RESOLUTION # 17-01-Ed
A RESOLUTION PURSUANT TO PUBLIC LAW 102-477
REGARDING CONSOLIDATION OF
EMPLOYMENT, TRAINING AND EDUCATION SERVICES.
WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of American
Indians with Constitutional authority under the Act of June 18, 1934 and
the Oklahoma Indian Welfare Act of June 26, 1936, (49 Stat. 1967); and
WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in
Tribal tradition, derived from a history of organized self-government since
time immemorial, and recognized by treaties with the United States and in
the Constitution of the United States; and
WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution provides
for a separation of powers of the Tribal government by the reservation and
delegation of specific powers to other entities of the Tribal government; and,
except for these specific limitations, all other general powers of government
are embodied in the Legislature's authority "to enact legislation, transact
business, and otherwise speak and act on behalf of the Citizen Potawatomi
Nation in all matters on which the Nation is empowered to act now or in the
future"; and
WHEREAS, the Citizen Potawatomi Nation administers Department of Health & Human
Services, Child Care Development Block Grant, Bureau of Indian Affairs,
Adult Vocational Training, Employment Assistance, Community Services
Block Grant, General Assistance, and Johnson O'Malley programs as well
as the Department of Labor Workforce Investment Act; and
WHEREAS, Congress has enacted Public Law 102-477 which allows Tribes to voluntarily
consolidate various Employment Training and related programs; and
WHEREAS, Public Law 102-477 permits the consolidation of funding received for these
programs and allows greater flexibility in the development, coordination
and operation of said programs; and

WHEREAS, funding for the 477 Program is formula driven and appropriated annually
by the Federal Agencies (DOL, BIA, and DHHS) and is estimated, based on
FY2016 actual funding, to be approximately $4,539,971.
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN
POTAWATOMI NATION that a resolution consolidating these Employment and Training
and related programs and authorizing them to be administered in accordance with the
Nation's 102-477 plan, IS HEREBY APPROVED.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that by act of this resolution and
consistent with the separation of powers defined in the Constitution, if awarded, an
appropriation of up to $4,539,971 from the 477 account (or other applicable accounts) for
the implementation, negotiation, operation, enforcement, procurement, settlement, and or
completion of this contract, compact, regulation or agreement by the Tribal Chairman or
his designate IS HEREBY AUTHORIZED.

APPLICATION TO THE OFFICE OF INDIAN ENERGY AND ECONOMIC
DEVELOPMENT UNDER THE DEPARTMENT OF THE INTERIOR'S 'NATIVE
AMERICAN BUSINESS DEVELOPMENT INITIATIVE' GRANT PROGRAM
WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of American

economic development project under the Department of the Interior's Native
American Business Development Institute (NABDl) grant program; and
WHEREAS, enterprise development plays a critical role in creating jobs and generating
income in Indian Country, while also contributing to the national economy;
and

WHEREAS, the NABDI grant program is intended to help tribes create an economic
feasibility study of a potential enterprise, which can help secure investment,
reduce business risk, and assist with project roadmaps; and
WHEREAS, CPN's Iron Horse industrial park is currently in the early stages of
developing business partnerships and would benefit greatly from an
independent evaluation of long-term economic viability;
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN
POTAWATOMI NATION that a resolution supporting the submission of the FY 2016 CPN
Native American Business Development Institute Grant application to the Office of Indian
Energy and Economic Development, IS HEREBY APPROVED.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that by act of this resolution and
consistent with the separation of powers defined in the Constitution, if awarded, an
appropriation up to $165,000 from the FY 2016 Native American Business Development
Institute grant (or other applicable accounts) for the implementation, negotiation,
operation, enforcement, procurement, settlement and/or completion of this contract,
compact, regulation or agreement by the Tribal Chairman or his designate IS HEREBY
AUTHORIZED.

