A RESOLUTION APPROVING A FEE-TO-TRUST ACQUISITION APPLICATION TO
THE BUREAU OF INDIAN AFFAIRS AND REQUEST FOR TRUST ACQUISITION OF
THE (NON-GAMING/ON RESERVATION) WILLOUGHBY PROPERTY
WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of American
Indians with Constitutional authority under the Act of June 18, 1934 and the
Oklahoma Indian Welfare Act of June 26, 1936, (49 Stat. 1967); and
WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in Tribal
tradition, derived from a history of organized self-government since time
immemorial, and recognized by treaties with the United States and in the
Constitution of the United States; and
WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution provides for a
separation of powers of the Tribal government by the reservation and delegation
of specific powers to other entities of the Tribal government; and, except for
these specific limitations, all other general powers of government are embodied
in the Legislature's authority "to enact legislation, transact business, and
otherwise speak and act on behalf of the Citizen Potawatomi Nation in all matters
on which the Nation is empowered to act now or in the future"; and
WHEREAS, the Citizen Potawatomi Nation is making application to the Southern Plains
Regional Office of the Bureau of Indian Affairs to request transfer of "fee-
simple" title to the "United States of America in Trust for the Citizen Potawatomi
Nation"; and
WHEREAS, the Legislature believes that increasing the tribal land base furthers the pursuit of
Tribal Self Determination and allows future generations of tribal leaders to have
the flexibility to use the land for the health, welfare, and sovereignty of the
Citizen Potawatomi Nation; and
WHEREAS, Section 5 of the Indian Reorganization Act of June 18, 1934 (48 Stat. 985; 25
USC 465) provides authority for the Fee-to-Trust acquisition; and

WHEREAS, the property is ON-reservation or within the former reservation boundaries of the
Citizen Potawatomi Nation, legally described in Attachment A; and listed in the
Pottawatomie County Treasurer's records as parcel ID #0000-31-010-004-0-042-
02; parcel ID #0000-31-010-004-0-042-01; parcel ID #0000-31-010-004-0-042-
00; parcel ID #0000-31-010-004-0-041-00; parcel ID #0000-31-010-004-0-040-
00; parcel ID # 0000-31-010-004-0-018-00; parcel ID #0000-31-010-004-0-018-
01 (Willoughby tract); and
WHEREAS, the property was purchased with tribal funds for NON-gaming use and the land,
to which the Citizen Potawatomi Nation owns the surface rights in fee simple, is
not currently under lease; and
WHEREAS, there are improvements with ingress and egress for adequate traffic services; and
WHEREAS, the current and proposed land use is Tribal Self-Determination; increasing the
tribal land base which furthers the pursuit of Tribal Self Determination and
allows future generations of tribal leaders to have the flexibility to use the land
for the health, welfare, and sovereignty of the Citizen Potawatomi Nation; and,
for agricultural use.
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN
POTAWATOMI NATION that a resolution supporting the Fee-to-Trust acquisition application
to the Southern Plains Regional Office of the Bureau of Indian Affairs and trust acquisition of the
Willoughby Property, IS HEREBY APPROVED.

APPLICATION FOR FUNDING UNDER THE U.S. DEPARTMENT OF JUSTICE,
OFFICE OF JUSTICE PROGRAMS, OFFICE FOR VICTIMS OF CRIME FY 2019
TRIBAL VICITM SERVICES SET-ASIDE PROGRAM
WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of American

Oklahoma Indian Welfare Act of June 26, 1936, (49 Stat. 1967); and
WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in Tribal
tradition, derived from a history of organized self-government since time
immemorial, and recognized by treaties with the United States and in the
Constitution of the United States; and
WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution provides for a
separation of powers of the Tribal government by the reservation and delegation
of specific powers to other entities of the Tribal government; and, except for
these specific limitations, all other general powers of government are embodied
in the Legislature's authority "to enact legislation, transact business, and

