AUTHORIZED BY TITLE III OF THE INDIAN SELF-DETERMINATION AND
EDUCATION ASSISTANCE ACT (PUBLIC LAW 93-638) WITH AMENDMENTS. THE
NEGOTIATION AGREEMENT SHALL BE BETWEEN THE DHHS, PHS, IHS OFFICE
OF SELF-GOVERNANCE, AND THE CITIZEN POTAWATOMI NATION EFFECTIVE
AUGUST 1, 1997. THE AGREEMENT IS TO PROVIDE RESOURCES FOR
NEGOTIATION WITH IHS IN THE AMOUNT OF $20,000.00.
WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of American Indians
with constitutional authority under the Thomas-Rogers Oklahoma Indian Welfare Act of
June 26, 1936, (40 Stat. 1967); and
WHEREAS, the Citizen Potawatomi Nation, the largest of the Potawatomi Indian Tribes, has,
through a continuation of Potawatomi history and organized self government since time
immemorial, sovereign powers inherent in tribal tradition and recognized by treaties with
the United States and in the United States Constitution; and
WHEREAS, the Citizen Potawatomi Nation Constitution and By-laws provide that the Business
Committee is empowered to enact legislation, transact business, and otherwise speak or act
on behalf of the Citizen Potawatomi Nation in all matters on which the Tribe is empowered
to act now or in the future; and
WHEREAS, the FY-97 Cooperative Agreement announcement dated June 5, 1997 published by
the IHS sets the eligibility criteria for this application as follows:
1) Applicant must be
federally recognized as defined in P.L. 93-638,
2) Apply by a tribal resolution,
3) Have two
or more mature contracts,
4) Submit organization wide single audit reports for 1993, 1994,
and 1995 that contain no significant or material audit exceptions, and
5) Successfully
completed an IHS SG planning grant; and
WHEREAS, the Citizen Potawatomi Nation meets all eligibility criteria described in the foregoing
paragraph and hereby submits all application information as required for compacting; and

WHEREAS, the Citizen Potawatomi Nation has informed the Indian Health Services Headquarters
via a letter of intent dated March 15, 1995 and a tribal Resolution (Pott #95-56) dated March
29, 1995 that the Nation desires to compact under Self-Governance in all health programs,
functions, services, and activities managed by Oklahoma City Area IHS, Rockville
Headquarters, and the Shawnee, Oklahoma Service Unit; and
WHEREAS, the Citizen Potawatomi Nation administers a Title I Contract (No. 246-97-0017) for
all operations of the Nations Health Clinic to provide medical & health services. The clinic
contract was authorized by the Business Committee with the stipulation, ""When a compact
becomes available, the Title I Contract would be given Title III Compact status,"" not
withstanding, a letter of intent signed by Chairman, John A. Barrett, Jr. on March 15, 1995
signifies an interminable waiting period of two years and three month; and
WHEREAS, of the five Tribes which are in the Shawnee Service Unit area, the Citizen Potawatomi
Nation is the only Tribe remaining without a compact with IHS.
WHEREAS, the Citizen Potawatomi Nation has a record of successfully administering a varied
service program for tribal members utilizing special revenue funds as outlined in the annual
report; and
WHEREAS, the Business Committee of the Citizen Potawatomi Nation does hereby commit the
Nation to a negotiation agreement and directs John A. Barrett, Jr., Chairman, to assume the
position of a lead negotiator and final approval signatory for the Compact/AFA;

THEREFORE BE IT RESOLVED, that the Business Committee of the Citizen Potawatomi
Nation hereby requests that the Indian Health Services approve a negotiation cooperative
agreement in the amount of $20,000.00 to assist the Nation with costs associated with
negotiation for compact under the SGDP. This agreement is authorized by P.L. 93-638,
as amended.

WHEREAS, the Citizen Potawatomi Nation realizes the emergency and imminent
threat as a non-recurring situation, of which, represents an unusual and unique
set of circumstance that will have a large and lasting impact on the entire I.H.S.
Shawnee Service Unit; and
WHEREAS, the Oklahoma City Area Director of Indian Health Services has notified
our Nation that the existing I.H.S. Shawnee Health Center will close
permanently at the end of 1997; and
WHEREAS, the Citizen Potawatomi Nation realizes that without these important
health services, our tribal members lives will be at high risk until such time that
our existing clinic can be renovated and a full-time physician hired;

THEREFORE BE IT RESOLVED, that the Business Committee of the Citizen
Potawatomi Nation fully supports the Imminent Threat to Health application offered
through the Indian Community Development Block Grant Program.

