RESOLUTION #97-2 - RESOLUTION AUTHORIZING FY-96 ICDBG GRANT APPLICATION FOR THE CONSTRUCTION OF THE NAS-SHAT-NOB-MOT-SOWIN MEDICAL FACILITY, TO BE LOCATED ON (5) FIVE ACRES OF CITIZEN POTAWATOMI NATION TRUST LANDS. THE NAS-SHAT-NOB-MOT-SOWIN MEDICAL FACILITY, IS
TO PROVIDE A COMMUNITY FACILITY DESIGNED FOR A STATE-OF-THE-ART
MEDICAL ENVIRONMENT FOR THE BENEFIT OF THE PEOPLE OF THE
CITIZEN POTAWATOMI NATION AND THE IOWA TRIBE OF OKLAHOMA AND
OTHER INDIAN'S, NOT INDIGENOUS TO THE CENTRAL OKLAHOMA AREA. HEALTH PROGRAMS, ACTIVITIES, FUNCTIONS & SERVICES TO TRIBES WILL BE AVAILABLE TO THE TRIBES UPON COMPLETION OF THIS CONSTRUCTION
PROJECT. THE AMOUNT APPLIED FOR IN THE APPLICATION IS FOR ($750,000.00), SEVEN HUNDRED -FIFTY THOUSAND DOLLARS.
RESOLUTION #97-3 - RESOLUTION AUTHORIZING FY-96 ICDBG GRANT APPLICATION TRIBAL COMMITMENT IN THE AMOUNT OF $250,000 FOR DIRECT CONSTRUCTION CONTRIBUTION. THE NATION SHALL PROVIDE A QUALIFIED-LICENSED CONSTRUCTION SUPERINTENDENT ON A FULL-TIME SALARY WITH FULL STAFFING TO SUPERVISE THE CONSTRUCTION PROJECT AS SHOWN IN
THE BUDGET ATTACHED WITH OTHER PROVISIONS WHICH REFLECT THE
TOTAL AMOUNT CONTRIBUTED BY THE NATION FOR ($250,000.00). THE CEILING LIMIT OF $750,000.00 REQUEST IN THE APPLICATION SHALL BE DIRECTED WHOLLY TO THE ACTUAL CONSTRUCTION COSTS AND TO THE DESIGN FEES, SOILS ENGINEERING AND SURVEY.

FACILITY PROPOSED FOR NEW CONSTRUCTION ON TRIBAL TRUST LAND.
RESOLUTION #97-06 - A RESOLUTION AUTHORIZING FY-96 INDIGENOUS COMMUNITIES PROGRAM GRANT APPLICATION THROUGH THE LANNAN FOUNDATION FOR THE PRESERVATION OF THE POTAWATOMI LANGUAGE, CULTURE, AND TRADITION. THE PROPOSED GRANT PROJECT IS DESIGNED TO PROVIDE RESOURCES TO ASSIST THE CITIZEN POTAWATOMI NATION IN IDENTIFYING NATIVE AMERICANS WHO ARE KNOWLEDGEABLE OF THE CITIZEN POTAWATOMI LANGUAGE AND THE DEVELOPMENT OF HISTORICAL LIFE SKILLS TO TRAIN SELECTED INDIVIDUALS TO TEACH THE SKILLS TO TRIBAL MEMBERS
THROUGHOUT THE NATION. THE PROJECT WILL PLACE GREAT EMPHASIS ON
TEACHING CHILDREN. THE AMOUNT OF THE GRANT PROPOSAL IS $60,000 FOR
A TWO YEAR PERIOD.

WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma Incorporated
(""Corporation""), is a Federal Tribal Corporation authorized under the Oklahoma
Indian Welfare Act of June 26, 1936 (49 Stat. 1967) as the corporate entity of the
Citizen Potawatomi Nation, a federally recognized Indian Tribe formerly known as
the Citizen Band Potawatomi Indian Tribe of Oklahoma; and
WHEREAS, the Corporation is duly authorized and empowered by the corporate charter and by
laws to sue and be sued and to waive sovereign immunity; and
WHEREAS, the Corporation has been assigned the responsibility of conducting the off-track
gaming authorized by the ""Potawatomie [sic] Off-track Wagering Compact,"" a
compact between the Citizen Potawatomi Nation and the State of Oklahoma filed
with the Secretary of State for the State of Oklahoma on December 5, 1996; and
WHEREAS, the Corporation is negotiating agreements with Las Vegas Dissemination, Inc., a
Nevada corporation, d/b/a Las Vegas Dissemination Company (""LVDC"") to provide
certain services relating to said off-track gaming which agreements are captioned
""Race Information Service Agreement"" and ""Para-Mutuel Service Agreement""
requiring contract reciprocity and the resolutions of contractual disputes in Nevada
state courts; and
WHEREAS, the Board of Directors has determined that said agreements are in the best interests
of the Corporation and that a limited waiver of sovereign immunity from suit for
contractual issues is fair, equitable, and necessary for conducting business with
LVDC; and
WHEREAS, the Board of Directors may by resolution authorize officers to execute contracts in
the name of, for and on behalf of the Corporation;
NOW THEREFORE BE IT RESOLVED BY THE BOARD OF DIRECTORS FOR THE CITIZEN
BAND POTAWATOMI INDIAN TRIBE OF OKLAHOMA INCORPORATED THAT corporate
officers John A. Barrett, Jr., and Gene Bruno are hereby authorized to negotiate and execute, for and
on behalf of the Corporation, a Race Information Service Agreement and a Para-Mutuel Service

court for disputes arising under said agreements, and to do all things necessary and proper to

Incorporated hereby waives immunity from suit by Las Vegas Dissemination, Inc., in Nevada state
court for the amount of money agreed to in said contracts plus reasonable attorney fees subject to all
conditions contained in the Charter of Incorporation issued by the Assistant Secretary of the Interior.
The sovereign immunity waiver authorized herein is not intended and shall not be construed as
affecting the sovereign immunity of the Citizen Potawatomi Nation.

WHEREAS, the Citizen Potawatomi Nation, federally recognized
as an American Indian tribe with all constitutional
authority granted to the tribe under the auspices of
the Indian Reorganization Act of 1934 & the Thomas-
Rogers Act of 1936, and
WHEREAS, the Citizen Potawatomi Nation, the largest of the
Potawatomi Indian Tribes, has through a continuation
of Potawatomi history and organized self government
since time immemorial, sovereign powers inherent in
tribal tradition and recognized by treaties with the
United States of America and in the Constitution of
the United States, and
WHEREAS, the Citizen Potawatomi Nation's constitution and the
By-Laws provides that the Business Committee of this
tribe shall be granted the powers to act on behalf of
the tribe in all matters, except those which relate
to claims and treaties with the United States, and
WHEREAS, the Citizen Potawatomi Nation desiring to further
facilitate the Nation's application for the FY-96
HUD-Indian Community Development Block Grant and to
provide documentation of activities required prior
to the submittal of the application for funding, do
hereby authorize the following actions;
1) Conduct public meeting, record all comments, be
available to answer questions.
2) Inform tribal members of funds available for the
construction project proposed.
WHEREAS, the Citizen Potawatomi Nation, have been determined
to be eligible to apply for funds for construction of
community facility projects and by the documentation
of this resolution demonstrates their full commitment
to comply with all application requirements for a FY-
96 HUD-Indian Community Development Block Grant.
NOW THEREFORE BE IT RESOLVED, that the Business Committee
of the Citizen Potawatomi Nation does hereby fully
endorse, support and authorize this resolution for
documenting application requirements and will post
results of the community meeting and shall consider
all tribal member commentary for any modification(s)

