A RESOLUTION APPROVING AND SUPPORTING THE FISCAL YEAR 2018
FAMILY VIOLENCE PREVENTION SERVICES GRANT APPLICATION
TO THE UNITED STATES DEPARTMENT OF HEALTH AND HUMAN SERVICES'
ADMINISTRATION FOR CHILDREN AND FAMILIES.
WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of American
Indians with Constitutional authority under the Act of June 18, 1934 and the
Oklahoma Indian Welfare Act of June 26, 1936, (49 Stat. 1967); and
WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in Tribal
tradition, derived from a history of organized self-government since time
immemorial, and recognized by treaties with the United States and in the
Constitution of the United States; and
WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution provides for a
separation of powers of the Tribal government by the reservation and delegation
of specific powers to other entities of the Tribal government; and, except for
these specific limitations, all other general powers of government are embodied
in the Legislature's authority "to enact legislation, transact business, and
otherwise speak and act on behalf of the Citizen Potawatomi Nation in all matters
on which the Nation is empowered to act now or in the future"; and
WHEREAS, the Citizen Potawatomi Nation Indian Child Welfare program has operated a
Family Violence Prevention Services formula grant for many years and has
developed a professional working relationship with the office of Community
Services within the Administration for Children and Families; and
WHEREAS, the Citizen Potawatomi Nation Indian Child Welfare program will contract with
Project Safe, Unzner Center, Family Resource Center and Citizen Potawatomi
Nation Tribal Police, to provide auxiliary services to victims of family violence
and their dependents; and

WHEREAS, the goals of the Family Violence Prevention component of the Indian Child
Welfare program is to provide immediate shelter and related assistance to victims
of family violence and to expand efforts to prevent family violence; and
WHEREAS, these goals will be met if funding is received from the Administration for
Children and Families as a result of the grant application.
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN
POTAWATOMI NATION that a resolution supporting the Fiscal Year 2018 Family Violence
Preservation Services grant application to the United States Department of Health and Human
Services, Administration for Children and Families, IS HEREBY APPROVED.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that by act of this resolution and
consistent with the separation of powers defined in the Constitution, if awarded, an appropriation
of approximately $50,000.00 from the FY18 Family Violence Prevention fund (or other
applicable accounts) for the implementation, negotiation, operation, enforcement, procurement,
settlement, and or completion of this contract, compact, regulation or agreement by the Tribal
Chairman or his designate IS HEREBY AUTHORIZED.

CRIME IN INDIAN COUNTRY.

WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in Tribal

Constitution of the United States; and
WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution provides for a

Crime Victims Fund (CVF) has announced the availability of grant funds to
improve services for victims of crime in Indian country.; and

WHEREAS, the Citizen Potawatomi Nation is eligible for and desires to apply for DOJ OVC-
CVF funding; and

NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN
POTAWATOMI NATION that a resolution supporting the Citizen Potawatomi Nation's grant
application for funding under the United States Department of Justice's Office for Victims of
Crime, Crime Victims Fund as described above, IS HEREBY APPROVED.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that by act of this resolution and

WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of
American Indians with Constitutional authority under the Act of June 18,
1934 and the Oklahoma Indian Welfare Act of June 26, 1936, (49 Stat.
1967); and
WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in
Tribal tradition, derived from a history of organized self-government since
time immemorial, and recognized by treaties with the United States and in
the Constitution of the United States; and
WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution
provides for a separation of powers of the Tribal government by the
reservation and delegation of specific powers to other entities of the Tribal
government; and, except for these specific limitations, all other general
powers of government are embodied in the Legislature's authority "to
enact legislation, transact business, and otherwise speak and act on behalf
of the Citizen Potawatomi Nation in all matters on which the Nation is
empowered to act now or in the future"; and
WHEREAS, the Citizen Potawatomi Nation P.L. 102-477 Program (Employment and
Training/Social Services) assists low income Native American
households, who are otherwise ineligible for 477 program funds, with fuel
costs through vouchers to FireLake Convenience store, or other
emergency needs such as utility payments, or medical related needs; and

WHEREAS, if funded, the Citizen Potawatomi Nation will receive an estimated
$157,000 in a Community Services Block Grant (CSBG) to deliver such

