WHEREAS, The Citizen Band Potawatomi Indians of Oklahoma
is a Federally recognized Tribe of American Indians
under authority of the Oklahoma Indian Welfare Act
of 1936,
AND
WHEREAS, The Citizen Band Potawatomi Indians of Oklahoma are
dedicated to the continuing growth and progress of
Fire Lake Golf Course as an on going tribal enterprise,
AND
WHEREAS, The Chairman and Secretary-Treasurer are authorized
by the Citizen Band Potawatomi Tribe of Oklahoma
Constitution to have General Supervision of the
Business Affairs of the tribe and handle all monies,

COMMUNITY HEALTH REPRESENTATIVE PROGRAM FOR FISCAL YEAR 1984.
WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma is interest in
the further development of tribal capabilities for operations
of health services for the benefit of all tribal members, and
WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma is fully aware
of its options of contracts and hereby chooses to implement a
community Health Representative Program Contract for FY 84
under the authority of P.L. 93-638, and
WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma is a federally
recognized tribe of American Indians under authority granted
by the Indian Recognition Act of 1934, and
WHEREAS, a resolution duly adopted by the Citizen Band Potawatomi Indians
of Oklahoma addressed to the Area Director, Oklahoma City Area,
IHS, authorizing John A. Barrett, Jr., Tribal Administrator, to
acquire funds for the Community Health Representative Program
under P.L. 93-638 contracting authority, and
WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma is eligible for
consideration of grant and contract applications under P.L. 93-638
funds, and
WHEREAS, there is a need to provide home health services, health education
services, health maintenance services, disease control services,
and emergency Medical services programs, and
WHEREAS, the proposed and requested commencement date for the executed
Contract in October 1, 1983 through September 30, 1984, and
WHEREAS, the proposed term of the contract document is twelve (12) months, and
WHEREAS, John A. Barrett Jr., Tribal Administrator is authorized to conduct
contract negotiations and is the tribal official authorized to enter
into a contracted agreement with IHS on behalf of the governing body,
and

WHEREAS, these authorities will remain in effect until such time as the
Business Committee chooses to withdraw said authorizations, and
by subsequent resolution and
WHEREAS, the Business Committee reserves the right ot review the contract

RESOLUTION POTT# 84-6
A TRIBAL RESOLUTION MAKING CERTAIN ASSURANCES IN CONNECTION WITH
AN APPLICATION FOR THE COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM,
JOBS BILL (ACT OF MARCH 24, 1983, P.L. 98-3, 98 STAT. 13) FOR FISCAL YEAR 1983.
WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma have been determined eligible by the Department of Housing and Urban Development to submit an application for a grant to fund certain eligible Community Development Block Grant Program activities and in connection with such application does resolve and make certain assurances:
I. Prior to the submission of its application, the governing body of the applicant has followed traditional means of citizen involvement which has included the following:
(1) Furnished members information concerning amounts of funds available for proposed community development and housing activities and the range of activities that may be undertaken;
(2) Held one or more meetings to obtain the views of members on community development and housing needs. Meetings have been scheduled in ways and at times that allowed participation by members;
(3) Developed and published or posted the community development statement in a manner as to afford affected members an opportunity to examine its contents and to submit comments; and
(4) Afforded members an opportunity to review and comment on the applicant's performance under any active community development block grant.
II. Additionally, the applicant has:
(1) Considered any comments and views expressed by Tribal members and has modified its application as deemed appropriate; and
(2) Made the modified application available to members.
III. No part of paragraph II shall be construed to restrict the responsibility and authority of the applicant for the development of the application and the execution of its CDBG Program. Accordingly, the citizen participation requirements of Paragraph I do not include concurrence by any person or group involved in citizen participation in making final determinations concerning the funding’s and contents of the application.
IV.
(1) To the extent practicable, the Tribe will utilize funds awarded under the ""Jobs"" Program in a manner which maximizes immediate creation of new employment opportunities to individuals who were unemployed at least fifteen (15) of the last twenty-six (26) weeks immediately preceding March 24, 1983; and
(2) Jobs Bill funds will be obligated and disbursed as rapidly as possible so as to quickly assist the unemployed and the needy.

A RESOLUTION TO AUTHORIZE THE CITIZEN BAND POTAWATOMI INDIANS OF OKLAHOMA TRIBAL CHAIRMAN, ROBERT LEON BRUNO, AND THE SECRETARY-TREASURER, THELMA WANO BATEMAN, TO PURCHASE THE APPROXIMATELY 16.26 ACRES AND THE 4,000 SQUARE FOOT BUILDING LOCATED ON THE APPROXIMATELY 16.26 ACRES FOR A COMMODITY FOOD DISTRIBUTION PROGRAM AS AUTHORIZED BY THIS RESOLUTION.
WHEREAS, The Citizen Band Potawatomi Indians of Oklahoma is a Federally recognized
Tribe of American Indians under authority of the Oklahoma Indian Welfare Act of 1936,
AND
WHEREAS, The Citizen Band Potawatomi Indians of Oklahoma are interested in purchasing approximately 16.26 acres of land and 4,000 square foot building located on the approximately 16.26 acres to house and operate the Commodity Food Distribution Program for the benefit of all Indians in the traditional Potawatomi Reservation boundaries,
AND
WHEREAS, the real estate shall here by be legally described as:
Beginning at the Northwest Corner of the Northeast Quarter of the Northeast Quarter of Section 31, Township 10 North, Range 4 East of the Indian Meridian, thence South 1320 feet, thence West 720 feet to a point on the East line of Right-of-Way of A.T.&S.F. Railroad Company, thence in a Northeasterly direction along the East line of said Right-of-Way to a point in Section Line between Sections 30 and 31, thence East along said Section Line 447 feet to place of beginning, except the WYE of the A.T.&S.F. Railroad Company, containing 16.26 acres, more or less;
AND
WHEREAS, the purchase price of the approximately 16.26 acres and the 4,000 square foot building shall not exceed the $135,000.00 asking price,
AND
WHEREAS, the purchase of the land and the building shall be in keeping with the contract agreement as established by Steve Parker, authorized Attorney for the Tribe,
AND
WHEREAS, the land and the building shall be purchased through and in keeping with the loan and its conditions as granted and established by the Federal
National Bank in Shawnee, Oklahoma;
AND
WHEREAS, Robert Leon Bruno, Tribal Chairman, and Thelma Wano Bateman, Secretary-
Treasurer, are authorized to enter into the purchase contract pursuant to this matter,

THEREFORE BE IT RESOLVED that Robert Leon Bruno, Tribal Chairman, and Thelma
Wano Bateman, Secretary-Treasurer, of the Citizen Band Potawatomi Indians of
Oklahoma shall be authorized to act in behalf of the Tribe to enter into the purchase contract and the loan contract for approximately 16.26 acres of land and a 4,000 square foot building on the approximately 16.26 acres of land.

