WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of American Indians with Constitutional authority under the Act of June 18, 1934 and the Oklahoma Indian Welfare Act of June 26, 1936, (49 Stat. 1967); and WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in Tribal tradition, derived from a history of organized self-government since time immemorial, and recognized by treaties with the United States and in the Constitution of the United States; and WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution provides for a separation of powers of the Tribal government by the reservation and delegation of specific powers to other entities of the Tribal government; and, except for these specific limitations, all other general powers of government are embodied in the Legislature's authority "to enact legislation, transact business, and otherwise speak and act on behalf of the Citizen Potawatomi Nation in all matters on which the Nation is empowered to act now or in the future"; and WHEREAS, the Citizen Potawatomi Nation P.L. 102-477 Program (Employment and Training/Social Services) assists low income Native American households, who are otherwise ineligible for 477 program funds, with fuel costs through vouchers to FireLake Convenience Store, or other emergency needs such as utility payments, or medical related needs; and RESOLUTION # 13-01-HHS PAGE # 2 CITIZEN POTAWATOMI NATION WHEREAS, if funded, the Citizen Potawatomi Nation will receive an estimated $3541.00 in a Community Services Block Grant (CSBG) to deliver such assistance. NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN POTAWATOMI NATION that a resolution supporting the submission of the FY 2013 Community Services Block Grant (CSBG) application to the Administration for Children and Families, IS HEREBY APPROVED. NOW, THEREFORE, BE IT FURTHER RESOLVED, that by act of this resolution and consistent with the separation of powers defined in the Constitution, if awarded, an appropriation up to $3541.00 from the FY 2013 CSBG fund (or other applicable accounts) for the implementation, negotiation, operation, enforcement, procurement, settlement and/or completion of this contract, compact, regulation or agreement by the Tribal Chairman or his designate IS HEREBY AUTHORIZED. Barrett Chairman CITIZEN POTAWATOMI NATION RESOLUTION # 13-05-NR A RESOLUTION APPROVING A FEE-TO-TRUST ACQUISITION APPLICATION TO THE BUREAU OF INDIAN AFFAIRS AND REQUEST FOR TRUST ACQUISITION OF THE (NON-GAMING/ON RESERVATION) SKAGGS PROPERTY WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of American Indians with Constitutional authority under the Act of June 18, 1934 and the Oklahoma Indian Welfare Act of June 26, 1936, (49 Stat. 1967); and WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in Tribal tradition, derived from a history of organized self-government since time immemorial, and recognized by treaties with the United States and in the Constitution of the United States; and WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution provides for a separation of powers of the Tribal government by the reservation and delegation of specific powers to other entities of the Tribal government; and, except for these specific limitations, all other general powers of government are embodied in the Legislature's authority "to enact legislation, transact business, and otherwise speak and act on behalf of the Citizen Potawatomi Nation in all matters on which the Nation is empowered to act now or in the future"; and WHEREAS, the Citizen Potawatomi Nation is making application to the Southern Plains Regional Office of the Bureau of Indian Affairs to request transfer of "fee- simple" title to the "United States of America in Trust for the Citizen Potawatomi Nation"; and WHEREAS, the Legislature believes that increasing the tribal land base furthers the pursuit of Tribal Self Determination and allows future generations of tribal leaders to have the flexibility to use the land for the wealth, welfare, and sovereignty of the Citizen Potawatomi Nation; and WHEREAS, Section 5 of the Indian Reorganization Act of June 18, 1934 (48 Stat. 985; 25 USC 465) provides authority for the Fee-to-Trust acquisition; and RESOLUTION # 13-05-NR PAGE # 2 CITIZEN POTAWATOMI NATION WHEREAS, the property is ON-reservation or within the former reservation boundaries of the Citizen Potawatomi Nation, legally described in Attachment A; and listed in the Pottawatomie County Treasurer's records as parcel ID # (1110-00-001-022-0- 000-00Skaggs tract); and WHEREAS, the Citizen Potawatomi Nation owns the surface rights to the property in fee simple which was purchased with tribal funds for NON-gaming use and the land is currently not under lease; and WHEREAS, the current and proposed land use is residential housing, is necessary to facilitate tribal self determination and housing, and there are improvements with adequate ingress and egress for traffic services; and WHEREAS, the Citizen Potawatomi Nation agrees to indemnify and hold harmless the United States, its agents and employees, against any lawsuits, loss, expense, and claim potentially filed against the tribe for any damages relating to asbestos and lead- based paint, if