A RESOLUTION REQUESTING THE BUREAU OF LAND MANAGEMENT TO DETERMINE THROUGH
INDEPENDENT ENGINEERING OPINION THE RISK OF FRESH WATER WELL CONTAMINATION ON
CITIZEN POTAWATOMI TRUST LAND BY A UNITIZED WATER FLOOD PROJECT APPROVED BY THE
OKLAHOMA CORPORATION COMMISSION
WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma is a federally
recognized tribe of American Indians with constitutional authority
under the Indian Reorganization Act of 1934 and the Thomas-Rogers
Act of 1936; and
WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma, the largest of
the Potawatomi Indian tribes, has, through a continuation of
Potawatomi history and organized self government since time
immemorial, sovereign powers inherent in tribal tradition and
recognized by treaties with the United States and in the United
States Constitution; and
WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma Constitution
and By-Laws provide that the Business Committee of the Tribe shall
be granted the power to act on behalf of the Tribe in all matters
except those relating to claims or treaties with the United States;
and
WHEREAS, Jetson Operating Company seeks the unitized management, operation
and further development of the Earlsboro Sand common source of
supply by enhanced recovery operations and creation of the Sacred
Heart Field Earlsboro Sand Unit; and
WHEREAS, the land is CP-50 Thomas Nona Citizen Band Potawatomi trust land,
legal description: SW/4 NE/4, SE/4 NW/4, SW/4 and W/2 NW/4 SE/4 of
Section 19, Township 6 North, 5 East and SE/4 NE/4, E/2 SW/4 NE/4,

WHEREAS, the Texas Band Kickapoo are included in the Area Directors formula; and
WHEREAS, historically, until receiving Federal recognition, they were a part of
the Oklahoma Kickapoo Tribe; and
WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma proposes that any
proportionate share for the Texas Kickapoo come from a reduced portion
for the Oklahoma Kickapoo; and
WHEREAS, until an ultimate decision is made on the contractibility or availability
of funds from Executive Direction and Administrative services these are
the only two programs the Texas Kickapoo will share with the other Five

WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma is a federally recognized
tribe of American Indians with constitutional authority under the
Indian Reorganization Act of 1934 and the Thomas-Rogers Act of 1936; and
WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma, the largest of the
Potawatomi Indian Tribes, has, through a continuation of Potawatomi history
and organized self government since time immemorial, sovereign powers
inherent in tribal tradition and recognized by treaties with the United

WHEREAS, P.L. 99-154 and P.L. 200-203 enacted by Congress in 1986 and 1987,
respectively, amended Section 7871 of the Internal Revenue Code, placing
substantial restrictions on the ability of Indian Tribes to issue private
activity bonds in comparison to units of state and local government,
thereby putting Indian Tribes at a disadvantage in recruiting and
attracting industry beneficial to the Indian community; and
WHEREAS, it is deemed highly necessary and desirable that Section 7871 of the
Internal Revenue Code be amended so as to put Indian Tribes on a parity
with other units of government regarding the ability to issue tax-exempt
bonds for industrial and economic development.
NOW THEREFORE BE IT RESOLVED, that Congress is hereby urged to amend Section 7871 and
other applicable Sections of the Internal Revenue Code so as to increase the ability
of American Indian Tribes to issue tax-exempt bonds to attract industry and promote
economic development within Indian communities, thereby resulting in Indian Tribes
being on more nearly equal footing with state, municipalities, counties, and other
units of local government in the ability to finance economic development activities.

WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma Constitution
and by-laws provide that the Business Committee of the Tribe shall
be granted the power to act on behalf of the Tribe in all matters
except those relating to claims or treaties with the United States;

WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma has contracted
for operation of the BIA Credit and Finance Program since January 1,
1989; and
WHEREAS, the current workload involves approximately 40% of one employees
time; and
WHEREAS, continued operation of the Credit Program is greatly hindering other
programs; and
WHEREAS the projected contract amount for 1991 is only $1,000; and
WHEREAS, these are not enough funds to effectively run the Credit Program.

to any victim or dependent of a victim of family
violence ; and
WHEREAS, no income eligibility standard will be applied to
individuals receiving assistance while confidentiality
of all records will be maintained; and
WHEREAS, the expiration date of this resolution shall be
September 30, 1993; and
WHEREAS, the proposed start date of this grant shall be
immediate upon funding;

WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma Constitution
and by-laws provide that the Business Committee of the Tribe shall
be granted the power to act on behalf of the Tribe in all matters
except those relating to claims or treaties with the United States;

WHEREAS, the Business Committee of the Citizen Band Potawatomi Indian Tribe
of Oklahoma has previously requested that Federal presence be
maintained at the Shawnee Agency; and
WHEREAS, the position of Superintendent at the Shawnee Agency was vacated on
September 30, 1990, at which time Mr. Bell C. Haney officially
retired; and
WHEREAS, the Superintendent's position at the Shawnee Agency was then
advertised; and
WHEREAS, since September 30, 1990 the Superintendent's position has been
filled through temporary employment and by detailing of employees;

WHEREAS, the Anadarko Area Director has now submitted a list of six (6)
individuals who applied for the permanent position of Superintendent
and who were determined to be eligible; and
WHEREAS, the Business Committee of the Citizen Band Potawatomi Indian Tribe
of Oklahoma has been requested to rank the top three (3) candidates
1-2-3; and
WHEREAS, after review of the eligible individuals and their resumes, the
Business Committee of the Citizen Band Potawatomi Indian Tribe of
Oklahoma recommends (1) James De Haas, (2) Vernon James, and (3)
Paul Imotichey.

