Call to order: Chairman Barrett called the meeting to order at 1:10pm.
First item of business: Resolution 17-38-App: A resolution approving a loan agreement between
the Citizen Potawatomi Nation and BOKF, NA dba Bank of Oklahoma. Motion to approve
Resolution 17-38-App was made by Representative Boursaw and seconded by Representative
Payne. The motion passed with 15 in favor, 0 opposed, 1 absent and 0 abstaining.
Twentieth item of business: Adjournment: There being no further business before the
Legislature, motion to adjourn was made by Representative Schmidlkofer and seconded by
Representative Bowden. The motion passed with 15 in favor, 0 opposed, 1 absent and 0
abstaining. The meeting adjourned at 10:00am January 20, 2017.

Call to order: Chairman Barrett called the meeting to order at 5:45pm followed by the
invocation.
First item of business: Minutes from the Quarterly meeting held on December 8, 2016. Motion
to approve the minutes was made by Representative Schmidlkofer and seconded by
Representative Whistler. The motion passed with 15 in favor, 0 opposed, 1 absent and 0
abstaining.
Second item of business: Minutes from the special electronic meeting held on January 19, 2017.
Motion to approve the minutes was made by Representative Dave Carney and seconded by
Representative Bowden. The motion passed with 15 in favor, 0 opposed, 1 absent and 0
abstaining.
Third item of business: Resolution 17-39-R&G: A resolution approving the rescheduling of the
Quarterly meeting of the Legislature from Thursday, February 23, 2017, to Monday, March 6,
2017. Motion to approve Resolution 17-39-R&G was made by Representative Bowden and
seconded by Representative Schmidlkofer. The motion passed with 15 in favor, 0 opposed, 1
absent and 0 abstaining.
Fourth item of business: Resolution 17-40-R&G: A resolution approving reapportionment of the
Citizen Potawatomi Nation legislative districts. Motion to approve Resolution #17-40-R&G was
made by Representative Schmidlkofer and seconded by Representative Whistler. The motion
passed with 15 in favor, 0 opposed, 1 absent and 0 abstaining.
Representative Lambert joined the meeting.
Representative Boursaw had to leave the meeting (tornado warning).
Fifth item of business: Resolution 17-41-J&PS: A resolution approving and supporting the
Citizen Potawatomi Nation's fy2017 continuation application to the Indian Health Services for
funding of the Domestic Violence Prevention Initiative (DVPI) program. Motion to approve
Resolution #17-41-J&PS was made by Representative Schmidlkofer and seconded by
Representative Bowden. The motion passed with 15 in favor, 0 opposed, 1 absent and 0
abstaining.

of Health & Human Services' Administration for Children and Families. Motion to approve

Representative Payne. The motion passed with 15 in favor, 0 opposed, 1 absent and 0
abstaining.
Seventh item of business: Resolution 17-43-J&PS: A resolution approving and supporting the
Citizen Potawatomi Nation's grant application for funding under the Department of Justice's
fy2017 Coordinated Tribal Assistance Solicitation (CTAS) to continue development of
comprehensive approaches to public safety and criminal justice. Motion to approve Resolution
#17-43-J&PS was made by Representative Whistler and seconded by Representative Wesselhoft.
The motion passed with 15 in favor, 0 opposed, 1 absent and 0 abstaining.
Representative Boursaw rejoined the meeting.
Eighth item of business: Resolution 17-44-ED&C: A resolution authorizing the Citizen
Potawatomie Nation's Citizen Potawatomi Community Development Corporation's proposed
2017 CDFI Grant Assistance Program grant application offered through the US Department of
the Treasury - CDFI Fund. Motion to approve Resolution #17-44-ED&C was made by
Representative Payne and seconded by Representative Johnson. The motion passed with 16 in
favor, 0 opposed, 0 absent and 0 abstaining.
Ninth item of business: Resolution 17-45-TC&A: A resolution supporting the Citizen Potawatomi
Nation's grant application for funding under the Institute of Museum and Library Services'
fy2017 Basic Library Services with Education/Assessment Option program. Motion to approve
Resolution #17-45-TC&A was made by Representative Dave Carney and seconded by
Representative Eva Marie Carney. The motion passed with 16 in favor, 0 opposed, 0 absent and
0 abstaining.
Tenth item of business: Resolution 17-46-HHS: A resolution approving and supporting the
Citizen Potawatomi Nation's fy2017 continuation application to the Indian Health Services for
funding of a youth methamphetamine/suicide education and prevention program with
supplement. Motion to approve Resolution #17-46-HHS was made by Representative Kraft and
seconded by Representative Boursaw. The motion passed with 16 in favor, 0 opposed, 0 absent
and 0 abstaining.
Eleventh item of business: Resolution 17-47-HHS: A resolution supporting the Citizen
Potawatomi Nation's grant application for funding under the Federal Transit Administration's
fy2017 Public Transportation on Indian Reservations, Tribal Transit Program. Motion to approve
Resolution #17-47-HHS was made by Representative Barrett and seconded by Representative

Twelfth item of business: Ordinance 17-07-HHS-T31: An ordinance amending Title 31, Labor
and Employment, of the Tribal Code of the Citizen Potawatomi Nation. Motion to approve

Representative Wesselhoft. The motion passed with 16 in favor, 0 opposed, 0 absent and 0
abstaining.