INDUSTRIAL PARK INFRASTRUCTURE APPLICATION FOR FUNDING
THROUGH THE UNITED STATES DEPARTMENT OF COMMERCE, ECONOMIC
DEVELOPMENT ADMINISTRATION.
WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of
American Indians with Constitutional authority under the Act of
June 18, 1934 and the Oklahoma Indian Welfare Act of June 26,
1936, (49 Stat. 1967); and
WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent
in Tribal tradition, derived from a history of organized self-
government since time immemorial, and recognized by treaties with
the United States and in the Constitution of the United States; and
WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution
provides for a separation of powers of the Tribal government by the

Tribal government; and, except for these specific limitations, all

WHEREAS, the Department of Commerce, Economic Development
Administration, is soliciting funding proposals for FY2016 Economic
Development Assistance programs; and
WHEREAS, the Union Pacific Railroad line from McAlester, Oklahoma to
Shawnee, Oklahoma is a key link in the restoration and stimulation
of commerce for the east-west railroad corridor for the State of
Oklahoma and for the Citizen Potawatomi Nation; and

WHEREAS, additional rail line construction is necessary to extend rail to
additional building sites within Iron Horse Industrial Park; and
WHEREAS, the proposed project period is up to two years at a total cost of
$2,000,000 in grant funding from the Economic Development
Administration;
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE
CITIZEN POTAWATOMI NATION that a resolution supporting and approving the
Citizen Potawatomi Nation's Industrial Park Phase III application for funding
through the U.S. Department of Commerce, Economic Development
Administration IS HEREBY APPROVED.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that by act of this resolution
and consistent with the separation of powers defined in the Constitution, if
awarded, an appropriation of $ 2,000,000 from the Industrial Park Phase III EDA
(or other applicable accounts) for the implementation, negotiation, operation,
enforcement, procurement, settlement, and or completion of this contract,
compact, regulation or agreement by the Tribal Chairman or his designate IS
HEREBY AUTHORIZED.

"FY 2017 COMMUNITY SERVICES BLOCK GRANT (CSBG)" APPLICATION TO
THE ADMINISTRATION FOR CHILDREN AND FAMILIES.
WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of
American Indians with Constitutional authority under the Act of
June 18, 1934 and the Oklahoma Indian Welfare Act of June 26,
1936, (49 Stat. 1967); and
WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are
inherent in Tribal tradition, derived from a history of organized self-
government since time immemorial, and recognized by treaties with
the United States and in the Constitution of the United States; and
WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution
provides for a separation of powers of the Tribal government by the
reservation and delegation of specific powers to other entities of the
Tribal government; and, except for these specific limitations, all

WHEREAS, the Citizen Potawatomi Nation P.L. 102-477 Program (Employment
and Training/Social Services) assists low income Native American
households, who are otherwise ineligible for 477 program funds,
with fuel costs through vouchers to FireLake Convenience Store, or
other emergency needs such as utility payments, or medical related
needs; and

WHEREAS, if funded, the Citizen Potawatomi Nation will receive up to
$161,632.00 in a Community Services Block Grant (CSBG) to
deliver such assistance.

CITIZEN POTAWATOMI NATION that a resolution supporting the submission of
the FY 2017 Community Services Block Grant (CSBG) application to the
Administration for Children and Families, IS HEREBY APPROVED.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that by act of this resolution
and consistent with the separation of powers defined in the Constitution, if
awarded, an appropriation up to $161,632 from the FY 2017 CSBG fund (or other
applicable accounts) for the implementation, negotiation, operation, enforcement,
procurement, settlement and/or completion of this contract, compact, regulation or

WHEREAS, energy development undertaken by Native American tribes could play a
critical role in creating jobs and generating income in Indian Country, while
also contributing to the national economy; and
WHEREAS, the TEDC grant program is intended to help tribes:

WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of American

the Oklahoma Indian Welfare Act of June 26, 1936, (49 Stat. 1967); and
WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in
Tribal tradition, derived from a history of organized self-government since
time immemorial, and recognized by treaties with the United States and in
the Constitution of the United States; and
WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution provides
for a separation of powers of the Tribal government by the reservation and
delegation of specific powers to other entities of the Tribal government; and,
except for these specific limitations, all other general powers of government
are embodied in the Legislature's authority "to enact legislation, transact
business, and otherwise speak and act on behalf of the Citizen Potawatomi
Nation in all matters on which the Nation is empowered to act now or in the
future"; and
WHEREAS, substance abuse is a significant societal problem and the incidence of teen
suicide is at an all-time high; and
WHEREAS, the Indian Health Service is soliciting new applications for funding of
behavioral health staff through a competing supplement to existing MSPI
awards; and
WHEREAS, these funds will employ additional behavioral health staff for Native youth at
CPN Behavioral Health Services who will offer counseling and group
sessions on self-control, emotional awareness, communication, social
problem-solving and peer relationships as well as provide suicide
prevention activities.

NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN
POTAWATOMI NATION that a resolution supporting the FY2016 MSPI Competing
Supplement for Behavioral Health Staff IS HEREBY APPROVED.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that by act of this resolution and
consistent with the separation of powers defined in the Constitution, if awarded, an
appropriation of up to $200,000 in IHS competitive funding from the MSPI Competing
Supplement for Behavioral Health Staff account (or other applicable accounts) for the
implementation, negotiation, operation, enforcement, procurement, settlement, and or
completion of this contract, compact, regulation or agreement by the Tribal Chairman or
his designate IS HEREBY AUTHORIZED.

WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of American
Indians with Constitutional authority under the Act of June 18, 1934 and

WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in

WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution provides

WHEREAS, the Citizen Potawatomi Nation has an existing Direct Implementation
Agreement with the Federal Highway Administration (FHWA) to plan for
transportation improvements within the Nation's jurisdiction as afforded
under the Tribal Transportation Program (TTP); and
WHEREAS, funding for the Transportation Improvement Plan is estimated to be
$22,220,000 for FY 2017 through FY 2021; and
WHEREAS, the Chairman has reviewed and prioritized the updated combined FY 2017
through FY 2021 Transportation Improvement Plan which must be
submitted to the FHWA; and

WHEREAS, this Transportation Improvement Plan will be amended by resolution, if
necessary, when new Tribal Transportation Program projects are identified
and/or priorities change.
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN
POTAWATOMI NATION that a resolution accepting the updated combined Fy 2017
through 2021 Tribal Transportation Program Transportation Improvement Plan and
authorizing its continued inclusion in the agreement with FHWA IS HEREBY
APPROVED.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that by act of this resolution and
consistent with the separation of powers defined in the Constitution an appropriation of
approximately $22,220,000 from the Federal Highway Administration account (or other
applicable accounts) for the implementation, negotiation, operation, enforcement,

WHEREAS, the Bureau of Indian Affairs, through the Office of Indian Energy and Economic
Development (lEED), is soliciting grant proposals from Indian tribes for projects to
build tribal capacity for energy resource development under the Department of the
Interior's Tribal Energy Development Capacity (TEDC) grant program; and
WHEREAS, energy development undertaken by Native American tribes could play a critical role
in creating jobs and generating income in Indian Country, while also contributing to
the national economy; and
WHEREAS, the TEDC grant program is intended to help tribes;
1.) determine the current level of a tribe's technical, administrative or
management capacity for identified energy resource development activities;
2.) determine which technical, administrative or management capacities for
tribal energy resource development need enhancement;
3.) determine what processes and/or procedures may be used to eliminate
capacity gaps or obtain the development of energy resources development
capacity (including training and policy/code development);
4.) determine how the processes and/or procedures identified above will be
implemented.

WHEREAS, if awarded, up to $150,000 in grant funds from the Tribal Energy Development
Capacity Program, will be used to conduct an assessment of CPN's current and
future electricity needs, determine the most favorable of several energy development
business structures and establish the required framework to execute that option for
future energy development; and
WHEREAS, the TEDC program delivers funds via P.L. 93-638 contracts; if awarded, CPN will
enter into a P.L. 93-638 contract in order to carry out the project activities described
in the FY 2016 CPN TEDC application.
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN POTAWATOMI NATION
that a resolution supporting the submission of the FY 2016 CPN Tribal Energy Development Capacity contract
proposal to the Office of Indian Energy and Economic Development, IS HEREBY APPROVED.

