Finding Aid21-01-R&G-OR-T4- An Ordinance amending Title 4, Chapter 1, Election Code, of the Citizen Potawatomi Nation Tribal Code. TRANSCRIPTION: Citizen Potawatomi Nation Ordinance #21-01-R&G-OR-T4 AN ORDINANCE AMENDING TITLE 4, CHAPTER 1, ELECTION CODE, OF THE CITIZEN POTAWATOMI NATION TRIBAL CODE. WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of American Indians with Constitutional authority under Act of June 18, 1934 and the Oklahoma Indian Welfare Act of June 26, 1936, (49 Stat. 1967); and WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in Tribal tradition, derived from a history of organized self-government since time immemorial, and recognized by treaties with the United States and in the Constitution of the United States; and WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution provides for a separation of powers of the Tribal government by the reservation and delegation of specific powers to other entities of the Tribal government; and, except for these specific limitations, all other general powers of government are embodied in the Legislature's authority "to enact legislation, transact business, and otherwise speak and act on behalf of the Citizen Potawatomi Nation in all matters on which the Nation is empowered to act now or in the future;" and WHEREAS, the Tribal Code of the Citizen Potawatomi Nation is a living document and requires updating from time to time; and WHEREAS, the amendment of the following regulations governing tribal elections will define and streamline the process of filing for tribal office; and NOW, THEREFORE BE IT ORDAINED BY THE LEGISLATURE OF THE CITIZEN POTAWATOMI NATION that Title 4, Chapter 1, Section 4-1-147 of the Tribal Code of the Citizen Potawatomi Nation be amended to read as follows: Section 4-1-147 Filing Period The filing period for Tribal Elections shall begin on the second Wednesday of December prior to the next election and end on the second Wednesday of January prior to the next election unless amended by the Tribal Legislature prior to this beginning date. A candidate must file by United States Mail, Federal Express, or United Parcel Service, received no later than 5:00 PM of the second Wednesday of January or the end of a new filing period as designated by the Legislature. Ord.21-01-RG-Or-T4 NOW, THEREFORE BE IT ENACTED BY THE LEGISLATURE OF THE CITIZEN POTAWATOMI NATION that an Ordinance amending Title 4, Chapter 1, Section 4-1-147 of the Citizen Potawatomi Nation Tribal Code IS HEREBY APPROVED. EFFECTIVE DATE: This ordinance shall become effective upon adoption by the Legislature of the Citizen Potawatomi Nation. CERTIFICATION In his capacity as Secretary-Treasurer of the Citizen Potawatomi Nation, the undersigned hereby certifies that the above and foregoing ordinance is a true and correct copy of Ordinance #21-01-R&G-OR-T4, as approved on the 25th day of February, 2021, with 14 voting for, 0 opposed, 0 absent and 0 abstaining.
