RESOLUTION # 09-01-JPS
A RESOLUTION AUTHORIZING AND APPROVING A JUVENILE
DETENTION SERVICES AGREEMENT BY AND BETWEEN THE CITIZEN
POTAWATOMI NATION AND THE SAC AND FOX NATION.
WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of
American Indians with Constitutional authority under the Act of June 18,
1934 and the Oklahoma Indian Welfare Act of June 26, 1936, (49 Stat.
1967); and
WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in
Tribal tradition, derived from a history of organized self-government since
time immemorial, and recognized by treaties with the United States and in
the Constitution of the United States; and
WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution
provides for a separation of powers of the Tribal government by the
reservation and delegation of specific powers to other entities of the Tribal
government; and, except for these specific limitations, all other general
powers of government are embodied in the Legislature's authority "to
enact legislation, transact business, and otherwise speak and act on behalf
of the Citizen Potawatomi Nation in all matters on which the Nation is
empowered to act now or in the future"; and
WHEREAS, the Citizen Potawatomi Nation Indian Child Welfare Department desires to
enter into an agreement with the Sac and Fox Nation for juvenile services
at the Sac and Fox Nation Juvenile Facility, located in Stroud, Oklahoma;
and
WHEREAS, the Citizen Potawatomi Nation recognizes that the agreement for detention
services is on an as needed basis and is contingent on available space as
determined by the Sac and Fox Nation Juvenile Facility; and

WHEREAS, admission to the Sac and Fox Juvenile Facility shall be allowed only by a
written order of the Citizen Potawatomi Nation Court Judge.
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE
CITIZEN POTAWATOMI NATION, that a resolution authorizing the agreement
for juvenile detention services between the Citizen Potawatomi Nation and the Sac and
Fox Nation IS HEREBY APPROVED.
NOW, THEREFORE BE IT FURTHER RESOLVED, that by act of this resolution
and consistent with the separation of powers defined in the Constitution, an appropriation
of $2,000.00 from the Indian Child Welfare account for the negotiation, operation,
enforcement, procurement, settlement and/or completion of this contract or agreement by
the Tribal Chairman or his designate IS HEREBY AUTHORIZED.

WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in
Tribal tradition, derived from a history of organized self-government since
time immemorial, and recognized by treaties with the United States and in
the Constitution of the United States; and
WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution
provides for a separation of powers of the Tribal government by the
reservation and delegation of specific powers to other entities of the Tribal
government; and, except for these specific limitations, all other general
powers of government are embodied in the Legislature's authority "to
enact legislation, transact business, and otherwise speak and act on behalf
of the Citizen Potawatomi Nation in all matters on which the Nation is

WHEREAS, the Citizen Potawatomi Nation desires to enter into a twelfth-year grant
agreement with the Indian Health Service for approximately $626,735.00
to continue its Special Diabetes Program; and
WHEREAS, in Fiscal Year 2009, the Citizen Potawatomi Nation proposes to continue
its Diabetic Program aimed at diabetic prevention and education and
primary, secondary, and tertiary diabetic services for the Native American
community; and

WHEREAS, the Citizen Potawatomi Nation is not required to provide matching or in-
kind donations to receive the funds.
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE
CITIZEN POTAWATOMI NATION, that a resolution supporting the "Citizen
Potawatomi Nation's Fiscal Year 2009 Diabetes Grant - Year 12" proposal to the Indian
Health Service under the Special Diabetes Program for Indians, IS HEREBY
APPROVED.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that by act of this resolution
and consistent with the separation of powers defined in the Constitution, if awarded, an
appropriation of $626,735.00 from the Indian Health Service fund (or other applicable
accounts) for the implementation, negotiation, operation, enforcement, procurement,
settlement, and or completion of this contract, compact, regulation or agreement by the

PROGRAM
WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of
American Indians with Constitutional authority under the Act of June 18,
1934 and the Oklahoma Indian Welfare Act of June 26, 1936, (49 Stat.
1967); and
WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in
Tribal tradition, derived from a history of organized self-government since
time immemorial, and recognized by treaties with the United States and in
the Constitution of the United States; and
WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution
provides for a separation of powers of the Tribal government by the
reservation and delegation of specific powers to other entities of the Tribal
government; and, except for these specific limitations, all other general
powers of government are embodied in the Legislature's authority "to
enact legislation, transact business, and otherwise speak and act on behalf

WHEREAS, the United States Department of Housing and Urban Development (HUD)
is soliciting grant applications of up to $800,000 through the Fiscal Year
2008 Indian Community Development Block Grant (ICDBG) program; and