any, associated with the improvements located on the property described in Attachment A; NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN POTAWATOMI NATION that a resolution supporting the Fee-to-Trust acquisition application to the Southern Plains Regional Office of the Bureau of Indian Affairs and trust acquisition of the Skaggs Property, IS HEREBY APPROVED. L. 109-59, 119 Stat. 1144 (August 10, 2005), and the Delegations of Authority set forth in 49 CFR § 1.48(b)(29); and WHEREAS, an Indian Reservation Roads Program Agreement with the United States Department of Transportation, will authorize the Citizen Potawatomi Nation to perform the planning, research, design, engineering, construction, and maintenance of highway, road, bridge, parkway, or transit facility programs or projects funded through the Federal Highway Administration; and WHEREAS, the Citizen Potawatomi Nation by virtue of funds obtained from the Indian Reservation Roads Program Agreement, can streamline administration and management of transportation projects that are located on, or which provide access to, the Citizen Potawatomi Nation pursuant to 25 CFR Part 170; and RESOLUTION # 13-08-NR PAGE # 2 CITIZEN POTAWATOMI NATION WHEREAS, the Legislature fully supports and endorses the negotiation and submission of an Indian Reservation Roads Program Agreement with the United States Department of Transportation, Federal Highway Administration. WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of American Indians with Constitutional authority under the Act of June 18, 1934 and the Oklahoma Indian Welfare Act of June 26, 1936, (49 Stat. 1967); and WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in Tribal tradition, derived from a history of organized self-government since time immemorial, and recognized by treaties with the United States and in the Constitution of the United States; and WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution provides for a separation of powers of the Tribal government by the reservation and delegation of specific powers to other entities of the Tribal government; and, except for these specific limitations, all other general powers of government are embodied in the Legislature's authority "to enact legislation, transact business, and otherwise speak and act on behalf of the Citizen Potawatomi Nation in all matters on which the Nation is empowered to act now or in the future"; and WHEREAS, Resolution #01-40, adopted on October 25, 2000, established the Citizen Potawatomi Nation Floodplain Board, appointed members, and designated duties; and WHEREAS, Resolution #01-40 further states that members of the Floodplain Management Board shall serve without compensation and members of the Floodplain Management Board may be removed for cause only after a public hearing for that purpose; and WHEREAS, Resolution #07-93 adopted on February 12, 2007, increased the number of Floodplain Management Board members to six; and WHEREAS, John A. Barrett Tribal Chairman CITIZEN POTAWATOMI NATION RESOLUTION # 13-14-NR A RESOLUTION AUTHORIZING THE SUBMISSION OF THE FY 2013 CITIZEN POTAWATOMI NATION "EAGLE AVIARY TRAINING AND INFRASTRUCTURE IMPROVEMENT" TRIBAL WILDLIFE GRANT APPLICATION TO THE DEPARTMENT OF INTERIOR, U.S. FISH AND WILDLIFE SERVICE WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of American Indians with Constitutional authority under the Act of June 18, 1934 and the Oklahoma Indian Welfare Act of June 26, 1936, (49 Stat. 1967); and WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in Tribal tradition, derived from a history of organized self-government since time immemorial, and recognized by treaties with the United States and in the Constitution of the United States; and WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution provides for a separation of powers of the Tribal government by the reservation and delegation of specific powers to other entities of the Tribal government; and, except for these specific limitations, all other general powers of government are embodied in the Legislature's authority "to enact legislation, transact business, and otherwise speak and act on behalf of the Citizen Potawatomi Nation in all matters on which the Nation is empowered to act now or in the future"; and WHEREAS, the Department of Interior, U.S. Fish and Wildlife Service, is soliciting grant application to develop projects to benefit wildlife and wildlife habitat conservation, training and education, including species that are not hunted or fished; and WHEREAS, the Citizen Potawatomi Nation Eagle Aviary is proposing to increase the infrastructure support for the Eagle Aviary to include 2 small isolation side mews, a pond and multipurpose shop building as well as to partner with U.S. Fish and Wildlife Service (USFWS) to develop and implement training tools which will better assist other tribes who have been referred by USFWS to the CPN Eagle Aviary for training purposes; and RESOLUTION # 13-14-NR PAGE # 2 CITIZEN POTAWATOMI NATION WHEREAS, the estimated cost of the proposed two year project is $290,000, of which $200,000 for salary, equipment, construction of an Aviary multipurpose building, 2 isolation side mews, and training and