RESOLUTION # 13-01-HHS
A RESOLUTION APPROVING THE SUBMISSION OF THE "FY 2013
COMMUNITY SERVICES BLOCK GRANT (CSBG)" APPLICATION TO THE
ADMINISTRATION FOR CHILDREN AND FAMILIES.
WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of
American Indians with Constitutional authority under the Act of June 18,
1934 and the Oklahoma Indian Welfare Act of June 26, 1936, (49 Stat.
1967); and
WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in
Tribal tradition, derived from a history of organized self-government since
time immemorial, and recognized by treaties with the United States and in
the Constitution of the United States; and
WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution
provides for a separation of powers of the Tribal government by the
reservation and delegation of specific powers to other entities of the Tribal
government; and, except for these specific limitations, all other general
powers of government are embodied in the Legislature's authority "to
enact legislation, transact business, and otherwise speak and act on behalf
of the Citizen Potawatomi Nation in all matters on which the Nation is
empowered to act now or in the future"; and
WHEREAS, the Citizen Potawatomi Nation P.L. 102-477 Program (Employment and
Training/Social Services) assists low income Native American
households, who are otherwise ineligible for 477 program funds, with fuel
costs through vouchers to FireLake Convenience Store, or other
emergency needs such as utility payments, or medical related needs; and

WHEREAS, if funded, the Citizen Potawatomi Nation will receive an estimated
$3541.00 in a Community Services Block Grant (CSBG) to deliver such
assistance.
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE
CITIZEN POTAWATOMI NATION that a resolution supporting the submission of the
FY 2013 Community Services Block Grant (CSBG) application to the Administration for
Children and Families, IS HEREBY APPROVED.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that by act of this resolution
and consistent with the separation of powers defined in the Constitution, if awarded, an
appropriation up to $3541.00 from the FY 2013 CSBG fund (or other applicable
accounts) for the implementation, negotiation, operation, enforcement, procurement,
settlement and/or completion of this contract, compact, regulation or agreement by the
Tribal Chairman or his designate IS HEREBY AUTHORIZED.
CERTIFICATION
The Legislature of the Citizen Potawatomi Nation hereby certifies that the above is a true

CITIZEN POTAWATOMI NATION that a resolution supporting the submission of the
FY 2013 Lower Income and Energy Assistance Program (LIHEAP) grant application to
the Administration for Children and Families, IS HEREBY APPROVED.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that by act of this resolution
and consistent with the separation of powers defined in the Constitution, if awarded, an
appropriation up to $ 27,601.00 from the FY 2013 LIHEAP fund (or other applicable

WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of

"CPN/Scattered Existing Homes W&S EPA" to the U.S. Indian Health
Service (IHS) under the office of Environmental Health Sanitation
Facilities Construction Branch under the authority of P.L. 86-121 for the
construction of sanitation facilities; and

WHEREAS, IHS will provide the funds and the Citizen Potawatomi Nation will
design and construct the facilities under the provisions of the Self-
Governance Compact that became effective on October 1, 1998. The total
cost to IHS for providing sanitation facilities to 26 homes is $153,000.00
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE
CITIZEN POTAWATOMI NATION, that a resolution supporting the entire project for
construction of sanitation facilities as provided by the provisions of the Citizen
Potawatomi Nation's Self Governance Compact with IHS/DHHS effective on October 1,
1998 and the multi-year funding agreement for 2008-2010 as executed by these parties
and effective on October 1, 2007 IS HEREBY APPROVED.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that by act of this resolution
and consistent with the separation of powers defined in the Constitution, an appropriation
of $ 153,000.00 from the Office of Environmental Health (or other applicable accounts)
for the implementation, negotiation, operation, enforcement, procurement, settlement,
and or completion of this contract, compact, regulation or agreement by the Tribal
Chairman or his designate IS HEREBY AUTHORIZED.

NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE
CITIZEN POTAWATOMI NATION, that a resolution supporting the entire project for
construction of sanitation facilities as provided by the provisions of the Citizen
Potawatomi Nation's Self Governance Compact with IHS/DHHS effective on October 1,

States, its agents and employees, against any lawsuits, loss, expense, and claim
potentially filed against the tribe for any damages relating to asbestos and lead-
based paint, if any, associated with the improvements located on the property

research, design, engineering, construction, and maintenance of highway, road, bridge,
parkway, or transit facility programs or projects funded through the Federal Highway
Administration; and
WHEREAS, the Citizen Potawatomi Nation by virtue of funds obtained from the Indian Reservation
Roads Program Agreement, can streamline administration and management of
transportation projects that are located on, or which provide access to, the Citizen
Potawatomi Nation pursuant to 25 CFR Part 170; and

WHEREAS, the Department of Interior, U.S. Fish and Wildlife Service, is soliciting grant
application to develop projects to benefit wildlife and wildlife habitat
conservation, training and education, including species that are not hunted or
fished; and
WHEREAS, the Citizen Potawatomi Nation Eagle Aviary is proposing to increase the
infrastructure support for the Eagle Aviary to include 2 small isolation side
mews, a pond and multipurpose shop building as well as to partner with U.S.
Fish and Wildlife Service (USFWS) to develop and implement training tools
which will better assist other tribes who have been referred by USFWS to the
CPN Eagle Aviary for training purposes; and

WHEREAS, the estimated cost of the proposed two year project is $290,000, of which
$200,000 for salary, equipment, construction of an Aviary multipurpose

Tribal match of up to $90,000 includes in-kind salary and fringe match for two
years.
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN
POTAWATOMI NATION that a resolution authorizing the submission of the fy 2013 Eagle
Aviary Infrastructure Improvement Tribal Wildlife grant application to the U.S. Fish and Wildlife
Service IS HEREBY APPROVED.

WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of American

boundaries of the Citizen Potawatomi Nation, legally described in
Attachment A; and listed in the Pottawatomie County Treasurer's

WHEREAS, the property was purchased with tribal funds for NON-gaming use;

the United States, its agents and employees, against any lawsuits,
loss, expense, and claim potentially filed against the tribe for any
damages relating to asbestos and lead-based paint, if any, associated

proposed resubmission of the community development project
pursuant to citizen participation requirements as set forth in 24 CFR

WHEREAS, the Employment & Training Building will be constructed following
applicable standards and guidelines from the Building Officials and
Code Administrators (BOCA), Life and Safety Codes, and Americans
with Disabilities Act (ADA); and
WHEREAS, the project period for the proposed Employment & Training Building
construction project is 2 years, with a total project cost of
$1,070,000 of which $800,000 (or 75%) is the Federal share, and
$270,000 (or 25%) is Tribal leverage; and
WHEREAS, the Citizen Potawatomi Nation has adopted an operation and
maintenance plan and commits the necessary funding as referenced
within the Letter of Commitment provided by the Employment &
Training program for facility upkeep; and
WHEREAS, tribal leverage will consist of $165,000 cash and a parking lot valued
at $105,000.

construction of sanitation facilities; and
WHEREAS, the IHS will provide the funds and the Citizen Potawatomi Nation will design
and construct the facilities under the provisions of the Self-Governance
Compact that became effective in fiscal year 1998. The total cost to IHS for
providing sanitation facilities to 29 eligible homes is $247,000.00; and

construction of sanitation facilities as provided by the provisions of the Self-

IHS/DHHS executed by both parties and effective in May 2012 in connection
with said compact.

availability of grant funds to improve Tribal law enforcement
and justice systems with the stipulation that these funds are
available for a variety of specified purposes as outlined in ten
"Purpose Areas"; and
WHEREAS, the Citizen Potawatomi Nation is eligible for, and desires to
apply for, funding under three of the ten Purpose Areas:
Purpose Area 1, "Public Safety and Community Policing;" ;
Purpose Area 3, "Justice Systems and Alcohol and Substance
Abuse;"; and Purpose Area 9 "Tribal Youth Program" and
WHEREAS, under Purpose Area 1, Citizen Potawatomi Nation is proposing
the addition of police and police vehicles with equipment and
supplies for the Tribal Police department at an estimated cost
of no more than $1,000,000 with no match required; and
WHEREAS, under Purpose Area 3, the Citizen Potawatomi Nation is
proposing to enhance ongoing direct alcohol and substance
abuse services provided to tribal youth, at an estimated cost of
no more than $750,000 with no match required; and

proposing to enhance ongoing direct services provided through
the tribal youth program, at an estimated cost of no more than

WHEREAS, the approved Plan, dated November 1996, requires annual
budgets to be prepared by the Tribal Legislature for approval

cited in the Tribal Constitution and the federal statutes specific
to the Indian Claims Commission, within which Trust Funds
and earnings from Trust Funds retain their original tax exempt

service area, being defined as Pottawatomie County, Cleveland County,
Oklahoma County, and areas adjacent to the eight Potawatomi District
Offices; and

WHEREAS, the center-based, voucher and after school program will provide Native
American families with quality day care facilities in which to leave their
children.