WHEREAS, the U.S. Department of Justice (DOJ) Office of Justice Programs (OJP) Office for
Victims of Crime (OVC) is seeking applications for funding under the FY 2019
Tribal Victim Services Set-Aside Program to further DOJ's mission by
improving public safety, supporting Indian tribes, and enhancing services for
victims of crime; and
WHEREAS, DOJ plans to award grants of up to $720,000 total over a three year period in
support of OVC's mission is to enhance the nation's capacity to assist crime
victims and provide leadership in changing attitudes, policies, and practices to
promote justice and healing for all victims of crime; and

WHEREAS, Citizen Potawatomi Nation is proposing to develop an Adult Protective Services
(APS) Program offering supportive services for elders and vulnerable adults,
which would be well-supported by this three year grant of up to $720,000; and
WHEREAS, there is no non-Federal cash cost-share required by the Citizen Potawatomi
Nation.
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN
POTAWATOMI NATION that a resolution authorizing and supporting the Citizen Potawatomi
Nation's application for funding under the FY 2019 U.S. Department of Justice (DOJ) Office of
Justice Programs (OJP) Office for Victims of Crime (OVC) Tribal Victim Services Set-Aside
Program IS HEREBY APPROVED.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that by act of this resolution and
consistent with the separation of powers defined in the Constitution, if awarded, an appropriation
of federal funds up to $720,000 from the FY19 Department of Justice (DOJ) Office of Justice
Programs (OJP) Office for Victims of Crime (OVC) Tribal Victim Services Set-Aside Program,
and no in-kind match for the implementation, negotiation, operation, enforcement, procurement,
settlement, and or completion of this contract, compact, regulation or agreement by the Tribal
Chairman or his designate IS HEREBY AUTHORIZED.

WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of

WHEREAS, the National Indian Gaming Association (NIGA) is a voluntary association of
Tribal Gaming entities representing federally recognized tribal governments
involved in gaming enterprises in Indian Country whose purpose is to promote a
cooperative relationship among the Tribes and their representatives; and
WHEREAS, NIGA also promotes regulatory standards, methods of operation, educational
seminars and the exchange of information and ideas for the mutual benefit of all
members and acts as a gaming regulatory advisory group; and

WHEREAS, as a member of NIGA, the Citizen Potawatomi Nation will receive all
publications, meeting notices and action alerts and discounted registration fees on
all meetings and seminars.
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN
POTAWATOMI NATION that a resolution approving membership in the National Indian
Gaming Association and authorizing payment of membership dues IS HEREBY APPROVED.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that by act of this resolution and
consistent with the separation of powers defined in the Constitution, an appropriation of $7,500
from the FireLake Entertainment Center and $17,500 from the Grand Casino, Hotel and Resort
account (or other applicable accounts) for the implementation, negotiation, operation,
enforcement, procurement, settlement, and or completion of this contract, compact, regulation or
agreement by the Tribal Chairman or his designate IS HEREBY AUTHORIZED.

A RESOLUTION SUPPORTING THE CITIZEN POTAWATOMI NATION'S GRANT
APPLICATION TO THE ECONOMIC DEVELOPMENT ADMINISTRATION
UNDER THE DEPARTMENT OF COMMERCE'S
'FY 2018 ECONOMIC DEVELOPMENT ASSISTANCE' PROGRAM
WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of American
Indians with Constitutional authority under the Act of June 18, 1934 and the
Oklahoma Indian Welfare Act of June 26, 1936, (49 Stat. 1967); and
WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in Tribal
tradition, derived from a history of organized self-government since time
immemorial, and recognized by treaties with the United States and in the
Constitution of the United States; and
WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution provides for a
separation of powers of the Tribal government by the reservation and delegation
of specific powers to other entities of the Tribal government; and, except for
these specific limitations, all other general powers of government are embodied
in the Legislature's authority "to enact legislation, transact business, and
otherwise speak and act on behalf of the Citizen Potawatomi Nation in all matters
on which the Nation is empowered to act now or in the future"; and
WHEREAS, the Economic Development Administration, through the Department of
Commerce, is soliciting grant proposals from Indian tribes for projects to
provide investments that support construction, non-construction, planning,
technical assistance, and revolving loan fund projects; and
WHEREAS, the EDA grant program is intended to support economic development, foster job
creation, and attract private investment in economically distressed areas of the
United States; and

