TRANSCRIPTION: RESOLUTION POTT# 94-1 A RESOLUTION ADDING AN AMENDMENT TO THE ELECTION ORDINANCE WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma is a federally recognized tribe of American Indians with constitutional authority under the Indian Reorganization Act of 1934 and the Thomas-Rogers Act of 1936; and WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma, the largest of the Potawatomi Indian Tribes, has, through a continuation of Potawatomi history and organized self government since time immemorial, sovereign powers inherent in tribal tradition and recognized by treaties with the United States and in the United States Constitution; and WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma Constitution and By-Laws provide that the Business Committee of the Tribe shall be granted the power to act on behalf of the Tribe in all matters except those relating to claims or treaties with the United States; and WHEREAS, the Election Committee of the Citizen Band Potawatomi Tribe submitted to the Business Committee the following amendment to the Election Ordinance under Article IV, S4-109 Poll Watchers; Each candidate may designate in writing one person, not a candidate, to watch the activities at the polls ADD a. A Poll Watcher is eligible if: 1. A member of the Tribe. 2. 21 years of age or older b A Poll Watcher is not qualified for appointment if: 1. Under any court-ordered guardianship due to mental incapacity. 2. Ever convicted of a felony. 3. Ever convicted of a non-felonious crime involving the election laws of the Tribe, or 4. Ever found civilly or criminally liable for breaching a fiduciary or contractual duty to the Tribe. Such designation must be presented to Election Committee Officials one week prior to the election. Poll watchers may not interfere in any way with the conduct of the election, but may observe only. Any poll watcher interfering with the election or attempting to electioneer in any way may be ejected from the poll area by a marshal or law enforcement officer. WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma is a federally recognized tribe of American Indians with Constitutional authority under the Indian Reorganization Act of 1934 and Thomas-Rogers Act of 1936; and WHEREAS, the Citizen Band Potawatomi Indian Tribe Of Oklahoma, the largest of the Potawatomi Indian Tribes, has, through a continuation of Potawatomi history of organized self government since time immemorial, sovereign powers inherent in tribal tradition and recognized by treaties with the United States and in the United States Constitution; and WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma Constitution and By-Laws provide that the Business Committee of the Tribe shall be granted the power to act on behalf of the Tribe in all matters except those relating to claims of treaties with the United States; and WHEREAS, the Tribal Administrator and Tribal Chairman, are hereby granted authority to negotiate any items pursuant to this grant and any amendments thereto; and WHEREAS, the Federal Resister, Vol 59, No. 53 on Friday March 18, 1994 listed the Citizen Band Potawatomi of Oklahoma as eligible for this grant; WHEREAS, the proposed start date of this grant shall be immediate upon funding; NOW THEREFORE, BE IT RESOLVED, that the Business Committee of the Citizen Band Potawatomi Indian Tribe of Oklahoma authorizes the Indian Child Welfare Department to submit an application for funding to the Office of Community Services. THEREFORE, BE IT RESOLVED that the Business Committee of the Citizen Band Potawatomi Indian Tribe of Oklahoma hereby accepts and agrees to the offer of $500.00 per year from Mr. Joe Semtner, of Seminole, Oklahoma for a One year period beginning on July 1, 1994 and ending on June 30, 1995.