TRANSPORTATION IMPROVEMENT PROGRAM WITH THE
BUREAU OF INDIAN AFFAIRS
WHEREAS, the Citizen Potawatomi Nation is a federally recognized
tribe of American Indians with the constitutional authority under
the Thomas-Rogers Oklahoma Indian Welfare Act of June 26,
1936, (40 Stat. 1967); and
WHEREAS, the Citizen Potawatomi Nation, the largest of the
Potawatomi Indian Tribes, has, through a continuation of
Potawatomi history and organized self-government since time
immemorial, sovereign powers inherent in tribal tradition and
recognized by treaties with the United States Constitution; and
WHEREAS, the Citizen Potawatomi Nation Constitution and By-laws
provide that the Business Committee is empowered to enact
legislation, transact business, and otherwise speak or act on behalf
of the Citizen Potawatomi Nation in all matters on which the Tribe
is empowered to act now or in the future; and
WHEREAS, the Citizen Potawatomi Nation is eligible under P.L. 93-638
to contract for the operations of Bureau of Indian Affairs (BIA)
provided services; and
WHEREAS, the Citizen Potawatomi Nation desires to contract with the
Bureau of Indian Affairs for its portion of two percent (2%)
Planning Funds ($9,500 in CY97) to develop a Tribal
Transportation Improvement Plan (TIP) as afforded by the Indian
Self-Determination and Education Assistance Act (25 CFR Part
800); and

WHEREAS, the Citizen Potawatomi Nation appoints Chairman, John A.
Barrett, Jr. to act as Negotiator and Executive Authority on the
Nation's behalf; and
WHEREAS, the Citizen Potawatomi Nation will conform to all aspects of
the CFR appropriate to the given program to be contracted; and
WHEREAS, the Citizen Potawatomi Nation proposes to contract with the
Bureau of Indian Affairs for a period beginning October 1, 1997
and ending October 1, 2000;

THEREFORE BE IT RESOLVED, that the Business Committee of the
Citizen Potawatomi Nation fully supports all efforts to contract with the
Bureau of Indian Affairs for the Transportation Improvement Program.

WHEREAS, Congress has enacted Public Law 102-477 which allows Tribes to
voluntarily consolidate various Employment Training, Education,
and Child Care Services; and
WHEREAS, Public Law 102-477 permits the consolidation of funding received
for these programs and allows greater flexibility in the
development, coordination, and operation of said programs:
WHEREAS, in order to operate under Public Law 102-477 demonstration
project, the Citizen Potawatomi Nation is requesting all Social
Services funds (Contract #CTB08T82105) be moved into the
P.L. 102-477 (except Child Abuse Funds totaling $15,500 with
allocations of $11,000 Child Abuse, $500 Child Protection Team,
and $4,000 for Iowa Tribe). Funds to be moved include $34,700
Social Services plus monies allocated for Contract Support.
WHEREAS, the Citizen Potawatomi Nation is requesting all General
Assistance funds be moved into the P.L. 102-477 demonstration
project. General Assistance Funds to be moved total $15,000.
WHEREAS, the Citizen Potawatomi Nation is requesting all Higher
Education, Adult Vocational Training (AVT) and Direct
Employment (DE) funds (Contract #CTB08T82102) be moved
into P.L. 102-744. Funds to be moved include $55,000 Higher
Education and $54,509 AVT/DE, plus $24,285 allocated to
Contract Support.

these programs be administered in accordance with that plan negotiated with the

WHEREAS, funding receipt of the HOME grant is contingent upon 100%
leverage or matching of HUD funds as directed in the HOME

WHEREAS, the `Native American Housing Assistance and Self-
Determination Act of 1996' (`NAHASDA') passed by the
104th Congress consolidates various Department of Housing
and Urban Development programs into a block grant on
behalf of Indian Tribes to provide housing assistance for
Native Americans; and
WHEREAS, to receive grant funding under the NAHASDA, an Indian
Tribe or the tribally designated housing entity must submit to
HUD an Indian Housing Plan with respect to a 5-year and a
1-year period in a form prescribed by the Secretary; and
WHEREAS, by exercise of the power of self government an Indian tribe,
pursuant to the Act, may authorize an entity other than the
tribal government to receive grant amounts and provide
assistance under this Act for affordable housing for Indians;

