Finding AidCITIZEN POTAWATOMI NATION RESOLUTION # 15-01-J&PS A RESOLUTION SUPPORTING THE CITIZEN POTAWATOMI NATION'S CONSERVATION LAW ENFORCEMENT OFFICER APPLICATION FOR FUNDING THROUGH THE BUREAU OF INDIAN AFFAIRS FY 2014 CONSERVATION LAW ENFORCEMENT OFFICER PROGRAM AND AUTHORIZING THE IMPLEMENTATION THEREOF, IF AWARDED WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of American Indians with Constitutional authority under the Act of June 18, 1934 and the Oklahoma Indian Welfare Act of June 26, 1936, (49 Stat. 1967); and WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in Tribal tradition, derived from a history of organized self-government since time immemorial, and recognized by treaties with the United States and in the Constitution of the United States; and WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution provides for a separation of powers of the Tribal government by the reservation and delegation of specific powers to other entities of the Tribal government; and, except for these specific limitations, all other general powers of government are embodied in the Legislature's authority "to enact legislation, transact business, and otherwise speak and act on behalf of the Citizen Potawatomi Nation in all matters on which the Nation is empowered to act now or in the future"; and WHEREAS, the Bureau of Indian Affairs (BIA), through its Conservation Law Enforcement Officer (CLEO) program, has announced availability of Fiscal Year 2014 funds to provide base salary funding to increase CLEO presence on Indian lands for the protection, conservation and enhancement of Indian fish, wildlife and associated natural resources; and WHEREAS, the CPN proposes to create one CLEO position in order to provide for the protection of CPN tribal natural resources where the Tribe has jurisdiction and enforceable game codes; and WHEREAS, the CLEO will ultimately fill the law enforcement gap that currently exists for natural resource protection and conservation at the CPN; and RESOLUTION # 15-01-J&PS PAGE # 2 CITIZEN POTAWATOMI NATION WHEREAS, there is no non-Federal cash cost share requirement required by the Citizen Potawatomi Nation. NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN POTAWATOMI NATION that a resolution supporting the Citizen Potawatomi Nation's Conservation Law Enforcement Officer application for funding through the Bureau of Indian Affairs fy 2014 Conservation Law Enforcement Officer Program IS HEREBY APPROVED. NOW, THEREFORE, BE IT FURTHER RESOLVED, that by act of this resolution and consistent with the separation of powers defined in the Constitution, if awarded, an appropriation of up to $47,000 for up to five years from the Fy 2014 Conservation Law Enforcement Officer fund (or other applicable accounts) for the implementation, negotiation, operation, enforcement, procurement, settlement, and or completion of this contract, compact, regulation or agreement by the Tribal Chairman or his designate IS HEREBY AUTHORIZED. Barrett Tribal Chairman CITIZEN POTAWATOMI NATION RESOLUTION # 15-02-J&PS A RESOLUTION AUTHORIZING AND SUPPORTING THE FY 2014 FAMILY VIOLENCE PREVENTION SERVICES GRANT APPLICATION TO THE UNITED STATES DEPARTMENT OF HEALTH AND HUMAN SERVICES' ADMINISTRATION FOR CHILDREN AND FAMILIES. WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of American Indians with Constitutional authority under the Act of June 18, 1934 and the Oklahoma Indian Welfare Act of June 26, 1936, (49 Stat. 1967); and WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in Tribal tradition, derived from a history of organized self-government since time immemorial, and recognized by treaties with the United States and in the Constitution of the United States; and WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution provides for a separation of powers of the Tribal government by the reservation and delegation of specific powers to other entities of the Tribal government; and, except for these specific limitations, all other general powers of government are embodied in the Legislature's authority "to enact legislation, transact business, and otherwise speak and act on behalf of the Citizen Potawatomi Nation in all matters on which the Nation is empowered to act now or in the future"; and WHEREAS, the Citizen Potawatomi Nation Indian Child Welfare program has operated a Family Violence Prevention Services formula grant for many years and has developed a professional working relationship with the office of Community Services within the Administration for Children and Families; and WHEREAS, the Citizen Potawatomi Nation Indian Child Welfare program will contract with Project Safe, Unzner Center, Family Resource Center and Citizen Potawatomi Nation Tribal Police to provide auxiliary services to victims of family violence and their dependents; and WHEREAS, the goals of the Family Violence component of the Indian Child Welfare program are to provide immediate shelter and related assistance to victims of family violence and to expand efforts to prevent family violence; and RESOLUTION # 15-02-J&PS PAGE # 2 CITIZEN POTAWATOMI NATION WHEREAS, these goals will be met if funding is received from the Administration for Children and Families as a result of this grant application. NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN POTAWATOMI NATION that a resolution supporting the Fy 2014 Family Violence Prevention Services grant application to the United States Department of Health and Human Services' Administration for Children and Families IS HEREBY APPROVED. Barrett Tribal Chairman CITIZEN POTAWATOMI NATION