WHEREAS, because of the increasing number of Native Americans requiring health
care services within the Tribal community as evidenced by Citizen
Potawatomi Nation Health Clinic's long waiting list for appointments and
services, the Citizen Potawatomi Nation is submitting an application for the
construction of a new professional services annex to be located adjacent to
the Tribal health clinic within the Tribal Jurisdictional Area; and
WHEREAS, the professional services annex will meet an essential community
development need by providing a facility in which outpatient behavioral
health treatment, audiology, eye-ware, contract health services, a training
area, shipping and receiving, and a centralized business office will be
provided for Native Americans living within the Shawnee Service Area;
and
WHEREAS, the Citizen Potawatomi Nation has adopted an operation and maintenance
plan and commits the necessary funding of $82,834 to provide for facility
upkeep; and
WHEREAS, the Citizen Potawatomi Nation operates the Health System under a Self-
Governance Agreement with the Indian Health Service and commits annual
operating funds of approximately $9,824,684; and
WHEREAS, the professional services annex will be constructed following applicable
standards and guidelines from the Building Officials and Code
Administrators (BOCA), Life and Safety Codes, Americans with
Disabilities Act (ADA), and American Institute of Architects (AIA)
consistent with IHS standards; and
WHEREAS, a Public Meeting was held on June 18, 2008 to solicit comments from
Tribal and community members regarding the proposed community
development pursuant to citizen participation requirements as set forth in
24 CFR 1003.604; and
WHEREAS, the project period for the proposed professional services annex construction
project is two years, with a total project cost of $1,075,000 of which
$800,000 (or 74%) is the Federal share, and $275,000 (or 26%) is Tribal
leverage; and

WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in Tribal

Department of Labor Workforce Investment Act; and
WHEREAS, Congress has enacted Public Law 102-477 which allows Tribes to voluntarily
consolidate various Employment Training and related programs; and
WHEREAS, Public Law 102-477 permits the consolidation of funding received for these
programs and allows greater flexibility in the development, coordination and
operation of said programs; and

WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution provides for a
separation of powers of the Tribal government by the reservation and delegation of
specific powers to other entities of the Tribal government; and, except for these
specific limitations, all other general powers of government are embodied in the
Legislature's authority "to enact legislation, transact business, and otherwise speak
and act on behalf of the Citizen Potawatomi Nation in all matters on which the
Nation is empowered to act now or in the future"; and
WHEREAS, the United States Department of Transportation, Federal Transit Administration
announced the availability of approximately $12 million for its Fiscal Year 2008
Public Transportation on Indian Reservations Program, a/k/a the Tribal Transit
Program, and is soliciting grant applications; and
WHEREAS, the Citizen Potawatomi Nation is submitting a grant application to expand its existing
basic transit service based on the need as evidenced from the increasing number of
transportation requests; and
WHEREAS, the Citizen Potawatomi Nation's proposed Tribal Transit system will include: (1) on-
demand local transportation to and from the Citizen Potawatomi Nation Health Clinic;
(2) on-demand transportation of local Citizen Potawatomi Nation Health Clinic
patients to and from their out-of-town medical appointments; 3) fixed routes to

include employee transportation, workforce trainee transportation, and general
transportation for the local community; and
WHEREAS, the proposed project period is year three of a four year Transit Project with an annual
total cost of $309,387 of which $276,541, or 89%, is the Federal share, and $32,846,
or 11%, the non-Federal match that will be provided through in-kind and cash
contributions.
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN
POTAWATOMI NATION that a resolution authorizing an FY 2008 Tribal Transit Grant Proposal
to the United States Department of Transportation IS HEREBY APPROVED.

WHEREAS, the Union Pacific Railroad line from McAlester, Oklahoma to Shawnee, Oklahoma is a key
link in the restoration and stimulation of commerce of the east-west railroad corridor for
the State of Oklahoma and for the Citizen Potawatomi Nation; and
WHEREAS, the Citizen Potawatomi Nation is evaluating the potential purchase and restoration of this
66 miles of unused rail in order to stimulate the local economy and provide economic
opportunity for both the Indian and non-Indian community; and
WHEREAS, an analysis and critique of the state commissioned estimate(s) of the cost of acquiring and
refurbishing the line is needed as well as an independent engineering estimate to
accurately estimate the cost of refurbishing and upgrading the rail line to the current 10
mph standard as well as to an improved 25 mph standard; and

