A RESOLUTION APPROVING THE CITIZEN POTAWATOMI NATION'S
PROPOSAL FOR A FISCAL YEAR 2013 CLEAN WATER ACT SECTION 106
TRIBAL WATER POLLUTION CONTROL GRANT THROUGH THE U.S.
ENVIRONMENTAL PROTECTION AGENCY
WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of
American Indians with Constitutional authority under the Act of
June 18, 1934 and the Oklahoma Indian Welfare Act of June 26,
1936, (49 Stat. 1967); and
WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are
inherent in Tribal tradition, derived from a history of organized self-
government since time immemorial, and recognized by treaties with
the United States and in the Constitution of the United States; and
WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution
provides for a separation of powers of the Tribal government by the
reservation and delegation of specific powers to other entities of the
Tribal government; and, except for these specific limitations, all
other general powers of government are embodied in the
Legislature's authority "to enact legislation, transact business, and
otherwise speak and act on behalf of the Citizen Potawatomi Nation
in all matters on which the Nation is empowered to act now or in the
future"; and
WHEREAS, the U.S. Environmental Protection Agency is soliciting proposals for
its Fiscal Year 2013 Clean Water Act Section 106 Tribal Water
Pollution Control grant and Section 106 grant funds may be used for
water quality planning and management activities; and
WHEREAS, the Citizen Potawatomi Nation is submitting a funding proposal for
$89,441.00 over a one-year period which includes the required 5%
tribal match; and

WHEREAS, the Citizen Potawatomi Nation will use grant funds to continue to
develop its water quality program by building tribal capacity to
conduct baseline water quality monitoring and assessments and
water resource planning.
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE
CITIZEN POTAWATOMI NATION, that a resolution approving the Nation's
proposal for a Clean Water Act Section 106 Tribal Water Pollution Control grant
NOW, THEREFORE, BE IT FURTHER RESOLVED, that by act of this resolution
and consistent with the separation of powers defined in the Constitution, if
awarded, an appropriation of $89,441.00 from the FY13 EPA Clean Water Act
Section 106 Tribal Water Pollution Control fund (or other applicable accounts) for
the implementation, negotiation, operation, enforcement, procurement, settlement,
and or completion of this contract, compact, regulation or agreement by the Tribal
Chairman or his designate IS HEREBY AUTHORIZED.
CERTIFICATION
The Legislature of the Citizen Potawatomi Nation hereby certifies that the above is
a true and exact copy of Resolution POTT # 14-01-NR, as approved on the 1st

develop capacity to support its environmental protection programs;

WHEREAS, proposed activities include training environmental staff, developing
environmental codes and ordinances, developing an underground
storage tank inspection program, and preparing an application to the
U.S. Environmental Protection Agency for a Clean Water Act Section
319 Tribal Nonpoint Source Pollution Control program.
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE
CITIZEN POTAWATOMI NATION, that a resolution approving the Nation's
proposal for an Indian General Assistance Program grant through the U.S.
Environmental Protection Agency IS HEREBY APPROVED.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that by act of this resolution
and consistent with the separation of powers defined in the Constitution, if
awarded, an appropriation of up to $128,000.00 from the FY13 EPA Indian
General Assistance Program fund and other applicable accounts for the
implementation, negotiation, operation, enforcement, procurement, settlement,
and/or completion of this contract, compact, regulation or agreement by the Tribal
Chairman or his designate IS HEREBY AUTHORIZED.

WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of American Indians
with Constitutional authority under the Act of June 18, 1934 and the Oklahoma
Indian Welfare Act of June 26, 1936, (49 Stat. 1967); and
WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in Tribal
tradition, derived from a history of organized self-government since time
immemorial, and recognized by treaties with the United States and in the
Constitution of the United States; and
WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution provides for a
separation of powers of the Tribal government by the reservation and delegation of
specific powers to other entities of the Tribal government; and, except for these
specific limitations, all other general powers of government are embodied in the
Legislature's authority "to enact legislation, transact business, and otherwise speak
and act on behalf of the Citizen Potawatomi Nation in all matters on which the
Nation is empowered to act now or in the future"; and
WHEREAS, the Citizen Potawatomi Nation is making application to the Southern Plains Regional
Office of the Bureau of Indian Affairs to request transfer of "fee-simple" title to the
"United States of America in Trust for the Citizen Potawatomi Nation"; and
WHEREAS, the Legislature believes that increasing the tribal land base furthers the pursuit of
Tribal Self Determination and allows future generations of tribal leaders to have the
flexibility to use the land for the health, welfare, and sovereignty of the Citizen
Potawatomi Nation; and
WHEREAS, Section 5 of the Indian Reorganization Act of June 18, 1934 (48 Stat. 985; 25 USC
465) provides authority for the Fee-to-Trust acquisition; and
WHEREAS, the property is ON-reservation or within the former reservation boundaries of the
Citizen Potawatomi Nation, legally described in Attachment A; and listed in the
Pottawatomie County Treasurer's records as parcel ID #0000-00-001-007-0-000-00,
parcel ID #2310-00-002-001-0-000-00, parcel ID #2310-00-003-005-0-000-00, parcel ID #2310-
00-003-038-0-000-00, parcel ID #2310-00-006-001-0-000-00, parcel ID #2310-00-006-003-0-000-