travel, is the Federal share. The Tribal match of up to $90,000 includes in-kind salary and fringe match for two years. NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN POTAWATOMI NATION that a resolution authorizing the submission of the fy 2013 Eagle Aviary Infrastructure Improvement Tribal Wildlife grant application to the U.S. Fish and Wildlife Service IS HEREBY APPROVED. Barrett Tribal Chairman CITIZEN POTAWATOMI NATION RESOLUTION # 13-21-NR A RESOLUTION APPROVING A FEE-TO-TRUST ACQUISITION APPLICATION TO THE BUREAU OF INDIAN AFFAIRS AND REQUEST FOR TRUST ACQUISITION OF THE (NON-GAMING/ON RESERVATION) PEGGY PECORE PROPERTY WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of American Indians with Constitutional authority under the Act of June 18, 1934 and the Oklahoma Indian Welfare Act of June 26, 1936, (49 Stat. 1967); and WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in Tribal tradition, derived from a history of organized self- government since time immemorial, and recognized by treaties with the United States and in the Constitution of the United States; and WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution provides for a separation of powers of the Tribal government by the reservation and delegation of specific powers to other entities of the Tribal government; and, except for these specific limitations, all other general powers of government are embodied in the Legislature's authority "to enact legislation, transact business, and otherwise speak and act on behalf of the Citizen Potawatomi Nation in all matters on which the Nation is empowered to act now or in the future"; and WHEREAS, the Citizen Potawatomi Nation is making application to the Southern Plains Regional Office of the Bureau of Indian Affairs to request transfer of "fee-simple" title to the "United States of America in Trust for the Citizen Potawatomi Nation''; and RESOLUTION # 13-21-NR PAGE # 2 CITIZEN POTAWATOMI NATION WHEREAS, the Legislature believes that increasing the tribal land base furthers the pursuit of Tribal Self Determination and allows future generations of tribal leaders to have the flexibility to use the land for the health, welfare, and sovereignty of the Citizen Potawatomi Nation; and WHEREAS, Section 5 of the Indian Reorganization Act of June 18, 1934 (48 Stat. 985; 25 USC 465) provides authority for the Fee-to-Trust acquisition; and WHEREAS, the property is ON-reservation or within the former reservation boundaries of the Citizen Potawatomi Nation, legally described in Attachment A; and listed in the Pottawatomie County Treasurer's records as parcel ID # 0000-25-010-003-0-009-00 and parcel ID # 0000-25-010-003-0-013-00 (Peggy Pecore tract); and WHEREAS, the property was purchased with tribal funds for NON-gaming use; and the Citizen Potawatomi Nation owns the surface rights to the property in fee simple; and the land is currently not under lease; and WHEREAS, the current land use is residential and the proposed land use is residential and is necessary to facilitate tribal self determination; and WHEREAS, there are improvements and the property has ingress and egress for adequate traffic services; and WHEREAS, the Citizen Potawatomi Nation agrees to indemnify and hold harmless the United States, its agents and employees, against any lawsuits, loss, expense, and claim potentially filed against the tribe for any damages relating to asbestos and lead-based paint, if any, associated with the improvements located on the property described in Attachment A; and NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN POTAWATOMI NATION that a resolution supporting the Fee-to-Trust acquisition application to the Southern Plains Regional Office of the Bureau of Indian Affairs and trust acquisition of the Peggy Pecore Property, IS HEREBY APPROVED. Barrett Tribal Chairman CITIZEN POTAWATOMI NATION RESOLUTION # 13-22-NR A RESOLUTION APPROVING A FEE-TO-TRUST ACQUISITION APPLICATION TO THE BUREAU OF INDIAN AFFAIRS AND REQUEST FOR TRUST ACQUISITION OF THE (NON-GAMING/ON RESERVATION) BILLY BLACK PROPERTY WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of American Indians with Constitutional authority under the Act of June 18, 1934 and the Oklahoma Indian Welfare Act of June 26, 1936, (49 Stat. 1967); and WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in Tribal tradition, derived from a history of organized self- government since time immemorial, and recognized by treaties with the United States and in the Constitution of the United States; and WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution provides for a separation of powers of the Tribal government by the reservation and delegation of specific powers to other entities of the Tribal government; and, except for these specific limitations, all other general powers of government are embodied in the Legislature's authority "to enact legislation, transact business, and otherwise speak and act on behalf of the Citizen Potawatomi Nation in all matters on which the Nation is empowered to act now or in the future"; and WHEREAS, the Citizen Potawatomi Nation is making application to the Southern Plains Regional Office of the Bureau of Indian Affairs to request transfer