WHEREAS, this project will result in Phase III in the development of an industrial park which
will entail the construction of approximately two additional miles of rail within
the Park and will provide for the purchase of equipment necessary for the actual
operation of the Transload facility and warehousing storage area; and
WHEREAS, the EDA grant program considers 50% non-Federal in-kind match from the
Citizen Potawatomi Nation as essential to the project which will consist of
$3,000,000 EDA grant funds and a $3,000,000 Tribal match.
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN
POTAWATOMI NATION that a resolution supporting the submission of the FY 2018
Economic Development Assistance Programs grant application to the EDA Department of
Commerce, IS HEREBY APPROVED.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that by act of this resolution and
consistent with the separation of powers defined in the Constitution, if awarded, up to $3,000,000
from the FY 2018 Economic Development Assistance Programs grant (or other applicable
accounts for the implementation, negotiation, operation, enforcement, procurement, settlement
and/or completion of this contract, compact, regulation or agreement by the Tribal Chairman or
his designate IS HEREBY AUTHORIZED.

A RESOLUTION APPROVING THE RE-APPOINTMENT AND TERMS OF OFFICE FOR
SHAWN HOWARD AND BRAD PELTIER AS MEMBERS OF THE
CITIZEN POTAWATOMI NATION
FLOODPLAIN MANAGEMENT BOARD.
WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of American Indians with Constitutional authority under the Act of June 18, 1934 and the Oklahoma Indian Welfare
Act of June 26, 1936, (49 Stat. 1967); and

WHEREAS, Resolution #01-40, adopted on October 25, 2000, established the Citizen Potawatomi
Nation Floodplain Board, appointed members, and designated duties; and
WHEREAS, Resolution #01-40 further states that members of the Floodplain Management Board shall serve without compensation and members of the Floodplain Management Board may be
removed for cause only after a public hearing for that purpose; and
WHEREAS, Resolution #13-13-NR, adopted on August 30, 2012, increased the number of Floodplain
Management Board members to seven and provided for staggered terms of office to more
effectively monitor the floodplain and preserve the institutional memory of the CPN
Floodplain Management Board;
WHEREAS, Shawn Howard and Brad Peltier are currently serving terms that expire October 1, 2019.

Human Services/Indian Health Service FY 2020 Annual Funding Agreement, Federal
Grants and Contracts, and Tribal Programs;
WHEREAS, the Legislature recognizes that budgets provided are intended as management and
planning tools for each program and service provided by the Citizen Potawatomi Nation;
and

WHEREAS, the Legislature accepts that budget line items may or may not change over the next 12
months to better fit the needs of the program or service but that the total budgets will not
be changed significantly.
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN
POTAWATOMI NATION, that a resolution approving the Citizen Potawatomi Nation operating budgets
for Fiscal Year 2020, as presented, IS HEREBY APPROVED.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that by act of this resolution and consistent with

WHEREAS, the existing Citizen Potawatomi Nation Health System does not provide
adequate facilities for provide the services needed by the Indian population;
and
WHEREAS, the Citizen Potawatomi Nation has the necessary resources, as well as the
experience, to design, reconstruct, remodel and equip a health facility;
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE
CITIZEN POTAWATOMI NATION that a resolution approving submission of the
application for participation with the Indian Health Service in the FY 2020 Joint Venture
Construction Program to rehabilitate and convert a portion of the Mission Hill Hospital for
use as an outpatient Urgent Care Facility IS HEREBY APPROVED.

WHEREAS, First National Bank and Trust Company can, and desires to, purchase and in turn
lease the necessary medical equipment for the facility to the Citizen Potawatomi
Nation Health Service at favorable rates, and

WHEREAS, Resolution #19-49-HHS was passed on April XX, 2019 authorizing a Lease
Agreement between Citizen Potawatomi Health Services and First National Bank
for medical and imaging equipment at an estimated cost of $1,850,000; and
WHEREAS, the actual costs of the equipment is $2,040,561.11.
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN
POTAWATOMI NATION that a resolution authorizing and supporting a Lease Agreement by
and between the Citizen Potawatomi Nation Health Service and First National Bank and Trust
Company, IS HEREBY APPROVED.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that by act of this resolution and
consistent with the separation of powers defined in the Constitution, an appropriation up to
$2,040,561.11 from the CPN Health Service (or other applicable accounts) for the
implementation, negotiation, operation, enforcement, procurement, settlement and/or completion