WHEREAS, the Citizen Potawatomi Nation is a federally recognized tribe of American Indian
with constitutional authority under the Thomas-Rogers Oklahoma Indian Welfare
Act of June 26, 1936, (40 Stat. 1967); and
WHEREAS, the Citizen Potawatomi Nation, the largest of the Potawatomi Indian Tribes, has
through a continuation of Potawatomi history and organized self government since
time immemorial, sovereign powers inherent in tribal tradition and recognized by
treaties with the United States and in the United States Constitution; and
WHEREAS, the Citizen Potawatomi Nation Constitution and By-Laws provide that the Business
Committee is empowered to enact legislation, transact business, and otherwise speak
or act on behalf of the Citizen Potawatomi Nation in all matters on which the Tribe
is empowered to act now or in the future; and
WHEREAS, the Potawatomi purchased a thirty square mile Reservation in Indian Territory
(""Potawatomi Reservation"") consistent with the Treaty with the Potawatomi of 1867 [italicized on original] (15 Stats. 521); and
WHEREAS, the Absentee Shawnee Tribe of Oklahoma (""Absentee Shawnee"") does not now have
and never has had a reservation with boundaries similar to the Potawatomi
Reservation; and

WHEREAS, the United States Department of the Interior, Bureau of Indian Affairs, nevertheless,
has consistently and illegally treated the Absentee Shawnee as jointly sharing with
the Potawatomi in said Potawatomi Reservation; and
WHEREAS, the Indian Claims Commission has determined that ""It is undisputed that the Absentee Shawnee's possession of such Oklahoma lands were not ‘locations made for them’
by the Government;"" that the Absentee Shawnee were, ""in the nature of squatters’
whose possession was neither from time immemorial nor was their possession of
lands within the Oklahoma Reservation obtained under any color of title or
recognition of ownership by the Congress or the exclusive branch of the Government
or by the Citizen Band."" Citizen Band of Potawatomi Indians of Oklahoma v. United
States of America, [italicized on original] Docket No. 96, 6 Ind. Cl. Comm 646, 664-665 (Sept 18, 1956)
(opinion of the commission); and
WHEREAS, a United States District Court has declared that there is ""no treaty or agreement with
A-S Tribe, Act of Congress, Executive Order, purchase or any other act setting apart
land within the boundaries of the Potawatomi Reservation for the use of the A-S
Tribe"" Citizen Band Potawatomi Indian Tribe of Oklahoma v. Collier, [italicized on original] Case No. CIV-
92-2161-R (W. D. Okla.); and
WHEREAS, the Absentee Shawnee have asserted jurisdiction over people and activities occurring
within the Potawatomi Reservation boundaries though such persons and activities are
exclusively within the jurisdiction of the Potawatomi; and
WHEREAS, any such purported exercise of jurisdiction on lands or over persons within the
Potawatomi Reservation shall be considered a criminal act and shall be punished
within the courts of the Citizen Potawatomi Nation; and
WHEREAS, for the reasons previously enumerated, the Absentee Shawnee should be given notice
to cease asserting jurisdiction over land and people within the Potawatomi
Reservation except for lands held in trust by the United States for the Absentee
Shawnee or lands held in trust for individual Absentee Shawnee allotees;

NOW, THEREFORE, BE IT RESOLVED THAT the Chairman of the Business Committee is
hereby authorized to give written notice to the Absentee Shawnee Tribe of Oklahoma to cease
exercising purported civil and criminal jurisdiction within the Potawatomi Reservation boundaries
except for lands held in trust by the United States for the Absentee Shawnee or lands held in trust
for individual Absentee Shawnee allotees.

WHEREAS, the Citizen Potawatomi Nation is a federally recognized tribe of American
Indians with constitutional authority authorized under the Oklahoma Indian

WHEREAS, the Citizen Potawatomi Nation has, through a history of organized

change the definition of ""an Indian Tribe"" as stated in Public Law 101-601,
The Native American Graves Protection and Repatriation Act (NAGPRA)
to allow non-federally recognized Native American groups to claim native
American human remains and cultural objects, and
WHEREAS, The Citizen Potawatomi Nation views this action by the NAGPRA Review
Committee as a violation of tribal sovereignty and a threat to the
fundamental religious rights and customs of the Citizen Potawatomi

Nation, and is contrary to the intent of Congress in the passage of the
NAGPRA law, and
WHEREAS, The Citizen Potawatomi Nation requests the National Congress of

federally recognized Native American Tribe and is therefore of primary
interest to the NCAI,

THEREFORE BE IT RESOLVED BY THE CITIZEN POTAWATOMI NATION,
that The National Congress of American Indians is requested to pass a resolution
opposing the change in the definition of ""an Indian tribe"" as proposed by the NAGPRA
Review Committee, and supporting the original language in the Native American Graves
Protection and Repatriation Act.