of "fee-simple" title to the "United States of America in Trust for the Citizen Potawatomi Nation''; and RESOLUTION # 13-22-NR PAGE # 2 CITIZEN POTAWATOMI NATION WHEREAS, the Legislature believes that increasing the tribal land base furthers the pursuit of Tribal Self Determination and allows future generations of tribal leaders to have the flexibility to use the land for the health, welfare, and sovereignty of the Citizen Potawatomi Nation; and WHEREAS, Section 5 of the Indian Reorganization Act of June 18, 1934 (48 Stat. 985; 25 USC 465) provides authority for the Fee-to-Trust acquisition; and WHEREAS, the property is ON-reservation or within the former reservation boundaries of the Citizen Potawatomi Nation, legally described in Attachment A; and listed in the Pottawatomie County Treasurer's records as parcel ID # 4215-00-041-013-0-000-00 (Billy Black tract); and WHEREAS, the property was purchased with tribal funds for NON-gaming use; and WHEREAS, the Citizen Potawatomi Nation owns the surface rights to the property in fee simple and the land is currently not under lease; and WHEREAS, the current land use is residential and the proposed land use is residential and is necessary to facilitate tribal self determination; and WHEREAS, there are improvements and the property has ingress and egress for adequate traffic services; and WHEREAS, the Citizen Potawatomi Nation agrees to indemnify and hold harmless the United States, its agents and employees, against any lawsuits, loss, expense, and claim potentially filed against the tribe for any damages relating to asbestos and lead-based paint, if any, associated with the improvements located on the property described in Attachment A; and NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN POTAWATOMI NATION that a resolution supporting the Fee-to-Trust acquisition application to the Southern Plains Regional Office of the Bureau of Indian Affairs and trust acquisition of the Billy Black Property, IS HEREBY APPROVED. Barrett Tribal Chairman CITIZEN POTAWATOMI NATION RESOLUTION # 13-29-Ed A RESOLUTION AUTHORIZING THE CITIZEN POTAWATOMI NATION'S PROPOSED EMPLOYMENT & TRAINING BUILDING APPLICATION FOR FUNDING THROUGH THE UNITED STATES DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT UNDER THE FISCAL YEAR 2013 INDIAN COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of American Indians with Constitutional authority under the Act of June 18, 1934 and the Oklahoma Indian Welfare Act of June 26, 1936, (49 Stat. 1967); and WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in Tribal tradition, derived from a history of organized self- government since time immemorial, and recognized by treaties with the United States and in the Constitution of the United States; and WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution provides for a separation of powers of the Tribal government by the reservation and delegation of specific powers to other entities of the Tribal government; and, except for these specific limitations, all other general powers of government are embodied in the Legislature's authority "to enact legislation, transact business, and otherwise speak and act on behalf of the Citizen Potawatomi Nation in all matters on which the Nation is empowered to act now or in the future"; and WHEREAS, the United States Department of Housing and Urban Development (HUD) is soliciting grant applications of up to $800,000 through the Fiscal Year 2013 Indian Community Development Block Grant (ICDBG) program; and WHEREAS, the Citizen Potawatomi Nation is proposing the construction of a new CPN Employment & Training building in Shawnee, Oklahoma under Public Facilities and Improvement Projects; and RESOLUTION # 13-29-Ed PAGE # 2 CITIZEN POTAWATOMI NATION WHEREAS, the Employment & Training Facility will meet an essential community need by improving the current public facility that provides community assistance to low-to-moderate income beneficiaries; and WHEREAS, a public meeting notice was published and held in 2011, another public meeting notice will be published and held in 2013 to solicit comments from Tribal and community members regarding the proposed resubmission of the community development project pursuant to citizen participation requirements as set forth in 24 CFR 1003.604; and WHEREAS, the Employment & Training Building will be constructed following applicable standards and guidelines from the Building Officials and Code Administrators (BOCA), Life and Safety Codes, and Americans with Disabilities Act (ADA); and WHEREAS, the project period for the proposed Employment & Training Building construction project is 2 years, with a total project cost of $1,070,000 of which $800,000 (or 75%) is the Federal share, and $270,000 (or 25%) is Tribal leverage; and WHEREAS, the Citizen Potawatomi Nation has adopted an operation and maintenance plan and commits the necessary funding as referenced within the Letter of Commitment provided by the Employment & Training program for facility upkeep; and WHEREAS, tribal leverage will consist of $165,000 cash and a parking lot valued at $105,000. NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN POTAWATOMI NATION that a resolution supporting