CITIZEN BAND POTAWATOMI INDIANS OF OKLAHOMA
A RESOLUTION ADOPTING ADMINISTRATIVE PROCEDURES ALLOWING DR.
FRANCIS LEVIER TO FUNCTION AS TRIBAL ADMINISTRATOR GIVING HIM
FULL AUTHORITY TO MAKE NECESSARY PERSONNEL CHANGES AND SUSPENDING
THE CURRENT PERSONNEL POLICIES.
WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma is a
federally recognized Tribe of American Indians under
authority of the Oklahoma Indian Welfare Act of 1936;
and
WHEREAS, the Citizen Band Potawatomi Business Committee is duly
authorized to act on behalf of the Tribe by authority
of the Tribal Constitution and By-Laws; and
WHEREAS, Article 4, Section 3 of the Tribal Constitution
provides authority to establish ""appropriate administrative
agencies of the tribe""; and
WHEREAS, immediate personnel and policy changes are needed
to perform the goals, objectives, and functions
of the tribal government; now

WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma is a federally
recognized Tribe of American Indians under authority of the
Oklahoma Indian Welfare Act of 1936; and
WHEREAS, the Citizen Band Potawatomi Business Committee is duly
authorized to act on behalf of the Tribe by authority of the
Tribal Constitution and By-Laws; and
WHEREAS, the Citizen Band Potawatomi Indians deem it necessary to
strengthen the Tribal Government by licensing and regulating
certain conduct within the Tribal jurisdiction, and;
WHEREAS, the purpose of the General Revenue and Taxation Ordinance is
to provide simple, fair, straightforward, and efficient
procedures for licensing and regulation, and;
WHEREAS, the levy and collection of certain revenue and taxes, the

establishment of the rates of tax is the responsibility of the

SHOEMANN'S BREACH OF HIS FIDUCIARY DUTY AND VIOLATIONS OF TRIBAL
AND FEDERAL LAWS WHILE TRIBAL ADMINISTRATOR.
WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma is a
federally recognized Tribe of American Indians under
authority of the Oklahoma Indian Welfare Act of 1936;
and
WHEREAS, the Citizen Band Potawatomi Business Committee has
authority to act in behalf of the Tribe as authorized
in the Tribal Constitution and By-Laws; and
WHEREAS, the Business Committee of the Citizen Band Potawatomi
Indian Tribe of Oklahoma has asked its tribal attorney
to investigate the activities of former Tribal
Administrator John D. Schoemann in connection with
his operation of the tribal bingo program from 1980
through 1983, in connection with his sale to the tribe
of 16.26 acres in August of 1983 for the USDA commodity
food program, and in connection with his purchase of
golf clubs in the Spring of 1983; and
WHEREAS, the tribal attorney has now reported to the Business
Committee that in all three operations Mr. Schoemann
violated his fiduciary duty as Tribal Administrator
and violated federal statutory and regulatory law
and tribal law, and should be made to account for the
funds received; and
WHEREAS, the tribal attorney has recommended that the Business
Committee bring suit to force Mr. Schoemann to account
for the monies received on these three activities and
to return the money to the tribe; now
THEREFORE, BE IT RESOLVED, that the Business Committee of the
Citizen Band Potawatomi Indians of Oklahoma hereby authorize
Michael Minnis, tribal attorney, to bring suit in an appropriate
forum against John Schoemann and others to require an accounting
from Mr. Schoemann when he was Tribal Administrator and a return
of all funds improperly retained by Mr. Schoemann and others in
violation of Mr. Schoemann's fiduciary duty to the tribe and in
violation of federal statutory and regulatory law and tribal law
and do all other matters and conduct other investigations as may
be necessary to bring and fully prosecute this suit; and
BE IT FURTHER RESOLVED that this authority shall remain in effect
for however long is necessary to fully prosecute this litigation.

monthly payments on the Business Lease/Contract held
with the Tribe since at least April, 1985; and
WHEREAS, the Tribe has made demand on Enterprise Management Consultants
for payment of back lease payments and were refused; and
WHEREAS, Enterprise Management Consultants has failed to make
lease payments and has breached the conditions of the
lease held with the Tribe in at least four other ways
and the lease has now been terminated; and
WHEREAS, Enterprise Management Consultants has been advised that
the lease has been terminated and they are to peacefully
vacate the premises; and
WHEREAS, Enterprise Managment has refused to vacate said premises; and
WHEREAS, neither the Secretary of the Interior nor the Assistant
Secretary of the Interior for Indian Affairs has approved
the Enterprise Management Consultants management agreement
dated April 8, 1985; and
WHEREAS, said management agreement is in violation of Bureau
of Indian Affairs guidelines and is not in the best
interest of the Tribe; and
WHEREAS, Enterprise Managment Consultants has refused to negotiate
with the Tribe for the purpose of entering into a management
contract that would meet B.I.A. guidelines and would
be in the best interest of the Tribe; and
WHEREAS, Enterprise Management Consultants, Inc. has been told
to discontinue operating bingo on Tribal land; and

are in violation of the Tribal Bingo Ordinance;