WHEREAS, the property was purchased with tribal funds for NON-gaming use, and the Citizen
Potawatomi Nation owns the surface rights to the property in fee simple, which is
not currently under lease; and
WHEREAS, the current land use is residential and agricultural. The proposed land use is cultural
and governmental and is necessary to facilitate tribal self-determination; and
WHEREAS, there are improvements with adequate ingress and egress for traffic and services; and
WHEREAS, the Citizen Potawatomi Nation agrees to indemnify and hold harmless the United
States, its agents and employees, against any lawsuits, loss, expense, and claim
potentially filed against the tribe for any damages relating to asbestos and lead-
based paint, if any, associated with the improvements located on the property
described in Attachment A; and
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN
POTAWATOMI NATION that a resolution supporting the Fee-to-Trust acquisition
application to the Southern Plains Regional Office of the Bureau of Indian Affairs
and trust acquisition of the Tibbets Property, IS HEREBY APPROVED.

CITIZEN POTAWATOMI NATION AND VIDEO GAMING TECHNOLOGIES, INC.

Nation and has need of additional games - with VGT games have been
identified as being popularly played games; and
WHEREAS, negotiated terms and conditions for the lease of 350 games and
related equipment and accessories as set forth in the attached
Agreement have been approved by both parties; and

WHEREAS, it is the intention of the Citizen Potawatomi Nation and VGT that
neither a proprietary interest in VGT nor a management agreement
as defined by the Indian Gaming Regulatory Act shall be created
under the Agreement;
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE
CITIZEN POTAWATOMI NATION, that a resolution approving a Lease Agreement
with Video Gaming Technologies, Inc. for 350 games and authorizing Tribal
Chairman, john A. Barrett to sign this Agreement and all future amendments,
modifications or changes to this Lease Agreement IS HEREBY APPROVED.

United States, its agents and employees, against any lawsuits, loss, expense,

WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of American
Indians with Constitutional authority under the Act of June 18, 1934 and

WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in
Tribal tradition, derived from a history of organized self-government since
time immemorial, and recognized by treaties with the United States and in
the Constitution of the United States; and
WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution provides
for a separation of powers of the Tribal government by the reservation and
delegation of specific powers to other entities of the Tribal government; and,
except for these specific limitations, all other general powers of government
are embodied in the Legislature's authority "to enact legislation, transact
business, and otherwise speak and act on behalf of the Citizen Potawatomi
Nation in all matters on which the Nation is empowered to act now or in the

WHEREAS, the Citizen Potawatomi Nation is a Member of the Indian Government in
Good Standing of the National Congress of American Indians and meets all
requirements for Tribal membership, pursuant to Article II, Section IIA of
the Constitution of the National Congress of American Indians (NCAI);
WHEREAS, based on the tribal citizenry, the Nation shall have 180 votes according to
Article II, Section 6C of the NCAI Constitution and By-Laws;
NOW THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN
POTAWATOMI NATION, that pursuant to Article III, section 2 of the NCAI Constitution,

WHEREAS, the Citizen Potawatomi Nation is an eligible applicant with a current Hazard
Mitigation plan that identifies tornadoes as a high priority hazard due to the
potential loss of life and destruction of property caused by high winds
resulting from frequent tornadoes; and
WHEREAS, the proposed Tribal Community Safe Room construction project will mitigate
the potential loss of life and property damage within the Citizen Potawatomi
Nation resulting from tornadoes by providing safe and secure shelter during
a tornado event; and

WHEREAS, the proposed site of the Tribal Community Safe Room construction project
is the Grand complex location and an engineering feasibility study has been
completed that shows the project is feasible and has the potential to reduce
or eliminate loss of life in highly populated areas of tribal lands; and
WHEREAS, there is a 25% non-Federal cost share requirement, cash or in-kind, for
which the Citizen Potawatomi Nation will contribute up to $626,388, with
the Federal share up to $1,879,164 for a total project cost up to
$2,505,552.
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN
POTAWATOMI NATION that a resolution authorizing a funding request to the Federal
Emergency Management Agency's FY 2013 Pre Disaster Mitigation Program for the
Community Safe Room project IS HEREBY APPROVED.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that by act of this resolution and

