RESOLUTION # 16-01-HHS
A RESOLUTION APPROVING A MEMORANDUM OF UNDERSTANDING
BETWEEN THE CITIZEN POTAWATOMI NATION AND AMERIND RISK
MANAGEMENT CORPORATION FOR AN OFFERING OF PROPERTY AND
CASUALTY INSURANCE PRODUCTS TO PERSONS RESIDING WITHIN THE
RESERVATION BOUNDARIES OF THE CITIZEN POTAWATOMI NATION.
WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of
American Indians with Constitutional authority under the Act of
June 18, 1934 and the Oklahoma Indian Welfare Act of June 26,
1936, (49 Stat. 1967); and
WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are
inherent in Tribal tradition, derived from a history of organized self-
government since time immemorial, and recognized by treaties with
the United States and in the Constitution of the United States; and
WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution
provides for a separation of powers of the Tribal government by the
reservation and delegation of specific powers to other entities of the
Tribal government; and, except for these specific limitations, all
other general powers of government are embodied in the
Legislature's authority "to enact legislation, transact business, and
otherwise speak and act on behalf of the Citizen Potawatomi Nation
in all matters on which the Nation is empowered to act now or in the
future"; and
WHEREAS, many of those residing within the boundaries of the Citizen
Potawatomi Nation tribal jurisdiction are underserved by the
insurance industry in regard to property and casualty products; and

WHEREAS, the Citizen Potawatomi Nation wishes to improve access to affordable
property and casualty insurance for those citizens residing within the
boundaries of its jurisdiction; and
WHEREAS, the Citizen Potawatomi Nation is an equity member, in good standing,
of the AMERIND Risk Management, a sovereign 25 USC Subsection
477, Section 17 corporation providing modestly prices insurance for
home owners and renters for property and casualty coverage; and
WHEREAS, AMERIND will offer insurance plans and bind coverage with
individual members of the Nations who reside within the Citizen
Potawatomi Nation jurisdiction to protect the health, safety and
welfare of tribal citizens.
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE
CITIZEN POTAWATOMI NATION that a resolution approving a memorandum of
understanding between the Citizen Potawatomi Nation and AMERIND Risk
Management IS HEREBY APPROVED.

A RESOLUTION AUTHORIZING AND ACCEPTING THE PROPOSED SETTLEMENT

WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution provides

delegation of specific powers to other entities of the Tribal government; and,
except for these specific limitations, all other general powers of government
are embodied in the Legislature's authority "to enact legislation, transact
business, and otherwise speak and act on behalf of the Citizen Potawatomi
Nation in all matters on which the Nation is empowered to act now or in the
future"; and
WHEREAS, the Citizen Potawatomi Nation ("Nation") entered into a retainer agreement
with the Law Firm of Greer, Russell, Dent & Leathers, PLLC (Greer Law
Firm) to participate in an Avandia related tort claim against Glaxco-Smith-
Kline, LLC and pursue all related claims: and
WHEREAS, the Legislature of the Citizen Potawatomi Nation has been made aware of a
proposed Settlement Agreement ("Agreement") which under Paragraph Six,
requires that the Nation represent it has had the assistance of legal counsel,
the Greer Law Firm, in negotiation, review and execution of the settlement
Agreement as well in understanding the legal significance and approval of the
Settlement Agreement as well as the dismissal of the lawsuit; and
WHEREAS, with the assistance of its legal counsel, the Citizen Potawatomi Nation has
discussed the Settlement Agreement as required under Paragraph Six,
including the scope of the settlement, the indemnification requirements, the

waiver of sovereign immunity and the confidentiality of the settlement terms;
and
WHEREAS, the Legislature of the Citizen Potawatomi Nation acknowledges that the
Settlement Agreement includes a waiver of the Nation's sovereign immunity
and/or exhaustion of Tribal court remedies in response to any claim by
Glaxco-Smith-Kline, LLC as stipulated in Paragraph Ten of the Settlement
Agreement.
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN
POTAWATOMI NATION that a resolution authorizing and accepting the proposed
Settlement Agreement as being in the best interest of the Nation IS HEREBY APPROVED.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that by act of this resolution and
consistent with the separation of powers defined in the Constitution, if awarded, an
appropriation of $589,787.50 from the Glaxco-Smith-Kline Settlement fund (or other
applicable accounts) for the implementation, negotiation, operation, enforcement,
procurement, settlement, and or completion of this contract, compact, regulation or
agreement by the Tribal Chairman or his designate IS HEREBY AUTHORIZED.