CITIZEN POTAWATOMI NATION that a resolution supporting the submission of the
FY 2019 Community Services Block Grant (CSBG) application to the Administration for
Children and Families, IS HEREBY APPROVED.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that by act of this resolution
and consistent with the separation of powers defined in the Constitution, if awarded, an
appropriation of $157,000.00 from the FY19 CSBG fund (or other applicable accounts)

LIHEAP funds to deliver such assistance.
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN
POTAWATOMI NATION that a resolution supporting the submission of the FY 2019 Lower
Income and Energy Assistance Program (LIHEAP) grant application to the Administration for

pathways include: (1) connects active centers of population; (2) contributes to industrial
activities; (3) contributes to economic development; (4) provides access to jobs; (5)
contributes to law and order; (6) removes isolation; (7) provides access to education and
cultural activities; (8) provides access to hospital facilities; (9) contributes to accident
prevention; and (10) provides emergency services; and

exceed $300,000, with no match required.

A RESOLUTION OF THE CITIZEN POTAWATOMI NATION TRIBAL LEGISLATURE IN
SUPPORT OF FEDERAL LEGISLATION ENSURING MEDICAIDS FULFILLMENT OF
FEDERAL TRUST RESPONSIBILITY TO AMERICAN INDIANS/ALASKA NATIVES.
WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of American Indians with
Constitutional authority under the Act of June 18, 1934 and the Oklahoma Indian Welfare
Act of June 26, 1936, (49 Stat. 1967); and
WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in Tribal tradition,
derived from a history of organized self-government since time immemorial, and
recognized by treaties with the United States and in the Constitution of the United States;
and
WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution provides for a
separation of powers of the Tribal government by the reservation and delegation of specific
powers to other entities of the Tribal government; and, except for these specific limitations,
all other general powers of government are embodied in the Legislature's authority "to
enact legislation, transact business, and otherwise speak and act on behalf of the Citizen
Potawatomi Nation in all matters on which the Nation is empowered to act now or in the
future"; and
WHEREAS, the Citizen Potawatomi Nation represents all Federally-recognized American Indian and
Alaska Native (Al/AN) Self-Governance Tribal governments in the Oklahoma City Area
by advocating for the provision of quality health care to Al/ANs, as well as upholding
the Federal government's trust responsibility to provide health care to all Al/AN Tribal
governments; and
WHEREAS, Tribes have a unique government-to-government relationship with the Federal government,
and it is required that the Federal government consult with Tribes on any policy or
action that will significantly impact Tribal governments; and,
WHEREAS, Tribal Nations are political, sovereign entities whose status stems from the inherent
sovereignty they possess as self-governing people predating the founding of the United
States, and since its founding the United States has recognized them as such and entered
into treaties with them on that basis; and,

WHEREAS, Executive Order 13175 sets forth clear definitions and frameworks for consultation,
policymaking and accountability to ensure that consultation with Indian Tribes is
meaningful; and
WHEREAS, in 24 U.S.C. § 1602(a)(1) Congress declared that "it is the policy of this Nation, in fulfillment
of its special trust responsibilities and legal obligations to Indians...to ensure the highest
possible health status for Indians and urban Indians and to provide all resources necessary
to effect that policy."
WHEREAS, in 1955, Congress created the Indian Health Service (IHS) in order to help fulfill its trust
responsibility for health care to Tribes; and
WHEREAS, the unmet health needs of AI/ANs are severe and the health status of AI/ANs is far below
that of the general population of the United States, resulting in an average life expectancy
for Al/ANs 4.5 years less than that for the U.S. all races population; and
WHEREAS, in 1976, Congress noted that Medicaid payments were a "needed supplement to a health
care program which has for too long been insufficient to provide quality health care to the
American Indian" (H.R. Rep. No. 94-1026-Part III); and
WHEREAS, in 1976, Congress established the authority for the IHS, Tribal Nations, and Tribal health
organizations, to seek reimbursement under the federal Medicaid program in order to help
fulfill its trust responsibility for health care to the Tribes; and
WHEREAS, in FY 2017, the congressional appropriations for IHS was only $3,026 per person,¹ as
compared to average per capita spending nationally for personal health care services of
$9,207;² and
WHEREAS, the IHS continues to be funded by Congress at less than half of expected need—even when
considering available government health insurance resources—leading to rationed care and
worse health outcomes for AI/ANs;³ and
WHEREAS, the federal Medicaid program generates significant resources that are critical to the ability
of Tribal Nations to meet the health care needs of Tribal citizens, but there are significant
gaps in access to quality health care services under the federal Medicaid program for low-
and moderate-income Al/ANs, depending upon state of residence; and
WHEREAS, Al/ANs across the United States have substantially different eligibility and access to
services under the federal Medicaid program based on their state of residence; and