MEETING OF THE LEGISLATURE FROM

WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of

WHEREAS, the last Thursday of November 2019 is Thanksgiving Day. In order to
allow the legislators and tribal employees to spend the holiday with their
families, it is necessary to reschedule the autumnal quarterly meeting of
the tribal legislature.
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE
CITIZEN POTAWATOMI NATION, that a resolution rescheduling the fall quarterly
meeting of the Legislature from Thursday, November 28, 2019, to Wednesday,
December 4, 2019, IS HEREBY APPROVED.
NOW THEREFORE BE IT FURTHER RESOLVED, that by act of this resolution

WHEREAS, these funds are separate and distinct from the trust fund/judgment monies
previously withdrawn from BIA management; and
WHEREAS, the Citizen Potawatomi Nation is hereby requesting disbursement of the funds,
including all accrued interest to be utilized by the Nation for trust property
management; and
WHEREAS, the Citizen Potawatomi Nation Legislation hereby authorizes monthly drawdowns
of all funds deposited into BIA Account PL#7476705 which are considered
Citizen Potawatomi Nation General Funds as part of the overall revenue
projection for support of the operations of the Citizen Potawatomi Nation.

WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in
Tribal tradition, derived from a history of organized self-government since
time immemorial, and recognized by treaties with the United States and in
the Constitution of the United States; and
WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution provides
for a separation of powers of the Tribal government by the reservation and
delegation of specific powers to other entities of the Tribal government;
and, except for these specific limitations, all other general powers of
government are embodied in the Legislature's authority "to enact
legislation, transact business, and otherwise speak and act on behalf of the
Citizen Potawatomi Nation in all matters on which the Nation is empowered

WHEREAS, there exists a need to identify and authorize certain individuals to conduct

WHEREAS, the criteria used to select and evaluate these proposed roads include: (1) connects
active centers of population; (2) contributes to industrial activities; (3)
contributes to economic development; (4) provides access to jobs; (5) contributes
to law and order; (6) removes isolation; (7) provides access to education and
cultural activities; (8) provides access to hospital facilities; (9) contributes to
accident prevention; and (10) provides emergency services; and

WHEREAS, the goal of both of these programs is to increase home and community based
services to older Native Americans, which respond to local needs and are
consistent with evidence-based prevention practices; and

Potawatomi Nation will provide nutritional and supportive services including
congregate and home-delivered meals, information, and transportation, as well as

A RESOLUTION APPROVING THE CITIZEN POTAWATOMI NATION'S FILING TO
INTERVENE IN CHEROKEE NATION ET. AL. v. STITT, SEEKING A
DECLATORY JUDGMENT OF THE LEGAL EFFECT OF PART 15 (B) OF THE
OKLAHOMA MODEL TRIBAL-STATE GAMING COMPACT.
WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of American
Indians with Constitutional authority under the Act of June 18, 1934 and the
Oklahoma Indian Welfare Act of June 26, 1936, (49 Stat. 1967); and
WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in Tribal
tradition, derived from a history of organized self-government since time
immemorial, and recognized by treaties with the United States and in the
Constitution of the United States; and
WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution provides for a
separation of powers of the Tribal government by the reservation and delegation
of specific powers to other entities of the Tribal government; and, except for
these specific limitations, all other general powers of government are embodied
in the Legislature's authority "to enact legislation, transact business, and
otherwise speak and act on behalf of the Citizen Potawatomi Nation in all matters
on which the Nation is empowered to act now or in the future"; and
WHEREAS, on December 31, 2019, the Cherokee Nation, Chickasaw Nation and Choctaw
Nation filed W.D. Okla. Case No., 5:19-cv-01198-D, Cherokee Nation et. al. v.
Stitt, seeking a declaratory judgment of the legal effect of the "shall
automatically renew" clause of Part 15(B) of the Model Tribal-State Gaming
Compact, and if necessary, injunctive relief against Governor Stitt; and
WHEREAS, counsel for the Plaintiffs has stated that any tribe having a gaming compact with
the State of Oklahoma is welcome to intervene in the matter; and

WHEREAS, the Citizen Potawatomi Nation has a significant and vested interest in the outcome
of the case;

POTAWATOMI NATION that a resolution authorizing the Citizen Potawatomi Nation
intervene in the matter of Cherokee Nation et. al. v. Stitt IS HEREBY APPROVED.