A RESOLUTION APPROVING MEMBERSHIP INTO THE UNITED INDIAN NATIONS OF
OKLAHOMA, KANSAS AND TEXAS (UNIOKT) FOR THE CITIZEN POTAWATOMI
NATION, CONFIRMING DELEGATES AND AUTHORIZING PAYMENT OF
MEMBERSHIP DUES.
WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of American
Indians with Constitutional authority under the Act of June 18, 1934 and
the Oklahoma Indian Welfare Act of June 26, 1936, (49 Stat. 1967); and
WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in
Tribal tradition, derived from a history of organized self-government since
time immemorial, and recognized by treaties with the United States and in
the Constitution of the United States; and
WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution provides
for a separation of powers of the Tribal government by the reservation and
delegation of specific powers to other entities of the Tribal government; and,
except for these specific limitations, all other general powers of government
are embodied in the Legislature's authority "to enact legislation, transact
business, and otherwise speak and act on behalf of the Citizen Potawatomi
Nation in all matters on which the Nation is empowered to act now or in the
future"; and
WHEREAS, the United Indian Nations of Oklahoma, Kansas and Texas (UNIOKT) is a
voluntary association of federally recognized Indian Nations whose purpose
is to foster a cooperative relationship among the Tribes and their
representatives in regard to policy development, economic development.
Healthcare, compacting, gaming and taxation; and
WHEREAS, UNIOKT also promotes regulatory standards, methods of operation,
educational seminars and the exchange of information and ideas for the
mutual benefit of all members;

WHEREAS, as a member of UNIOKT, the Citizen Potawatomi Nation will receive all
publications, meeting notices and action alerts on all meetings and
seminars; and
WHEREAS, as the principal elected officials of the Citizen Potawatomi Nation charged
with the day-to-day operations of the Nation, Chairman John A. Barrett
shall be the Delegate and Vice Chairman Linda Capps shall be the Alternate
Delegate to represent the interest of the Citizen Potawatomi Nation. Such
designation shall remain in full force and effect until subsequent notice is
issued.
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN
POTAWATOMI NATION that a resolution approving membership in the United Indian
Nations of Oklahoma, Kansas and Texas; authorizing Chairman John A. Barrett and Vice
Chairman Linda Capps as delegate and alternate delegate; and authorizing payment of
membership dues IS HEREBY APPROVED.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that by act of this resolution and
consistent with the separation of powers defined in the Constitution, if awarded, an
appropriation of $ 2,000 from the CPN General Account (or other applicable accounts) for
the implementation, negotiation, operation, enforcement, procurement, settlement, and or
completion of this contract, compact, regulation or agreement by the Tribal Chairman or

A RESOLUTION APPROVING TRANSPORTATION FOR TRIBAL MEMBERS TO

WHEREAS, the Citizen Potawatomi Nation desires to show their support of the
22nd Annual Potawatomi Traditional Gathering hosted by the Forest
County Potawatomi in Carter, Wisconsin; and
WHEREAS, this Gathering will be held August 13th through 16th , 2015 and will
provide traditional teachings and cultural activities; and

WHEREAS, the Citizen Potawatomi Nation desires to provide transportation to
and from this Gathering in an effort to encourage participation by
tribal members; and
WHEREAS, the Citizen Potawatomi Nation also realizes the expenses related to an
undertaking of this magnitude and desires to offer support to the
hosting tribe.
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE
CITIZEN POTAWATOMI NATION, that a resolution approving the chartering of a
bus to transport tribal members to the 22nd Annual Potawatomi Traditional
Gathering and a monetary donation IS HEREBY APPROVED.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that by act of this resolution
and consistent with the separation of powers defined in the Constitution, if
awarded, an appropriation up to $20,000 from the General Account (or other
applicable accounts) for the implementation, negotiation, operation, enforcement,
procurement, settlement, and or completion of this contract, compact, regulation
or agreement by the Tribal Chairman or his designate IS HEREBY AUTHORIZED.

