WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of American Indians with Constitutional authority under the Act of June 18, 1934 and the Oklahoma Indian Welfare Act of June 26, 1936, (49 Stat. 1967); and WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in Tribal tradition, derived from a history of organized self-government since time immemorial, and recognized by treaties with the United States and in the Constitution of the United States; and WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution provides for a separation of powers of the Tribal government by the reservation and delegation of specific powers to other entities of the Tribal government; and, except for these specific limitations, all other general powers of government are embodied in the Legislature's authority "to enact legislation, transact business, and otherwise speak and act on behalf of the Citizen Potawatomi Nation in all matters on which the Nation is empowered to act now or in the future"; and WHEREAS, the Citizen Potawatomi Nation administers Department of Health & Human Services, Child Care Development Block Grant, Bureau of Indian Affairs, Adult Vocational Training, Employment Assistance, Community Services Block Grant, General Assistance, and Johnson O'Malley programs as well as the Department of Labor Workforce Investment Act; and WHEREAS, Congress has enacted Public Law 102-477 which allows Tribes to voluntarily consolidate various Employment Training and related programs; and WHEREAS, Public Law 102-477 permits the consolidation of funding received for these programs and allows greater flexibility in the development, coordination and operation of said programs; and RESOLUTION # 17-01-Ed PAGE # 2 CITIZEN POTAWATOMI NATION WHEREAS, funding for the 477 Program is formula driven and appropriated annually by the Federal Agencies (DOL, BIA, and DHHS) and is estimated, based on FY2016 actual funding, to be approximately $4,539,971. NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN POTAWATOMI NATION that a resolution consolidating these Employment and Training and related programs and authorizing them to be administered in accordance with the Nation's 102-477 plan, IS HEREBY APPROVED. WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of American Indians with Constitutional authority under the Act of June 18, 1934 and the Oklahoma Indian Welfare Act of June 26, 1936, (49 Stat. 1967); and WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in Tribal tradition, derived from a history of organized self-government since time immemorial, and recognized by treaties with the United States and in the Constitution of the United States; and WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution provides for a separation of powers of the Tribal government by the reservation and delegation of specific powers to other entities of the Tribal government; and, except for these specific limitations, all other general powers of government are embodied in the Legislature's authority "to enact legislation, transact business, and otherwise speak and act on behalf of the Citizen Potawatomi Nation in all matters on which the Nation is empowered to act now or in the future"; and WHEREAS, domestic violence is a significant societal problem and the incidence of domestic violence is at an all-time high; and WHEREAS, CPN was awarded a five-year grant from Indian Health Service for funding of initiatives for domestic violence prevention in FY2015, for which there is an annual continuation application due May 31 ; and WHEREAS, the program emphasizes practice based community outreach and education programs, including advocacy to provide victims increased access to services in the community, and collaborative interventions between legal and human services resulting in a coordinated response to domestic violence. WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of American Indians with Constitutional authority under the Act of June 18, 1934 and the Oklahoma Indian Welfare Act of June 26, 1936, (49 Stat. 1967); and WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in Tribal tradition, derived from a history of organized self-government since time immemorial, and recognized by treaties with the United States and in the Constitution of the United States; and WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution provides for a separation of powers of the Tribal government by the reservation and delegation of specific powers to other entities of the Tribal government; and, except for these specific limitations, all other general powers of government are embodied in the Legislature's authority "to enact legislation, transact business, and otherwise speak and act on behalf of the Citizen Potawatomi Nation in all matters on which the Nation is empowered to act now or in the future"; and WHEREAS, the Citizen Potawatomi Nation has identified a need for increased law enforcement equipment and a continuation and enhancement of the CPN Reentry and Diversion, and Tribal Youth Programs; and WHEREAS, the United States Department of Justice's (DOJ) Coordinated Tribal Assistance Solicitation (CTAS) has announced the availability of grant funds to improve Tribal law enforcement and justice systems with the stipulation that these funds are available for a variety of specified purposes as outlined in ten "Purpose Areas"; and WHEREAS, the Citizen Potawatomi Nation is eligible for and desires to apply for funding under the three following three-year (four-year for PA9) project Purpose Areas: Purpose Area 1, "Public Safety and Community Policing;" Purpose Area 3, "Justice Systems and Alcohol and Substance Abuse"; and Purpose Area 9, "Tribal Youth"; and WHEREAS, under Purpose Area 1, for the Tribal Police Department, Citizen Potawatomi Nation is proposing the purchase of Automated External Defibrillators and a vehicle/trailer combination for moving equipment to crime scenes as well as crisis response mobile command with an estimated cost of up to $200,000; and RESOLUTION # 17-43-J&PS PAGE # 2 CITIZEN POTAWATOMI NATION WHEREAS, under Purpose Area 3, the Citizen Potawatomi Nation is proposing to continue Reentry and Diversion services and enhance the program with legal assistance services with an estimated cost up to $750,000; and WHEREAS, under Purpose Area 9, the Citizen Potawatomi Nation is proposing to enhance and expand direct services provided by the CPN Tribal Youth Program with an estimated cost up to $350,000; NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN POTAWATOMI NATION that a resolution supporting the Citizen Potawatomi Nation's grant application for funding under the United States Department of Justice's Coordinated Tribal Assistance Solicitation (CTAS) Purpose Areas 1, 3, and 9 as described above, IS HEREBY APPROVED.
