RESOLUTION # 18-01-HHS
A RESOLUTION APPROVING THE SUBMISSION OF THE
"FY 2018 COMMUNITY SERVICES BLOCK GRANT (CSBG)" GRANT
APPLICATION TO THE ADMINISTRATION FOR CHILDREN AND FAMILIES.
WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of
American Indians with Constitutional authority under the Act of
June 18, 1934 and the Oklahoma Indian Welfare Act of June 26,
1936, (49 Stat. 1967); and
WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are
inherent in Tribal tradition, derived from a history of organized self-
government since time immemorial, and recognized by treaties with
the United States and in the Constitution of the United States; and
WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution
provides for a separation of powers of the Tribal government by the
reservation and delegation of specific powers to other entities of the
Tribal government; and, except for these specific limitations, all
other general powers of government are embodied in the
Legislature's authority "to enact legislation, transact business, and
otherwise speak and act on behalf of the Citizen Potawatomi Nation
in all matters on which the Nation is empowered to act now or in the
future"; and
WHEREAS, the Citizen Potawatomi Nation P.L. 102-477 Program (Employment
and Training/Social Services) assists low income Native American
households, who are otherwise ineligible for 477 program funds,
with fuel costs through vouchers to FireLake Convenience store, or
other emergency needs such as utility payments, or medical related
needs; and

WHEREAS, if funded, the Citizen Potawatomi Nation will receive an estimated
$157,000 in a Community Services Block Grant (CSBG) to deliver
such assistance.
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE
CITIZEN POTAWATOMI NATION that a resolution supporting the submission of
the FY 2018 Community Services Block Grant (CSBG) application to the
Administration for Children and Families, IS HEREBY APPROVED.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that by act of this resolution
and consistent with the separation of powers defined in the Constitution, if
awarded, an appropriation of $157,000.00 from the FY18 CSBG fund (or other
applicable accounts) for the implementation, negotiation, operation, enforcement,
procurement, settlement, and or completion of this contract, compact, regulation
or agreement by the Tribal Chairman or his designate IS HEREBY AUTHORIZED.

the FY 2018 Lower Income and Energy Assistance Program (LIHEAP) grant
application to the Administration for Children and Families, IS HEREBY

WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of
American Indians with Constitutional authority under the Act of
June 18, 1934 and the Oklahoma Indian Welfare Act of June 26,
1936, (49 Stat. 1967); and
WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are
inherent in Tribal tradition, derived from a history of organized self-
government since time immemorial, and recognized by treaties with
the United States and in the Constitution of the United States; and
WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution
provides for a separation of powers of the Tribal government by the
reservation and delegation of specific powers to other entities of the
Tribal government; and, except for these specific limitations, all
other general powers of government are embodied in the
Legislature's authority "to enact legislation, transact business, and

WHEREAS, the Citizen Potawatomi Nation desires to enter into an agreement
with the Indian Health Service for the twenty-first year to continue its
Special Diabetes Program grant of approximately $1,092,387; and

WHEREAS, in 2018, the Citizen Potawatomi Nation proposes to continue the
Diabetic Program aimed at diabetic prevention and education
including primary, secondary, and tertiary diabetic services for the
Native American community; and
WHEREAS, the Citizen Potawatomi Nation is not required to provide matching or
in-kind donations to receive the funds;
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE
CITIZEN POTAWATOMI NATION, that a resolution supporting the "Citizen
Potawatomi Nation's 2018 Diabetes Grant - Year 21" proposal to the Indian Health
Service under the Special Diabetes Program for Indians, IS HEREBY APPROVED.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that by act of this resolution
and consistent with the separation of powers defined in the Constitution, if
awarded, an appropriation up to $1,092,387 from the Indian Health Service fund