DOMESTIC VIOLENCE PREVENTION INITIATIVE (DVPI) PROGRAM
WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of
American Indians with Constitutional authority under the Act of
June 18, 1934 and the Oklahoma Indian Welfare Act of June 26,
1936, (49 Stat. 1967); and
WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are
inherent in Tribal tradition, derived from a history of organized self-
government since time immemorial, and recognized by treaties with
the United States and in the Constitution of the United States; and
WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution
provides for a separation of powers of the Tribal government by the
reservation and delegation of specific powers to other entities of the
Tribal government; and, except for these specific limitations, all
other general powers of government are embodied in the
Legislature's authority "to enact legislation, transact business, and
otherwise speak and act on behalf of the Citizen Potawatomi Nation
in all matters on which the Nation is empowered to act now or in the
future"; and
WHEREAS, domestic violence is a significant societal problem and the incidence
of domestic violence is at an all-time high; and
WHEREAS, the Indian Health Service is soliciting applications for funding
initiatives of domestic violence prevention with a three-year funding
term; and

WHEREAS, the program will emphasize practice-based community outreach and
education programs, including advocacy to provide victims increased
access to services in the community, and collaborative interventions
between legal and human services resulting in a coordinated response
to domestic violence; and
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE
CITIZEN POTAWATOMI NATION that a resolution supporting the request to the
Indian Health Services for funding of the Domestic Violence Prevention Initiative
program IS HEREBY APPROVED.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that by act of this resolution and
consistent with the separation of powers defined in the Constitution, if awarded, an
appropriation of up to $185,000 in IHS competitive funding from the Domestic Violence
Prevention Initiative fund (or other applicable accounts) for the implementation,
negotiation, operation, enforcement, procurement, settlement, and or completion of this
contract, compact, regulation or agreement by the Tribal Chairman or his designate IS
HEREBY AUTHORIZED.

WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of

WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are

incidence of teen suicide is at an all-time high; and
WHEREAS, the Indian Health Service is soliciting applications for funding of
initiatives for suicide prevention and behavioral issues associated
with methamphetamine use'; and

development such as self-control, emotional awareness,

CITIZEN POTAWATOMI NATION that a resolution supporting the Youth
Methamphetamine/Suicide Education and Prevention program IS HEREBY

purpose of financing qualified projects to Native American businesses.
WHEREAS, Citizen Potawatomi Nation guarantees repayment of 100% of all principal,
interest, and Call Premium, if any, owed to the Qualified Issuer associated
with the 2015 CDFI Bond Guarantee Loan to CPCDC for a term of up to
29.5 years. Payment under the Guarantee will be made upon presentment
of evidence from the Master Servicer Trustee of a Payment Default by
CPCDC as defined in the Bond Loan Agreement.

WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution provides
for a separation of powers of the Tribal government by the reservation and
delegation of specific powers to other entities of the Tribal government; and,
except for these specific limitations, all other general powers of government
are embodied in the Legislature's authority "to enact legislation, transact
business, and otherwise speak and act on behalf of the Citizen Potawatomi
Nation in all matters on which the Nation is empowered to act now or in the

WHEREAS, 24 CFR Part 58.2(a)(7)(ii), states the Indian Nation, in this case the Citizen
Potawatomi Nation, "is the responsible entity, whether or not a Tribally
Designated Housing Entity is authorized to receive grant funds on behalf of
the tribe". Per 24 CFR Part 58.4(a) the responsible entity shall assume
responsibilities for: Environmental Reviews, Environmental Decision-Making
and Environmental Action; and
WHEREAS, 24 CFR Part 58.10 and 58.12 further state the responsible entity must
comply with the provisions of NEAP and 24 CFR Part 58 and develop
technical and administrative capacity for the Environmental Reviews: and

paperwork and accounting procedures and provide flexible spending under the
combined grants; and
WHEREAS, if awarded, funds will be used to enhance tribal program capacity in various
environmental media including surface water, solid and hazardous waste, climate
change, and underground storage tanks through training and technical assistance,
monitoring, and assessment activities.

Assistance Solicitation (CTAS) has announced the availability of
grant funds to improve Tribal law enforcement and justice systems

specified purposes as outlined in ten "Purpose Areas"; and
WHEREAS, the Citizen Potawatomi Nation is eligible for and desires to apply for
funding under the four following three-year project Purpose Areas:
Purpose Area 1 , "Public Safety and Community Policing;" Purpose
Area 3, "Justice Systems and Alcohol and Substance Abuse";
Purpose Area 5, "Violence Against Women"; and Purpose Area 9,
"Tribal Youth"; and
WHEREAS, under Purpose Area 1, Citizen Potawatomi Nation is proposing the
purchase of additional vehicles for the Tribal Police department with
an estimated cost of $500,000; and
WHEREAS, under Purpose Area 3, the Citizen Potawatomi Nation is proposing to
enhance ongoing direct services provided by the CPN Family Drug
Court, which treats Native American clients experiencing drug and/or
alcohol issues with an estimated cost up to $750,000; and
WHEREAS, under Purpose Area 5, the Citizen Potawatomi Nation is proposing to
continue ongoing direct services provided by The CPN House of
Hope, which provides supportive services, including emergency
shelter, to Native American victims of domestic violence, with an
estimated cost up to $900,000; and
WHEREAS, under Purpose Area 9, the Citizen Potawatomi Nation is proposing to
enhance ongoing direct services provided by The CPN Tribal Youth
Program with an estimated cost up to $350,000;

