RESOLUTION # 23-01-HHS
A RESOLUTION AUTHORIZING THE CITIZEN POTAWATOMI NATION'S
PROPOSED APPLICATION FOR FUNDING THROUGH THE UNITED STATES
DEPARTMENT OF HEALTH AND HUMAN SERVICES' SUBSTANCE ABUSE AND
MENTAL HEALTH SERVICES ADMINISTRATION FISCAL YEAR 2022 TRIBAL
OPIOID RESPONSE GRANT PROGRAM.
WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of American Indians
with Constitutional authority under the Act of June 18, 1934 and the Oklahoma
Indian Welfare Act of June 26, 1936, (49 Stat. 1967); and
WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in Tribal
tradition, derived from a history of organized self-government since time
immemorial, and recognized by treaties with the United States and in the
Constitution of the United States; and
WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution provides for a
separation of powers of the Tribal government by the reservation and delegation of
specific powers to other entities of the Tribal government; and, except for these
specific limitations, all other general powers of government are embodied in the
Legislature's authority "to enact legislation, transact business, and otherwise speak
and act on behalf of the Citizen Potawatomi Nation in all matters on which the
Nation is empowered to act now or in the future"; and
WHEREAS, the U.S. Department of Health and Human Services (DHHS) Substance Abuse and
Mental Health Services Administration (SAMHSA) Tribal Opioid Response (TOR)
grants program has announced the availability of grant funding to address the opioid
crisis in tribal communities by increasing access to FDA-approved medications for the
treatment of opioid use disorder (MOUD), and supporting the continuum of prevention,
harm reduction, treatment, and recovery support services for opioid use disorder (OUD)
and co-occurring substance use disorders. In addition to focusing on OUD, recipients
may also support the full continuum of prevention, harm reduction, treatment and
recovery support services for stimulant misuse and use disorders, including for cocaine
and methamphetamine.

WHEREAS, the Citizen Potawatomi Nation is eligible for, and desires to apply for, up to
$1,650,000 in Tribal Opioid Response funding.
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN
POTAWATOMI NATION that a resolution supporting the Citizen Potawatomi Nation's
proposed application for funding through the fy 2022 Department of Health and Human Services
Substance Abuse and Mental Health Services Administration Tribal Opioid Response grant
program IS HEREBY APPROVED.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that by act of this resolution and
consistent with the separation of powers defined in the Constitution, if awarded, an appropriation
of up to $1,650,000 from the FY 2022 DHHS SAMHSA TOR fund, for the implementation,
negotiation, operation, enforcement, procurement, settlement, and or completion of this contract,
compact, regulation or agreement by the Tribal Chairman or his designate IS HEREBY
AUTHORIZED.

A RESOLUTION APPROVING THE CITIZEN POTAWATOMI NATION'S
APPLICATION FOR FUNDING UNDER THE U.S. FISH AND WILDLIFE SERVICE
FISCAL YEAR 2022 TRIBAL WILDLIFE PROGRAM.
WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of American Indians
with Constitutional authority under the Act of June 18, 1934 and the Oklahoma
Indian Welfare Act of June 26, 1936, (49 Stat. 1967); and
WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in Tribal
tradition, derived from a history of organized self-government since time
immemorial, and recognized by treaties with the United States and in the
Constitution of the United States; and
WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution provides for a
separation of powers of the Tribal government by the reservation and delegation of
specific powers to other entities of the Tribal government; and, except for these
specific limitations, all other general powers of government are embodied in the

WHEREAS, the U.S. Fish and Wildlife Service, Native American Programs Office, is soliciting
applications for funding for Tribal Wildlife Grants for amounts up to $200,000,
with no match requirement; and
WHEREAS, the Citizen Potawatomi Nation has a need for funding to assist with veterinary costs
at the CPN Eagle Aviary; and
WHEREAS, the CPN Eagle Aviary Tribal Wildlife Grant project will provide necessary care to
birds at the facility via a partnership with an avian specialist veterinarian.

NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN
POTAWATOMI NATION that a resolution supporting the Citizen Potawatomi Nation's
application to the U.S. Fish and Wildlife Service fiscal year 2022 Tribal Wildlife Program IS
HEREBY APPROVED.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that by act of this resolution and

of federal funds up to $200,000 from the Fish and Wildlife Service Tribal Wildlife Grant Fund for

WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of
American Indians with Constitutional authority under the Act of June 18,

WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in

confirmation of the Legislature, the Chairman of the Citizen Potawatomi Nation
shall appoint members to the Election Committee and designate the Chairman of
the Election Committee”; and

and
WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution provides for a

specific powers to other entities of the Tribal government; and, except for these specific
limitations, all other general powers of government are embodied in the Legislature's
authority "to enact legislation, transact business, and otherwise speak and act on behalf of
the Citizen Potawatomi Nation in all matters on which the Nation is empowered to act
now or in the future"; and
WHEREAS, the Citizen Potawatomi Nation is a Member of the Indian Government in Good Standing
of the National Congress of American Indians and meets all requirements for Tribal
membership, pursuant to Article II, Section IIA of the Constitution of the National
Congress of American Indians (NCAI); and
WHEREAS, based on the tribal citizenry, the Nation shall have 180 votes according to Article II,
Section 6C of the NCAI Constitution and By-Laws;

members in Good Standing in NCAI in order to fulfill their responsibilities as Official Delegates to the
National Congress of American Indians Annual Session, Mid-Year Session, and Executive Council Session

WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution provides for a
separation of powers of the Tribal government by the reservation and delegation of
specific powers to other entities of the Tribal government; and, except for these specific
limitations, all other general powers of government are embodied in the Legislature's
authority “to enact legislation, transact business, and otherwise speak and act on behalf of
the Citizen Potawatomi Nation in all matters on which the Nation is empowered to act
now or in the future"; and
WHEREAS, the Legislature has been provided copies of budget containing every program budget
funded by the Department of the Interior/Bureau of Indian Affairs FY 2023 Annual
Funding Agreement including Department of Labor - PL 102-477 and Department of
Health and Human Services Child Care funds, Indirect Costs, Department of Health and
Human Services/Indian Health Service FY 2023 Annual Funding Agreement, Federal
Grants and Contracts, and Tribal Programs;
WHEREAS, the Legislature recognizes that budgets provided are intended as management and
planning tools for each program and service provided by the Citizen Potawatomi Nation;

Facilities Construction Branch under the authority of P.L. 86-121 for the construction of
sanitation facilities; and,
WHEREAS, IHS will provide the funds and the Citizen Potawatomi Nation will design and construct
the facilities under the provisions of the Self-Governance Compact that became effective
in fiscal year 1998. The total cost to IHS for providing sanitation facilities to 51 eligible
homes is $715,000 with a tribal contribution of $7,200 for a total of $722,200; and,

WHEREAS, the Citizen Potawatomi Nation fully supports the entire project for the construction of
sanitation facilities as provided by the provisions of its Self-Governance Compact with

Agreement 2018-2022 (MFA) with the IHS/DHHS executed by these parties and
effective in April, 2018, in connection with said compact.

Americans, which respond to local needs and are consistent with evidence-based
prevention practices; and

WHEREAS, the Citizen Potawatomi Nation recognizes the need for Title VI grant funds to provide care
to Native American elders and Native American elder caregivers and has participated in

years as one of the first grantees in 2000; and
WHEREAS, in achieving the goals of Part A and Part C of the Title VI Program, the Citizen Potawatomi
Nation will provide nutritional and supportive services including congregate and home-delivered
meals, information, and transportation, as well as caregiver support services
including support groups, referrals, information, assistance, and respite care to Native
American elders.
WHEREAS, the Citizen Potawatomi Nation is eligible for and desires to apply for up to $810,000.00 in
Title VI and Caregivers funding over 3 years.

RESOLUTION # 23-28-NR
A RESOLUTION APPROVING THE CITIZEN POTAWATOMI NATION'S
APPLICATION FOR FUNDING UNDER LINCOLN COUNTY, OKLAHOMA'S
ALLOCATION OF THE U.S. DEPARTMENT OF TREASURY'S AMERICAN
RESCUE PLAN ACT STATE AND LOCAL FISCAL RECOVERY FUND
PROGRAM TO EXPAND RURAL WATER DISTRICT #3.
WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of American
Indians with Constitutional authority under the Act of June 18, 1934 and
the Oklahoma Indian Welfare Act of June 26, 1936, (49 Stat. 1967); and
WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in
Tribal tradition, derived from a history of organized self-government since
time immemorial, and recognized by treaties with the United States and in
the Constitution of the United States; and
WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution provides
for a separation of powers of the Tribal government by the reservation and
delegation of specific powers to other entities of the Tribal government;
and, except for these specific limitations, all other general powers of
government are embodied in the Legislature's authority "to enact
legislation, transact business, and otherwise speak and act on behalf of the
Citizen Potawatomi Nation in all matters on which the Nation is empowered
to act now or in the future"; and,
WHEREAS, on August 22, 2022, the Lincoln County Commissioners approved an
allocation of Lincoln County's portion of the Department of Treasury's
American Rescue Plan Act (ARPA) State and Local Fiscal Recovery Fund
(SLFRF) in the amount of $604,000 for Rural Water District #3 to construct
a water line three miles west of State Highway 62 and State Highway 177
(Jacktown, Ok).

NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE
CITIZEN POTAWATOMI NATION that a resolution accepting the Lincoln County,
Oklahoma allocation of the U.S. Department Of Treasury's American Rescue Plan Act
State And Local Fiscal Recovery Fund Program to expand Rural Water District #3 IS
HEREBY APPROVED.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that by act of this resolution
and consistent with the separation of powers defined in the Constitution, if awarded, an
appropriation of funds up to $604,000 from the RWD3 Lincoln County ARPA SLFRF
Fund (or other applicable account) for the implementation, negotiation, operation,
enforcement, procurement, settlement, and or completion of this contract, compact,
regulation or agreement by the Tribal Chairman or his designate IS HEREBY
AUTHORIZED.
CERTIFICATION
The Legislature of the Citizen Potawatomi Nation hereby certifies that the above is a true
and exact copy of Resolution POT #23-28-NR, as approved on the 1st day of December,

RESOLUTION # 23-29-NR
A RESOLUTION ADOPTING THE REVISED TRIBAL MULTI-HAZARD
MITIGATION PLAN FOR THE CITIZEN POTAWATOMI NATION.
WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of
American Indians with Constitutional authority under the Act of June 18,
1934 and the Oklahoma Indian Welfare Act of June 26, 1936, (49 Stat.
1967); and
WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in
Tribal tradition, derived from a history of organized self-government since
time immemorial, and recognized by treaties with the United States and in
the Constitution of the United States; and
WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution
provides for a separation of powers of the Tribal government by the
reservation and delegation of specific powers to other entities of the Tribal
government; and, except for these specific limitations, all other general
powers of government are embodied in the Legislature's authority "to
enact legislation, transact business, and otherwise speak and act on behalf
of the Citizen Potawatomi Nation in all matters on which the Nation is
empowered to act now or in the future"; and
WHEREAS, the Nation has coordinated and collaborated with state agencies,
appropriate federal agencies and community members and developed a
Tribal Multi-Hazard Mitigation Plan that has been updated and approved
for adoption by the Federal Emergency Management Agency (FEMA);
and
WHEREAS, the purpose of the Tribal Multi-Hazard Mitigation Plan is to substantially
reduce risk of future loss of life and damage to property by developing
cost effective strategies to make the tribal community more disaster
resistant; and

WHEREAS, implementation of the planned strategies will reduce the impact of a
disaster, speeding the recovery phase of a disaster.
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE
CITIZEN POTAWATOMI NATION that a resolution adopting the revised Tribal
Multi-Hazard Mitigation Plan of the Citizen Potawatomi Nation IS HEREBY
APPROVED.

A RESOLUTION APPROVING A FEE-TO-TRUST ACQUISITION APPLICATION TO
THE BUREAU OF INDIAN AFFAIRS AND REQUEST FOR TRUST ACQUISITION OF
THE (NON-GAMING/ON RESERVATION) J AND A BROWN - ASHER PROPERTY
WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of American Indians with
Constitutional authority under the Act of June 18, 1934 and the Oklahoma Indian Welfare
Act of June 26, 1936, (49 Stat. 1967); and
WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in Tribal tradition,
derived from a history of organized self-government since time immemorial, and
recognized by treaties with the United States and in the Constitution of the United States;
and
WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution provides for a
separation of powers of the Tribal government by the reservation and delegation of
specific powers to other entities of the Tribal government; and, except for these specific
limitations, all other general powers of government are embodied in the Legislature's

WHEREAS, the Citizen Potawatomi Nation is making application to the Southern Plains Regional
Office of the Bureau of Indian Affairs to request transfer of "fee-simple" title to the
"United States of America in Trust for the Citizen Potawatomi Nation"; and
WHEREAS, the Legislature believes that increasing the tribal land base furthers the pursuit of Tribal
Self Determination and allows future generations of tribal leaders to have the flexibility
to use the land for the health, welfare, and sovereignty of the Citizen Potawatomi Nation;
and
WHEREAS, Section 5 of the Indian Reorganization Act of June 18, 1934 (48 Stat. 985; 25 USC 465)
provides authority for the Fee-to-Trust acquisition; and

WHEREAS, the property is ON-reservation or within the former reservation boundaries of the Citizen
Potawatomi Nation, legally described in Attachment A and listed in the Pottawatomie
County Treasurer's records as parcel ID #0000-18-006-004-002-00 (J and A Brown -
Asher property) and
WHEREAS, the property was purchased with tribal funds for NON-gaming use and the land, to which
the Citizen Potawatomi Nation owns the surface rights in fee simple, is not currently
under lease; and
WHEREAS, the current and proposed land use is economic development, Tribal Self-Determination and
increasing the tribal land base which furthers the pursuit of Tribal Self Determination and
allows future generations of tribal leaders to have the flexibility to use the land for the
health, welfare, and sovereignty of the Citizen Potawatomi Nation; and,
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN
POTAWATOMI NATION that a resolution supporting the fee-to-trust acquisition application to the
Southern Plains Regional Office of the Bureau of Indian Affairs and trust acquisition of the J and A Brown
- Asher property, IS HEREBY APPROVED.