THEREFORE BE IT RESOLVED, that the Citizen Band Potawatomi Indians of
Oklahoma do hereby acknowledge the CTSA Head Start JOM Indian Education
Committee as the authority responsible for the administration of the
Indian Education Program (JOM), Citizen Band Potawatomi Head Start of
Oklahoma, Contract #B00C14205378, FY82 with the rights and responsibilities
belonging thereto.

WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma is a Federally
recognized Tribe of American Indians organized under the Oklahoma
Indian Welfare Act of June 26, 1936; and the General Council
is the governing body of the Tribe,
AND;
WHEREAS, the Citizen Band Potawatomi Business Committee has authority
to act in behalf of the Tribe as authorized in the Tribal
Consitution and By-Laws,
AND
WHEREAS, any lawsuit filed against the Tribe presents a threat to the
Tribe's Sovereign Status,
AND
WHEREAS, any lawsuit filed against a member of the Business Committee
who is acting within his or her authority and official capacity

A RESOLUTION AUTHORIZING THE FIRM OF LANDES ENGINEERING, P.O. BOX 1032, SHAWNEE, OK,
TO PERFORM THE FOLLOWING LISTED FUNCTIONS PURSUANT TO THE TRIBES FY83 COMMUNITY DEVELOPMENT BLOCK GRANT.
WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma is a federally recognized
Tribe of American Indians under authority granted by the Oklahoma Indian
Welfare Act of 1936; and
WHEREAS, the Citizen Band Potawatomi Business Committee has authority to act in
behalf of the Tribe as authorized in the Tribal Consitution and By-Laws;
and,
WHEREAS, the following services are required to complete the FY83 project, this
resolution shall authorize the firm of Landes Engineering to perform the
following tasks,
NOW, THEREFORE BE IT RESOLVED, that this resolution in the amounts authorized herein,
is contingent upon full funding from the Department of Housing and Urban Development
in the amount of $339,500.00. This Resolution shall be viewed by the parties hereto as
a two (2) phase agreement. Should the Tribe receive partial funding for one of the
two activities, those being a mobile home park and/or a gasoline station/convenience
store facility, this resolution shall be binding upon the parties hereto and the covenants
herein respectively in the amounts of - $4,100 and/or $21,300, said amounts payable
to the Contractor by the Tribe upon partial success of the two part Community
Development Block Grant application for FY83.
Should the Tribe not be awarded any Community Development Block Grant funds for FY83,
this Contract shall be rendered null and void, and the Tribe shall be held harmless
for any preparation costs incurred by the Contractor pursuant to such preparation.
BE IT FURTHER RESOLVED, it is agreed that the Landes Engineering Firm will be paid
as follows:

shall further serve as the Tribal Resolution, from this Tribe,
necessary to enter into such contract, and
WHEREAS, the Five Tribes have deemed it necessary to have administrative
and decision making authority regarding the use and purpose of
the Shawnee Tribal Equity Health Care Program in the following
program service areas:
(1) Hospital and Clinics,
(2) Alcohol
Program, and
(3) Community Health Nursing, and
WHEREAS, the proposed term of the contract is twelve (12) months, and
WHEREAS, the proposed commencement date for the execution of the contract
is September 1, 1983, or at the earliest possible date thereafter,

Tribes, or their designees, are authorized to coordinate proposal

Tribes of Oklahoma as the primary contract agent for Shawnee Tribal Equity
Health Care Program for FY83, and
BE IT FURTHER RESOLVED that the Citizen Band Potawatomi Indians of Oklahoma
will provide to the Absentee Shawnee, the Iowa, the Kickapoo, and the Sac and
Fox Tribes of Oklahoma reports in accordance with administrative provisions of
Article III and Article IV of P.L. 93-638 Cost Reimbursement Contracts, and
BE IT FURTHER RESOLVED that these authorities shall remain in effect for the
term of the proposed project or until such time as all parties inclusive,
the Absentee Shawnee, the Iowa, the Kickapoo, the Sac and Fox, and the Citizen
Band Potawatomi shall agree unanimously to an alternative plan for the
disposition of project resources through duly approved and certified Tribal
Resolutions, and

recognize and honor this Resolution as:
1. acceptance by the Citizen Band Potawatomi Indians of Oklahoma of
authorities granted by the Absentee Shawnee, the Iowa, the Kickapoo
and the Sac and Fox Tribes of Oklahoma for the Citizen Band Potawatomi
Indians of Oklahoma to serve as primary contract agent for such
Equity Health Care Program as may be awarded during fiscal year 1983,and
2. a concurring Resolution, as mandated by P.L. 93-638 statute and regulation,
of the Tribe for award of such Equity Health Care Program
contract as may be awarded to the Citizen Band Potawatomi Indians
of Oklahoma.

WHEREAS, each of the Five Tribes reserves the right to review the contract
document and any amendments thereto prior to signature by the
designated Tribal Administrator of the Citizen Band Potawatomi Indians

THEREFORE BE IT RESOLVED that the Citizen Band Potawatomi shall act in behalf
of itself, the Absentee Shawnee, the Iowa, the Kickapoo, and the Sac and Fox
Tribes of Oklahoma as the primary contract agent for Shawnee Tribal Equity
Health Care Program for FY83, and
BE IT FURTHER RESOLVED that the Citizen Band Potawatomi Indians of Oklahoma
will provide to the Absentee Shawnee, the Iowa, the Kickapoo, and the Sac and
Fox Tribes of Oklahoma reports in accordance with administrative provisions of
Article III and Article IV of P.L. 93-638 Cost Reimbursement Contracts, and
BE IT FURTHER RESOLVED that these authorities shall remain in effect for the
term of the proposed project or until such time as all parties inclusive,
the Absentee Shawnee, the Iowa, the Kickapoo, the Sac and Fox, and the Citizen
Band Potawatomi shall agree unanimously to an alternative plan for the
disposition of project resources through duly approved and certified Tribal
Resolutions, and