Citizen Potawatomi Nation. Motion to approve Resolution #17-49-LCoE was made by
Representative Eva Marie Carney and seconded by Representative Schmidlkofer. The motion
passed with 16 in favor, 0 opposed, 0 absent and 0 abstaining.
Fifteenth item of business:- Resolution 17-50-NR: A resolution supporting the addition of new
routes to the Nation's existing National Tribal Transportation Field Inventory System (formerly
the Roads Inventory Field Data System) and requesting the Bureau of Indian Affairs add these
new routes to the National Tribal Transportation Field Inventory of the Citizen Potawatomi
Nation. Motion to approve Resolution #17-50-NR was made by Vice Chairman Capps and
seconded by Representative Dave Carney. The motion passed with 16 in favor, 0 opposed, 0
absent and 0 abstaining.

Sixteenth item of business: Resolution 17-51-NR: A resolution supporting the update of the
Citizen Potawatomi Nation's Long Range Transportation Plan and requesting the Bureau of
Indian Affairs implement these changes to the Nation's Long Range Transportation Plan. Motion
to approve Resolution #17-51-NR was made by Representative Bowden and seconded by
Representative Barrett. The motion passed with 15 in favor 0 opposed, 1 absent and 0
abstaining.
Seventeenth item of business: Ordinance 17-08-ED&C-T23: An ordinance creating an Industrial
Development Authority. Motion to approve Ordinance #17-08-ED&C-T23 was made by
Representative Whistler and seconded by Representative Payne. The motion passed with 15 in
favor, 0 opposed, 1 absent and 0 abstaining.
Nineteenth item of business: Ordinance 17-09-ED&C-T23: An ordinance creating a Limited
Liability Company Act. Motion to approve Ordinance #17-09-ED&C-T23 was made by Vice

Twentieth item of business: Ordinance 17-10-R&G-T51: An ordinance creating Title 51 ,

made by Representative Wesselhoft and seconded by Representative Whistler. The motion

GENERAL COUNCIL MEETING
June 24, 2017
Call to Order: Chairman Barrett called the meeting to order at
7:00 a.m. Roll call included: Chairman John A. Barrett; Vice-
Chairman Linda Capps; Secretary-Treasurer D. Wayne Trousdale
and Representatives David Barrett, Jon Boursaw, Bobbi Bowden,
Dave Carney, Eva Marie Carney, Mark Johnson, Lisa Kraft, Gene
Lambert, Rande Payne, Paul Schmidlkofer, Roy Slavin, Paul
Wesselhöft, and Robert Whistler.
Absent: None.
There was a motion made by Representative Slavin, and seconded
by Representative Dave Carney, to recess and turn the meeting
over to the Election Committee for purposes of balloting. The
motion passed with 16 voting for, 0 opposed, 0 absent and 0
abstaining.
Meeting reconvened at 3:20 p.m. with Chairman Barrett calling the
General Council to order. Chairman Barrett offered a prayer
followed by the presentation of the colors.
Introductions: Chairman Barrett began the meeting by
introducing Vice Chairman Capps. The Vice Chairman then
introduced the members of the Tribal Legislature, the Election
Committee, the members of the Tribal District Court, the Supreme
Court, the Legal Department, the Boxing Commission and the
Gaming Commission.

Carol Cox Keller, granddaughter of Robert Joseph Navarre, was
gifted with a shawl by Vice Chairman Capps in appreciation of
Mrs. Keller's gift of the sculpture "Appeal to the Great Spirit" by
Cyrus Dallin which will be displayed at the Heritage Center.
Chairman's remarks: Chairman Barrett began his remarks by
stating "We have won. In regard to the litigation with the State of
Oklahoma, we have won on behalf of every tribe." He informed
the Council that the arbitrator, Judge Boudreau, applied the
Bracker Test and determined that for every $1 the State would
receive in sales tax, it would cost them $1.10. CPN, as the 5th
largest tribe, was a test case for the State. The larger tribes don't
collect sales tax therefore the State chose to come after CPN.
He continued by saying the Citizen Potawatomi Nation provides
all services that a city or state would provide its citizens but the
CPN form of government is different than that of any other
government. Only one-third of the tribal population is located
within the state of Oklahoma while two-thirds live outside of the
state. Yet, one half of the tribal legislature are from outside the
state. The Chairman, Vice Chairman and Secretary-Treasurer are
elected 'at-large' giving those tribal members outside of
Oklahoma the ability to elect 11 members of the tribal legislature.

