CITIZEN BAND POTAWATOMI INDIAN TRIBE OF OKLAHOMA
A RESOLUTION APPROVING A CLASS III GAMING COMPACT WITH THE STATE OF OKLAHOMA AND
AUTHORIZING BUSINESS COMMITTEE CHAIRMAN, JOHN A. BARRETT, JR., TO EXECUTE SAME ON
BEHALF OF THE TRIBE.
WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma is a federally
recognized tribe of American Indians organized under authority of the
Oklahoma Indian Welfare Act of 1936; and
WHEREAS, the Citizen Band Potawatomi Business Committee is duly authorized to act
on behalf of the Tribe by authority of the Tribal Constitution and
By-Laws; and
WHEREAS, the Business Committee has the responsibility to create policy, establish
operational standards, and otherwise manage the daily affairs of tribal
enterprises; and
WHEREAS, the Citizen Band Potawatomi currently operates Class II gaming in
facilities located within tribal Indian country; and
WHEREAS, Congress, through the Indian Gaming Regulatory Act, has authorized states
to negotiate Class III gaming compacts with Indian tribes; and
WHEREAS, the Citizen Band Potawatomi Business Committee has determined that said
gaming compact, a copy of which is attached, is necessary and in the
Tribe's best interest;
NOW, THEREFORE, BE IT RESOLVED by the Business Committee of the Citizen Band
Potawatomi Indian Tribe of Oklahoma that the attached Tribal-State Class III gaming
compact is approved and the Chairman is hereby authorized to sign same on behalf of
the Tribe and to do all things necessary and proper to acknowledge and effect the
Tribe's approval of same. Further, the Tribal Secretary is directed to authenticate
the Chairman's signature and capacity to sign said compact.

Indian Tribe of Oklahoma, do hereby certify that the above is a true and exact copy

CITIZEN BAND POTAWATOMI INDIAN TRIBE OF OKLAHOMA
A RESOLUTION PROTESTING THE PLACEMENT OF RAY SPRINGWATER INTO THE
REALTY/LAND OPERATIONS POSITION AT THE SHAWNEE AGENCY.
WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma is a
federally recognized tribe of American Indians with
constitutional authority under the Indian Reorganization Act of
1934 and the Thomas-Rogers Act of 1936;
WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma, the
largest of the Potawatomi Indian Tribes, has, through a
continuation of Potawatomi history and organized self
government since time immemorial, sovereign powers inherent in
tribal tradition and recognized by treaties with the United
States and in the United States Constitution; and
WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma
Constitution and by-laws provide that the Business Committee of
the Tribe shall be granted the power to act on behalf of the
Tribe in all matters except those relating to claim or
treaties with the United States; and
WHEREAS, the Business Committee of the Citizen Band Potawatomi Indian
Tribe of Oklahoma has learned of the Area Director's plan to
transfer or detail Ray Springwater from the Pawnee Agency to a
vacant position at the Shawnee Agency; and
WHEREAS, the Business Committee is aware of alleged problems with Mr.
Springwater at his current place of employment and on his
previous job; and
WHEREAS, over the past three (3) years we have had an excellent working
relationship with the Realty/Land Operations staff at the
Shawnee Agency; and
WHEREAS, we do not wish to jeopardize this relationship with a potential
problem employee.
NOW THEREFORE BE IT RESOLVED THAT the Business Committee of the Citizen
Band Potawatomi Indian Tribe of Oklahoma hereby opposes any action by the
Anadarko Area Director to transfer Mr. Ray Springwater into the vacant
Realty/Land Operations position at the Shawnee Agency.

Indian Tribe of Oklahoma do hereby certify that the above is a true and

A RESOLUTION AUTHORIZING THE CITIZEN BAND POTAWATOMI INDIAN TRIBE
OF OKLAHOMA'S INDIAN CHILD PROTECTION AND CHILD ABUSE PREVENTION
DEMONSTRATION GRANT APPLICATION FOR FY 1992.
WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma is
a federally recognized tribe of American Indians with
constitutional authority under the Indian Reorganization
Act of 1934 and Thomas-Rogers Act of 1936; and
WHEREAS, the Citizen Band Potawatomi Indian Tribe Of Oklahoma,
the largest of the Potawatomi Indian Tribes, has,
through a continuation of Potawatomi history of
organized self government since time immemorial,
sovereign powers inherent in tribal tradition and
recognized by treaties with the United States and in the
United States Constitution; and
WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma
Constitution and By-Laws provide that the Business
Committee of the Tribe shall be granted the power to act
on behalf of the Tribe in all matters except those
relating to claims of treaties with the United States;
and
WHEREAS, the Tribal Administrator and Tribal Chairman, are hereby
granted authority to negotiate any items pursuant to
this grant and any amendments thereto; and
WHEREAS, the Tribe has a continuing interest in protecting Native
American Children from abuse and providing services to
their families;
WHEREAS, the proposed start date of this grant shall be September
30, 1992; and
THEREFORE, BE IT RESOLVED, that the Business Committee of the
Citizen Band Potawatomi Indian Tribe of Oklahoma requests funding
from the Department of Health and Human Services and Indian Health
Services to provide an Indian Child and Family Service Program to
promote the stability of eligible Indian families.