WHEREAS, it is the desire of the Citizen Potawatomi Nation that the transfer of trust
funds take place in the form of a cash transfer of the proceeds of a

such liquidation take place in time to transfer the funds no later than
November 15, 1996, and
WHEREAS, Mr. Larry Briggs is appointed as agent for the Citizen Potawatomi Nation
to approve the sales price of all the securities to be liquidated prior to
transfer of the cash proceeds to the First National Bank and Trust,
Shawnee, Oklahoma,

THEREFORE BE IT RESOLVED, That the Citizen Potawatomi Nation directs the
Bureau of Indian Affairs Office of Trust Funds Management to liquidate the entire
portfolio of the Nation's trust funds prior to transfer to the First National Bank and
Trust, Shawnee, Oklahoma with Larry Briggs acting as the Nation's agent for
approval of the sales prices of the liquidated securities.

WHEREAS, the Citizen Potawatomi Nation is a federally recognized tribe of American Indian

benefit of Citizen Potawatomi Nation Tribal members and for non-indigenous Indians
residing in the IHS Shawnee Service Unit area; and

WHEREAS, the Citizen Potawatomi Nation, pursuant to P.L. 93-638 as amended, by this
resolution action do hereby make claim specifically for this Nation's share of funds

and funding at Headquarters-Indian Health Service, Rockville, MD., with the further
stipulation that funds identified as ""Environmental"" are to remain intact under Indian
Health Service Management; and
WHEREAS, the Business Committee of the Citizen Potawatomi Nation hereby directs those
funds identified as the Nation's share of funds now managed by the Indian Health
Service be transferred immediately or as soon as practicable prior to December 3,
1996, a contract agreement subject to the stipulation stated in the foregoing
paragraph regarding ""Environmental""funds; and [as typed on original]
WHEREAS, the Business Committee further directs that the Indian Health Service shall make
available to the contract agreement those fundings for transitional costs, indirect costs,
contract support costs (both direct & indirect), and those costs deemed to be necessary
for start-up, be made an integral part of this contract agreement, and also that these
funds be included in a health compact under self-governance at the appropriate time; and
WHEREAS, Resolution Pott #96-74, previously submitted, authorized a contract by a consortium
including the Iowa Tribe of Oklahoma and the consortium no longer exists, therefore
Resolution Pott #96-74 should be repealed;

THEREFORE BE IT RESOLVED that the Business Committee authorized a P.L. 93-638 contract
with the Indian Health Service for provision of health programs, activities, services and functions

WHEREAS, the Citizen Potawatomi Nation Constitution and By-Laws provide that the
Business Committee of the Citizen Potawatomi Nation is empowered to
enact legislation, transact business, and otherwise speak and act on behalf
the Citizen Potawatomi Nation in all matters on which the Nation is
empowered to act now or in the future except those relating to claims or
treaties with the United States; and
WHEREAS, The Citizen Potawatomi Nation was issued a Federal Corporate Charter
concurrently with the Tribal Constitution and By-Laws in 1983 for the
Citizen Band Potawatomi Indian Tribe of Oklahoma Incorporated and was
granted the power to create subsidiary entities of that corporation, doing so
in the issuance of a Certificate of Incorporation for Potawatomi