WHEREAS, state governments are not reimbursed for the costs of care provided by urban Indian health
care providers to AI/ANs to the same degree that state governments are reimbursed for
care to AI/ANs provided by IHS and Tribal health care providers; and
WHEREAS, the federal Medicaid program provides insufficient flexibility to Tribes to design and
implement health service delivery approaches that meet the often times unique
circumstances in Indian country; and
WHEREAS, Tribal Nations have developed a legislative proposal to address these gaps in access to
quality health care services which will create authority for states to extend Medicaid
eligibility to all AI/ANs with household income up to 138% of the federal poverty level;
authorize Indian Health Care Providers in all states to receive Medicaid reimbursement for
health care services authorized under the Indian Health Care Improvement Act and
delivered to Al/ANs; extend full federal funding (through 100% FMAP) to states for
Medicaid services furnished by urban Indian providers to Al/ANs, in addition to services
furnished by IHS/Tribal providers to AI/ANs; clarify that state Medicaid programs are
authorized to implement Indian-specific policies and are not permitted to override Indian-
specific Medicaid provisions in federal law through state waivers; and removes the
limitation on billing by Indian health care providers for services provided outside the four
walls of clinic facility.
WHEREAS, these provisions, if enacted, will improve access to quality health care services for Al/ANs
across all states, and thereby advance the Federal government's trust responsibility to
Al/ANs and Tribal governments;
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN
POTAWATOMI NATION that a resolution authorizing the Citizen Potawatomi Nation's support of the
enactment of legislation to ensure Medicaid advances the Federal government's trust responsibility
to Al/AN Tribal governments IS HEREBY APPROVED.

Community Development Corporation's Community Development Financial
Institutions office, an 11,000 square foot public facility building, in Shawnee,
Oklahoma; and
WHEREAS, a public meeting notice was published and a meeting was held on May 24th, 2018
to solicit comments from Tribal and community members regarding the proposed
submission of this public facility development project pursuant to citizen
participation requirements as set forth in 24 CFR 1003.604; and
WHEREAS, the Citizen Potawatomi Nation has adopted an operations and maintenance plan
for the planned CPN Community Development Corporation's Community

Development Financial Institutions public facility and by approval of this
resolution commits to pay associated costs from an allocation of tribal funds.
Annual costs to satisfy the operations and maintenance plan requirements for this

WHEREAS, the project period for the proposed Community Development Corporation facility
under the Public Facilities Program is five years, with a total project cost of
$1,075,000 of which $800,000 (or 75%) is the Federal share, and $275,000 (or
25.58%) is Tribal leverage which is firmly committed by Citizen Potawatomi
Nation; and
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN
POTAWATOMI NATION that a resolution supporting and approving the Citizen Potawatomi
Nation's Citizen Potawatomi Community Development Corporation's proposed Public Facility
application for funding through the 2018 ICDBG program IS HEREBY APPROVED.

NATION'S GRANT APPLICATION FOR FUNDING UNDER THE U.S. DEPARTMENT OF
ENERGY'S FY 2018 ENERGY INFRASTRUCTURE DEPLOYMENT ON TRIBAL LANDS
FUNDING.
WHEREAS, the Citizen Potawatomi Nation is a federally recognized tribe of American
Indians with constitutional authority authorized under the Oklahoma Indian
Welfare Act of June 26, 1936, (49 Stat. 1967);
WHEREAS, Article 6, Section 2 of the Constitution of the Citizen Potawatomi Nation, requires "It shall
be the duty of the Chairman to preside at all meetings of Council and the Legislature and
perform all duties appertaining to the office, and the Chairman shall see that the laws of
the Tribe are faithfully enforced. The Chairman shall have general supervision of the
affairs of the Council and of the Legislature."; and
WHEREAS, the Citizen Potawatomi Nation recognizes the need for developing our tribal energy
resources to help alleviate the dependency on foreign energy sources while advancing
Tribal sovereignty through social and economic progress; and
WHEREAS, financial assistance is available from the Department of Energy to allow the Citizen
Potawatomi Nation to deploy community-scale energy generating systems on Tribal
Lands (DE-FOA-0001847; DOE Topic Area 2); and
WHEREAS, the Citizen Potawatomi Nation's proposed project will network up to 4MW of distributed
generation powered by natural gas in order to offset rising energy costs, taking steps
towards energy independence; and
WHEREAS, the Citizen Potawatomi Nation's proposed project will take place across approximately
377 acres of CPN trust land, both the generation site and the tribal facilities to be served,
which include CPN Tribal Headquarters, the CPN Child Development Center, FireLake
Discount Foods, FireLake Entertainment Center, CPN Cultural Heritage Center, FireLake
Arena, FireLake Bowl and North and South Reunion Halls, comprising a total of 360,145
sq. feet are in trust; and

