RESOLUTION POTT# 94-1
A RESOLUTION ADDING AN AMENDMENT TO THE ELECTION ORDINANCE
WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma is a
federally recognized tribe of American Indians with
constitutional authority under the Indian Reorganization Act
of 1934 and the Thomas-Rogers Act of 1936; and
WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma, the
largest of the Potawatomi Indian Tribes, has, through a
continuation of Potawatomi history and organized self
government since time immemorial, sovereign powers inherent in
tribal tradition and recognized by treaties with the United
States and in the United States Constitution; and
WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma
Constitution and By-Laws provide that the Business Committee
of the Tribe shall be granted the power to act on behalf of
the Tribe in all matters except those relating to claims or
treaties with the United States; and
WHEREAS, the Election Committee of the Citizen Band Potawatomi Tribe
submitted to the Business Committee the following amendment to
the Election Ordinance under Article IV, S4-109 Poll Watchers;
Each candidate may designate in writing one person, not a
candidate, to watch the activities at the polls
ADD
a. A Poll Watcher is eligible if:
1. A member of the Tribe.
2. 21 years of age or older
b A Poll Watcher is not qualified for appointment if:
1. Under any court-ordered guardianship due to mental
incapacity.
2. Ever convicted of a felony.
3. Ever convicted of a non-felonious crime involving
the election laws of the Tribe, or
4. Ever found civilly or criminally liable for
breaching a fiduciary or contractual duty to the
Tribe.
Such designation must be presented to Election Committee
Officials one week prior to the election. Poll watchers may
not interfere in any way with the conduct of the election, but
may observe only. Any poll watcher interfering with the
election or attempting to electioneer in any way may be
ejected from the poll area by a marshal or law enforcement
officer.

WHEREAS, the members of the Election Committee voted to approve the
following amendment to the Election Ordinance,

THEREFORE BE IT RESOLVED, that the Business Committee of the Citizen
Band Potawatomi Indian Tribe approve the above mentioned amendment to
the Election Ordinance under Article IV, S4-109.

A RESOLUTION AUTHORIZING THE CITIZEN BAND POTAWATOMI INDIAN TRIBE
OF OKLAHOMA'S INDIAN CHILD WELFARE FAMILY VIOLENCE PREVENTION AND
SERVICES GRANT APPLICATION FOR FY 1993.
WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma is
a federally recognized tribe of American Indians with
constitutional authority under the Indian Reorganization
Act of 1934 and Thomas-Rogers Act of 1936; and
WHEREAS, the Citizen Band Potawatomi Indian Tribe Of Oklahoma,
the largest of the Potawatomi Indian Tribes, has,
through a continuation of Potawatomi history of
organized self government since time immemorial,
sovereign powers inherent in tribal tradition and
recognized by treaties with the United States and in the
United States Constitution; and
WHEREAS, the Citizen Band Potawatomi Indian Tribe of Oklahoma

relating to claims of treaties with the United States;
and
WHEREAS, the Tribal Administrator and Tribal Chairman, are hereby
granted authority to negotiate any items pursuant to
this grant and any amendments thereto; and
WHEREAS, the Federal Register, Vol 58, No. 100 on Wednesday May
26, 1993 listed the Citizen Band Potawatomi of Oklahoma
as eligible for this grant;
WHEREAS, the proposed start date of this grant shall be immediate
upon funding;
NOW
THEREFORE, BE IT RESOLVED, that the Business Committee of the
Citizen Band Potawatomi Indian Tribe of Oklahoma authorizes the
Indian Child Welfare Department to submit an application for
funding to the Office of Community Services.

WHEREAS, these small uninvested accounts have been idle for several years,

WHEREAS, these funds are identified as Program Funds, an unclaimed per capita
share from 1978 and Proceeds of Labor, and
WHEREAS, the total amount is less than $10,000.00, and
WHEREAS, the Tribe can utilize these funds in accordance with Federal
Regulations;
NOW;
THEREFORE, BE IT RESOLVED that the Business Committee of the Citizen Band
Potawatomi authorizes the withdrawal of certain uninvested accounts, both
principal and interest to be utilized in tribal trust fund programs; and
THEREFORE, BE IT FURTHER RESOLVED the Tribal Administrator is hereby authorized
to initiate action for this withdrawal and any future withdrawals, if necessary.
CERTIFICATION
We, the undersigned members of the Business Committee of the Citizen Band
Potawatomi Indian Tribe of Oklahoma do hereby certify that the above is a true

from local authorities and private individuals
interested in the welfare of Indian children and their

WHEREAS, the Iowa Indian Tribe of Oklahoma is a federally
recognized tribe of American Indians as defined by 25
CFR, Part 23, Subpart C, paragraph 23.21, and is
eligible for an Indian Child Welfare Act Program, and
WHEREAS, the Citizen Band Potawatomi Indian Tribe Of Oklahoma,
and the Iowa Tribe have been in a consortium agreement
for the previous four year period; and
WHEREAS, the proposed start date of this extension shall be
September 30, 1993;

THEREFORE, BE IT RESOLVED, that the Business Committee of the
Citizen Band Potawatomi Indian Tribe of Oklahoma requests funding
from the Bureau of Indian Affairs through a grant extension under
the Indian Child Welfare Act to provide an Indian Child and Family
Service Program to promote the stability of eligible Indian
families; and,
FURTHER, BE IT RESOLVED, that the Potawatomi Indian Tribe of
Oklahoma does administer an Indian Child Welfare Program in behalf
of the Iowa Tribe of Oklahoma for Fiscal Year 1993; and,

to the Bureau of Indian Affairs for a juvenile detention
facility; and
WHEREAS, there is not a juvenile detention facility in Oklahoma
that is operated by a tribe, even though there is a dire
need for such a facility; and
WHEREAS, tribal governments desire to place their children in a
structure environment that is sensitive to cultures,
traditions, and values of American Indians whenever
detention is necessary; and
WHEREAS, tribal leaders recognize that the juvenile population is
growing; juvenile crimes are becoming more violent; and
neither the state nor the tribes have the facilities
available to rehabilitate the American Indian juveniles;
and

WHEREAS, the Sac and Fox Nation is in the process of constructing
and operating such a facility that will be available to
the American Indian population and will be sensitive to
cultures, traditions, and values of American Indians;

from local authorities and private individuals

the Business Committee chooses to withdraw said authorization
and by subsequent resolution; and