WHEREAS, a traffic study is needed to identify potentially divertible commodity movements to the line
as well as to identify potential shippers located along the line with estimates of traffic

and the Harvard Project, has agreed to contract with the Citizen Potawatomi Nation to complete
the necessary feasibility study; and
WHEREAS, the project period for the proposed feasibility study is one year with a total cost of $40,000.
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN
POTAWATOMI NATION that a resolution supporting and approving the Citizen Potawatomi Nation's

opportunities for Native Americans and to develop experience for its members in contract administration; and
WHEREAS, the National Fund for Excellence in American Indian Education (hereinafter, "National Fund")
is a non-profit, federally chartered organization, established by the Secretary of the Interior pursuant to
25 U.S. Code, section 458 (a) and incorporated in the District of Columbia in July, 2004 for the purpose of
securing government and private funds to further the educational opportunities of Native
American students attending schools funded by the Bureau of Indian Education, U.S. Department
of the Interior; and
WHEREAS, the Office of Indian Energy and Economic Development (IEED) was established within
the Office of the Secretary, Indian Affairs, U.S. Department of the Interior to provide high-level support for
the Department's goal of serving tribal communities by helping tribes stimulate job creation and
economic development; and
WHEREAS, the National Fund sought funding to support the preparation of a strategic business plan to
enable it to begin operations and the IEED agreed to provide such funding, if administered by the Citizen
Potawatomi Nation; and

WHEREAS, IEED operates the Native American Business Development Institute (NABDI), which links
tribes seeking preparation of economic feasibility studies and strategic business plans with distinguished

WHEREAS, the National Fund seeks to have the Olin School of Business, Washington University in
St. Louis (hereinafter, "Olin") prepare a strategic business plan with funding provided by IEED through its
NABDI program; and
WHEREAS, Olin has agreed to prepare a strategic business plan for the National Fund at the rate
of $17,500.00 ($16,000.00 for preparation of the plan and $1500.00 for associated travel); and
WHEREAS, the Citizen Potawatomi Nation agrees to be the contract administrator for these funds
under the Public Law 102-477 program. It shall transfer the $17,500.00 to Olin and oversee Olin's
completion of the strategic business plan for the National Fund; and
WHEREAS, IEED has agreed to include within the funds to be administered by the Citizen Potawatomi
Nation an additional $1,835 to cover indirect costs and an additional $6,124 for administering the funds;

WHEREAS, the weatherization project is eligible for renewal upon an annual review
by both the Citizen Potawatomi Nation and OG&E.

program partnership agreement between the Citizen Potawatomi Nation and OG&E IS

WHEREAS, the Citizen Potawatomi Nation is a federally recognized tribe of American Indians
with constitutional authority under the Oklahoma Indian Welfare Act of June 26,
1936, (49 Stat. 1967); and
WHEREAS, the Citizen Potawatomi Nation, the largest of the Potawatomi Indian Tribes, has,
through a continuation of Potawatomi history and organized self government
since time immemorial, sovereign powers inherent in tribal tradition and
recognized by treaties with the United States and in the United States
Constitution; and
WHEREAS, the Citizen Potawatomi Nation Constitution provides that according to Article 7,

Department are working with limited budgets to protect tribal and local property
and ensure the safety of all local residents, including many Citizen Potawatomi
Nation tribal members; and

with Project Safe and the Unzner Center/Hope House to provide auxiliary
services to victims of family violence and their dependents; and

assistance to federally recognized tribal governments to improve the operations
of existing tribal courts, establishing a core structure for tribal courts, improving
case management, developing civil and criminal codes, acquiring equipment and
software, and training of tribal court staff over a 24 month period; and
WHEREAS, the Citizen Potawatomi Nation recognizes the need to increase the capacity and
strengthen the infrastructure of the tribal court system; and

further developing policies and procedures and assisting with all court duties as
assigned; and 3) providing funds for a contract attorney to provide legal

development of civil and criminal codes that reflect coordination with federal
laws; and

WHEREAS, the Citizen Potawatomi Nation recognizes the urgent need for a victim-centered
approach to provide transitional housing services that move individuals of
domestic violence, dating violence, sexual assault, or stalking, into permanent
housing and the lack of resources available to Native American women within a
rural community; and

Tribal Veterans Representative on an appointment basis and supply a work area
complete with a computer and Internet capability to access the on-line training
and other ODVA information; and

WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in
Tribal tradition, derived from a history of organized self-government since
time immemorial, and recognized by treaties with the United States and in
the Constitution of the United States; and
WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution
provides for a separation of powers of the Tribal government by the
reservation and delegation of specific powers to other entities of the Tribal
government; and, except for these specific limitations, all other general
powers of government are embodied in the Legislature's authority "to
enact legislation, transact business, and otherwise speak and act on behalf
of the Citizen Potawatomi Nation in all matters on which the Nation is