WHEREAS, the Tribe has obtained judgements against the corporate defendants and
anticipates obtaining judgments against the individual defendants in the
federal district court case Citizen Band Potawatomi Indian Tribe of Oklahoma
v. Enterprise Management Consultants, Inc., Case No. CIV 86-1171-A; and
WHEREAS, the Tribes wished to reduce its attorney fee expense, but continue to pursue
the judgements in the above described case;
THEREFORE BE IT RESOLVED, that the Business Committee of the Citizen Band Potawatomi
Indian Tribe of Oklahoma hereby approves the contingent fee contract to which this
Resolution will be attached and made a part hereof with the law firm of Michael Minnis

WHEREAS, pursuant to the Distribution Act of 1973 a program plan utilizing 20%
of the total awards was developed for each, a Scholarship and
Prosthetics Program from the 1978 award and a Land Acquisition,
Development and Maintenance Program from the 1983 award; and
WHEREAS, there is a large number of unclaimed shares remaining in IIM, and
WHEREAS, numerous efforts have been made to locate these people by listing
their names in the Tribal newspaper and by posting their names at
Annual Council meetings; and
WHEREAS, the Distribution Act of 1973 provides that after a six year period,
all unclaimed shares revert to the Tribe for programming purposes.
NOW THEREFORE BE IT RESOLVED, that the Business Committee of the Citizen Band
Potawatomi Tribe hereby authorizes the Bureau of Indian Affairs to release all
unclaimed shares from the Tribe's 1978 and 1983 payments with assurance they
will be deposited in appropriate program accounts, and
NOW THEREFORE BE IT FURTHER RESOLVED, that the Citizen Band Potawatomi Tribe
will provide adequate clerical help to work with Area Office personnel in the

WHEREAS, The Board of County Commissioners of Pottawatomie County asked the
Tribe to donate the above described 0.02-acre tract of land for
the purpose of participating in the Secondary Road Improvement
Project RS-6340(100)C, which will result in completion of proposed
project, giving the Tribe and other users of the road a much
better access to business and market. If they are required to
compensate the Tribe for subject right-of-way, the payment would
be taken from funds already donated to the County by the Tribe
through the Bureau of Indian Affairs for Project MEGC-5440(21)
(22) AKA Hardesty Road.
WHEREAS, An appraisal has been completed for the 0.02-acre right-of-way
above described, and it was estimated that the sum of $150.00
would be considered adequate compensation for granting the
proposed easement. The Tribe has been advised of the appraised
value; however, it is felt that the benefit to the land will far
exceed the appraisal amount. Therefore, they wish to waive
payment for said right-of-way.
THEREFORE, BE IT RESOLVED, that the Business Committee of the Citizen Band

by-laws provide that the Business Committee of the Tribe shall be
granted the power to act on behalf of the Tribe in all matters except

WHEREAS, there can be but one food distribution agency serving a given
geographic region; and
WHEREAS, the Sac & Fox Nation has made application to provide such services
through the USDA, Food and Nutrition Service; and
WHEREAS, the Sac & Fox Nation shall provide services to the Citizen Band
Potawatomi Tribe area and membership; NOW
NOW THEREFORE BE IT RESOLVED, that the Citizen Band Potawatomi Indian Tribe of
Oklahoma hereby supports the Sac & Fox Nation in its efforts to provide
services to the Citizen Band Potawatomi Indian Tribe of Oklahoma.

A RESOLUTION IN SUPPORT OF THE HOUSE SELECT COMMITTEE BILL
CITED AS THE OKLAHOMA INDIAN FOUR WINDS CULTURAL STUDY ACT
WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma is a federally
recognized tribe of American Indians with constitutional authority
under the Indian Reorganization Act of 1934 and the Thomas-Rogers Act
of 1936; and
WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma, the largest of
the Potawatomi Indian Tribes, has, through a continuation of
Potawatomi history and organized self government since time
immemorial, sovereign powers inherent in tribal tradition and
recognized by treaties with the United States and in the United States
Consitution; and
WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma Constitution and
by-laws provide that the Business Committee of the Tribe shall be
granted the power to act on behalf of the Tribe in all matters except
those relating to claims or treaties with the United States; and
WHEREAS, the Citizen Band Potawatomi Tribe of Oklahoma is a member of the
Oklahoma Institute of Indian Heritage; and
WHEREAS, the House Select Committee is currently sponsoring a bill in the
amount of $450,000 cited as the ""Oklahoma Indian Four Winds Cultural
Study Act; and,
WHEREAS, this bill will direct the Secretary of the Interior to prepare a study
on the Oklahoma Indian ""Four Winds"" Indian Cultural Center; and
WHEREAS, the purpose of this study shall be to prepare a detailed area program,
preliminary design documents and to contain a final site plan
including historical sites and tribal history of the member tribes;
and,
WHEREAS, on the basis of this study the Secretary shall identify sites
appropriate to Oklahoma Indian History and discuss the feasibility and
suitability of locating this project in conjunction with the Oklahoma
Riverfront Redevelopment Authority master plan for the North Canadian
River; and,
WHEREAS, the Secretary shall prepare this study in consultation with the member
tribes of the Oklahoma Institute of Indian Heritage; and,

WHEREAS, the Citizen Band Potawatomi Tribe of Oklahoma supports the efforts of
Oklahoma Institute of Indian Heritage to establish this cultural

SEPARATION OF THE CHILDREN FROM THE FAMILY UNDER CITIZEN BAND
POTAWATOMI TRIBAL COURT CASE # JFJ-88-06-07-08-09-10-P AT THE
DISCRETION OF THE COURT.
WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma

termination of parental rights and separation of the children
from the family at the discretion of the Court.