Section
1- DEFINTIONS
a) ""Project"" is defined as any program undertaken by the housing authority to expand or
improve housing stock owned or operated by an IHA.
b) ""Board"" is defined to be the Oklahoma Indian Preference Pre-Qualifications Board
(OIPB).
c) ""Indian"" is defined to mean any person who is a member of any tribe, band, group,
pueblo, or community which is recognized by the Federal Government as eligible for
services for preference under the Indian Preference Regulations.
d) ""Indian-Owned Economic Enterprise"" is defined to mean any Indian owned commercial,
industrial, or business activity established or organized for the purpose of profit,
provided that such Indian owner shall constitute not less that 51 per centum of the
enterprise.
e) ""Joint Venture"" is defined to mean any group of two or more joined together for the
purpose of establishing an economic unit, and that each may sell, assign, transfer or
otherwise dispose of ownership independent of one another.
f) ""Indian Organization"" is defined to mean the recognized governing body of any Indian
Tribe; any legally established organization of Indians which is controlled, sanctioned, or
chartered by such governing body or which is democratically elected by the adult
members of the Indian community to be served by such organization and which includes
the maximum participation of Indians in all phases of its activities.
Section
2— MEMBERSHIP
The Oklahoma Indian Preference Pre-Qualifications Board shall consist of one (1) Member from
each participating Indian Housing Authority, who has development or CIAP funding. Each
Member (and alternates) will be appointed, in writing, by their Indian Housing Authority.
Section
3— POWERS AND DUTIES
The said board shall meet once a month (or as needed) at a place and time specified by the Board.
Each participating Indian Housing Authority will be advised of the time and place of each meeting
at least five (5) days prior to the meeting.
The said Board shall follow the adopted By-laws of the organization in the conduct of its business.
Said Board, in determining the qualifications of each applicant for said Pre-Qualification approval
must, among other things consider the following:

1. Proof of Indian ownership of the applicant company - Proof of Indian ownership shall include,
but not be limited to:
(i) Certification by a Tribe or other evidence that the applicant is and Indian and therefore
eligible to receive preference. The Board shall accept certification of a tribe that an
individual is a member.
(ii) Evidence relating to the stock ownership, structure, management, control, financing, and
salary or profit-sharing arrangements of the enterprise which evidence 51 per centum
Indian ownership and control.
The Board shall keep record of all applications for Indian Preference Pre-Qualification approval
showing for each the date of application, name of applicant, place of business, place of residence,
and whether approval was refused, granted, or pending, and any other pertinent information the
Board finds necessary to keep and record, including whether the approval has been suspended or
revoked.
Section 4 — PROCEDURES FOR REVOCATION OR SUSPENSION OF PRE-QUALIFICATION
Said Board shall any time have the power to revoke or suspend the approval of any person who is
guilty of any fraud or deceit in obtaining approval, or for other good cause. Any recommendation
for suspension of any person for cause must be submitted, in writing, to the Board for consideration
at the next regular meeting, special meeting, or emergency meeting, duly called for that purpose.
a) Manner in which revocation or suspension proceedings are to be conducted.
Proceedings for revocation or suspension or pre-qualification shall be undertaken by
the Board.
b) Investigation of Complaints. All complaints touching upon fraud or deceit in obtaining
approval shall be referred to HUD, who shall refer the complaint to the HUD Office of
Investigation. Written documentation of the complaints shall be forwarded to the
President of the Board for inclusion in the applicant's file.
c) Notice of Proceedings. Prior to any action for suspension or revocation, the Board
shall instruct the President to give ten (10) days notice thereof by certified mail to the
applicant, that the revocation or suspension will be considered at the next meeting of
the Pre-Qualification Board. The date of such meeting shall be less that ten (10) days
from the date of the notice; however, for good cause shown, the applicant may waive in
writing the ten (10) days notice and request consideration of the complaint at a