RESOLUTION # 15-03-TC&A A RESOLUTION AUTHORIZING THE CITIZEN POTAWATOMI NATION'S APPLICATION FOR FUNDING UNDER THE FISCAL YEAR 2014 INSTITUTE OF MUSEUM AND LIBRARY SERVICES NATIVE AMERICAN LIBRARY ENHANCEMENT GRANT PROGRAM WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of American Indians with Constitutional authority under the Act of June 18, 1934 and the Oklahoma Indian Welfare Act of June 26, 1936, (49 Stat. 1967); and WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in Tribal tradition, derived from a history of organized self- government since time immemorial, and recognized by treaties with the United States and in the Constitution of the United States; and WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution provides for a separation of powers of the Tribal government by the reservation and delegation of specific powers to other entities of the Tribal government; and, except for these specific limitations, all other general powers of government are embodied in the Legislature's authority "to enact legislation, transact business, and otherwise speak and act on behalf of the Citizen Potawatomi Nation in all matters on which the Nation is empowered to act now or in the future"; and WHEREAS, the Institute of Museum and Library Services has allocated Fiscal Year 2014 funds for the implementation of certain projects which provide enhanced care and access to Native American library holdings; and WHEREAS, the Citizen Potawatomi Nation Cultural Heritage Center Library holds unique tape media concerning tribal history and Potawatomi language that is too fragile for everyday use; and RESOLUTION # 15-03-TC&A PAGE # 2 CITIZEN POTAWATOMI NATION WHEREAS, the membership of the Citizen Potawatomi Nation would benefit greatly from the digitization and in-library availability of these materials; and WHEREAS, there is no non-Federal cash cost share required by the Citizen Potawatomi Nation; NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN POTAWATOMI NATION, that a resolution authorizing and supporting the Nation's application for funding under the FY 2014 IMLS Native American Library Enhancement Program IS HEREBY APPROVED. In addition, the combined 5 county rate within the tribal service area was 16.4%, indicating a severe and unacceptable issue within the tribal community; and WHEREAS, the Citizen Potawatomi Nation Tribal Youth Program proposes to submit a grant application with three overarching goals: (1) To enhance community prevention services, including education, surveillance and data collection and evaluation by partnering with clinical counterparts; (2) Create a supportive environment that promotes awareness and builds support for public dialogue while also encouraging healthy and empowered individuals, families and communities to prevent suicidal tendencies or other destructive life choices; and (3) Develop, improve, and implement life skills education and suicide prevention strategies within the targeted population (youth ages 10-24) to reduce associated risks within the community; and WHEREAS, the proposed program will allow our tribal community to support youth and young adults as they transition into adulthood by facilitating strong connections to family and culture through collaborations with tribal and community counseling and treatment agencies; and WHEREAS, the Tribal Youth Program will also engage communities by partnering with local public schools and colleges to provide education/training, substance abuse education and also address other mitigating factors that may lead to suicide risks; and WHEREAS, the Citizen Potawatomi Nation TYP program is seeking funding up to the amount of $200,000 for Year 1, which is designated as a planning year. Upon successful completion of objectives, proposals can be submitted for up to $200,000 per year for Years 2-5; and WHEREAS, there is no non-Federal cash cost share required by the Citizen Potawatomi Nation. NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN POTAWATOMI NATION that a resolution authorizing and supporting the Citizen Potawatomi Nation's application for funding to the American Red Cross Oklahoma Tornadoes Grant program IS HEREBY APPROVED. NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN POTAWATOMI NATION that a resolution authorizing and supporting the Citizen Potawatomi Nation's BIA Invasive Wildlife Program application for funding under FY 2015 entitled "Invasive Wildlife Eradication" IS HEREBY APPROVED. Barrett Tribal Chairman CITIZEN POTAWATOMI NATION RESOLUTION # 15-76-HHS A RESOLUTION SUPPORTING AN INCREASE IN FUNDING FOR THE CITIZEN POTAWATOMI NATION'S SANITATION FACILITIES CONSTRUCTION PROGRAM, P.L. 86-121 FOR SCATTERED EXISTING HOMES OFFERED THROUGH THE U.S. INDIAN HEALTH SERVICE (PROJECT OK 15-U04) WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of American Indians with Constitutional authority under the Oklahoma Indian Welfare Act of June 26, 1936, (49 Stat. 1967) and the Oklahoma Indian Welfare Act of June 26, 1936, (40 Stat. 1967); and WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in Tribal tradition, derived from a history of organized self-government since time immemorial, and recognized by treaties with the United States and in the Constitution of the United States; and WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution provides for a separation of powers of the Tribal government by the reservation and delegation of specific powers to other entities of the Tribal government; and, except for these specific limitations, all other general powers of government are embodied in the Legislature's