Project; and

progress reports be submitted to this tribe on a timely

WHEREAS, the Citizen Band Potawatomi Business Committee is duly

has recognized a need to request technical assistance
from the Bureau of Indian Affairs to work out problems

Committee requests that the BIA detail Larry Noel through the
Intergovernmental Personnel Act to the tribe, and comply with the request

WHEREAS, the Citizen Band Potawatomi Indians of Oklahoma is a

authority of the Oklahoma Indian Welfare Act of 1936;
and
WHEREAS, the Citizen Band Potawatomi Business Committee is duly
authorized to act on behalf of the Tribe by authority
of the Tribal Constitution and By-Laws; and
WHEREAS, the Business Committee has determined that a conflict
exists with the Indirect Cost program; and
WHEREAS, the policies of the Inspector Generals Indirect Cost
program and the application by the Bureau of Indian
Affairs appears to conflict; and
WHEREAS, the negotiated Indirect Cost rates approved by the
Tribes and Inspector General does not always parallel
the amount of funds made available by the BIA;

THEREFORE BE IT RESOLVED, that the Business Committee requests that the
Inspector General move to resolve any conflict with the Bureau of Indian
Affairs regarding Indirect Cost amounts allowed by BIA via Contract
Support Monies, and to meet with the tribe and their selected audit firm
for clarification.

in need of video equipment necessary to produce a series
of films, presentations, or documentary's on behalf of

WHEREAS, the video equipment necessary to produce the series must
be of studio quality; and
WHEREAS, the Business Committee requests that Amoco Oil Company
donate to the tribe, studio quality video equipment and
accessories;

video from Amoco Oil Company to produce a series of tribal films and

shall he exhibited in the filming of each production thereafter.

TO ENTER INTO A CONTRACTUAL AGREEMENT WITH THE INDIAN HEALTH SERVICE,
OKLAHOMA CITY AREA, TO PROVIDE FOR P.L. 93-638 INDIAN
SELF-DETERMINATION CONTINUATION FUNDS TO BE USED FOR THE COMMUNITY
HEALTH REPRESENTATIVE PROGRAM FOR FISCAL YEAR 1987.
WHEREAS, The Citizen Band Potawatomi Indians of Oklahoma is a federally
recognized Tribe of American Indians under authority of the
Oklahoma Indian Welfare Act of 1936; and
WHEREAS, The Citizen Band Potawatomi Business Committee is duly
authorized to act on behalf of the Tribe by authority of the
Tribal Constitution and By-Laws; and
WHEREAS, The Citizen Band Potawatomi Indians of Oklahoma, is interested
in the further development of tribal capabilities for
operations of health services for the benefit of all tribal
members; and
WHEREAS, The Citizen Band Potawatomi Indians of Oklahoma is fully aware
of its options of contracts and hereby chooses to implement a
Community Health Representative Program Contract for FY-87
under the authority of P.L. 93-638;
and
WHEREAS, The Citizen Band Potawatomi Tribal Administrator is eligible
for consideration of grant and contract applications under
P.L. 93-638 Funds; and
WHEREAS, There is a need to provide home health services, health
education services, health maintenance services, disease
control services, and emergency Medical services program; and
WHEREAS, The proposed and requested commencement date for the executed
contract is November 1, 1986 through October 31, 1987; and
WHEREAS, The proposed term of the contract document is twelve (12)
months; and
WHEREAS, These authorities will remain in effect until such time as the
Business Committee chooses to withdraw said authorizations,
and by subsequent resolution; and
WHEREAS, The Business Committee reserves the right to review the
contract document and any amendments thereto prior to
signature by designated person; now
THEREFORE, BE IT RESOLVED, that the Business Committee of the Citizen
Band Potawatomi Indians of Oklahoma wishes to make application to the
Oklahoma City Area Indian Health Service for P.L. 93-638 funds to
contract for the Community Health Representative Program.