services with Lucent Technologies Inc. requiring contractual

lease with the consent of the Department of Housing and Urban Development
""HUD""; and
WHEREAS, the Citizen Potawatomi Nation, formerly the Citizen Band Potawatomi Tribe of
Oklahoma, AKA The Potawatomi Indians of Oklahoma retained, as outlined in part
fourteen (14) of the above reference lease, the right to purchase any remaining
balance due to HUD; and
WHEREAS, the Citizen Potawatomi Nation retained the right to and possession of the land,
housing units and other units at any time during the term of said lease; and
WHEREAS, upon termination of the lease, lessee shall upon demand surrender to the lessor
complete and peaceable possession of the premises; and
WHEREAS, provisions of the Housing and Community Development Reconciliation Amendments
of 1985 (P.L. 99-272 enacted April 7, 1986) authorized the Secretary to forgive
outstanding principal and interest on loans made by the Secretary of Indian Housing
Authorities; and
WHEREAS, the Housing Authority of the Absentee Shawnee Tribe has executed the Consolidated
Annual contributions contract Form HUD-53012A and Form HUD-53012B, which
states that ""any loan made by HUD to the Housing Authority of the Absentee
Shawnee Tribe, that has any principal or interest amount outstanding or accrued that
is payable from debt service annual contributions shall be forgiven and any promise
to repay principal and interest in a loan contract shall be canceled”; and
WHEREAS, the Housing Authority of the Absentee Shawnee Tribe of Oklahoma has removed the
above reference low rent project's indebtedness to HUD from its general ledger, with
accounting entries provided by HUD using the amount necessary to reduce the
project's debt to zero; and
WHEREAS, the Citizen Potawatomi Nation requests HUD to make a determination and
distribution of fair and proportionate share of any assets identified with this project,
i.e., operating reserves, equipment, comp. grant funds, office supplies, etc.; and

WHEREAS, the Citizen Potawatomi Nation has, through a history of organized
self-government since time immemorial, sovereign powers inherent in
Tribal tradition and recognized by treaties with the United States and in the
United States Constitution; and
WHEREAS, the Citizen Potawatomi Nation Constitution and By-Laws provide that the
Business Committee of the Citizen Potawatomi Nation is empowered to
enact legislation, transact business, and otherwise speak and act on behalf
the Citizen Potawatomi Nation in all matters on which the Nation is

with the Bureau of Indian Affairs, precluding any form of ""workout""
occasioned by a default on the loan as has been suggested by a Bureau of
Indian Affairs official as the only means of obtaining new terms; NOW

POTAWATOMI NATION'S INTENTION TO PROVIDE AN EFFECTIVE CONTINUUM
OF CARE FOR DRUG AND ALCOHOL TREATMENT SERVICES.
WHEREAS, the Citizen Potawatomi Nation is a federally recognized tribe of American Indians
with constitutional authority under the Thomas-Rogers Oklahoma Indian Welfare
Act of June 26, 1936, (40 Stat. 1967); and
WHEREAS, the Citizen Potawatomi Nation, the largest of the Potawatomi Indian Tribes, has,
through a continuation of Potawatomi history of organized self government since
time immemorial, sovereign powers inherent in tribal tradition and recognized by
treaties with the United States and in the United States Constitution; and
WHEREAS, the Citizen Potawatomi Nation Constitution and By-Laws provide that the Business
Committee is empowered to enact legislation, transact business, and otherwise
speak or act on behalf of the Citizen Potawatomi Nation in all matters on which the
Tribe is empowered to act now or in the future; and
WHEREAS, the Citizen Potawatomi Nation desires to strengthen its capacity in tribal
government by improving and maintaining tribal programs and activities; and
WHEREAS, the Tribal Administrator, is hereby granted authority to negotiate with the Indian
Health Service any items pursuant to this Resolution; and
WHEREAS, the Health and Community Services is hereby authorized to execute the Programs
resulting from the implementation of this Resolution; and

WHEREAS, the Citizen Potawatomi Nation withdraws all previous authorizations for any
agency, including the Native American Center of Recovery or any of its staff or
subcontractors, to provide drug and alcohol treatment services on behalf of the
Tribe;

THEREFORE, BE IT RESOLVED, that the Business Committee of the Citizen Potawatomi
Nation requests all carryover from the previous year funding, all indirect cost allowances and all
current year funding for substance abuse treatment be immediately transferred from the Native
American Center of Recovery to the Citizen Potawatomi Nation.