A RESOLUTION DIRECTING THE BUSINESS COMMITTEE CHAIRMAN TO SUBMIT A TRIBAL-STATE
CLASS III GAMING COMPACT TO THE SECRETARY OF THE INTERIOR FOR APPROVAL.
WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma is a federally
recognized tribe of American Indians organized under the authority of the
Oklahoma Indian Welfare Act of 1936; and
WHEREAS, the Citizen Band Potawatomi Business Committee is duly authorized to act
on behalf of the Tribe by authority of the Tribal Constitution and
By-Laws; and
WHEREAS, the Business Committee has the responsibility to create policy, establish
operational standards, and otherwise manage the daily affairs of tribal
enterprises; and
WHEREAS, the Business Committee has previously authorized the Chairman to sign a
Tribal-State Class III Gaming Compact between the Citizen Band Potawatomi
Indian Tribe of Oklahoma and the State of Oklahoma dated July 6, 1992;
and
WHEREAS, the Governor of the State of Oklahoma has signed and the Joint Committee
on State-Tribal Relations has endorsed the aforementioned gaming compact;
and
WHEREAS, the Oklahoma Indian Gaming Regulatory Act requires that agreements such
as the aforesaid compact be approved by the Secretary of the Interior;
NOW, THEREFORE, BE IT RESOLVED BY THE BUSINESS COMMITTEE OF THE CITIZEN BAND
POTAWATOMI INDIAN TRIBE OF OKLAHOMA THAT the Chairman of the Business Committee of
the Citizen Band Potawatomi Indian Tribe of Oklahoma is hereby directed to submit
the Tribal-State Class III Gaming Compact between the Citizen Band Potawatomi Indian
Tribe of Oklahoma and the State of Oklahoma dated July 6, 1992 to the Secretary of
Interior and seek approval of same as is consistent with Indian Gaming Regulatory
Act. Further, the Chairman is hereby authorized to do all things reasonable and
necessary to carry out these directions.

within the Citizen Potawatomi reservation boundaries
placed in trust is necessarily in conflict with
Citizen Potawatomi treaties and federal law, and
would diminish the potential return of the
Citizen Potawatomi lands to the jurisdiction and
control of the Tribe; and
WHEREAS, the Absentee Shawnee have asked or will ask that
lands within the Citizen Potawatomi reservation
boundaries be placed in trust for the use and
benefit of the Absentee Shawnee;

NOW, THEREFORE, BE IT RESOLVED BY THE BUSINESS COMMITTEE OF
THE CITIZEN BAND POTAWATOMI INDIAN TRIBE OF OKLAHOMA that the
Chairman of the Business Committee, John A. Barrett, Jr., is
hereby directed to write a letter to the Bureau of Indian
Affairs and/or the Secretary of the Interior expressing the
opposition of the Citizen Band Potawatomi Indian Tribe of
Oklahoma to the United States taking in trust for the use and
benefit of other Indian tribes lands that lie within the
Citizen Band Potawatomi Indian Tribe of Oklahoma reservation.
Further, the Chairman is hereby authorized to do all things
reasonable and necessary to carry out these directions and to
make the Citizen Potawatomi opposition effective, including
by way of example, not by way of limitation, directing the
Tribal Attorney to file an appropriate lawsuit to protect the
rights guaranteed by treaties and federal law.