WHEREAS, DOE requires a 50% cost share of total project costs. The total project cost of $2,090,151
over a two year period of which $1,000,000 is the Federal share, and $1,090,151 is the
non-Federal share. The cost share via cash and in-kind services includes, but is not
limited to, equipment, installation, personnel, oversight of negotiations and purchases;
and
WHEREAS, Cost share provided by CPN for this project includes $149,344 in salary and fringe,
$300,000 in equipment purchase costs, and $640,807 tribal contributions to facilities,
electrical and mechanical costs for a combined value of $1,090,151.
WHEREAS, CPN believes in the expansion of Tribal sovereignty through energy independence and
commits to this project.
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN

Hearth Act of 2012, Section 40-3-102-Title and 40-3-103 - Definition, subleasing
is authorized through guidelines designated to the lessee; and
WHEREAS, John F. Barrett, owner of BDC Gun Room, wishes to sublease to Nathan O.
Beauchamp, owner of Shawnee Outdoors, LLC, the right of possession no
greater than what he presently holds as the lessee under the Citizen Potawatomi
Nation business site lease, subject to the approval of the Vice Chairman,
Secretary-Treasurer and principals of BDC Gun Room and Shawnee Outdoors,
LLC, and confirmation by the Citizen Potawatomi Nation Tribal Legislature; and

INFRASTRUCTURE AND TRANSFER-LOADING FACILITY.
WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of American Indians
with Constitutional authority under the Oklahoma Indian Welfare Act of June 26,
1936, (49 Stat. 1967); and
WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in Tribal
tradition, derived from a history of organized self-government since time
immemorial, and recognized by treaties with the United States and in the
Constitution of the United States; and
WHEREAS, Article 7, Section 2 of the Citizen Potawatomi Nation Constitution provides for a
separation of powers of the Tribal government by the reservation and delegation of
specific powers to other entities of the Tribal government; and, except for these
specific limitations, all other general powers of government are embodied in the
Business Committee's authority "to enact legislation, transact business, and
otherwise speak and act on behalf of the Citizen Potawatomi Nation in all matters
on which the Nation is empowered to act now or in the future"; and
WHEREAS, the Citizen Potawatomi Nation Community Development Corporation has the
authority to make loans to the Nation at a fair and equitable interest rate; and

WHEREAS, the Citizen Potawatomi Nation Community Development Corporation Loan
Committee will approve this loan in the amount pursuant to the terms and
conditions attached hereto.
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN
POTAWATOMI NATION, that a resolution authorizing a loan agreement between the Citizen
Potawatomi Nation Community Development Corporation, Citizen Potawatomi Industrial
Authority and the Citizen Potawatomi Nation IS HEREBY APPROVED.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that by act of this resolution and
consistent with the separation of powers defined in the Constitution, the Legislature of the Citizen
Potawatomi Nation hereby approves an appropriation of $4,250,000.00 from the CPN
Community Development Corporation for the implementation, negotiation, operation,
enforcement, procurement, settlement, and or completion of this contract, regulation or agreement

Services and Sales, LTD of Alberta Canada and is engaged in the
manufacture of high density polyethylene pipe; and