A RESOLUTION APPROVING THE RESCHEDULING OF THE QUARTERLY
MEETING OF THE LEGISLATURE FROM

WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of

WHEREAS, scheduling conflicts necessitate rescheduling the winter quarterly meeting
of the tribal legislature.
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE

quarterly meeting of the Legislature from Thursday, February 27, 2020, to Monday,
February 17, 2020, IS HEREBY APPROVED.
NOW THEREFORE BE IT FURTHER RESOLVED, that by act of this resolution
and consistent with the separation of powers defined in the Constitution, the

COORDINATED TRIBAL ASSISTANCE SOLICITATION (CTAS) PROGRAM.
WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of American

the Oklahoma Indian Welfare Act of June 26, 1936, (49 Stat. 1967); and
WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in

Solicitation (CTAS) has announced the availability of grant funds to improve
Tribal law enforcement and justice systems with the stipulation that these
funds are available for a variety of specified purposes as outlined in nine
"Purpose Areas"; and

WHEREAS, the Citizen Potawatomi Nation is eligible for and desires to apply for funding
under the following project Purpose Area: Purpose Area 3, "Tribal Justice

continue the CPN Re-entry and Diversionary program with an estimated
three-year project cost up to $900,000;
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE
CITIZEN POTAWATOMI NATION that a resolution supporting and approving the
Citizen Potawatomi Nation's proposed application for funding through the 2020 DOJ
CTAS program IS HEREBY APPROVED.

WHEREAS, the Citizen Potawatomi Nation is proposing the construction of FireLake Car Wash
as an economic development project in Shawnee, Oklahoma; and
WHEREAS, a public meeting notice was published and a meeting was held on January 16th ,
2020 to solicit comments from Tribal and community members regarding the
proposed submission of this economic development project pursuant to citizen
participation requirements as set forth in 24 CFR 1003.604; and

WHEREAS, the project period for the proposed FireLake Car Wash building construction
under the Economic Development Program is three years, with a total project cost
of $2,322,661 of which $900,000 (or 38.75%) is the Federal share, and $1,422,661
(or 61.25%) is Tribal leverage which is firmly committed by Citizen Potawatomi
Nation; and
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN
POTAWATOMI NATION that a resolution supporting and approving the Citizen Potawatomi
Nation's proposed Economic Development Project application for funding through the 2019
ICDBG program IS HEREBY APPROVED.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that by act of this resolution and
consistent with the separation of powers defined in the Constitution, if awarded, an appropriation
of $900,000 from the FY 2019 ICDBG Fund and $1,422,661 from Citizen Potawatomi Nation for

WHEREAS, the criteria used to select and evaluate these proposed roads, parking lots,
sidewalks and pathways include: (1) connects active centers of population; (2)

provides access to jobs; (5) contributes to law and order; (6) removes isolation;
(7) provides access to education and cultural activities; (8) provides access to
hospital facilities; (9) contributes to accident prevention; and (10) provides
emergency services; and
WHEREAS, the proposed route provide access leading to places of employment, health
facilities, educational training, etc.
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN
POTAWATOMI NATION that a resolution supporting the addition of this new route as
identified in Attachment "A", updating of CPN's existing National Tribal Transportation Field
Inventory, and requesting the Bureau of Indian Affairs to add the requested new route to the
Citizen Potawatomi Nation's National Tribal Transportation Field Inventory IS HEREBY

WHEREAS, the Citizen Potawatomi Nation may place these excess public funds in interest
bearing insured or collateralized accounts that meet all requirements for Federal
and State public funds and thereby earn interest on these public funds until said
funds are needed to fulfill their intended contractual purposes;

WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in Tribal
tradition, derived from a history of organized self-government since time
immemorial, and recognized by treaties with the United States and in the
Constitution of the United States; and
WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution provides for a
separation of powers of the Tribal government by the reservation and delegation
of specific powers to other entities of the Tribal government; and, except for these
specific limitations, all other general powers of government are embodied in the
Legislature's authority "to enact legislation, transact business, and otherwise speak
and act on behalf of the Citizen Potawatomi Nation in all matters on which the
Nation is empowered to act now or in the future"; and
WHEREAS, the United States Congress has appropriated a sum of money to the Citizen
Potawatomi Nation under Title V and VI of the Coronavirus Aid, Relief, and
Economic Security Act ("CARES") Act (hereafter, CVRF); and
WHEREAS, the CARES Act and guidance thereon promulgated by the United States Department
of the Treasury permits the Nation to administer its CVRF for all appropriate
purposes, and the Nation desires to do so, including the payment of payroll costs
for the Nation's public health and public safety employees, the establishment of a
program for business interruption grants, and the establishment of a program for
emergency financial assistance to individuals, and other purposes appropriate to
CVRF; and

WHEREAS, the Citizen Potawatomi Nation has received $7,500 through the Federal Highway
Administration Tribal Transportation Program safety funds to update its 2014
Transportation Safety Plan including crash data, interviews with Tribal
Transportation personnel and meetings with all concerned safety stakeholders; and
WHEREAS, the project must be listed on the Citizen Potawatomi Nation's Transportation
Improvement Program (TIP) before funds can be expended; and

assisted treatment using one of three FDA-approved medications for the
treatment of opioid use disorder. In addition to focusing on opioid use

WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of American
Indians with Constitutional authority under the Act of June 18, 1934 and
the Oklahoma Indian Welfare Act of June 26, 1936, (49 Stat. 1967); and
WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in
Tribal tradition, derived from a history of organized self-government since
time immemorial, and recognized by treaties with the United States and in
the Constitution of the United States; and
WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution provides
for a separation of powers of the Tribal government by the reservation and

funding in the amount of $62,608 under the Tribal Historic Preservation
Office Grant.

range of other capacities, including as a member of the Citizen Potawatomi Nation
Color Guard; and
WHEREAS, Julia Slavin has worked side by side with Representative Slavin as his beloved
wife and helpmate, assisting and supporting him in his many endeavors on behalf
of the Nation; and
WHEREAS, Representative Slavin walked on April 21, 2020, during the COVID19 pandemic,
which has precluded members of the Legislature from delivering, in person, words
of condolence and gratitude to Julia Slavin;

Stitt, seeking a declaratory judgment of the legal effect of the "shall
automatically renew" clause of Part 15(B) of the Model Tribal-State Gaming
Compact, and if necessary, injunctive relief against Governor Stitt; and,

WHEREAS, Resolution #20-33-ED&C, passed by the Legislature of the Citizen Potawatomi
Nation on January ??, 2020, authorized the Citizen Potawatomi Nation to

WHEREAS, on June 8, 2020, the proposed gaming agreements with the Comanche Nation and
Otoe-Missouri Tribe and the Governor of Oklahoma, J. Kevin Stitt were deemed
approved by the Department of the Interior; and,
WHEREAS, the Legislature of the Citizen Potawatomi Nation feels that it is in the best interest
of the Nation to join other tribes in litigation challenging the gaming agreements
in federal court.
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN
POTAWATOMI NATION that a resolution authorizing a letter of engagement with Sonosky,
Chambers, Sachse, Endreson & Perry, LLP for legal services in compact litigation and
authorizing the Tribal Chairman or his Designee to execute the agreement IS HEREBY

funding; and
WHEREAS, the Citizen Potawatomi Nation is proposing 1) purchase, construction or
rehabilitation of a structure for a public facility, 2) purchase, construction or
rehabilitation of new housing, 3) provision of eligible public services, or any
combination of the aforementioned for the purpose of preparing for, preventing,
and responding to COVID-19; and

WHEREAS, the total project cost is estimated to be $900,000 of which $900,000 (or 100%) is
the Federal share; and
