Barrett, Jr., and Gene Bruno are hereby authorized to negotiate and execute, for and on behalf of the Corporation FireLake Intrastate Common Pool Pari-Mutuel Wagering Agreement with Tulsa Fair including provisions waiving suit immunity and authorizing suit in a federal court in Oklahoma for disputes arising under said agreement, and to do all things necessary and proper to effectuate this authorization and THAT the Citizen Band Potawatomi Indian Tribe of Oklahoma Incorporated hereby waives immunity from suit by Tulsa County Public Facilities Authority, in a federal court in Oklahoma for the amount of money agreed to in said contract plus reasonable attorney fees subject to all conditions contained in the Charter of Incorporation issued by the Assistant Secretary of the Interior. The sovereign immunity waiver authorized herein is not intended and shall not be construed as affecting the sovereign immunity of the Citizen Potawatomi Nation. WHEREAS, the Citizen Potawatomi Nation is a federally recognized tribe of American Indians with constitutional authority under the Thomas-Rogers Oklahoma Indian Welfare Act of June 26, 1936, (40 Stat. 1967); and WHEREAS, the Citizen Potawatomi Nation, the largest of the Potawatomi Indian Tribes, has, through a continuation of Potawatomi history and organized self government since time immemorial, sovereign powers inherent in tribal tradition and recognized by treaties with the United States and in the United States Constitution; and WHEREAS, the Citizen Potawatomi Nation Constitution and By-Laws provide that the Business Committee is empowered to enact legislation, transact business, and otherwise speak or act on behalf of the Citizen Potawatomi Nation in all matters on which the Tribe is empowered to act now or in the future; and WHEREAS, the U.S. Department of Justice has provided a grant to Native American Connections, Inc, (NACI) located in Phoenix, Arizona; and WHEREAS, the major intent of this grant is to contract with Native American Tribes and Alaska Natives to provide services with a special emphasis on enforcing underage drinking laws; and WHEREAS, NACI is administering this initiative and soliciting proposals for projects that range from $45,000 to $50,000, and will provide technical assistance to the successful contractors; and WHEREAS, the Citizen Potawatomi Nation wishes to develop a model program to reduce underage drinking; NOW RESOLUTION # 99-78 PAGE # 2 CITIZEN POTAWATOMI NATION THEREFORE BE IT RESOLVED, that the Business Committee of the Citizen Potawatomi Nation supports and hereby authorizes the submission of an application on behalf of the Citizen Potawatomi Nation for a model project to reduce underage drinking.