1. acceptance by the Citizen Band Potawatomi Indians of Oklahoma of

and the Sac and Fox Tribes of Oklahoma for the Citizen Band Potawatomi

WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma is a federally
recognized Tribe of American Indians under authority of the Oklahoma

WHEREAS, Public Law 95-627 Section 17 of the Child Nutrition Act of 1966,
as amended extends WIC Program funding through Fiscal Year 1984,
and
WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma is responsible
for the administration of the WIC Program and shall do so in
accordance with program regulations, OMB circulars A-87, A-90, A-95,
A-102, A-110, 7CFR-3015 and any other pertinent guidelines issued
by the United States Department of Agriculture, and
WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma WIC Program will
accept all administrative functions of the Tonkawa WIC program
as determined to be in accordance with program regulations, and

Course have need of fill sand and washed class A sand in the normal course
of construction;

WHEREAS: Sand Dredging Company, Inc. , has agreed to provide sand at a reduced price
in return for the Tribe’s $14,500 in Certificates of Deposit at the
Farmers and Merchants Bank as well as assigning the twenty cents (20¢)
per ton royalty on and sand sales from their property;
AND
WHEREAS: Sand Dredging Company, Inc., has agreed to put up as security a 2/9
interest in 160 acres of property,

draw a contract and security agreement for signature by the Chairman and Secretary-

THE PRACTICE OF WILDLIFE MANAGEMENT WITHIN SOUTH POTTAWATOMIE COUNTY.
WHEREAS, The Citizen Band Potawatomi Indians of Oklahoma is a federally
recognized Tribe of American Indians under authority of the
Oklahoma Indian Welfare Act of 1936; and
WHEREAS, The Citizen Band Potawatomi Indians of Oklahoma Business
Committee, as the governing body of the Tribe, is charged
by the Tribal Constitution and By-Laws to transact business
and otherwise speak or act on behalf of the Tribe in all
matters on which the Tribe is empowered to act; and
WHEREAS, The Citizen Band Potawatomi Indians of Oklahoma desire to
preserve, by necessity and tradition, the conservation and
prudent management of wildlife; and
WHEREAS, The Citizen Band Potawatomi Indians of Oklahoma Business
Committee believe that it is for the common good of all residents
of Pottawatomie County that a policy of utility and cooperation
between the Tribe and the State of Oklahoma Fish and Wildlife
Department be established; and
THEREFORE BE IT RESOLVED that the Citizen Band Potawatomi Indians of
Oklahoma Business Committee authorizes and approves a fish
and wildlife program which shall have the following functions:
(1.) The establishment by membership of the Potawatomi
Sportsmen's Club, whose members subscribe to the
purposes stated above and reside within the Pottawatomie
County boundaries, and agree to fully cooperate with
the State of Oklahoma hunting, fishing and conservation
laws, rules and regulations.
(2.) The cost of cooperation with the State of Oklahoma
and the Citizen Band Potawatomi Indians of Oklahoma's
Potawatomi Sportsmen's Club shall be $10 annually;
the operating costs to be borne entirely by membership
fees and contributions of members, which may be matched
annually by the Business Committee by an appropriation
not to exceed $200.
(3.) A game warden will be appointed who will serve at
no salary other than expenses and whose function
will be:
(a.) To represent the Tribe at meetings of the
Sportsmen's Club and in contacts with the
State of Oklahoma, other individuals or
organizations;
(b.) To meet annually with the Director of the
Oklahoma State Game Hatchery and to become

familiar with and assure membership cooperation
with laws, rules and regulations of The State of
Oklahoma and those adopted herein and hereafter
by the Tribe;
(c.) To place requisitions for quail and/or wild turkey
hatchlings which will be brought to South Pottawatomie
County (old reservation area) to be cared
for and released in accordance with the requirements
of the Oklahoma Game Hatchery and the
Citizen Band Potawatomi Tribe of Oklahoma;
(d.) To establish membership and issue membership
cards to those citizens of Pottawatomie County
who apply for membership; to accept membership
fees and contributing donations. The game warden
may not delegate his duty to accept fees and
donations without prior approval of the Business
Committee. All collections of donations by the
game warden are to be receipted by numerically
accountable cash receipts and all such collections
are to be paid intact to the Tribal Accounting
Department within 24 hours of collection for
deposit in a Sportsmen's Club account. All
disbursements are to be made by the system
established and maintained by the Accounting
Department in accordance with Business Committee
directives.
(e.) The game warden has the responsibility of recommending
and presenting to the Business Committee
annually rules and regulations adopted by the
Club to insure the orderly organization, execution
and control of the functions herein stated.

WHEREAS, the settlement of this case has taken three years and is still
unsettled; and
WHEREAS, the Tribal Business Committee sees it in the best interest of
Tribal Accounts to be invested at the highest rate of interest
in insured accounts; and
WHEREAS, the Business Committee of the Citizen Band Potawatomi Indians
of Oklahoma agree to exercise the right to P.L. 93-638 that
part of which governs the operations and investments of the
Tribe, now
THEREFORE BE IT RESOLVED, that the Tribe here-by notifies the Bureau
of Indian Affairs not to invest any Citizen Band Potawatomi
Indians Tribal funds into uninsured accounts effective as of
the day this resolution is certified.

WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma is a Federally
recognized Tribe of American Indians under authority of the
Oklahoma Indian Welfare Act of 1936; and
WHEREAS, the Constitution and By-Laws reserves exclusive power only in
those areas relating to claims and rights growing out of treaties
and elections, and
WHEREAS, the quorum at a General Council is, by Tribal Constitution and
By-Laws, fifty people and a majority of twenty-six (26) may elect
and act on behalf of nearly eleven thousand Tribal Members, and
WHEREAS, The Citizen Band Potawatomi Tribe of Oklahoma Business Committee
feels that this quorum and majority is not representative of
the will of the majority of all Tribal Members, and
WHEREAS, the Tribal Constitution and By-Laws ""Article VII - Elections""
provides in Section 1, that elections will be held ""under
rules and regulations prescribed by the Business Committee,"" and
WHEREAS, “Article XI, Amendments” and “By-Laws, Article IV, Quorum"" of
the Constitution and By-Laws recognizes a referendum vote as
the only means of amending and enacting the Tribal Constitution
in a truly representative manner and that equal representation
is a goal of any just and concerned government, and
WHEREAS, while the language “to transact business"" in Article IV of the
By-Laws means the conduct of the General Council Meeting; accepting
reports of the Secretary-Treasurer and other Tribal officials and
employees, discussion of Resolutions to be submitted to referendum
vote, installing elected officials, elections and reports
or the Election Committee, it does not mean any action which
denies a vote to membership of the Council, as described in the
Constitution and By-Laws “Articles III - Membership of Council"",