authority "to enact legislation, transact business, and otherwise speak and act on behalf of the Citizen Potawatomi Nation in all matters on which the Nation is empowered to act now or in the future"; and WHEREAS, the Citizen Potawatomi Nation is submitting a Project Scope entitled "CPN/Scattered Existing Water & Sewer" to the U.S. Indian Health Service (IHS) under the office of Environmental Health Sanitation Facilities Construction Branch under the authority of P.L. 86-121 for the construction of sanitation facilities; and RESOLUTION # 15-76-HHS PAGE # 2 CITIZEN POTAWATOMI NATION WHEREAS, IHS will provide the funds in the amount of $316,849.00 and the Citizen Potawatomi Nation agrees to provide $3,201.00 in matching funds for the design and construction of sanitation facilities under the provisions of the Self-Governance Compact that became effective on October 1, 1998. The total cost for providing sanitation facilities to 51 homes is $320,050.00 NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN POTAWATOMI NATION, that a resolution supporting the entire project for construction of sanitation facilities as provided by the provisions of the Citizen Potawatomi Nation's Self Governance Compact with IHS/DHHS effective on October 1, 1998 and the multi-year funding agreement for 2013-2017 (MFA) with the I.H.S/DHHS executed by these parties and effective in May, 2012 IS HEREBY APPROVED. NOW, THEREFORE, BE IT FURTHER RESOLVED, that by act of this resolution and consistent with the separation of powers defined in the Constitution, an appropriation of $ 320,050.00 from the Office of Environmental Health (or other applicable accounts) for the implementation, negotiation, operation, enforcement, procurement, settlement, and or completion of this contract, compact, regulation or agreement by the Tribal Chairman or his designate IS HEREBY AUTHORIZED. The total cost for providing sanitation facilities to 25 homes is $225,425.00. NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN POTAWATOMI NATION, that a resolution supporting the "Citizen Potawatomi Nation's Fiscal Year 2016 Diabetes Grant - Year 19" proposal to the Indian Health Service under the Special Diabetes Program for Indians, IS HEREBY APPROVED. NOW, THEREFORE, BE IT FURTHER RESOLVED, that by act of this resolution and consistent with the separation of powers defined in the Constitution, if awarded, an appropriation up to $626,735.00 from the Indian Health Service fund (or other applicable accounts) for the implementation, negotiation, operation, enforcement, procurement, settlement, and or completion of this contract, compact, regulation or agreement by the Tribal Chairman or his designate IS HEREBY AUTHORIZED. WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of American Indians with Constitutional authority under the Act of June 18, 1934 and the Oklahoma Indian Welfare Act of June 26, 1936, (49 Stat. 1967); and WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in Tribal tradition, derived from a history of organized self-government since time immemorial, and recognized by treaties with the United States and in the Constitution of the United States; and WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution provides for a separation of powers of the Tribal government by the reservation and delegation of specific powers to other entities of the Tribal government; and, except for these specific limitations, all other general powers of government are embodied in the Legislature's authority "to enact legislation, transact business, and otherwise speak and act on behalf of the Citizen Potawatomi Nation in all matters on which the Nation is empowered to act now or in the future"; and WHEREAS, the Indian Health Service is accepting applications for FY 2015 competitive cooperative agreement funding directed at Healthy Heart and Diabetes Prevention Initiatives; and WHEREAS, the Citizen Potawatomi Nation has implemented a community directed diabetes program for seventeen years and provides care for approximately 550 Native Americans who have been diagnosed with diabetes; and WHEREAS, the Citizen Potawatomi Nation proposes to provide a Healthy Heart Program aimed at cardiovascular disease risk reduction in Native Americans with diabetes through intensive activities including case management, disease management, and self-management education; and RESOLUTION # 15-79-HHS PAGE # 2 CITIZEN POTAWATOMI NATION WHEREAS, the Citizen Potawatomi Nation also proposes less intensive community awareness activities such as health fairs, exercise challenges, and competitions for those at risk for cardiovascular disease; and WHEREAS, the Citizen Potawatomi Nation can apply for base funding of $324,300 for a 2 year project period with no matching funds or in-kind services required. NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN POTAWATOMI NATION that a resolution authorizing and supporting the "Citizen Potawatomi Nation's Fiscal Year 2015 Competitive Diabetes Healthy Heart Initiative Application to the Indian Health Service under the Special Diabetes Program for Indians IS HEREBY APPROVED. NOW, THEREFORE, BE IT FURTHER RESOLVED, that by act of this resolution and consistent with the separation of powers defined in the Constitution, if awarded, an appropriation of federal funds of $324,300.00 from the Indian Health Service fund (or other applicable accounts) for the implementation, negotiation, operation, enforcement, procurement, settlement, and or completion of this contract, compact, regulation or agreement by the Tribal Chairman or his designate IS HEREBY AUTHORIZED.