WHEREAS, the Citizen Potawatomi Nation Indian Child Welfare program will contract
with Project Safe, Unzner Center, Family Resource Center and Citizen
Potawatomi Nation Tribal Police to provide auxiliary services to victims of
family violence and their dependents; and
WHEREAS, the goals of the Family Violence component of the Indian Child Welfare
program are to provide immediate shelter and related assistance to victims
of family violence and to expand efforts to prevent family violence; and

WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in

WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution provides
for a separation of powers of the Tribal government by the reservation and

are embodied in the Legislature's authority "to enact legislation, transact

WHEREAS, the Indian Health Service is accepting applications for FY 2013 competitive
cooperative agreement funding directed at Healthy Heart and Diabetes
Prevention Initiatives; and
WHEREAS, the Citizen Potawatomi Nation has implemented a community directed
diabetes program for sixteen years and provides care for approximately 550
Native Americans age 18 and over who have been diagnosed with diabetes;
and
WHEREAS, the Citizen Potawatomi Nation proposes to provide a Healthy Heart Program
aimed at cardiovascular disease risk reduction in Native Americans with
diabetes through intensive activities including case management, disease
management, and self-management education; and

WHEREAS, the Citizen Potawatomi Nation also proposes less intensive community
awareness activities such as health fairs, exercise challenges, and

annually for a 2 year project period with no matching funds or in-kind
services required.
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN
POTAWATOMI NATION that a resolution authorizing and supporting the "Citizen
Potawatomi Nation's Fiscal Year 2013 Competitive Diabetes Healthy Heart Initiative
Application to the Indian Health Service under the Special Diabetes Program for Indians IS

Construction Branch under the authority of P.L. 86-121 for the
construction of sanitation facilities; and
WHEREAS, IHS will provide the funds in the amount of $92,150.00 and the Citizen
Potawatomi Nation agrees to provide $2,850.00 in matching funds for the
design and construction of sanitation facilities under the provisions of the
Self-Governance Compact that became effective on October 1, 1998. The
total cost for providing sanitation facilities to 15 homes is $95,000.00.

NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN

sanitation facilities as provided by the provisions of the Citizen Potawatomi Nation's Self
Governance Compact with IHS/DHHS effective on October 1, 1998 and the multi-year
funding agreement for 2013-2017 as executed by these parties and effective on October 1,
2012 IS HEREBY APPROVED.

A RESOLUTION SUPPORTING THE SUBMISSION OF THE
CITIZEN POTAWATOMI COMMUNITY DEVELOPMENT CORPORATION
AS A HARVARD PROJECT ON AMERICAN INDIAN ECONOMIC
DEVELOPMENT HONORING NATIONS ALL-STAR NOMINEE.
WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of
American Indians with Constitutional authority under the Act of
June 18, 1934 and the Oklahoma Indian Welfare Act of June 26,
1936, (49 Stat. 1967); and
WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are
inherent in Tribal tradition, derived from a history of organized self-
government since time immemorial, and recognized by treaties with
the United States and in the Constitution of the United States; and
WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution
provides for a separation of powers of the Tribal government by the
reservation and delegation of specific powers to other entities of the
Tribal government; and, except for these specific limitations, all
other general powers of government are embodied in the
Legislature's authority "to enact legislation, transact business, and
otherwise speak and act on behalf of the Citizen Potawatomi Nation
in all matters on which the Nation is empowered to act now or in the
future"; and
WHEREAS, the Harvard Project on American Indian Economic Development aims
to understand the conditions under which sustained, self-determined
social and economic development is achieved among American
Indian nations; and
WHEREAS, in 1998, the Harvard Project on American Indian Economic
Development established Honoring Nations to highlight tribal
government success by celebrating, documenting and

disseminating the stories of outstanding programs in Indian
self-governance. At the heart of Honoring Nations is the

WHEREAS, in 2006, the Citizen Potawatomi Community Development
Corporation was awarded highest honors by the Harvard
Project's Honoring Nations and is eligible to apply as an All-Star
to participate in an exclusive award cycle to share insights on
sustainability and continued reaffirmations of self-governance.