A RESOLUTION FOR THE ADOPTION OF POLICY AND REGULATION BY WHICH THE CITIZEN
BAND POTAWATOMI GRIEVANCE COMMITTEE SHALL ACT PURSUANT TO
ARTICLE IX OF THE CITIZEN BAND POTAWATOMI CONSTITUTION AND BY-LAWS.
WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma is a
Federally recognized Tribe of American Indians under authority
of the Oklahoma Indian Welfare Act of 1936; and
WHEREAS, the Citizen Band Potawatomi Business Committee is empowered
to act in behalf of the Tribe by the Tribal Constitution
and By-Laws; and
WHEREAS, in the interest of prompting a just and equitable application
of Article IX of the Constitution; and
WHEREAS, it is the directive of the Citizen Band Potawatomi Business
Committee in agreement with a majority of the duly elected
Grievance Committee Members that the following policies,
regulations, and definitions shall apply to Article III of
the By-Laws of the Constitution of the Citizen Band
Potawatomi Tribe of Oklahoma:
1. Investigation of complaints of misconduct in-office shall
require an affidavit of the complaintant detailing the
specific misconduct. This affidavit will be given to
the accused to prepare an affidavit of response.
2. The Grievance Committee will then investigate the validity
of the complaint by substantiation of the specific allegation
of the complaintant and the rebuttal of the accused.
3. After the weight of evidence in the complaint is considered,
the Grievance Committee will draft a Resolution stating
its findings, recording the vote, and calling a Special
General Council should it be required. This Resolution
will be submitted to the complaintant, accused, and the
Business Committee as a whole at least thirty (30) days
prior to the Special General Council.
4. After giving the accused a public hearing in Special
General Council, the Grievance Committee shall submit the
Grievance Committee Resolution, the Resolution of the
General Council for referendum vote, the grievance filed,
both affidavits and a ballot indicating a choice for
or against removal from office to all members of the
General Council. These ballots will be cast in accordance
to the Election and Voting Ordinance of the Citizen Band
Potawatomi Tribe pertaining to a referendum vote on the
Resolutions of the General Council, including provisions
for a filing fee to defray expenses or submission of a
petition in lieu of a filing fee. The filing fee or
petition in lieu of a filing fee will be paid or submitted
by the complaintant.

5. After certification of the results of the Referendum
Vote, by the Election Committee, the Grievance Committee
will either remove the accused and call for the election
of a successor in accordance to the Election and Voting
Ordinance, or will inform the accused in writing of the

6. All records of the removal and new election will be
maintained by the Election Committee. Records of the
investigation will be maintained by the Grievance Committee.

WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma is a Federally
recognized Tribe of American Indians under authority of the
Oklahoma Indian Welfare Act of 1936; and
WHEREAS, the Citizen Band Potawatomi Business Committee is empowered
to act in behalf of the Tribe by the Tribal Constitution and
By-Laws; and
WHEREAS, the Citizen Band Potawatomi Business Committee is committed
to creating a more efficient and competent Tribal Staff to
the betterment of Tribal operations and affairs; and
WHEREAS, it is the directive of the Citizen Band Potawatomi Business
Committee that the following changes be made in the Personnel
Policies of the Tribe in the interest of the beforementioned
commitment, to wit:
1. Strike sections titled “Appeal and Grievance Procedures"",
page 18 through page 22, #6, and page 23, #2.
2. Replace the Stricken passages to read as follows:
APPEAL AND GRIEVANCE PROCEDURE
1 ) Any permanent employee who wishes to appeal a
personnel action by any level of supervisor may
file a written appeal with the Tribal Administrator.
The Tribal Administrator will interview both the
Supervisor, and Employee and make a final determination.
Any further appeal will be through a personal intercession
by a Business Committee Member who may choose
to present the appeal to the Business Committee. If
no Member of the Business Committee chooses to hear
the appeal, the decision of the Tribal Administrator
is final.
2) (as reads on page 22, #7)
3. Revise page 23, #2 and #3 to read as follows:
2 ) Involuntary termination (dismissal) - When circumstances
so warrant an employee may have to be involuntarily
terminated. Such action shall be recommended by the
employee’s supervisor, and approved by the next higher
authority following careful consideration of all
aspects of the specific case. A written notice of
termination signed by the employee’s supervisor or
Program Director which states the reason for dismissal
shall be given.
3) Lay-Offs - A layoff shall be construed as removal from
a position because of the abolition of the position
due to reorganization, funding, program reduction, or
other administrative readjustments. Personnel who
are layed-off are eligible for rehiring.

WHEREAS, The Citizen Band Potawatomi Indians of Oklahoma is a federally
recognized Tribe of American Indians under authority of the
Oklahoma Indian Welfare Act of 1936; and
WHEREAS, The Citizen Band Potawatomi Business Committee is empowered
to act in behalf of the Tribe by the Tribal Constitution and
By-Laws; and
WHEREAS, The Citizen Band Potawatomi Business Committee is committed
to creating a more efficient Tribal Staff to the betterment

1.) That all Committeemembers will discharge their duties
as prescribed by the By-Laws.

by a Staff Member has been filed.
3.) That those Officers whose duties involve attendance
at the Tribal Offices, Constitutional oversight,
maintenance of records, authentication of accounts,
or any other interaction with the Tribal Staff must
conduct themselves in a manner that provides the
least disruption of Tribal business. The Tribal
Administrator will submit any and all documents,
records and reports required for fulfillment of any
Officer's Constitutional duties by request from
the Business Committee. Business Committeemembers will
follow the chain of command in all business with the
Tribal Staff. The Business Committee will establish
for themselves a designated work and records storage
area separate from the conduct of daily administration
in order to provide for clearly defined lines of
authority for Tribal Staff. Individual Business
Committeemembers may be restricted or censured for
disruptive behavior or violations of the chain of
command described as follows:

more complete network of Indian child protective services in the Potawatomi tribal
service area, and better coordination with existing child protective services in
the state of Oklahoma, and;
WHEREAS, the Citizen Band Potawatomi Indians desires to impliment the aforementioned
programs by applying for funds in the amount of $210,000 from the Office of Human
Development Services FY-1984 Coordinated Discretionary Funds Program, now
THEREFORE, BE IT RESOLVED, that the Citizen Band Potawatomi Business Committee voted
to support the application for funds in the amount of $210,000 from the office of
Human Development Services FY-1984 Coordinated Discretionary Funds Porgram, for
the purpose of establishing a state wide child protection team: Hot Line, Clearing
House, and Technical Assistance project.