and approving the Citizen Potawatomi Nation's proposed Employment & Training Public Service Facility application for funding through the 2013 ICDBG program IS HEREBY APPROVED. L. 86-121 FOR NEW AND LIKE NEW HOMES OFFERED THROUGH THE U.S. INDIAN HEALTH SERVICE (PROJECT OK 13-E23) WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of American Indians with Constitutional authority under the Act of June 18, 1934 and the Oklahoma Indian Welfare Act of June 26, 1936, (49 Stat. 1967); and WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in Tribal tradition, derived from a history of organized self-government since time immemorial, and recognized by treaties with the United States and in the Constitution of the United States; and WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution provides for a separation of powers of the Tribal government by the reservation and delegation of specific powers to other entities of the Tribal government; and, except for these specific limitations, all other general powers of government are embodied in the Legislature's authority "to enact legislation, transact business, and otherwise speak and act on behalf of the Citizen Potawatomi Nation in all matters on which the Nation is empowered to act now or in the future"; and WHEREAS, the Citizen Potawatomi Nation is submitting a Project Scope entitled "Citizen Potawatomi Scattered Housing" to the U.S. Indian Health Service (IHS) under the office of Environmental Health Sanitation Facilities Construction Branch under the authority of P.L. 86-121 for the construction of sanitation facilities; and WHEREAS, the IHS will provide the funds and the Citizen Potawatomi Nation will design and construct the facilities under the provisions of the Self-Governance Compact that became effective in fiscal year 1998. The total cost to IHS for providing sanitation facilities to 29 eligible homes is $247,000.00; and RESOLUTION # 13-35-HHS PAGE # 2 CITIZEN POTAWATOMI NATION WHEREAS, the Citizen Potawatomi Nation fully supports the entire project for construction of sanitation facilities as provided by the provisions of the Self- Governance Compact with IHS/DHHS that became effective in fiscal year 1998, and the Multi-year Funding Agreement 2012-2016 (MFA) with IHS/DHHS executed by both parties and effective in May 2012 in connection with said compact. WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of American Indians with Constitutional authority under the Act of June 18, 1934 and the Oklahoma Indian Welfare Act of June 26, 1936, (49 Stat. 1967); and WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in Tribal tradition, derived from a history of organized self-government since time immemorial, and recognized by treaties with the United States and in the Constitution of the United States; and WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution provides for a separation of powers of the Tribal government by the reservation and delegation of specific powers to other entities of the Tribal government; and, except for these specific limitations, all other general powers of government are embodied in the Legislature's authority to enact legislation, transact business, and otherwise speak and act on behalf of the Citizen Potawatomi Nation in all matters on which the Nation is empowered to act now or in the future"; and RESOLUTION # 13-38-J&PS PAGE # 2 CITIZEN POTAWATOMI NATION WHEREAS, the Citizen Potawatomi Nation is experiencing an increased need for law enforcement staff and equipment and tribal youth programs; and WHEREAS, the United States Department of Justice's (DOJ) Coordinated Tribal Assistance Solicitation (CTAS) has announced the availability of grant funds to improve Tribal law enforcement and justice systems with the stipulation that these funds are available for a variety of specified purposes as outlined in ten "Purpose Areas"; and WHEREAS, the Citizen Potawatomi Nation is eligible for, and desires to apply for, funding under three of the ten Purpose Areas: Purpose Area 1, "Public Safety and Community Policing;" ; Purpose Area 3, "Justice Systems and Alcohol and Substance Abuse;"; and Purpose Area 9 "Tribal Youth Program" and WHEREAS, under Purpose Area 1, Citizen Potawatomi Nation is proposing the addition of police and police vehicles with equipment and supplies for the Tribal Police department at an estimated cost of no more than $1,000,000 with no match required; and WHEREAS, under Purpose Area 3, the Citizen Potawatomi Nation is proposing to enhance ongoing direct alcohol and substance abuse services provided to tribal youth, at an estimated cost of no more than $750,000 with no match required; and WHEREAS, under Purpose Area 9, the Citizen Potawatomi Nation is proposing to enhance ongoing direct services provided through the tribal youth program, at an estimated cost of no more than $500,000 with no match required and NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN POTAWATOMI NATION that a resolution supporting the Citizen Potawatomi Nation's grant application for funding under the United States Department of Justice's Coordinated Tribal Assistance Solicitation (CTAS) Purpose Areas 1, 3 and 9 as described above, IS HEREBY APPROVED.