WHEREAS, TXN Geophysical Services, Inc. wishes to conduct a geophysical survey
and/or seismic tests on above described 60.79-acre Tribal tract of land.
Surface energy will be the primary energy source, with mini-holes as a
fill-in in areas that are not accessible by vehicles. The mini-holes
will be 3"" in diameter, 5-7’ deep and will be drilled at 55’ intervals
along the seismic line. The equipment that will be used will consist
of a 4-wheel drive pickup pulling a small trailer. There will be no
timber cleared, only small amounts of underbrush and low lying limbs.
The mini-holes will be back-filled and the test area will be left in as
good condition as prior to beginning operations.
WHEREAS, The length of the proposed survey line across the tract is 1550 feet and
the width required is 10 feet. TXN Geophysical Services, Inc., agrees
to pay the Tribe at the rate of $750.00 per mile, or a total of $220.17
for 1550 feet, for a temporary right-of-way to cross above described
60.79-acre tract of land, the surface of which is owned by the tribe,
and for surface damages resulting from a seismic permit.
THEREFORE, BE IT RESOLVED, that the Business Committee hereby approves payment at
the rate of $750.00 per mile, or a total of $220.17 for 1550 feet, from TXN
Geophysical Services, Inc., for surface damages resulting from a seismic permit and
a 30-day temporary right-of-way across the above described 60.79-acre Tribal tract
of land.

WHEREAS, The Citizen Band Potawatomi Indian Tribe of Oklahoma is a

WHEREAS, The Citizen Band Potawatomi Indian Tribe of Oklahoma, the largest
of the Potawatomi Indian Tribes, has, through a continuation of

Potawatomi Indian Tribe of Oklahoma to execute any and all
documents necessary to effect the right-of-way on and across
Tribal lands located in Pottawatomie County, Oklahoma, and

A tract of land located in the NE/4 of Section 36-10N-3EIM,
more particularly described as: Beginning at the Northeast

WHEREAS, said grant of easement will require the approval of the Bureau of
Indian Affairs, Shawnee Agency, Shawnee, Oklahoma, and it is
herein requested that such approval be granted when the right-of-way
documents are submitted to them by Oklahoma Gas and Electric
Company.
THEREFORE BE IT RESOLVED, that the Business Committee of the Citizen Band
Potawatomi Indian Tribe of Oklahoma hereby approves and grants to Oklahoma
Gas and Electric Company a perpetual easement for the installation of
electrical power distribution lines on Tribal lands as above described;
and
THEREFORE BE IT FURTHER RESOLVED, that the Business Committee of the
Citizen Band Potawatomi Indian Tribe of Oklahoma hereby authorizes the
Chairman and Secretary/Treasurer to execute all documents necessary to
effect such right-of-way to Oklahoma Gas and Electric Company.

Potawatomi Indian Tribe of Oklahoma, who is the owner of a tract
of trust land identified and described as the NW/4 NW/4 of
Section 31, Township 10 North, Range 4 East, of the Indian
Meridian, in Pottawatomie County, Oklahoma, containing 40.00
acres; and
WHEREAS, the location of the service line required to serve the above
described property, and its extent, is more particularly shown
and delineated on the attached plat (s) marked """"Exhibit (s)"" which
have been prepared in accordance with 25 CFR 169.22 (c), and
which by this reference are made a part hereof; and
WHEREAS, the regulations of 25 CFR 169.22 provide that an agreement shall
be entered into by and between the landowner and the applicant
before any work by the applicant may be undertaken to construct
a service line across such land, and that applicant will agree
to comply with all the requirements of 25 CFR 169.22.
WHEREAS, those regulations further provide that a service line shall be
for the sole purpose of supplying the owner with electric power
for use by such owner; and
WHEREAS, the agreement between Oklahoma Gas and Electric Company and the
Tribe conveys no interest in the land traversed whatsoever.
THEREFORE BE IT RESOLVED, that the Business Committee of the Citizen Band
Potawatomi Indian Tribe of Oklahoma hereby grants a perpetual service line
agreement to the applicant, Oklahoma Gas and Electric Company, for the
construction and installation of underground electrical power distribution
lines on Tribal lands above described without payment of any monetary
compensation for damages; and
THEREFORE BE IT FURTHER RESOLVED, that the Business Committee of the
Citizen Band Potawatomi Indian Tribe of Oklahoma hereby authorizes the
Tribal Chairman and the Secretary/Treasurer to execute any and all
pertinent documents for the installation of electrical services on Tribal
land, above described.