A RESOLUTION FOR THE ADOPTION OF CERTAIN PURPOSES, DEFINITIONS AND
REGULATIONS FOR THE PURPOSE OF FORMING THE DEPARTMENT OF SOLID WASTE
MANAGEMENT.
WHEREAS, The Citizen Band Potawatomi Indians of Oklahoma is a
federally recognized Tribe of American Indians under
authority of the Oklahoma Indian Welfare Act of 1936:
and
WHEREAS, The Citizen Band Potawatomi Business Committee is
empowered to act in behalf of the Tribe by the Tribal
Constitution and By-Laws; and
WHEREAS, The Citizen Band Potawtomi Business Committee is
committed to creating a more efficient Tribal Staff
to the betterment of Tribal operations and affairs;
and
WHEREAS, The Department of Solid Waste Management and the
following PURPOSE, DEFINITIONS and attached Rules
and Regulations: (see attached - Solid Waste
Management Rules and Regulations), are enacted,
to wit:
100. PURPOSE
It is the purpose of this resolution and it is hereby de-
clared to be the policy of this Citizen Band Potawatomi Tribe and
its subdivisions to regulate the disposal of solid wastes in a
manner that will
(a) protect the public health, safety and welfare;
(b) prevent water pollution or air pollution;
(c) prevent
the spread of disease and the creation of nuisances;
(d) conserve
valuable land and other natural resources;
(e) enhance the beauty
and quality of the environment; and
(f) encourage recycling of
solid waste.
101. DEFINITIONS
As used in this resolution, unless the context otherwise
requires:
(1) ""Committee"" means the Citizen Band Potawatomi Tribe
Business Committee;

(2) “Department” means the subdivision of the board dealing
with the management of solid waste disposal.
(3) ""Person"" means any individual, corporation, company,
firm, partnership, association, trust, state agency, government
instrumentality or agency, institution, county, any incorporated
city or town or municipal authority or trust in which any governmental
entity is a beneficiary, venture, or other legal entity
however organized;
(4) ""Solid waste"" means all putrescible and nonputrescible
refuse in solid or semisolid form including, but not limited to,
garbage, rubbish, ashes or incinerator residue, street refuse,
dead animals, demolition wastes, construction wastes, solid or
semisolid commercial and industrial wastes and hazardous wastes
including explosives, pathological wastes, chemical wastes,
herbicide and pesticide wastes. Scrap materials which are source
separtated for collection and processing as industrial raw materials
shall not be considered discarded for the purpose of this
act, except when contained in the waste collection by or in behalf
of a county, city or town;
(5) ""Disposal site"" means any place subject to standards
promulgated by the Committee at which solid waste is dumped,
abandoned, or accepted or disposed of by incineration, land filling,
composting, shredding, compaction, baling or any other
method or by processing by pyrolysis, source recovery or any
other method, technique or process designed to change the physical,
chemical or biological character or composition of any

solid waste so as to render such waste safe or nonhazardous,
amenable to transport, recovery or storage or reduced in volume;
and
(6) ""Solid Waste Management System"" means the system that
may be developed for the purpose of disposal of solid wastes by
any person engaging in such process as a business or by any
tribe, any municipality, authority, trust, county or by any combination
thereof at one or more disposal sites.
102. ADVISORY BOARD
(a) There is hereby created, in accordance with the provisions
of this Resolution, the Solid Waste Management Advisory
Board consisting of three (3) members. The members shall be appointed
by the Committee within thirty (30) days after the effective
date of this resolution. The members shall serve at the
pleasure of the Business Committee.
102.1
A Regional solid waste planning Board from any two or more
Tribes may be established consisting of three members from each
corresponding Tribe. The Board shall study the advisability of
establishing a Regional Solid Waste Management district; ways for
the organization, operation and control of the district; and the
methods of selecting, constructing, maintaining and operating a
Regional Solid Waste Management System to serve the needs of the
district. It shall estimate construction and operating costs and
shall study methods of financing the regional district. These
studies will be submitted to the Business Committee, or Committees
for their approval.

102.2
If by majority vote of its members, the Regional Solid Waste
Planning Board and the Business Committee, or Committees deems
feasible and advisable the establishment of a Regional Solid
Waste Management District, the board shall draw up a proposed
agreement. The agreement shall contain provisions setting forth
a legal description of the proposed boundaries of the district;
the sharing of construction and operating costs; the number;
method of selection and terms of office of the members of the
Regional Solid Waste Management District Board; the general area
in which other tribes or portions thereof may be admitted to the
district; the method by which the agreement may be amended; the
procedure for the preparation and adoption of the annual budget;
the levy of fees, taxes, and charges and any other matters
which the committee judges advisable. All plans and operations
shall be governed by the provisions of this Resolution.
102.3
The Regional Solid Waste Planning and Advisory Board shall
Report its findings and recommendations to the Committee, or
Committees. If the Committee recommends that a Regional Solid
Waste Management District be established, a copy of the proposed
Agreement shall accompany each report. The Board will approve
Its establishment and support. The district shall immediately
begin to function according to the terms of the agreement.
102.4
The district shall be a body politic and corporate, shall be

governed by the Regional Solid Waste Management District Board,
and shall have the following powers and duties:
1.To purchase land within the boundaries of the district
with the consent of the corresponding Tribes, and to plan, construct
and equip a disposal site and collection system for the
benefit of the residents of the district and to make any necessary
contracts in relation thereto;
2. To incur debt in the manner provided by law for the
purpose of acquiring land and for planning, constructing and
equipping a disposal site and/or collection system for a term not
exceeding twenty-five (25) years;
3. To issue bonds and notes in the manner provided by law
in the name and upon the full faith and credit of the district.
The bonds or notes shall be signed by the chairman and treasurer
of the Regional Solid Waste Management District committee, and
the Business Committee;
4. To receive and disburse funds for any district purpose;
5. To receive any grants or gifts for the purposes of the
regional district;
6. To incure temporary debt in anticipation of revenue to
he received;
7. To engage legal counsel;
8. To employ any executive director and other employees
necessary to operate the district;
9. To adopt an annual operating budget;
10. To enter into contracts for solid waste collection and
disposal with persons, companies, corporations, including the

