A RESOLUTION REQUESTING THE SECRETARY OF THE INTERIOR TO CONVERT TITLE TO
THREE ACRES FROM FEE SIMPLE TO TRUST STATUS.
WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma is a
federally recognized tribe of American Indians with
constitutional authority under the Indian Reorganization Act
of 1934 and the Thomas-Rogers Act of 1936; and
WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma, the
largest of the Potawatomi Indian Tribes, has, through a
continuation of Potawatomi history and organized self government
since time immemorial, sovereign powers inherent in tribal
tradition and recognized by treaties with the United States
and in the United States Constitution; and
WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma
Constitution and By-Laws provide that the Business Committee
of the Tribe shall be granted the power to act on behalf of
the Tribe in all matters except those relating to claims of
treaties with the United States; and
WHEREAS, it is a standing policy of the Citizen Band Potawatomi Indian
Tribe of Oklahoma to acquire additional land to increase its
land base; and
WHEREAS, a three-acre, more or less, tract of land has been acquired by
the Citizen Band Potawatomi Indian Tribe of Oklahoma with a
warranty deed showing the Citizen Band Potawatomi Indian Tribe
of Oklahoma as the legal owner of the tract of land filed in
Pottawatomie County, State of Oklahoma, on January 3, 1989, at
Book 1725, Page 210; and
WHEREAS, the legal description of the land is:
A tract of land in the Southwest Corner of the
Northeast Quarter of the Southwest Quarter
(NE/4 SW/4) of Section Thirty-One (31), Township
Ten (10) North, Range Four (4) East of
the Indian Meridian, Pottawatomie County,
Oklahoma, described as follows: Commencing at
a point 20 chains South and 11 chains West of
the center of Section 31, Township 10 North,
Range 4 East; running thence West 9 chains;
thence North 3.34 chains; thence East 9 chains;

WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma
Constitution and by-laws provide that the Business Committee of
the Tribe shall be granted the power to act on behalf of the
Tribe in all matters except those related to claims of
treaties with the United States, and
WHEREAS, all BIA contracts has been modified for 1990 and funds are
being added to the tribes Letter of Credit, and
WHEREAS, there is $21,451 available from non-contracted BIA Programs;
Community Fire Protection, Adult Education, Outdoor Recreation,
and Self Determination that must be programmed, and
WHEREAS, the Realty Contract and the Aid to Tribal Government Contract
appear to have the greatest need for additional funds,
NOW
THEREFORE, BE IT RESOLVED, that the Shawnee Agency Superintendent is
hereby authorized to reprogram $12,000 into the Citizen Band Potawatomi’s
Aid to Tribal Government Contract and $9,451 into the Realty Contract and
the contracts be modified to reflect these additional amounts, and
THEREFORE, BE IT FURTHER RESOLVED, that the Tribal Administrator is hereby
authorized to adjust the budgets of the two affected BIA Contracts to show
the modified budgets, and
THEREFORE, BE IT STILL FURTHER RESOLVED, that authority is hereby
delegated to the Tribal Administrator to prepare and negotiate any future
budget modifications that may be necessary for any of the Citizen Band
Potawatomi BIA Contracts.

Administration have expressed a desire to be served directly by the
Anadarko Area Office; and
WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma recognizes there are
certain Secretarial responsibilities that cannot be contracted; and
WHEREAS, after contracting or reprogramming by any of the Shawnee Tribes is
achieved those Secretarial responsibilities will remain; and
WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma, not wishing to
contract or reprogram Executive Direction and Administration funds at
this time, requests the continuing presence of a Federal representative
or representatives in Shawnee, Oklahoma.
NOW THEREFORE, BE IT RESOLVED THAT the Business Committee of the Citizen Band

WHEREAS, the Federal District Court in 1987 ruled in favor of the Oklahoma
Tax Commission; and
WHEREAS, that decision was appealed to the Tenth Federal Circuit Court in
Denver, Colorado; and
WHEREAS, the Tenth Federal Circuit Court in Denver, Colorado overturned the
Federal District Court decision and ruled on behalf of the Citizen
Band Potawatomi Indian Tribe of Oklahoma; and
WHEREAS, on January 29, 1990, the Oklahoma Tax Commission petitioned the U.S.
Supreme Court to review the Tenth Circuit opinion; and
WHEREAS, the Supreme Court has made no decision yet whether to hear the case;
and
WHEREAS, there is a strong possibility the Supreme Court may hear the
Oklahoma Tax Commission appeal; and
WHEREAS, any decision made favorable for the Oklahoma Tax Commission would
have a devastating effect on all enterprising Indian Tribes
nationwide doing business on Trust land; and

WHEREAS, the ultimate issue at stake is that of tribal sovereignty; and
WHEREAS, the Citizen Band Potawatomi is in a legal battle regarding
sovereignty of Indian Tribes and is actually representing all

WHEREAS, it is felt our chance for a legal victory would be greatly enhanced
by intervention on our behalf and on behalf of all Indian Tribes, by
our Federal Government representation, the Department of the
Interior, Bureau of Indian Affairs; and