The Tribal Legislature controls the money and laws but acts by
resolution only.
The judicial branch basically began with Judge Lujan. In the
1970s a quorum of fifty tribal members could decide the fate of
all 11,000 tribal members which lead to the 1985 take over. Judge
Lujan as a CFR judge was called in and ordered the tribe to
develop laws and rules of government. This was the impetus to
change the tribe's constitution. CPN is the only tribe that doesn't
have to wait until a law is broken to act. The court can rule before
a cause of action takes place which heads off fights and forces
reconciliation.
Chairman Barrett described the Citizen Potawatomi Nation as a
very progressive tribe with a forward looking tribal constitution.
CPN is one of the few tribes to allow absentee voting and the only
tribe with representation for those who live outside of the tribal
jurisdiction.
The Chairman also stated the Citizen Potawatomi Nation is very
progressive in its approach to tribal benefits. Three generations
of tribal members basically lost everything. The Potawatomi are
the most treatied tribe in history and with every treaty something
was lost. Things are just now beginning to turn around and it is
time for the tribe to repay those who helped the tribe catch up in
his opinion.
He provided a brief look at what would have to be given up in
order to give per capita payments:
A trust fund managed by the US government would have to
be established for those tribal members under the age of
18.
The payments would be taxable.
A $700 payment would net about $580 per individual but
cost the tribe about $25-30 million for one payment to all
tribal members.
This would be about 90% of all of the tribe's unobligated
cash resources.

No more scholarships.
No more mortgage assistance.
No more burial assistance.
No more pharmaceutical assistance.
He said tribes all over the country are facing this same dilemma.
The Prairie Potawatomi have closed their rolls. Hannahville Indian
Community residents must now be born on reservation to enroll.
The US government has finally figured out how to have tribes get
rid of themselves. To avoid the demise of tribes, there should be
a law to set aside for future generations' health and education
before any per capita payments.
The Chairman concluded by stating however this election turns
out, CPN will still be in business tomorrow.
Next, Chairman Barrett recognized Doris and Carl Brenner on the
occasion of their 73' wedding anniversary.
Former elected officials in attendance, Beverly Hughes, Bob Lewis,
Mary Powell, Christy Hall and Theresa Adame, were thanked for
helping get the tribe where it is today.
The future of the tribe was recognized with the introduction of
the Potawatomi Leadership class of 2017 and the candidates for
elected office.
Approval of Previous Minutes: On a motion made by David
Barrett and seconded by Thomas Fitzgerald, the minutes of the
previous General Council meeting held on June 25, 2016, were
approved as read by Secretary-Treasurer Trousdale. The motion
passed unanimously.
Recognition of Potawatomis: Chairman Barrett, following tribal
tradition, recognized the wisest and the youngest tribal citizen
present and the tribal member who traveled the farthest to attend
General Council. Doris Brenner, 91 years old, was recognized as
the wisest tribal member present. Seven month old Evelyn Guy
was recognized as the youngest tribal member in attendance and
Ginger Blackmon of Anchorage, Alaska traveled the farthest to
attend General Council.

Election Results: Chairman Barrett introduced Gary
Bourbonnais, chairman of the Election Committee. Mr.
Bourbonnais stated that over 26,000 notices for the election had
been sent out to all tribal members over the age of 18. Of those
26,000 notices, 2,176 responded with requests for ballots.
Approximate 1,600 ballots were returned.
Mr. Bourbonnais then announced the results of the 2017 General
Election. The fy 2017-18 set-aside budget was approved with 1863
in favor and 115 opposed. Both Representatives Roy Slavin and
Eva Marie Carney re-elected without opposition. Robert Whistler
was re-elected as District #4 representative by a vote of 164 to 19
over Jahn Eric Humphreys. Jon Boursaw defeated challenger
Theresa Adame, 150 to 86 for the District #4 representative
position. Chairman Barrett was re-elected to another 4 year term
as Chairman by a vote of 1689 to 306 over Steve Castaneda.
Swearing in ceremony: Representatives Roy Slavin, Eva Marie
Carney, Robert Whistler, Jon Boursaw and Chairman John Barrett
were all sworn into their respective offices.
Adjournment: There being no further business before the
Council, a motion to adjourn was made by Anton Morton and
seconded by Gilbert Lewis. Meeting adjourned at 5:20p.m.