State of Oklahoma, other states, other tribes, non-member cities,
Towns and counties as well as other bodies politic, and the
United States of America; and
11. To submit a semiannual report to the committee containing
a detailed financial statement, and a statement showing the
method by which fees and charges are computed.
102.5.
Persons receiving service under the provisions of this resolution
may be assessed a fee, taxes or charge as provided in the
approved agreement and any amendments thereto.
102.6.
The powers, duties and liabilities of a Regional Solid Waste
Management District shall be vested in an exercised by a Regional
Solid Waste Management district Board of three (3) members organized
in acordance with the agreement. With final approval of
all actions being given by the corresponding tribal heads. The
Board shall choose a chairman by ballot from its membership. It
shall appoint a secretary and a treasurer, who may be the same
person, but who need not be members of the Board. The treasurer
shall receive and take charge of all money belonging to the
district and shall pay any bill of the district which has been
approved by the Board. The treasurer may, by a vote of the Board
be compensated for his services.
102.7.
Semiannually, the Regional Solid Waste Management District
Board shall determine the amounts necessary to be raised to maintain
and operate the district during the next calendar year, and

the amounts required for payment of debt and interest incurred
by the district that will be due in the next year. The Board
shall prepare a budget in support of the operation of the district
in accordance with the terms of the agreement. Prior to
December 31 of each year the district Board shall hold at least
one public hearing at some convenient place in the district to
prepare a preliminary budget and the preliminary apportionment of
the amounts listed in the budget. This preliminary budget will
be submitted to the advisory Board for review then to the committee
for approval.
102.8.
Each year the Committee Auditor and Inspector shall cause
an audit to be made of the accounts of the Regional Solid Waste
Management District Board and for this purpose he and his authorized
agents shall have access to all necessary papers, books
and records. Upon the completion of each audit, a report thereon
shall be made to the chairman of the district committee, and a
copy thereof shall be sent to the committee.
102.9.
The agreement made under Section 104 of this resolution or
any amendment to such an agreement may contain provisions authorizing
any participating tribe to sell, or lease to the Regional
Solid Waste Management refuse disposal district any disposal site
and any land appurtenant thereto or used in connection therewith
or any other property useful for the purposes of the district.
Any tribe may authorize such sale, lease or license accordingly.
In case of a sale, the price and time or times of payment and the

method by which the tribes or committee other than the selling
tribe shall be assessed for such payment shall be set forth in
the agreement; but in no case shall payments be made which shall
extend over a period in excess of twenty-five (25) years. In the
case of a lease, the rental fee and terms of payment and assessment
shall be set forth in the agreement. The lease may be for
a term not in excess of twenty-five (25) years, and may contain
provisions for the extension of the lease for an additional term
not in excess of twenty-five (25) years at the option of the
board.
103.
TRIBAL SOLID WASTES MANAGEMENT SYSTEMS.
(a) The tribe shall have the authority to levy and collect
such fees and charges and require such licenses as may be appropriate
to discharge their responsibility, and such fees,
charges and licenses shall be based on a fee schedule as set
forth in an agreement with the committee.
(b) Tribes may accept and disburse funds derived from
grants from the federal or state governments or from private
sources or from monies that may be appropriated from the General
Fund, for the installation and operation of a Solid Waste Management
System, either individually or as a party to a Regional
Solid Wastes District.
(d) The committee shall have the right to establish policies
for the operation of a Solid Wastes Management System including
hours of operation, character and kind of wastes accepted
at the disposal site, and such other rules as may be necessary
for the safety of the operation personnel.

(e) All districts or tribes are delegated the authority
Necessary to fulfill these purposes.
104. AGREEMENT REQUIRED – NOTICE.
After adoption of the rules and regulations as provided in
Section 105 of this title and a reasonable time fixed by the committee
for compliance therewith, no person shall dispose of solid
wastes at any site or facility other than a site or facility for
which an agreement for solid waste disposal has been issued by
the committee, except that no provision of this resolution shall
be construed so as to prevent a person from disposing of solid
waste from his own household upon his own land provided such
disposal does not create a nuisance or a hazard to the public
health or does not violate a federal or state law. Upon issuance
of any such agreement the committee shall file a recordable
notice of the agreement in the land records of the tribe in which
the site is located. The notice shall contain the legal description
of the site as well as the terms under which the agreement
is issued.
105. RULES AND REGULATIONS
The committee is directed and empowered to adopt and promulgate
rules and regulations for the transportation of solid
waste and disposal sites including, but not limited to, the disposal
site location, construction, operation and maintenance of
the disposal site or disposal process as necessary to implement
the purposes and intent of this resolution. Rules and regulations
authorized under the provisions herein shall be promulgated

and adopted in compliance with this resolution. Notice of
such rules and regulations shall be given to the committee and be
heard thereon before the adoption of such rules and regulations.
106. POWERS AND DUTIES OF THE DEPARTMENT OF SOLID
WASTE MANAGEMENT.
The Department shall have the following powers and duties:
(1) To advise, consult, cooperate and coordinate with other
tribes, agencies and instrumentalities of the state, other states
and the Federal Government and with affected groups and industries
in the formulation of plans and the implementation of the
Solid Wastes Disposal Program.
(2) To accept and administer such loans and grants from the
Federal Government and from other sources as may be available to
the department for the planning, construction, and operation of
solid wastes disposal facilities.
(3) Develop a statewide Solid Wastes Management plan in
cooperation with other tribal governments. When feasible,
emphasis shall be given to areawide planning.
(4) To design, examine and approve plans and specifications
for Solid Wastes Disposal facilities and inspect construction and
operation of Solid Wastes Disposal sites and facilities.
(5) To issue, contine in effect, revoke, modify or deny,
under rules and regulations of the committee agreements for the
establishment, construction and the operation or maintenance of
Solid Wastes Disposal sites and facilities.
(6) To make investigations and inspections which it deems

necessary to insure compliance with this resolution or the rules
and regulations promulgated under authority of this resolution.
(7) To make final inspections of closed or abandoned solid
wastes disposal sites to determine compliance with rules and
regulations for proper closure and proper filling and drainage of
the site.
Notwithstanding the foregoing provisions of this section,
any tribe may by ordinance or resolution adopt standards for the
location, design, construction, and maintenance of solid wastes
disposal sites and facilities more restrictive than those adopted
by the committee under the provisions of this resolution.
107. The Department is designated by the committee for participation
in federal program.
The Department is hereby designated the agency for all committee
purposes of the Federal Solid Waste Disposal Act (Public
Law 89-272) as it exists or may be amended.
108. ILLEGAL DUMPING OF SOLID WASTES — PRESUMPTION.
It shall be unlawful for any person to dump, deposit, throw
or in any manner leave or abandon any solid waste, including but
not limited to, garbage, tin cans, bottles, rubbish, refuse or
trash on tribal property without an agreement with the committee.
109. INJUCTION.
In addition to any other remedies provided in this resolution,
the committee may institute immediate closing of a site in
violation of this resolution or the rules, regulations or standards
adopted thereunder.

