WHEREAS, any services provided by the Citizen Potawatomi Nation pursuant to this determination
shall be deemed to be provided under the Title V Compact and Funding Agreement
entered into by the Tribe under the Indian Self-Determination and Education Assistance
Act, and
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN
POTAWATOMI NATION that a resolution authorizing health and wellness clinic services to tribal
community beneficiaries who are not otherwise eligible for the clinic services of the Citizen Potawatomi

participate in a research study under the guidelines of a Susan G. Komen Grant
for the Cure® to help eliminate health disparities, beliefs and practices of Native
American women towards breast cancer screening; and

WHEREAS, the United States Department of Agriculture (USDA) has awarded a combined grant and
low interest loan through Rural Development's Rural Utility Services Program; and
WHEREAS, the Citizen Potawatomi Nation is constructing an 8-inch waterline extension and a new
pump station to provide backup water supply to both the Macomb and Dale treatment
facilities of Rural Water District #3; and
WHEREAS, the total project cost of $1,283,450 consists of $1,096,836 which is split as $331,836 of
grant award and $765,000 loan with terms of 3.75% APR, and 40 year monthly loan
payments of $2,907 and $186,614 which has been funded from U.S. Indian Health
Service; and
WHEREAS, the Citizen Potawatomi Nation will make annual contributions, if necessary, to ensure the
system's financial viability during the expansion period as provided by the approved
capital operating budget; and

WHEREAS, the Citizen Potawatomi Nation will complete the required SF 3550-28 Authorization
Agreement for Preauthorized Payments for all new and existing indebtedness to Rural
Development which allows payment to be electronically debited from the authorized
account; and
WHEREAS, the Citizen Potawatomi Nation accepts and adopts a loan resolution on RUS Bulletin
1780-28, Loan Resolution Security Agreement. The loan approval conditions will be
understood, agreed to and followed by the Citizen Potawatomi Nation. A copy of the
minutes adopting the resolution will be attached to the loan resolution; and
WHEREAS, the Citizen Potawatomi Nation accepts the grant and the conditions of RUS Bulletin
1780-12, Association, Water and Waste System Grant Agreement and hereby authorizes
the Chairman and Secretary-Treasurer to execute the Grant Agreement at the time of
grant closing.
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN
POTAWATOMI NATION that a resolution accepting the grant/loan agreement to the United States
Department of Agriculture for backup water supply for Rural Water District #3 and authorizing the

community members regarding the proposed community development pursuant to citizen

A RESOLUTION APPROVING A CROSS DEPUTIZATION AGREEMENT BY
AND BETWEEN THE CITIZEN POTAWATOMI NATION AND
THE CITY OF SHAWNEE, OKLAHOMA.
WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of
American Indians with Constitutional authority under the Act of June 18,
1934 and the Oklahoma Indian Welfare Act of June 26, 1936, (49 Stat.
1967); and
WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in
Tribal tradition, derived from a history of organized self-government since
time immemorial, and recognized by treaties with the United States and in
the Constitution of the United States; and
WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution
provides for a separation of powers of the Tribal government by the
reservation and delegation of specific powers to other entities of the Tribal
government; and, except for these specific limitations, all other general
powers of government are embodied in the Legislature's authority "to
enact legislation, transact business, and otherwise speak and act on behalf
of the Citizen Potawatomi Nation in all matters on which the Nation is
empowered to act now or in the future"; and
WHEREAS, the city of Shawnee has requested the assistance of the Citizen Potawatomi
Nation in enforcing the traffic and safety ordinances applicable to
Shawnee; and
WHEREAS, the Citizen Potawatomi Nation Police Department has the ability to
provide the requested assistance to Shawnee and the Nation desires to
provide it;

VIOLENCE PREVENTION SERVICES GRANT APLICATION TO THE UNITED
STATES DEPARTMENT OF HEALTH AND HUMAN SERVICES' ADMINISTRATION
FOR CHILDREN AND FAMILIES.
WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of American

Services within the Administration for Children and Families; and
WHEREAS, the Citizen Potawatomi Nation Indian Child Welfare program will contract with
Project Safe, Unzner Center, Family Resource Center and Citizen Potawatomi
Nation Tribal Police, to provide auxiliary services to victims of family violence
and their dependents; and

WHEREAS, the goals of the Family Violence component of the Indian Child Welfare
program are to provide immediate shelter and related assistance to victims
of family violence and to expand efforts to prevent family violence; and
WHEREAS, the goals will be met if funding is received from the Administration for
Children and Families as a result of the grant application.
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE
CITIZEN POTAWATOMI NATION that a resolution supporting the Fiscal Year 2011
Family Violence Preservation Services grant application to the United States Department
of Health and Human Services, Administration for Children and Families IS HEREBY
APPROVED.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that by act of this resolution
and consistent with the separation of powers defined in the Constitution, if awarded, an
appropriation of approximately $103,000.00 from the FY11 Family Violence Prevention
fund (or other applicable accounts) for the implementation, negotiation, operation,
enforcement, procurement, settlement, and or completion of this contract, compact,
regulation or agreement by the Tribal Chairman or his designate IS HEREBY
AUTHORIZED.