management activities on CPN trust land; and
WHEREAS, the Tribal Youth Natural Resource Management project will ultimately provide
opportunities for youth to become engaged in the field of natural resource
management and a career in natural resources management; and

resources to help alleviate the dependency on foreign energy sources while

WHEREAS, financial assistance is available from the Department of Energy to allow the Citizen
Potawatomi Nation to deploy clean energy and energy efficiency projects; and
WHEREAS, the Citizen Potawatomi Nation's proposed community-scale clean energy
deployment project that will efficiently generate clean electricity to replace the
purchase of electricity to move towards energy independence; and
WHEREAS, this project will involve the purchase and installation of a 2-4 megawatt natural gas
generator(s), which will provide electricity to at least 5 buildings at the Citizen
Potawatomi Nation's complex located on tribal trust land including Tribal
Headquarters and attached Child Development Center, FireLake Discount Foods,
FireLake Entertainment Center, Cultural Heritage Center and North Reunion Hall;
and

with two invasive species, eastern red cedar and feral hogs, which require
focused efforts for eradication; and

grant award to spend the remaining funds for an updated Energy Development
Plan; and
WHEREAS, if agreed to, the remaining BIA grant funds will be used to update the Nation's
existing Energy Plan; and

consultant fees and supplies; and

WHEREAS, the program emphasizes practice-based community outreach and education
programs, including advocacy to provide victims increased access to
services in the community, and collaborative interventions between legal
and human services resulting in a coordinated response to domestic
violence.

application to the National Park Service for Tribal Historic Preservation
Office status via Resolution 03-129; and;
WHEREAS, the Citizen Potawatomi Nation signed an Agreement with the National Park
Service on July 25, 2007 to assume historic preservation duties on Tribal
lands that were previously the responsibility of the State; and

WHEREAS, a 20% non-Federal cost share or match is required and will come from personnel;

continuation application due May 31; and
WHEREAS, the program emphasizes educational programs focused on skill development
such as self-control, emotional awareness, communication, social problem-
solving and peer relationships as well as provide suicide prevention and
drug education.

WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of American
Indians with Constitutional authority under the Act of June 18, 1934 and
the Oklahoma Indian Welfare Act of June 26, 1936, (49 Stat. 1967); and
WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in
Tribal tradition, derived from a history of organized self-government since
time immemorial, and recognized by treaties with the United States and in
the Constitution of the United States; and
WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution provides
for a separation of powers of the Tribal government by the reservation and
delegation of specific powers to other entities of the Tribal government; and,
except for these specific limitations, all other general powers of government
are embodied in the Legislature's authority "to enact legislation, transact
business, and otherwise speak and act on behalf of the Citizen Potawatomi

WHEREAS, on March 7, 2005, the Federal Communication Commission (FCC)
Nationwide Programmatic Agreement (NPA) governing section 106 State
Historic Preservation Office review for wireless telecommunication facilities
became effective; and
WHEREAS, procedures for consulting with Indian tribes and Native Hawaiian
Organizations (NHO) were specifically addressed in the NPA; and
WHEREAS, the NPA dictates that applicants must make reasonable and good faith efforts
to identify any Indian tribe or NHO that may attach religious significance to
historic properties that may be affected by an undertaking; and

WHEREAS, Section 106 of the National Historic Preservation Act of 1966 requires the
FCC to take into account the effects of its proposed undertakings, which
typically include projects, activities or programs that require a permit,
license or approval from the FCC. The research in regard to this resolution
will be conducted by the Citizen Potawatomi Nation Cultural Heritage Center
Historic Preservation Officer; and
WHEREAS, a few tribes have been charging and collecting fees for the work involved
since 2005. Recently, many additional tribes have added the payment of a fee
as a contingency of their review and approval. Some fees for Oklahoma
tribes have exceeded $1,500 per site; and
WHEREAS, the Citizen Potawatomi Nation Cultural Heritage Center has been conducting
these activities for years, but there is no mechanism to collect back fees.
Rather, this resolution would give permission to CPN's Historic Preservation
Officer to establish and collect such fees from this point on. This will be
accomplished through the assistance of an FCC website.
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN
POTAWATOMI NATION that a resolution authorizing the Citizen Potawatomi Nation's
Historic Preservation Officer to establish and collect fees for future consultation from
applicants of FCC undertakings IS HEREBY APPROVED.