110. SEVERABILITY.
The provisions of this resolution are severable and if any
part or provision hereof shall be held void, the decision of the
court so holding shall not affect or impair any of the remaining
parts or provisions of this resolution;

WHEREAS, the Citizen Band Potawatomi Band Indians of Oklahoma is

WHEREAS, the Citizen Band Potawatomi Business Committee has
authority to act in behalf of the Tribe as authorized

the attached revision is in the best interests of

WHEREAS, the Citizen Band Potawatomi Tribe is a federally recognized
Tribe organized under the Oklahoma Indian Welfare Act of 1936;

WHEREAS, the Citizen Band Potawatomi Tribal Constitution and By-Laws
authorizes the Citizen Band Potawatomi Business Committee to act
on behalf of the Tribe in all matters except those relating to
claims and treaties,

WHEREAS, the August 4, 1984 election, in which Kenneth Peltier was elected
Secretary-Treasurer caused two of his relatives of the first
degree already employed by the Tribe to come into violation of
the Personnel Policy of the Tribe, AND
WHEREAS, federal personnel policy prohibits the termination of employees
for violations of this type that occur ""Ex Post Facto"" or, after
the fact, when neither of the two parties maintain hiring or
supervisory authority over each other, NOW
THEREFORE BE IT RESOLVED, that the Personnel Policies of the Citizen Band
Potawatomi Tribe are hereby amended to prohibit termination of Tribal
employees for ""after the fact"" violations of personnel policy when no
hiring or supervisory authority exists between the two parties involved.

interested in continuing operations of social services
and nutrition services for the benefit of
elderly Indians and elderly tribal members, and;

WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma
hereby make known their intent to make application
for a continuation grant to provide nutrition and
social services under Title VI of the Older Americans
Act, Grants to Indian Tribes, and;
WHEREAS, the proposed and requested commencement date for the
continuation grant is October 1, 1984 through September
29, 1987, and;
WHEREAS, the proposed term of the grant document is twelve (12)
months, and;
WHEREAS, the Title VI Director is authorized to coordinate
grant development and can be reached at telephone
number (405) 275-3121, and;
WHEREAS, the Tribal Administrator, is the tribal offical
authorized to enter into a grant agreement with the
Office of Human Development Services on behalf of
the governing body, and;
WHEREAS, the Tribal Administrator, is authorized to request
and sign amendments to the grant, and;
WHEREAS, the Tribal Administrator and the Title VI Director
are authorized to review, approve, and sign narrative
reports and invoices for payment, and;
WHEREAS, Administration on Aging is requested to send copies
of all correspondence to the Title VI Director, and;

time as the Business Committee chooses to withdraw
said authorizations by subsequent resolution, and;

the Shawnee Indian Clinic to be involved in the selection of
a Director for the service unit;

THEREFORE BE IT RESOLVED that the Citizen Band Potawatomi Tribe will
participate in, and be a member of the Five Tribe Committee made up of
representatives of the Citizen Band Potawatomi, Sac & Fox, Shawnee, Kickapoo
and Iowa Tribes. Said Inter-tribal Committee having the authority to:
I. Received the names of the top five applicants from Indian
Health Service Area Office in Oklahoma City,
II. To screen, review and interview applicants of the top
five they choose,
III. To reject those applicants that the committee feels are
not suited to provide proper representation for the five
Tribes in the Shawnee Service Unit,
IV. From the applicant file said committee will provide up to
three names for the position.
V. The committee may recommend or reject any or all names
submitted, until a suitable Director is located,
BE IT FURTHER RESOLVED, that said inter-tribal committee will remain seated
to act as a P.L. 93-638 advisory committee to provide investigation,
feasability and make recommendations to the Five Tribes in the Shawnee Area
as to which Bureau of Indian Affairs, and Indian Health Service programs
can be contracted, and administered by Tribal governments to provide
services more sensative to the needs of Tribal members.

SUPPORT THE OKLAHOMA INDIAN CHILD WELFARE ASSOCIATION IN THE ESTABLISHMENT
OF A CENTRAL CONTACT PLACEMENT AGENCY FOR OKLAHOMA INDIAN
CHILDREN.
WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma is a federally
recognized Tribe of American Indians under authority of the
Oklahoma Indian Welfare Act of 1936 and the General Council
is the governing body; and
WHEREAS, the Citizen Band Potawatomi Business Committee has authority
to act in behalf of the Tribe as authorized in the Tribal
Constitution and By-Laws; and
WHEREAS, the 1978 Federal Indian Child Welfare Act, 25 U.S.C. § 1901,
establishes a federal policy to protect the best interests
of Indian children and to promote the stability and security
of Indian tribes and families by. . . . the placement of Indian
children in foster or adoptive homes which will reflect the
unique values of Indian culture; and
WHEREAS, the Federal Indian Child Welfare Act, 25 U.S.C. §1915 provides
that a preference shall be given to placement of an Indian child
with a foster home licensed, approved, or specified by the Indian
child's Tribe; and
WHEREAS, the State of Oklahoma passed the Oklahoma Indian Child Welfare
Act, 10 O.S. §40-4.8, which authorizes the State of Oklahoma to
pay the cost of foster care by a tribally licensed foster home,
provided that the Tribe has entered into an agreement with the
state for such assistance; and
WHEREAS, the Oklahoma Indian Child Welfare Association was established by
the Oklahoma Indian tribes which received Indian Child Welfare
Act funds and one of the goals is to ensure Oklahoma Indian tribal
input into the placement of Oklahoma Indian children who are in
out of home placement; and
WHEREAS, the current practice is for the Oklahoma Court system to place
the child into the legal custody of the Department of Human
Services when the Indian child is to be placed out of the home; and
WHEREAS, the Department of Human Services has approached the Oklahoma
Indian Child Welfare Association to establish an agency which
would be the initial central contact placement agency to work
with Oklahoma Tribes in the placement of Oklahoma Indian
children;
NOW
THEREFORE BE IT RESOLVED, that the Citizen Band Potawatomi Tribe of
Indians of Oklahoma fully supports the Oklahoma Indian Child Welfare
Association to become the initial central contact placement agency
to work with the Oklahoma Indian Tribes in the placement of Oklahoma
Indian children.