Potawatomi Nation.
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE

WHEREAS, certain areas of Citizen Potawatomi Nation tribal lands are subject to flooding from nearby
rivers and streams, and because of the potential for serious damage to tribal properties
within these areas, there is a need for local flood insurance; and
WHEREAS, it is the desire of the Citizen Potawatomi Nation to participate in the National Flood
Insurance Program administered by the Federal Emergency Management Agency to be
eligible for flood insurance; and
WHEREAS, the Citizen Potawatomi Nation commits to enact and enforce local floodplain management
standards consistent with National Flood Insurance Program minimum criteria and to
assist the Federal Emergency Management Agency in the delineation of special flood
hazard areas as well as provide information concerning present uses and occupancy of
floodplain areas as the Federal Emergency Management Agency may request; and
WHEREAS, the Citizen Potawatomi Nation agrees to maintain for public inspection and furnish upon
request, any information on all new or substantially improved structures as it relates to the
National Flood Insurance Program; and

WHEREAS, the Citizen Potawatomi Nation agrees to cooperate with federal, state and local agencies
and private firms on undertakings to study, survey, map and identify floodplain hazards,

floodplain areas to prevent aggravation of existing hazards; and
WHEREAS, the Citizen Potawatomi Nation agrees to notify the Federal Emergency Management
Agency in writing whenever there has been a modification to any boundary of Citizen
Potawatomi Nation tribal lands, or has otherwise assumed or no longer has authority to
adopt and enforce floodplain management regulations for a particular area; and
WHEREAS, to participate in the National Flood Insurance Program, the Citizen Potawatomi Nation is
required to adopt ordinances that regulate special flood hazard areas within its jurisdiction.

of a project designed to educate children in the Potawatomi language using an

Project Safe, Unzner Center, Family Resource Center and Citizen Potawatomi
Nation Tribal Police, to provide auxiliary services to victims of family violence
and their dependents; and

WHEREAS, the goals of the Family Violence component of the Indian Child Welfare program
are to provide immediate shelter and related assistance to victims of family
violence and to expand efforts to prevent family violence; and

and Families as a result of the grant application.
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN
POTAWATOMI NATION that a resolution supporting the Fiscal Year 2019-2023 Family
Violence Prevention Services grant application to the United States Department of Health and
Human Services, Administration for Children and Families, IS HEREBY APPROVED.

Tribal law enforcement and justice systems with the stipulation that these funds
are available for a variety of specified purposes as outlined in ten "Purpose
Areas"; and

WHEREAS, the Citizen Potawatomi Nation is making application to the Southern Plains
Regional Office of the Bureau of Indian Affairs to request transfer of "fee-
simple" title to the "United States of America in Trust for the Citizen Potawatomi
Nation"; and
WHEREAS, the Legislature believes that increasing the tribal land base furthers the pursuit of
Tribal Self Determination and allows future generations of tribal leaders to have
the flexibility to use the land for the health, welfare, and sovereignty of the
Citizen Potawatomi Nation; and
WHEREAS, Section 5 of the Indian Reorganization Act of June 18, 1934 (48 Stat. 985; 25
USC 465) provides authority for the Fee-to-Trust acquisition; and

WHEREAS, the property is ON-reservation or within the former reservation boundaries of the
Citizen Potawatomi Nation, legally described in Attachment A; and listed in the

00 (Jordan tract); and
WHEREAS, the property was purchased with tribal funds for NON-gaming use; and
WHEREAS, the Citizen Potawatomi Nation owns the surface rights to the property in fee
simple and the land is currently not under lease but has improvements with
adequate ingress and egress for traffic services; and
WHEREAS, the current land use and the proposed land use is agricultural and is necessary to
facilitate Tribal Self-Determination and increasing the tribal land base which
furthers the pursuit of Tribal Self Determination and allows future generations of
tribal leaders to have the flexibility to use the land for the health, welfare, and
sovereignty of the Citizen Potawatomi Nation; and
WHEREAS, the Citizen Potawatomi Nation agrees to indemnify and hold harmless the United
States, its agents and employees, against any lawsuits, loss, expense, and claim
potentially filed against the tribe for any damages relating to asbestos and lead-
based paint, if any, associated with the improvements located on the property
described in Attachment A.

the Federal share, and $ 1,666,666.67 (or 25%) is Tribal leverage which is

WHEREAS, Congress has enacted Public Law 102-477 which allows Tribes to voluntarily consolidate
various employment, training and related programs; and
WHEREAS, Public Law 102-477 permits the consolidation of funding received for these programs and
allows greater flexibility in the development, coordination and operation of said
programs; and
WHEREAS, funding for the 477 Program is formula driven and appropriated annually by the Federal
Agencies (DOL, BIA, DOJ and DHHS) and is estimated, based on FY2018 actual
funding, to be approximately $12,500,000.