Gregory's University of resources available to the Citizen Potawatomi
Nation from existing and future Federal contracts, grants, and programs
as well as a portion of the Tribal scholarship moneys set-aside by the
Nation in its settlement with the Indian Claims Commission;

THEREFORE BE IT RESOLVED BY THE CITIZEN POTAWATOMI NATION,
that a pledge is hereby made in the amount of $1,000,000.00 to St. Gregory's University
for the design and implementation of a multi-year program of spiritual, educational and

WHEREAS, the best interests of the Citizen Potawatomi Nation are served by the
exclusion and removal of the Absentee Shawnee Housing Authority from
the Nation's jurisdiction under the authority of the Constitution of the
Citizen Potawatomi Nation, Article 2, Section 1(a), which provides that
the Nation shall ""... promote the general welfare of the Citizen Band
Potawatomi Indian Tribe of Oklahoma (now the Citizen Potawatomi
Nation) by exercising to the fullest possible extent the inherent powers of
self-government vested in the Tribe since time immemorial and any
additional powers of self-government vested in the Tribe by Federal or
state law; and
WHEREAS, authority to remove the Absentee Shawnee Housing Authority from the
jurisdiction of the Citizen Potawatomi Nation exists under Article 4,
Section 1, of the Constitution of the Citizen Potawatomi Nation which
provides that ""The jurisdiction and governmental powers of the Citizen
Potawatomi Nation shall ..... extend to all persons and to all real and
personal property ….. over which the Citizen Potawatomi Nation has
authority"", consistent with Federal law precedent under Worcester v.
Georgia 31 U.S. 515 (1832) stating that a Tribe has inherent power to
decide who may enter its reservation and under what conditions;

THEREFORE BE IT RESOLVED BY THE CITIZEN POTAWATOMI NATION,
that the Absentee Shawnee Housing Authority is hereby directed to vacate
the premises presently occupied on Father Murphy Drive and any other
locations in the jurisdiction of the Citizen Potawatomi Nation no later than
12:00 noon on the 31st day of March, 1997 or be removed.

WHEREAS, the Citizen Potawatomi Nation, the largest of the Potawatomi Indian

Tribal tradition and recognized by treaties with the United States and in the
United States Constitution; and

General Assistance to Tribes Program (GAP) to satisfy the above described
needs and providing a copy of the Standard Application Kit, completed

Potawatomi Nation that a formal request is made for $75,000 in funding from the General
Assistance for Tribes Program (GAP) to establish the Citizen Potawatomi Nation

WHEREAS, the Citizen Potawatomi Nation is a federally recognized tribe of American
Indians with constitutional authority under the Thomas-Rogers Oklahoma
Indian Welfare Act of June 26, 1936, (40 Stat. 1967); and
WHEREAS, the Citizen Potawatomi Nation, the largest of the Potawatomi Indian
Tribes, has, through a continuation of Potawatomi history of organized
self government since time immemorial, sovereign powers inherent in
tribal tradition and recognized by treaties with the United States and in the
United States Constitution; and
WHEREAS, the Citizen Potawatomi Nation Constitution and By-Laws provide that the
Business Committee is empowered to enact legislation, transact business,
and otherwise speak or act on behalf of the Citizen Potawatomi Nation in
all matters on which the Tribe is empowered to act now or in the future;
and
WHEREAS, the Citizen Potawatomi Nation desires to strengthen its capacity in tribal
government by improving and maintaining tribal programs and activities;
and
WHEREAS, Congress has enacted Public Law 104-193, ""Personal Responsibility and
Work Opportunity Reconciliation Act of 1996"" voluntarily establish a
TANF, (Temporary Assistance to Needy Families) Program; and
WHEREAS, Public Law 102-477 permits the consolidation of funding received for
these programs and allows greater flexibility in the development,
coordination and operation of said programs;

NOW THEREFORE, BE IT RESOLVED THAT effective July 1, 1997, that the
TANF Program be administered in accordance with that plan negotiated with the ACF of
Health and Human Services.
BE IT FURTHER RESOLVED THAT said program will be negotiation on an annual
Basis and that the authority to negotiate commence immediately.