CITIZEN BAND POTAWATOMI INDIANS OF OKLAHOMA
A RESOLUTION TO SUPPORT THE CONSOLIDATED TRIBAL GOVERNMENT PROGRAM IN
ORDER TO PROVIDE OR ASSIST IN THE PROVISION OF SERVICES, GOODS AND OTHER
ITEMS NECESSARY TO PROMOTE THE COMMON WELFARE, MAINTAIN TRUST PROPERTY OF
THE TRIBE, AND MAINTAIN THE TRIBAL POLICE DEPARTMENT.
WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma is a federally
recognized tribe of American Indians under authority of the
Oklahoma Indian Welfare Act of 1936 and the General Council is
the governing body;
AND
WHEREAS, the Citizen Band Potawatomi Business Committee has authority to
act on behalf of the Tribe as authorized in the Tribal
Constitution and By-Laws;
AND
WHEREAS, it is the goal of the Tribe to provide those needed and necessary
services and opportunities to Tribal members enabling them to
reach equal or above equal education levels of that of the
general population;
AND
WHEREAS, it is the goal of the Tirbe to provide those services necessary
to bring the health standards of all Tribal members equal to that
of the general population;
AND
WHEREAS, it is the goal of the Tribe to provide those services and/or
opportunities to allow all Tribal members to reside in decent,
safe, and sanitary homes; and trust property; and police service;
AND
WHEREAS, it is the goal of the Tribe to encourage a continued interest in
the hertiage, arts, and culture of the Tribe;
NOW
THEREFORE, BE IT RESOLVED, that the Citizen Band Potawatomi Indians of
Oklahoma supports the Consolidated Tribal Government Program in order to
provide services, goods and other services necessary to promote the common
welfare of the Tribe.

A RESOLUTION REQUESTING BUREAU OF INDIAN AFFAIRS FUNDING FOR A MEETING OF
ALL OKLAHOMA TRIBAL LEADERS.
WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma is a federally
recognized Tribe of American Indians organized under the authority
of the Oklahoma Indian Welfare Act of 1936 and the General Council
is the electorate of the Tribe; AND
WHEREAS, the Citizen Band Potawatomi Business Committee has the authority
to act on behalf of the Tribe in all matters by the Tribal
Constitution and By-Laws;
AND
WHEREAS, a meeting of all elected tribal leaders in the state of Oklahoma
is urgently needed to inform this leadership of the liabilities
posed by the current indirect cost contract policy;
AND
WHEREAS, certain actions planned and proposed by the Federal and State
government are a direct threat to Tribal sovereignty and assets;
AND
WHEREAS, funds are available for funding of this meeting through BIA
monies;
NOW
THEREFORE BE IT RESOLVED, that the Business Committee of the Citizen Band
Potawatomi Indian Tribe of Oklahoma formally requests that monies being
held by the Bureau of Indian Affairs be used to pay for a meeting of all
elected tribal leaders in the State of Oklahoma no later than October 30, 1984.

A RESOLUTION AUTHORIZING JOHN A. BARRETT, JR., TRIBAL ADMINISTRATOR TO
PROCEED ON BEHALF OF THE TRIBE IN CONJUNCTION WITH GLOBE LIFE AND
ACCIDENT INSURANCE COMPANY TO FORM INSURANCE CORPORATIONS IN THE STATE
OF ARIZONA FOR THE BENEFIT OF CITIZEN BAND POTAWATOMI TRIBAL MEMBERS.
WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma is a federally
recognized Tribe of American Indians organized under the authority
of the Oklahoma Indian Welfare Act of 1936 and the General Council
is the electorate of the Tribe; AND
WHEREAS, the Citizen Band Potawatomi Business Committee has the authority
to act on behalf of the Tribe in all matters by the Tribal
Constitution and By-Laws;
AND
WHEREAS, Globe Life and Accident Insurance company has proposed the
formation of insurance companies by the Tribe in the State of
Arizona to facilitate the providing of insurance benefits to
the Tribe;
AND
WHEREAS, the formation of these insurance companies will be done with
the advice, assistance and participation of Globe Life and
Accident Insurance Company;
AND
WHEREAS, the Tribal Administrator, John A. Barrett, Jr., needs formal
authorization to proceed in the formation of the companies on
the Tribe's behalf;
NOW
THEREFORE BE IT RESOLVED, that John A. Barrett, Jr. is authorized to
travel and act on behalf of the Tribe in conjunction with Globe Life and
Accident Insurance Corporation to form Arizona insurance companies for the
benefit of the Tribal members and business interests.

A RESOLUTION TO AUTHORIZE THE DRAWDOWN OF $40,000.00 FROM THE INTEREST
ACCRUDED ON THE 20% SET-ASIDE FOR THE SCHOLARSHIP PROGRAM.
WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma is a federally
recognized Tribe of American Indians organized under the Oklahoma
Indian Welfare Act of June 26, 1936; and the General Council is
the governing body of the Tribe;
AND
WHEREAS, the Citizen Band Potawatomi Business Committee has authority to
act in behalf of the Tribe as authorized in the Tribal Constitution
and By-Laws;
AND,
WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma were awarded a
claim and the monies were distributed to their tribal members;
AND,
WHEREAS, the General Council prepared and passed a plan for the use of
the Tribe’s 20% set-aside of the orginal amount of claim monies,
and this plan was approved by Congress;
AND,
WHEREAS the General Council voted to request the 20% set-aside monies
to be drawn down and given to the Tribe to be placed in a
trust account;
AND,
WHEREAS, the Citizen Band Potawatomi Business Committee is requesting
the drawdown of $40,000.00 from the interest accrued on said
20% set-aside to be used for the Scholarship Program,
NOW,
THEREFORE, BE IT RESOLVED, that the Citizen Band Potawatomi Business
Committee voted to request that $40,000.00 of interest accrued
be drawn down to be used for the Scholarship Program.