II or Class III gaming shall be allowed at any location unless a
separate license is issued by the Gaming Commission upon approval
by the Legislature for such site."; and

cost not to exceed $375,000 per year of which up to $300,000 is the
Federal share, and up to $75,000 is the non-Federal share; and

to provide care to Native American elders and Native American elder
caregivers and has participated in the Title VI Program Part A for the past
32 years, since 1981, and Part C for the past 13 years as one of the first

including congregate and home-delivered meals, information, and
transportation, as well as caregiver support services including support

Land Buy-Back Program to administer the outreach, land research, and
valuation efforts over a one year project period; and

Complex Child Development Center building in Shawnee, Oklahoma under
Public Facilities and Improvement Projects; and
WHEREAS, the Child Development Center will meet an essential community need by
providing childcare assistance to low-to-moderate income beneficiaries; and
WHEREAS, a public meeting notice will be published and held in 2014 to solicit
comments from Tribal and community members regarding the proposed
submission of the community development project pursuant to citizen
participation requirements as set forth in 24 CFR 1003.604; and

WHEREAS, the Grand Complex Child Development Center will be constructed following

Complex Child Development Center construction project is 2 years, with a
total project cost of $1,350,000, of which $800,000 (or 60%) is the Federal

WHEREAS, the Citizen Potawatomi Nation has adopted an operation and maintenance
plan and commits the necessary funding as referenced within the Letter of
Commitment provided by the Childcare Development Program for facility
upkeep; and
WHEREAS, tribal leverage will consist of $445,000 cash and a parking lot valued at
$105,000.

Assistance Solicitation (CTAS) has announced the availability of grant funds
to improve Tribal law enforcement and justice systems with the stipulation
that these funds are available for a variety of specified purposes as outlined
in ten "Purpose Areas"; and
WHEREAS, the Citizen Potawatomi Nation is eligible for and desires to apply for funding
under the two following three-year project Purpose Areas: Purpose Area 1,

department as well as additional vehicles for an estimated cost of $500,000;
and
WHEREAS, under Purpose Area 3, the Citizen Potawatomi Nation is proposing to
enhance ongoing direct services provided by The CPN Reentry Program,
which helps Native American offenders reintegrate successfully into society
after incarceration, with an estimated cost of up to $750,000; and
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN
POTAWATOMI NATION that a resolution supporting the Citizen Potawatomi Nation's
grant application for funding under the United States Department of Justice's Coordinated

substance abuse offenders who would otherwise serve only a portion of
their sentences and be released back into society to offend again because
the root cause of their behavior, substance abuse, has not been addressed;
and
WHEREAS, the high incidence of crimes that directly involve alcohol and drugs is
intolerable and unacceptable to the Citizen Potawatomi Nation; and

WHEREAS, to combat this, the Citizen Potawatomi Nation is submitting an application
to the U.S. Department of Justice, Substance Abuse and Mental Health

defendants convicted of alcohol and drug related offenses; and
WHEREAS, ultimately the offender must answer for his own actions, either in the form
of continued judicial supervision until the program is successfully
completed or in retribution should the offender fail to live up to his end of
the agreement; and
WHEREAS, the project period for the proposed Citizen Potawatomi Nation Adult Tribal
Healing to Wellness Court project is three years, with a total project cost not
to exceed $300,000 per year; and
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN
POTAWATOMI NATION that a resolution authorizing and supporting the Citizen
Potawatomi Nation's Substance Abuse and Mental Health Services Administration

WHEREAS, the CPN proposes to create the Wildlife Warriors project, which will allow
the CPN Eagle Aviary to collaborate with the CPN Cultural Mentorship
Program to install an eagle nest camera and give kid-friendly presentations
about wildlife conservation to youth ages 3-12 at the CPN Child
Development Center; and

550 Native Americans who have been diagnosed with diabetes; and
WHEREAS, the Citizen Potawatomi Nation proposes to provide a Healthy Heart Program
aimed at cardiovascular disease risk reduction in Native Americans with
diabetes through intensive activities including case management, disease
management, and self-management education; and