regularly scheduled meeting or special meeting, or emergency meeting to be held in
compliance with the By-laws.
d) Action by the Pre-Qualification Board. The Board shall thereupon undertake to
consider the complaint and either revoke or suspend the pre-qualification or dismiss the
complaint.
Section 5— APPEALS FROM ORDERS OF THE PRE-QUALIFICATION BOARD
a) Complaints alleging inadequate or inappropriate provision of Indian Preference shall
be in writing, signed and filed with the appropriate participating Indian Housing
Authority (IHA).
b) A complaint must be filed with the IHA no later than 20 days from the date of the
action (or omission) upon which the complaint is based.
c) Upon receipt of a complaint, the IHA shall promptly acknowledge its receipt and shall
investigate, and within 15 days shall either meet with, or communicate by mail or
telephone, with the complaining party in an effort to resolve the matter. In all cases,
but especially where the complaint indicates that expeditious action is required to
preserve the rights of the complaining party, the IHA shall endeavor to resolve the
matter a s [as shown on original] expeditiously as possible. If noncompliance with Indian Preference
requirements is found to exist, the IHA shall take appropriate steps remedy the
noncompliance and to amend its procedures so as to be in compliance. If the matter is
not resolved to the satisfaction of the complaining party, or if the IHA has failed to
communicate with the complaining party in an effort to resolve the complaint within 15
days following the IHA's receipt of a complaint, the complaining party may file a
written complaint with the appropriate Indian Field Office of HUD. In any event,
complaints filed with HUD must be received within six months after the alleged
adverse action by the IHA contractor or subcontractor. The address of the Indian Field
Office and the name of the appropriate Indian program officer shall be included in the
initial communication from the IHA acknowledging receipt of the complaint.
d) Upon receipt of a written complaint, the HUD Indian Field Office will request that the
IHA provide a written report setting forth all relevant facts, but not limited to: (A) the
date the complaint was filed with the IHA, (B) the name of the complaint, (C) the
nature of the complaint, including the manner in which Indian Preference was or was
not provided, and (D) actions taken by the IHA in addressing or resolving the
complaint. The IHA shall provide copies of its report and all relevant documents
concerning the complaint to HUD and to the complaining party within ten days after
receipt of the HUD request.

e) Upon receipt of the IHA's report, the HUD Indian Field Office will determine whether
the actions taken by the IHA comply with the requirements of Section 7 (b) of the
Indian Self-Determination and Education Assistance Act, and with Indian preference
requirements under this part. Notification of the Field Office's determination shall be
provided to the IHA and to the complaining party orally or in writing, no later than 30
days following HUD's receipt of the complaint. If the notice is oral, it shall be
promptly confirmed in writing, If the complaining party's alleged in jury will occur
during the 30 day period, the HUD Indian Field Office will make a good faith effort to
make its determination before the occurrence of such injury (e.g., contract award).
f) Where the HUD Indian Field Office determines on the basis of the facts provided by
the IHA and on the basis of other available information that there has been
noncompliance with Indian Preference requirements the Field Office shall instruct the
IHA to take appropriate steps to remedy the noncompliance and to amend its
procedures so as to be in compliance.
g) The decision of the HUD Indian Field Office may be appealed to the Assistant
Secretary for Public and Indian Housing.
Section 6— APPLICATIONS
Pre-qualified Indian bidders will be encouraged to bid upon Indian Housing Projects with the
participating Indian Housing Authorities. All applicants for said approval must be made upon the
application forms developed by the Business Committee. Said information shall be current as of the
day it is submitted.

WHEREAS, the Citizen Potawatomi Nation is a federally recognized tribe of American Indians
with the constitutional authority under the Thomas-Rogers Oklahoma Indian Welfare
Act of June 26, 1936, (40 Stat. 1967); and
WHEREAS, the Citizen Potawatomi Nation, the largest of the Potawatomi Indian Tribes, has,
through a continuation of Potawatomi history and organized self government since
time immemorial, sovereign powers inherent in tribal tradition and recognized by
treaties with the United States and in the United States Constitution; and
WHEREAS, the Citizen Potawatomi Nation Constitution and By-Laws provide that the
Business Committee is empowered to enact legislation, transact business, and
otherwise speak or act on behalf of the Citizen Potawatomi Nation in all matters