A RESOLUTION APPROVING A $680,000.00 ANNUAL BUDGET FROM INTEREST ON PROGRAM
MONEY FROM JUDGEMENT FUNDS AWARDED BY THE UNITED STATES COURT OF CLAIMS,
SUBJECT TO APPROVAL BY THE GENERAL COUNCIL AT THE ANNUAL MEETING ON JUNE 26,
1993.
WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma is a federally
recognized tribe of American Indians with constitutional authority
under the Indian Reorganization Act of 1934 and the Thomas-Rogers Act
of 1936; and
WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma, the largest of
the Potawatomi Indian Tribes, has, through a continuation of
Potawatomi history and organized self government since time
immemorial, sovereign powers inherent in tribal tradition and
recognized by treaties with the United States and in the United
States Constitution; and
WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma Constitution and
By-Laws provide that the Business Committee of the Tribe shall be
granted the power to act on behalf of the Tribe in all matters except
those relating to claims or treaties with the United States; and
WHEREAS, the Secretary of the Interior approved a ten-year Tribal Acquisition,
Development and Maintenance Plan in 1983; and
WHEREAS, the approved Plan, as published in the Federal Register on September
8, 1983 requires annual budgets to be prepared by the Tribal Business
Committee; and
WHEREAS, the approved Plan further requires that all annual budgets are
subject to approval by the General Council; and
WHEREAS, the Business Committee has prepared their annual budget:
LAND ACQUISITION, DEVELOPMENT AND MAINTENANCE PROGRAM
LAND ACQUISITION $ .00
DEVELOPMENT
1. BUILDINGS AND GROUNDS IMPROVEMENT AND RECREATION - All
tribally-owned trust property including golf course,
restaurant and pow wow grounds, planting grass
and trees, landscaping including fertilizer, grounds
equipment, lighting for driving range, parking lot
construction, soil and water conservation and fencing. $ 140,000.00

Savings in any one line item may be utilized for expenses involved in either of

WHEREAS, the budget year will commence July 1, 1993 and end June 30, 1994;

THEREFORE BE IT RESOLVED THAT the Business Committee of the Citizen Band
Potawatomi Indian Tribe of Oklahoma hereby authorizes the Election Committee to
place the above budget on the ballot for consideration at the June 26, 1993
General Council meeting.

POTAWATOMI INDIAN TRIBE OF OKLAHOMA AUTHORIZING AND APPROVING THE PURCHASE OF AN
UNDIVIDED 35/36 RESTRICTED INTEREST IN THE N/2 SW/4 OF SECTION 9-6N-5EIM,
POTTAWATOMIE COUNTY, OKLAHOMA, CONTAINING 80.00 ACRES.

Sale, to the Citizen Band Potawatomi Indian Tribe of Oklahoma their
interests in the following described property:
An undivided 35/36 restricted interest in the N/2 SW/4 of
Section 9-6N-5EIM, Pottawatomie County, Oklahoma, containing
80.00 acres, in the Catherine Bennett Allotment, CP-64; and
WHEREAS, a fair market value appraisal in the amount of $32,083.00 has been
made and approved by the Bureau of Indian Affairs; and
WHEREAS, the Business Committee of the Citizen Band Potawatomi Indian Tribe
of Oklahoma is agreeable to the purchase of this property at the
appraised value of $32,083.00.
THEREFORE, BE IT RESOLVED that the expenditures of Tribal money for the purchase
of the above described property at appraised value is hereby authorized; and
THEREFORE, BE IT FURTHER RESOLVED the Chairman, Vice-Chairman, or
Secretary/Treasurer is authorized to execute any documents required to consummate
this transaction.

A RESOLUTION REQUESTING SECRETARIAL APPROVAL OF A GENERAL COUNSEL CONTRACT
BETWEEN ATTORNEY MICHAEL MINNIS AND ASSOCIATES AND THE CITIZEN BAND POTAWATOMI
INDIAN TRIBE OF OKLAHOMA.
WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma is a federally
recognized tribe of American Indians with constitutional authority
under the Indian Reorganization Act of 1934 and the Thomas-Rogers
Act of 1936; and
WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma, the largest of

WHEREAS, the Business Committee of the Citizen Band Potawatomi Indian Tribe
of Oklahoma wishes to retain Michael Minnis and Associates in their
present capacity;
NOW;
THEREFORE, BE IT RESOLVED THAT the Business Committee of the Citizen Band
Potawatomi Indian Tribe of Oklahoma requests approval by the Area Director,
acting in behalf of the Secretary of Interior, of the attached General Counsel
Contract for a period of two (2) years with a starting date of August 22, 1993,
and ending date of August 21, 1995.

WHEREAS, the Tribal Administrator, is hereby granted authority to
implement and amend the contract; and
WHEREAS, the proposed and requested commencement date for the
executed contract is September 30, 1993, through
September 29, 1994; and

Indian Tribe of Oklahoma wishes to make a renewal
application to the Indian Health Services, Oklahoma City
Area, for a prevention substance abuse program;

Citizen Band Potawatomi Indian Tribe of Oklahoma enters into an
agreement with the Indian Health Service, Oklahoma City Area, for
such a program.