on October 1, 1998. The total cost for providing sanitation facilities
to 21 homes is $157,840.00

for construction of sanitation facilities as provided by the provisions of the Citizen

the I.H.S/DHHS executed by these parties and effective in May, 2012 IS HEREBY

American families with quality day care facilities in which to leave their

$900,000 each in support of Native education, specifically those
projects that focus on college and career readiness; and

Nation in all matters on which the Nation is empowered to act now or in the
future"; and
WHEREAS, the United States Department of Housing and Urban Development (HUD) is
soliciting grant applications of up to $800,000 through the Fiscal Year 2016
Indian Community Development Block Grant (ICDBG) program; and
WHEREAS, the Citizen Potawatomi Nation is proposing a new diagnostic specialty clinic at
Citizen Potawatomi Nation Health Services which will meet an essential
community need by expanding the capacity of CPNHS to provide specialized
on-site care to low and moderate income Native Americans; and
WHEREAS, a public meeting notice was published and a meeting will be held on May
31st 2016 to solicit comments from Tribal and community members
regarding the proposed submission of this public facility development
project pursuant to citizen participation requirements as set forth in 24 CFR
1003.604; and

WHEREAS, the Citizen Potawatomi Nation has adopted an operation and maintenance
plan and commits the necessary funding as referenced within the Letter of
Commitment provided by the CPN Health Services for facility upkeep; and
WHEREAS, the project period for the proposed diagnostic specialty clinic under the
Public Facilities Program is five years, with a total project cost of
$1,814,984.00 of which $800,000 (or 44%) is the Federal share, and
$1,014,984.00 (or 56%) is Tribal leverage; and
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN
POTAWATOMI NATION that a resolution supporting and approving the Citizen
Potawatomi Nation's Citizen Potawatomi Community Development Corporation's proposed
Public Facility application for funding through the 2016 ICDBG program IS HEREBY
APPROVED.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that by act of this resolution and
consistent with the separation of powers defined in the Constitution, if awarded, an
appropriation of $ 1,814,984.00 from the FY 2016 ICDBG Fund and other applicable
accounts for the implementation, negotiation, operation, enforcement, procurement,
settlement, and or completion of this contract, compact, regulation or agreement by the
Tribal Chairman or his designate IS HEREBY AUTHORIZED.

A RESOLUTION APPROVING THE CITIZEN POTAWATOMI NATION'S
GRANT APPLICATION FOR FUNDING UNDER THE FISCAL YEAR 2016 U.S.
DEPARTMENT OF HEALTH AND HUMAN SERVICES SUBSTANCE ABUSE
AND MENTAL HEALTH SERVICES ADMINISTRATION (SAMHSA NATIVE
CONNECTIONS)
WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of
American Indians with Constitutional authority under the Act of June 18,
1934 and the Oklahoma Indian Welfare Act of June 26, 1936, (49 Stat.
1967); and
WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in
Tribal tradition, derived from a history of organized self-government since
time immemorial, and recognized by treaties with the United States and in
the Constitution of the United States; and
WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution
provides for a separation of powers of the Tribal government by the
reservation and delegation of specific powers to other entities of the Tribal
government; and, except for these specific limitations, all other general
powers of government are embodied in the Legislature's authority "to
enact legislation, transact business, and otherwise speak and act on behalf
of the Citizen Potawatomi Nation in all matters on which the Nation is
empowered to act now or in the future"; and
WHEREAS, the Substance Abuse and Mental Health Services Administration is
soliciting applications for FY2016 grants to expand tribal behavioral
health treatment capacity; and

WHEREAS, the Citizen Potawatomi Nation is proposing the implementation of
additional behavioral health services to intervene in the lives of Native
youth before they fall into substance abuse or commit suicide; and
WHEREAS, the project period for the proposed project is five years, with a total award
not to exceed $200,000 per year for a maximum of five years with no cost
share requirement; and
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE
CITIZEN POTAWATOMI NATION that a resolution authorizing and supporting the
Citizen Potawatomi Nation's Substance Abuse and Mental Health Services
Administration application for funding in FY 2016 IS HEREBY APPROVED.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that by act of this resolution
and consistent with the separation of powers defined in the Constitution, if awarded, an
appropriation of federal funds up to $1,000,000 from the FY16 SAMHSA fund for the
implementation, negotiation, operation, enforcement, procurement, settlement, and or
completion of this contract, compact, regulation or agreement by the Tribal Chairman or
his designate IS HEREBY AUTHORIZED.