WHEREAS, the Business Committee has previously entered into a compact with the State of
Oklahoma to conduct off-track gaming under the Indian Gaming Regulatory Act that has
been duly approved and published in the Federal Register; and
WHEREAS, the Business Committee has assigned to the Citizen Band Potawatomi Indian Tribe
Incorporated, a federally-chartered tribal corporation, the responsibility for conducting the
gaming authorized by said compact; and

WHEREAS, said Corporation has entered into agreements with the Las Vegas Dissemination, Inc.,
a Nevada corporation d/b/a Las Vegas Dissemination Company (""LVDC"") providing that
neither the Corporation nor the Citizen Potawatomi Nation will contract with or enable any
other party to provide any of the services contemplated to be provided by LVDC pursuant
to the agreements, and
WHEREAS, LVDC has asked the Business Committee to provide a mechanism for enforcing these
exclusivity provisions against the Citizen Potawatomi Nation which is not a party to the
agreements; and
WHEREAS, the Business Committee is agreeable to providing such an enforcement mechanism;
NOW
THEREFORE BE IT RESOLVED, by the Business Committee of the Citizen Potawatomi Nation
that the Citizen Potawatomi Nation hereby waives immunity to suit initiated by the Las Vegas
Dissemination, Inc., a Nevada corporation, in the United States District Court for the Western
District of Oklahoma for the sole and only purpose of enforcing by injunctive means the Potawatomi
obligation during the life of the Race Information Service Agreement and Pari-Mutuel Service
Agreement with the Citizen Band Potawatomi Indian Tribe of Oklahoma Incorporated to refrain
from engaging any other entity to provide the services contemplated by said agreements. This waiver
is limited solely to the purpose enunciated and shall not be deemed a waiver for any purpose other
than that specifically set forth herein.

(P.L. 93-638 with technical amendments) for participation in the self-governance programs
(P.L. 100-473 Title III); and
WHEREAS, the Citizen Potawatomi Nation presently administers a variety of Bureau of Indian
Affairs Self-Determination contracts, the nation has mature contractor status, annual
program(s) audits have been completed with no significant findings, NOW

WHEREAS, those regulations further provide that a service line shall be for the sole purpose of
supplying the owner with electric power for use by such owner; and
WHEREAS, the agreement between Oklahoma Gas and Electric Company and the Tribe conveys
no interest in the land traversed whatsoever.
THEREFORE BE IT RESOLVED, that the Business Committee of the Citizen Potawatomi
Nation hereby grants a perpetual service line agreement to the applicant, Oklahoma Gas and Electric
Company, for the construction and installation of underground electrical power distribution lines on
Tribal lands above described without payment of any monetary compensation for damages; and

Citizen Potawatomi; and
WHEREAS, the funding formula presently utilized by the B.I.A. for funds distribution are based
on former assumptions that a common ""former reservation"" was shared by these two tribes,
is now found by the court to have been in grave error, and

of Indian Affairs, do hereby request immediate suspension of all negotiation activity

WHEREAS, the Citizen Potawatomi Nation believes that a need exists to provide higher education
opportunities for health professional who wish to improve their professional credentials and
knowledge; and

WHEREAS, the advent of PL93-638 contracting and Self-Governance compacts has displaced a
large number of IHS employees who may need to upgrade their professional credentials to
find employment in the private sector or tribal clinics and hospitals; and
WHEREAS, a unique facility combining educational capability with degree granting authority plus
clinical and professional residency capabilities would best provide the concentrated
educational experience suited to the working health professional, and
WHEREAS, the Citizen Potawatomi Nation intends to establish the Potawatomi College of Health
Professions through partnership with St. Gregory's University, Mission Hill Memorial
Hospital and St. Anthony's Hospital to provide education specifically designed to upgrade
nursing credentials and train students for medical practice management; and
WHEREAS, market research and evaluation of the areas of operations, educational need, specific
curriculum to address those needs, the number of health professional desiring training and/or
credentials improvement, facility design and location, and the necessary continuing revenue
and revenue sources required to perpetuate the college are vital to the Citizen Potawatomi
Nation in the implementation of its educational goals;

research and evaluation for the Potawatomi College of Health Professions with project

Potawatomi National Research Library’s Special Library

Health Service any items pursuant to this Resolution; and
WHEREAS, the Community and Family Services is hereby authorized to execute the Programs
resulting from the implementation of this Resolution; and