A RESOLUTION APPROVING A FEE-TO-TRUST ACQUISITION APPLICATION TO THE
BUREAU OF INDIAN AFFAIRS AND REQUEST FOR TRUST ACQUISITION OF THE
(NON-GAMING/ON RESERVATION) CULLISON PROPERTY
WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of American
Indians with Constitutional authority under the Act of June 18, 1934 and
the Oklahoma Indian Welfare Act of June 26, 1936, (49 Stat. 1967); and
WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in
Tribal tradition, derived from a history of organized self-government since
time immemorial, and recognized by treaties with the United States and in
the Constitution of the United States; and
WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution provides
for a separation of powers of the Tribal government by the reservation and
delegation of specific powers to other entities of the Tribal government; and,
except for these specific limitations, all other general powers of government
are embodied in the Legislature's authority "to enact legislation, transact
business, and otherwise speak and act on behalf of the Citizen Potawatomi
Nation in all matters on which the Nation is empowered to act now or in the
future"; and
WHEREAS, the Citizen Potawatomi Nation is making application to the Southern Plains
Regional Office of the Bureau of Indian Affairs to request transfer of "fee-
simple" title to the "United States of America in Trust for the Citizen
Potawatomi Nation"; and
WHEREAS, Section 5 of the Indian Reorganization Act of June 18, 1934 (48 Stat. 985;
25 USC 465) provides authority for the Fee-to-Trust acquisition; and
WHEREAS, the property is ON-reservation or within the former reservation boundaries
of the Citizen Potawatomi Nation, legally described in Attachment A; and
listed in the Pottawatomie County Treasurer's records as parcel ID
#0405-00-001-010-0-000-00 (Cullison tract); and

WHEREAS, the property was purchased with tribal funds for NON-gaming use; and the
Citizen Potawatomi Nation owns the surface rights to the property in fee
simple, which is currently not under lease; and
WHEREAS, the current and proposed land use is Indian housing, and is necessary to
facilitate tribal self-determination; and
WHEREAS, there are improvements with adequate ingress and egress for traffic and
services.
WHEREAS, the Citizen Potawatomi Nation agrees to indemnify and hold harmless the
United States, its agents and employees, against any lawsuits, loss, expense,
and claim potentially filed against the tribe for any damages relating to
asbestos and lead-based paint, if any, associated with the improvements
located on the property described in Attachment A;
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN

TRIBAL HOMELAND SECURITY GRANT PROGRAM AND AUTHORIZING THE
IMPLEMENTATION THEREOF, IF AWARDED
WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of American
Indians with Constitutional authority under the Act of June 18, 1934 and
the Oklahoma Indian Welfare Act of June 26, 1936, (49 Stat. 1967); and
WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in
Tribal tradition, derived from a history of organized self-government since
time immemorial, and recognized by treaties with the United States and in
the Constitution of the United States; and
WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution provides

Management Agency (FEMA), through their Tribal Homeland Security Grant
Program, have announced availability of Fiscal Year 2014 funds to support
the building, sustainment, and delivery of core capabilities to enable Tribes
to strengthen their capacity to prevent, protect against, mitigate, respond to,
and recover from potential terrorist attacks and other hazards; and
WHEREAS, the Citizen Potawatomi Nation proposes to create the East-Central Oklahoma
Emergency Communications Network (ECOECN), which will allow the CPN
Police Department to collaborate with CPN Emergency Management to
develop a communications network and provide reliable communications
capacity to a consortium of local agencies; and

WHEREAS, the ECOECN will ultimately establish communication capabilities sufficient
to permit federal, state, local and tribal agencies to mobilize a Command,
Control and Communications post to coordinate a response in the event of
a disaster or threat; and
WHEREAS, there is no non-Federal cash cost share requirement on behalf of the Citizen
Potawatomi Nation.
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN
POTAWATOMI NATION that a resolution supporting the Citizen Potawatomi Nation's
application to the U.S. Department of Homeland Security for funding an emergency
communications network IS HEREBY APPROVED.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that by act of this resolution and
consistent with the powers of separation defined in the Constitution, if awarded, an
appropriation of up to $5,000,000 from the fy 2014 Tribal Homeland Security (or other
applicable account) for the implementation, negotiation, operation, enforcement,
procurement, settlement and/or completion of this contract, compact, regulation or
agreement by the Tribal Chairman or his designate IS HEREBY AUTHORIZED.

WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in

time immemorial, and recognized by treaties with the United States and in
the Constitution of the United States; and
WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution provides

delegation of specific powers to other entities of the Tribal government; and,

and to perform all activities outlined under the grant application program
and to perform all activities proposed under the grant application; and
WHEREAS, the proposed project period is one-year with a total cost of $75,000 including
a cash match of 51% ($38,250) that will be provided by the Tribe at the
start of the project for budgeted line items including consultants; and

NOW THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN
POTAWATOMI NATION, that a resolution supporting the Citizen Potawatomi Nation's

authorizing Tribal Chairman John A. Barrett, Vice Chairman Linda Capps and/or
Secretary-Treasurer D. Wayne Trousdale to execute and sign all documents prepared in
connection with the grant application on behalf of the Citizen Potawatomi Nation IS
HEREBY APPROVED.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that by act of this resolution and
consistent with the separation of powers defined in the Constitution, if awarded, an
appropriation of up to $75,000 from the FY 2015 USDA RBOG fund (or other