WHEREAS, the Citizen Potawatomi Nation is a federally recognized tribe of American
Indians with constitutional authority authorized under the Oklahoma Indian
Welfare Act of June 26, 1936, (49 Stat. 1967);
WHEREAS, the Citizen Potawatomi Nation, the largest of the Potawatomi Indian Tribes, has,
through continuation of Potawatomi history of organized self-government since time
immemorial, sovereign powers inherent in Tribal tradition and recognized by
treaties with the United States and in the United States Constitution;
WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution provides for a
separation of powers of the Tribal government by the reservation and delegation of
specific powers to other entities of the Tribal government; and, except for these
specific limitations, all other general powers of government are embodied in the

WHEREAS, the Citizen Potawatomi Nation recognizes the need for developing tribal energy
resources to help alleviate the dependency on foreign energy sources while
advancing Tribal sovereignty through social and economic progress; and
WHEREAS, financial assistance is available from the Department of Energy, under grant
funding opportunity announcement DE-FOA-0001621, to allow the Citizen
Potawatomi Nation to conduct research as a part of the grant program "First Steps
Toward Developing Renewable Energy on Tribal Lands"; and
WHEREAS, the Citizen Potawatomi Nation's proposed renewable energy market viability project
will provide professionally researched data on the production and potential resale
of energy generated from renewable sources on tribal lands; and

of the proposed project, if awarded; and

including, but not limited to, grant administration, professional services,
and unrecovered indirect costs up to $16,667 as documented in the
application budget.

and must be protected; and

WHEREAS, the Citizen Potawatomi Nation is proposing an annual project to
support the operating costs of the CPN Eagle Aviary to be submitted
each year when funds are available; and
WHEREAS, the CPN Eagle Aviary has basic operating needs of about $100,000
per year, to cover the cost of eagle food, veterinary care, and

IMLS award of $50,000 with $39,566 in cost share provided through

to provide care to Native American elders and Native American elder

including congregate and home-delivered meals, information, and

Citizen Potawatomi Nation tribal lands and allotments as well as repair of
lands and fencing that have sustained damage from feral hogs; and

law enforcement and justice systems with the stipulation that these funds are
available for a variety of specified purposes as outlined in ten "Purpose Areas"; and
WHEREAS, the Citizen Potawatomi Nation is eligible for and desires to apply for funding under
the three following three-year (four-year for PA9) project Purpose Areas: Purpose
Area 1, "Public Safety and Community Policing;" Purpose Area 3, "Justice Systems
and Alcohol and Substance Abuse"; and Purpose Area 9, "Tribal Youth"; and
WHEREAS, under Purpose Area 1, for the Tribal Police Department, Citizen Potawatomi Nation
is proposing the purchase of Automated External Defibrillators and a vehicle/trailer
combination for moving equipment to crime scenes as well as crisis response mobile
command with an estimated cost of up to $200,000; and

WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution provides
for a separation of powers of the Tribal government by the reservation and
delegation of specific powers to other entities of the Tribal government; and,

WHEREAS, methamphetamine abuse is a significant societal problem and the incidence
of teen suicide is at an all-time high; and
WHEREAS, CPN was awarded a five-year grant from Indian Health Service for funding of
initiatives for suicide prevention and behavioral issues associated with
methamphetamine use in FY2015, for which there is an annual
continuation application due May 31; and
WHEREAS, CPN was awarded a four-year supplemental grant from Indian Health
Service for funding of behavioral health clinicians for suicide and substance
abuse prevention issues affecting Native youth in FY2016, which will be
awarded through the same continuation application; and