WHEREAS, the Director of the Community and Family Services, currently Rick Short, is to serve
as the contact person for answering technical questions, providing information, and attending
meetings regarding this program; and
WHEREAS, the population to be served by these programs, activities, services and functions will
be users who are Citizen Potawatomi Nation Tribal members and Indians non-indigenous to
the IHS Shawnee Service Unit Area.
WHEREAS, Resolution Pott #97-44 dated May 20, 1997 (provided with the Tribe's Letter of Intent
dated February 4, 1997) requested "all carryover from the previous year funding, all indirect
cost allowances and all current year funding for substance abuse treatment be immediately
transferred from the Native American Center of Recovery to the Citizen Potawatomi
Nation," meaning as soon as practical after May 20, 1997; and
WHEREAS, the Business Committee further directs by this resolution action that the Indian Health
Service shall make available to the contract agreement those fundings for preaward,
transitional costs, indirect costs, contract support costs (both direct and indirect), and those
costs deemed to be necessary for start-up, be made an integral part of this contract agreement,
and also that these funds may be included in a health compact under self-governance at the
appropriate time; furthermore, the Nation reserves the right to negotiate for Tribal shares at
the appropriate time; and
WHEREAS, the program annual state date for these services and for future annual contracts, if any,
shall be October 1 of the appropriate year; and
THEREFORE, BE IT RESOLVED, that the Business Committee of the Citizen Potawatomi
Nation authorize a P.L. 93-638 Title I contract with the Indian Health Service for provision of drug
and alcohol addition treatment programs, activities, services and functions heretofore provided by
the NACOR treatment facility for the Citizen Potawatomi Nation tribal members and for Indians
non-indigenous to the Shawnee Service Unit area.

WHEREAS, the Citizen Potawatomi Nation is a federally recognized tribe of American
Indians with constitutional authority authorized under the Oklahoma Indian
Welfare Act of June 26, 1936, (49 Stat. 1967); and
WHEREAS, the Citizen Potawatomi Nation, the largest of the Potawatomi Indian
Tribes, has, through a continuation of Potawatomi history of organized
self-government since time immemorial, sovereign powers inherent in
Tribal tradition and recognized by treaties with the United States and in the
United States Constitution; and
WHEREAS, the Citizen Potawatomi Nation Constitution and By-Laws provide that the
Business Committee of the Citizen Potawatomi Nation is empowered to
enact legislation, transact business, and otherwise speak and act on behalf
the Citizen Potawatomi Nation in all matters on which the Nation is
empowered to act now or in the future except those relating to claims or

WHEREAS, The Citizen Potawatomi Nation has contracted to purchase Oakcrest
Hospital from the bankrupt Sterling Healthcare Corporation through a
bankruptcy court approved contract with a $1,225,000.00 loan from
American National Bank and Trust Company secured with a pledge of the
stock of First National Bank and Trust Company owned by the Citizen
Potawatomi Nation; and
WHEREAS, a limited waiver of sovereign immunity from suit against the Citizen
Potawatomi Nation for the exclusive purposes of the loan
transaction with American National Bank and Trust Company is fair,

equitable, and necessary for the conduct of business between it and
American National Bank and Trust Company; NOW
THEREFORE BE IT RESOLVED BY THE CITIZEN POTAWATOMI NATION,

Nation for the amount of $1,285,000 and costs agreed to in loan documents with
American National Bank and Trust Company, plus reasonable attorney fees, in Federal
District Court, is hereby granted, limiting such waiver of sovereign immunity from suit to
actions arising from any default by the Citizen Potawatomi Nation on the loan agreement
and pertaining to enforcement of American National Bank's rights against the collateral
stock of First National Bank and Trust Company; and authorizing John A. Barrett, Jr. to
consummate the loan transaction with American National Bank and Trust Company and
authorizing the pledge of the bank stock of First National Bank and Trust Company as
collateral for the loan.

vendors as a first preference vendor; and
WHEREAS, the "piggybacking" of Indian vendors contracts to large business non-Indian VA
contractors should be stopped by an action of the United States Congress in
