Finding AidCitizen Potawatoml Nation Ordinance #25-01-Or-T5 AN ORDINANCE AMENDING TITLE 5, LEGISLATIVE BRANCH, OF THE TRIBAL CODE OF THE CITIZEN POTAWATOMI NATION. WHEREAS, the Tribal Code of the Citizen Potawatomi Nation requires updating from time to time in order to remain responsive to current needs, and WHEREAS, there is a need to update the Legislative Branch section of the code to reflect current practices and to protect and promote the growth of the Nation's economy. NOW, THEREFORE BE IT ORDAINED BY THE LEGISLATURE OF THE CITIZEN POTAWATOMI NATION that the portions of Title 5 of the Tribal Code of the Citizen Potawatomi Nation (Legislative Branch) expressly addressed herein are hereby amended to read as follows: Section 5-2-105 Forms of Legislative Activity (A) Committees shall consider all legislation in the form of Bills, each assigned sequential numbering as scheduled for Committee assignment by the Chairman. Bill numbering shall also contain numerical reference to the affected Tribal Code. Resolution may be assigned directly to the full Legislature without assignment to a Committee at the discretion of the Chairman. (B) All Bills shall be submitted in draft or concept form to the Legislative Services Department prior to assignment to a Committee for purposes of verification of constitutionality, consistency, savings clauses, Code footnoting and avoidance of duplication. The Legislative Services Department shall be directed by the Tribal Attorney. (C) Matters of temporary interest shall be in the form of Resolutions. Matters of continuing or permanent interest shall be in the form of Laws or Ordinances embodied in the Tribal Code. (D) There is reserved to the Citizen Potawatomi Nation Indian Council, as the Council is described in the Nation's Constitution Article 5, Sections 1-3, the authority to approve any action of the Legislature and/or of the Nation's Executive Officer(s), or to delegate specific authority to the Legislature and/or the Nation's Executive Officer(s), to take particular actions, prior to any such action of the Legislature or the Nation's Executive Officer(s) becoming effective, which action results in the sale, gift, relinquishment, exchange, trade, or other external transfer of any asset or property of the Nation or interest in any asset or property of the Nation, whether real property, personal property, intellectual property or other form of property, which has a value equal to, or in excess, of Ten Million Dollars ($10,000,000.00). NOW, THEREFORE BE IT ENACTED BY THE LEGISLATURE OF THE CITIZEN POTAWATOMI NATION that an Ordinance amending subsections of and enacting a new subsection of Title 5, Legislative Branch, of the Citizen Potawatomi Nation Tribal Code IS HEREBY APPROVED. EFFECTIVE DATE: This ordinance shall become effective upon adoption by the Legislature of the Citizen Potawatomi Nation. CERTIFICATION In his capacity as Secretary-Treasurer of the Citizen Potawatomi Nation, the undersigned hereby certifies that the above and foregoing ordinance is a true and correct copy of Ordinance #25-01-Or-T5, as approved on the 5th day of December, 2024 with 14 voting for, 0 opposed, 1 absent and 1 abstaining. Barrett, Jr. Tribal Chairman Citizen Potawatomi Nation Ordinance #25-02-Or-T44 AN ORDINANCE AMENDING TITLE 44, REVENUE AND TAXATION, OF THE TRIBAL CODE OF THE CITIZEN POTAWATOMI NATION. WHEREAS, the Tribal, Code of the Citizen Potawatomi Nation requires updating from time to time in order to remain responsive to current needs, and WHEREAS, there is a need to update the revenue and taxation code to reflect current rates and practices. NOW, THEREFORE BE IT ORDAINED BY THE LEGISLATURE OF THE CITIZEN POTAWATOMI NATION that the portions of Title 44 of the Tribal Code of the Citizen Potawatomi Nation (Revenue and Taxation) expressly addressed herein are hereby amended to read as follows: Section 44-3-102 Tax on Sales There is hereby levied upon the sale of property or goods within the tribal, jurisdiction a tax at rate set by the Tax Commission, which shall be a percentage of the actual sales price thereof exclusive of any rebates. If a sale is consummated by trade, barter, or exchange for anything other than money, the tax shall be computed at the fair market value of the property or goods sold. (A) The impact of the taxes imposed by this chapter is declared to be on the consumer and shall be added to the purchase price of the property or goods sold and recovered from the consumer. (B) Every retailer shall show the amount of such taxes paid as a separate item on any invoices or receipts which they may issue. NOW, THEREFORE BE IT ENACTED BY THE LEGISLATURE OF THE CITIZEN POTAWATOMI NATION that an Ordinance amending subsections of and enacting a new subsection of Title 44, Revenue and Taxation, of the Citizen Potawatomi Nation Tribal Code IS HEREBY APPROVED. EFFECTIVE DATE: This ordinance shall become effective upon adoption by the Legislature of the Citizen Potawatomi Nation. CERTIFICATION In his capacity as Secretary-Treasurer of the Citizen Potawatomi Nation, the undersigned hereby certifies that the above and foregoing ordinance is a true and correct copy of Ordinance #25-02-Or-T44, as approved on the 29th day of May, 2025 with 13 voting for, 0 opposed, 2 absent and 0 abstaining.