WHEREAS, the Citizen Potawatomi Nation desires to refinance the HUD 184 Loan for
the construction of the CPN Elder Living Complex in Rossville, Kansas;

WHEREAS, the refinance of the HUD 184 Loan will be facilitated by First National
Bank and Trust of Shawnee so the property and improvements itemized in
Attachment A can be utilized as collateral by the Nation for essential
governmental purpose projects ; and

Vice Chairman authority to perform duties assigned by the Chairman or

NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE

HUD 184 Loan for the construction of the Rossville Elder Living Complex and

requests that an accounting of all such funds be forwarded to the Office of the
Tribal Chairman on at least a quarterly basis.

for the four years for FY 2009 through FY 2012, including an estimated
$1,416,824 from the proposed Economic Stimulus Funding; and
WHEREAS, the Legislature has reviewed and prioritized the combined FY 2009 through FY
2012 Transportation Improvement Plan which must be submitted to the Bureau
of Indian Affairs; and

WHEREAS, the Citizen Potawatomi Nation and consultant have complied with the March 06, 2001
Memorandum and Federal Register 25CFR, Part 170, Page 43121, Question 6 while
performing this Cost to Construct Update; and
WHEREAS, the Citizen Potawatomi Nation and consultant has submitted Drafts of the Cost to
Construct Reports to the Bureau of Indian Affairs (BIA) Southern Plains Regional
Office and BIA Department of Transportation for review and comment prior to the
completion of this report in an attempt to solicit BIA involvement and input; and

Construct Update Report and associated Cost to Construct Table Values to replace the
data currently utilized for the Cost to Construct calculation of the Relative Need
Distribution Formula of the Tribal Transportation Allocation Methodology (TTAM)
and expects this data to be updated for the FY2009 calculation; and
WHEREAS, the Citizen Potawatomi Nation while taking the time and expending its own Tribal
funds to complete this project, requests to establish its own Geopolitical Region within
the BIA Southern Plains Region utilizing the data in the 2009 Cost to Construct Update
Report with the understanding that the Tribe will be responsible to maintain and update
this report in the future as needed.

66 miles of unused rail in order to stimulate the local economy and provide economic
opportunity for both the Indian and non-Indian community; and

CITIZEN POTAWATOMI NATION
WHEREAS, a study is needed to conduct an assessment of the potential opportunities to develop a
business park on Trust Land located on the Shawnee rail line and identify potential
industrial park industries and tenants as well as identify potentially divertible commodity
movements to the line. The study would also identify potential shippers, industries and
privately-run intermodal facilities located along the line with estimates of traffic volume in
order to estimate the potential revenue generated; and
WHEREAS, CompassLexecon, under the direction of Mr. Joe Kalt, of the Native Nations Institute and
the Harvard Project, has agreed to contract with the Citizen Potawatomi Nation to
complete the necessary feasibility study; and
WHEREAS, the project period for the proposed feasibility study is up to one year with a total cost of
$100,000, with the Nation providing $20,015 in In-kind matching funds in the form of
salary, fringe and travel-related expenses already approved in the Tribal budget.
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN
POTAWATOMI NATION that a resolution supporting and approving the Citizen Potawatomi Nation's
Railroad Feasibility Study application for funding through the Office of Indian Energy and Economic
Development IS HEREBY APPROVED.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that by act of this resolution and consistent with
the separation of powers defined in the Constitution, if awarded, an appropriation of $120,015 from the

WHEREAS, Article 7, Section 2 of the Citizen Potawatomi Nation Constitution

WHEREAS, animal population control is a serious problem for the Citizen Potawatomi
Nation, its members and local communities; and
WHEREAS, Saving Pets At Risk (SPAR) is a local, not for profit organization that
promotes animal welfare and responsible pet ownership through a spay
and neuter program; and

WHEREAS, the Legislature feels that a donation to SPAR to fund spaying and neutering

Pets at Risk for the purpose of funding the spaying or neutering of tribal members' pets

WHEREAS, the total cost of hiring the officers full time with fringe benefits is $224,192
and there is no local share requirement for American Recovery and
Investment Act of 2009 grants.

whom emergency shelter service or other crisis intervention services are
unavailable or insufficient; and
WHEREAS, the objectives of the proposed three year program are: (1) provide two full

health services and other needs; and to (2) provide a part time transporter
to take victims to doctor appointments, court, and school; and to (3)
provide a transportation vehicle, playground equipment, child care,
counseling, and job training.
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE
CITIZEN POTAWATOMI NATION that a resolution supporting an application for
funding to the Office on Violence Against Women Recovery Act IS HEREBY

younger than 18 years of age with effective mentoring programs to help youth