A RESOLUTION APPROVING THE
CITIZEN POTAWATOMI NATION'S GRANT APPLICATION
FOR FUNDING UNDER THE U.S. DEPARTMENT OF HOMELAND SECURITY
FY 2019 TRIBAL HOMELAND SECURITY GRANT PROGRAM
WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of
American Indians with Constitutional authority under the Act of June 18,
1934 and the Oklahoma Indian Welfare Act of June 26, 1936, (49 Stat.
1967); and
WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in
Tribal tradition, derived from a history of organized self-government since
time immemorial, and recognized by treaties with the United States and in
the Constitution of the United States; and
WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution
provides for a separation of powers of the Tribal government by the
reservation and delegation of specific powers to other entities of the Tribal
government; and, except for these specific limitations, all other general
powers of government are embodied in the Legislature's authority "to
enact legislation, transact business, and otherwise speak and act on behalf
of the Citizen Potawatomi Nation in all matters on which the Nation is
empowered to act now or in the future"; and
WHEREAS, the Department of Homeland Security (DHS) and Federal Emergency
Management Association (FEMA), through their Tribal Homeland
Security Grant Program (THSGP), have announced availability of Fiscal
Year 2019 funds to support the building, sustainment, and delivery of core
capabilities to enable Tribes to strengthen their capacity to prevent, protect
against, mitigate, respond to, and recover from potential terrorist attacks
and other hazards; and

WHEREAS, the CPN proposes to seek up to $100,000 in FY2019 FEMA THSGP
funding to acquire and up-fit two vehicles to facilitate logistics in disaster
response scenarios. These vehicles will enhance CPN Emergency
Management's ability to place supplies and equipment when and where it
is most needed to protect the Citizen Potawatomi Nation and to assist
surrounding communities; and
WHEREAS, there is no non-Federal cash cost-share required by the Citizen
Potawatomi Nation
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE
CITIZEN POTAWATOMI NATION that a resolution authorizing and supporting the
Citizen Potawatomi Nation's Federal Emergency Management Association application
for funding under the FY 2019 Tribal Homeland Security Grant Program IS HEREBY
APPROVED.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that by act of this resolution
and consistent with the separation of powers defined in the Constitution, if awarded, an
appropriation of federal funds up to $100,000 from the FY2019 DHS-FEMA Tribal
Homeland Security Grant Program, for the implementation, negotiation, operation,
enforcement, procurement, settlement, and or completion of this contract, compact,
regulation or agreement by the Tribal Chairman or his designate IS HEREBY
AUTHORIZED.

OPEN ONE OR MORE INTEREST BEARING CASH SWEEP PUBLIC FUND
ACCOUNTS WITH THE BANK OF OKLALHOMA.

WHEREAS, the Citizen Potawatomi Nation may place these excess public funds in interest
bearing insured or collateralized accounts that meet all requirements for Federal
and State public funds and thereby earn interest on these public funds until said
funds are needed to fulfill their intended contractual purposes

provided that these accounts meet all of the requirements for Federal and State public funds IS
HEREBY APPROVED.

WHEREAS, this Gathering will be held July 30 through August 4, 2019, and will
provide traditional teachings and cultural activities; and

WHEREAS, the Legislature of the Citizen Potawatomi Nation authorized a contribution
of $10,000 via Resolution 19-39-TC&A, dated February 28, 2019. The
Legislature realizes the expenses related to an undertaking of this
magnitude and desires to offer an additional $10,000 of financial support
to the hosting tribe for a total contribution of $20,000;
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE
CITIZEN POTAWATOMI NATION, that a resolution supporting the Annual
Potawatomi Gathering of Nations and authorizing an additional monetary contribution of
$10,000 IS HEREBY APPROVED.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that by act of this resolution
and consistent with the separation of powers defined in the Constitution, an appropriation
of $10,000 from the General Account (or other applicable accounts) for the
implementation, negotiation, operation, enforcement, procurement, settlement, and or
completion of this contract, compact, regulation or agreement by the Tribal Chairman or
his designate IS HEREBY AUTHORIZED.