THROUGH THE UNITED STATES DEPARTMENT OF HOUSING AND URBAN
DEVELOPMENT UNDER THE FISCAL YEAR 2017 INDIAN COMMUNITY
DEVELOPMENT BLOCK GRANT PROGRAM.
WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of
American Indians with Constitutional authority under the Act of
June 18, 1934 and the Oklahoma Indian Welfare Act of June 26,
1936, (49 Stat. 1967); and
WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are
inherent in Tribal tradition, derived from a history of organized self-
government since time immemorial, and recognized by treaties with
the United States and in the Constitution of the United States; and
WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution
provides for a separation of powers of the Tribal government by the
reservation and delegation of specific powers to other entities of the
Tribal government; and, except for these specific limitations, all
other general powers of government are embodied in the
Legislature's authority "to enact legislation, transact business, and
otherwise speak and act on behalf of the Citizen Potawatomi Nation
in all matters on which the Nation is empowered to act now or in the
future"; and
WHEREAS, the United States Department of Housing and Urban Development
(HUD) is soliciting grant applications of up to $800,000 through the
Fiscal Year 2017 Indian Community Development Block Grant
(ICDBG) program; and
WHEREAS, the Citizen Potawatomi Nation is proposing a new diagnostic and
specialty care clinic at Citizen Potawatomi Nation Health Services
which will meet an essential community need by expanding the

capacity of CPNHS to provide specialized on-site care to low and
moderate income Native Americans; and
WHEREAS, the project period for the proposed diagnostic and specialty care
clinic under the Public Facilities Program is five years, with a total
project cost of $1,814,984 of which $800,000 (or 44%) is the Federal
share, and $1,014,984 (or 56%) is Tribal leverage.
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE
CITIZEN POTAWATOMI NATION that this resolution represents a Firm
Commitment of leveraging funds for the Citizen Potawatomi Nation's proposed
Public Facility application for funding through the 2017 ICDBG program and IS
HEREBY APPROVED.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that by act of this resolution
and consistent with the separation of powers defined in the Constitution, if
awarded, an appropriation of $1,814,984 from the FY 2017 ICDBG Fund and
other applicable accounts for the implementation, negotiation, operation,
enforcement, procurement, settlement, and or completion of this contract,
compact, regulation or agreement by the Tribal Chairman or his designate IS
HEREBY AUTHORIZED.

capacity of CPNHS to provide specialized on-site care to low and

WHEREAS, the Citizen Potawatomi Nation has adopted an operations and
maintenance plan for the planned diagnostic and specialty care clinic
to be paid from an allocation of tribal third-party funds; and
WHEREAS, annual costs to satisfy the operations and maintenance plan
requirements for this public facility are projected at $121,338; and
WHEREAS, CPN has provided healthcare to the CPN tribal community since
1998 under a self-governance agreement with the Indian Health
Service, which guarantees annual funding, currently 20 million
dollars, for health services provided at CPN, including at the
proposed diagnostic and specialty care clinic.
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE
CITIZEN POTAWATOMI NATION that this resolution represents a Firm
Commitment of funding for the adopted operation and maintenance plan and
provision of services for the Citizen Potawatomi Nation's proposed Public Facility
application for funding through the 2017 ICDBG program and IS HEREBY
APPROVED.

to solicit comments from Tribal and community members regarding the
proposed project; and
WHEREAS, a 20% non-Federal cost share or match of up to $300,000 over the three
year period is required and will be committed; and

WHEREAS, the project period for the proposed Citizen Potawatomi Nation Internship
project is up to three years, with a total project cost not to exceed $500,000
per year of which up to $400,000 is the Federal share, and up to $100,000
is the non-Federal share; and
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN
POTAWATOMI NATION that a resolution authorizing and supporting the Citizen
Potawatomi Nation's Administration for Native Americans application for funding under the
FY 2017 SEDS program IS HEREBY APPROVED.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that by act of this resolution and
consistent with the separation of powers defined in the Constitution, if awarded, an
appropriation of federal funds up to $1,200,000 from the FY17 ANA Social and Economic
Development Strategies Project fund, and an in-kind match of up to $300,000 for the
implementation, negotiation, operation, enforcement, procurement, settlement, and or
completion of this contract, compact, regulation or agreement by the Tribal Chairman or
his designate IS HEREBY AUTHORIZED.

year period is required and will be committed; and
WHEREAS, the project period for the proposed Potawatomi Language Curriculum
Development and Implementation project is three years, with a total project
cost not to exceed $375,000 per year of which up to $300,000 is the
Federal share, and up to $75,000 is the non-Federal share; and

WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in

WHEREAS, the Citizen Potawatomi Nation tribal service area encompasses the children
whose parents reside or work within the boundaries of the declared tribal
service area, being defined as Pottawatomie County, Cleveland County and
Oklahoma County; and

WHEREAS, the Department of Health and Human Services through the Bureau of Indian
Affairs "477 Program" provides grants for the ongoing support of center-
based, voucher and after school program child care services estimated to be
$3,518,200.00 as provided by the CCDF Day Care Funds; and
WHEREAS, the center-based, voucher and after school program will provide Native
American families with quality day care facilities in which to leave their
children.
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN
POTAWATOMI NATION that a resolution authorizing the Citizen Potawatomi Nation's
"Center-based, Voucher and After School Program Child Care Services" application for

WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in

voluntary association of federally recognized Indian Nations whose purpose
is to foster a cooperative relationship among the Tribes and their
representatives in regard to policy development, economic development.
Healthcare, compacting, gaming and taxation; and
WHEREAS, UNIOKT also promotes regulatory standards, methods of operation,
educational seminars and the exchange of information and ideas for the
mutual benefit of all members;

WHEREAS, as a member of UNIOKT, the Citizen Potawatomi Nation will receive all
publications, meeting notices and action alerts on all meetings and
seminars; and
WHEREAS, as the principal elected officials of the Citizen Potawatomi Nation charged
with the day-to-day operations of the Nation, Chairman John A. Barrett
shall be the Delegate and Vice Chairman Linda Capps shall be the Alternate
Delegate to represent the interest of the Citizen Potawatomi Nation. Such
designation shall remain in full force and effect until subsequent notice is
issued.
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN
POTAWATOMI NATION that a resolution approving membership in the United Indian
Nations of Oklahoma, Kansas and Texas; authorizing Chairman John A. Barrett and Vice

WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in
Tribal tradition, derived from a history of organized self-government since
time immemorial, and recognized by treaties with the United States and in
the Constitution of the United States; and
WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution provides
for a separation of powers of the Tribal government by the reservation and
delegation of specific powers to other entities of the Tribal government; and,
except for these specific limitations, all other general powers of government
are embodied in the Legislature's authority "to enact legislation, transact
business, and otherwise speak and act on behalf of the Citizen Potawatomi
Nation in all matters on which the Nation is empowered to act now or in the
future"; and
WHEREAS, the Citizen Potawatomi Nation is submitting a Project Scope entitled
"Citizen Potawatomi Scattered Housing" to the U.S. Indian Health Service
(IHS) under the office of Environmental Health Sanitation Facilities
Construction Branch under the authority of P.L. 86-121 for the
construction of sanitation facilities; and
WHEREAS, the IHS will provide the funds and the Citizen Potawatomi Nation will design
and construct the facilities under the provisions of the Self-Governance
Compact that became effective in fiscal year 1998. The total cost to IHS for
providing sanitation facilities to 29 eligible homes is $310,000.00; and

WHEREAS, the Citizen Potawatomi Nation fully supports the entire project for the
construction of sanitation facilities as provided by the provisions of its Self-

1998, and the Multi-year Funding Agreement 2013-2017 (MFA) with the
IHS/DHHS executed by these parties and effective in May, 2012, in
connection with said compact;
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN
POTAWATOMI NATION, that a resolution supporting an increase in funding offered by the
Indian Health Services for sanitation facilities construction program under P.L. 86-121 for
new and like-new homes IS HEREBY APPROVED.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that by act of this resolution and
consistent with the separation of powers defined in the Constitution, if awarded, an
appropriation of $310,000.00 from the Office of Environmental Health (or other applicable

Titles, and Records Office (LTRO) Program from the Department of Interior,
Bureau of Indian Affairs (BIA), Southern Plains Regional Office under the
authority of Title IV of Public Law 93-638 as amended, and

tribe must have their dues paid and a delegate appointed by Resolution in
order to vote on caucus issues and elections at the Annual Symposium;