WHEREAS, the ""Oklahoma Indian Child Welfare Act was enacted in 1982 for the purpose of
clarification of state policies and procedures regarding the implementation by the
State of Oklahoma of the federal Indian Child Welfare Act"".
WHEREAS, there currently exists an Oklahoma State Legislative Committee titled the
Oklahoma Adoption Law Reform Committee, and
WHEREAS, the majority of the Oklahoma Adoption Reform Committee is made up of
attorneys involved in adoptions and adoption agency representatives, and
WHEREAS, the Oklahoma Adoption Reform Committee has no representatives from the
Tribes, and
WHEREAS, without sufficient Tribal representation on the Oklahoma Adoption Reform
Committee the best interest of Indian children, Indian parents, and the Tribes
cannot be assured, and
WHEREAS, the Oklahoma Adoption Reform Committee has established a subcommittee that is
involved in creating amendments to the Oklahoma Indian Child Welfare Act, and
WHEREAS, the attempts of the Adoption Law Reform Sub-Committee to amend the OICWA
10 Section 40.1 to include defining ""Existing Indian Family"" would not uphold the
purpose and intent of the Federal Indian Child Welfare Act, 25 U.S.C. s1901, and
therefore would not efficiently safeguard our children, families and the future of
our Tribe.
WHEREAS, specific proposed amendments of concern to the Citizen Potawatomi Nation
include the following:
1. ""The determination of the Indian status of a child shall be made as soon as
practicable after the initiation of the proceeding and once non-Indian status of a
child has been determined that status is maintained for all future proceedings
regardless of whether the Indian status of the child is established later in the
proceedings"".
2. Definition of the Existing Indian Family - ""The Oklahoma Indian Child Welfare
Act shall therefore, apply only when the Indian child is, as a result of the child
custody proceeding, being removed from an existing Indian family environment,
where one or both of the parents maintain a significant social, cultural, or political
affiliation with the Tribe or which the parent(s) is a member.

NOW THEREFORE, BE IT RESOLVED, that the Citizen Potawatomi Nation adamantly
opposes any amendments to the Oklahoma Indian Child Welfare Act and any amendments to the
Oklahoma Adoption Act involving Indian Children during the current legislative session.
NOW THEREFORE, BE IT FURTHER RESOLVED, that the Citizen Potawatomi Nation
adamantly opposes any action that would serve to add the proposed amendments or any of the
language contained therein as a rider to other pending legislation.
NOW THEREFORE, BE IT FURTHER RESOLVED, that amendments to the Oklahoma
Indian Child Welfare Act and any amendments to the Oklahoma Adoption Act involving Indian
children should only be developed by a legislative committee that includes representatives from
the tribes/nations whose governmental headquarters are located within the boundaries of the State
of Oklahoma.

Office as the ""Governor's Office of Highway Safety"" and encourages all

to finance tribal highway safety projects and to supplement local program
expenditures in the form of reimbursements; and

acknowledges a responsibility to maintain highway safety within their tribal
jurisdiction through a cooperative agreement with the Pottawatomie County
Sheriff's Office;

boundaries. The rehabilitation of homes will be for enrolled members that hold title or
assignment to the house that rehabilitation is to be provided; and
WHEREAS, it is the intent to the Housing Authority of the Kickapoo Tribe of Oklahoma to provide
service to the elderly, near elderly, handicapped and disabled tribal members living within a
two mile limit, that is within the jurisdiction of the Citizen Potawatomi Nation; and

WHEREAS, The housing authority of the Kickapoo tribe will only provide service to the tribal
member who owns their land in Fee Simple and holds title to the unit, or to the tribal member
who has an assignment to house on trust property. The Housing Authority will not provide
service to a Mutual Help or Low Rent unit that is in the Citizen Potawatomi Nation
jurisdiction.
NOW THEREFORE BE IT RESOLVED, that the Business Committee of the Citizen Potawatomi
Nation approves the waiver to the Housing Authority of the Kickapoo of Tribe of Oklahoma.

time immemorial, sovereign powers inherent in tribal tradition and recognized by
treaties with the United States Constitution; and

3) Educating and training tribal representatives in fish & wildlife biology,
management, and conservation;
4) Representing future tribal fish & wildlife needs through Congressional process;

WHEREAS, membership is required to benefit from the above listed services; and
WHEREAS, the Citizen Potawatomi Nation supports future funding of the NAFWS to
maintain its organization and to provide technical services to the CPN in building our
tribal fish & wildlife program; and
WHEREAS, the Citizen Potawatomi Nation hereby appoints K.C. Kraft, our Director of
Environmental Services, to be the CPN tribal representative and membership contact
person for all NAFWS related matters.

WHEREAS, the Citizen Potawatomi Nation is eligible to P.L. 93-638 contract the survey,
design, and construction of these projects; and