(NON-GAMING/ON RESERVATION) HOLLIS PROPERTY.
WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of American
Indians with Constitutional authority under the Act of June 18, 1934 and
the Oklahoma Indian Welfare Act of June 26, 1936, (49 Stat. 1967); and
WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in
Tribal tradition, derived from a history of organized self-government since
time immemorial, and recognized by treaties with the United States and in
the Constitution of the United States; and
WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution provides
for a separation of powers of the Tribal government by the reservation and
delegation of specific powers to other entities of the Tribal government; and,
except for these specific limitations, all other general powers of government
are embodied in the Legislature's authority "to enact legislation, transact
business, and otherwise speak and act on behalf of the Citizen Potawatomi
Nation in all matters on which the Nation is empowered to act now or in the
future"; and
WHEREAS, the Citizen Potawatomi Nation is making application to the Southern Plains
Regional Office of the Bureau of Indian Affairs to request transfer of "fee-
simple" title to the "United States of America in Trust for the Citizen
Potawatomi Nation"; and
WHEREAS, Section 5 of the Indian Reorganization Act of June 18, 1934 (48 Stat. 985;
25 USC 465) provides authority for the Fee-to-Trust acquisition; and
WHEREAS, the property is ON-reservation or within the former reservation boundaries
of the Citizen Potawatomi Nation and legally described in Attachment A; and
listed in the Pottawatomie County Treasurer's records as parcel ID #0000-
01-009-003-0-027-00 (Hollis property) and

WHEREAS, the Legislature believes that increasing the tribal land base furthers the
pursuit of Tribal Self Determination and allows future generations of tribal
leaders to have the flexibility to use the land for the health, welfare, and
sovereignty of the Citizen Potawatomi Nation; and
WHEREAS, the Citizen Potawatomi Nation owns the surface rights to the property in fee
simple and the land is currently not under lease; and
WHEREAS, the property was purchased with tribal funds for NON-gaming or gaming-
related use; there are improvements with ingress and egress adequate for
traffic and services; and
WHEREAS, the current and proposed land use is for residential purposes;
WHEREAS, the Citizen Potawatomi Nation agrees to indemnify and hold harmless the
United States, its agents and employees, against any lawsuits, loss, expense,
and claim potentially filed against the tribe for any damages relating to
asbestos and lead-based paint, if any, associated with the improvements
located on the property described in Attachment A;
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN
POTAWATOMI NATION that a resolution supporting the Fee-to-Trust acquisition
application to the Southern Plains Regional Office of the Bureau of Indian Affairs and trust
acquisition of the Hollis Property, IS HEREBY APPROVED.

WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in

time immemorial, and recognized by treaties with the United States and in
the Constitution of the United States; and
WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution provides

support the building, sustainment, and delivery of core capabilities to
enable Tribes to strengthen their capacity to prevent, protect against,

WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution
provides for a separation of powers of the Tribal government by the
reservation and delegation of specific powers to other entities of the
Tribal government; and, except for these specific limitations, all
other general powers of government are embodied in the
Legislature's authority "to enact legislation, transact business, and
otherwise speak and act on behalf of the Citizen Potawatomi Nation
in all matters on which the Nation is empowered to act now or in the
future"; and
WHEREAS, the Economic Development Administration, through the Department
of Commerce, is soliciting grant proposals from Indian tribes for
projects to create an economic development strategy for their
enterprises under the Planning and Local Technical Assistance
(PLTA) grant program; and

WHEREAS, the PLTA grant program is intended to help tribes and other local
governments create comprehensive economic development strategies
that may lead to the creation of economic development districts in
later project phases; and

potential benefits of creating a standalone economic development
district for CPN; and
WHEREAS, there is a 50% non-Federal cost share requirement required by the
Citizen Potawatomi Nation, which will be satisfied through in-kind
donations to the total project cost in an amount no greater than
$80,000.
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE

interest per annum, for the purpose of meeting the Agreement to provide
the USDA Community Facilities Relending Program with an irrevocable
letter of credit (or similar instrument such as a cash collateral account or a
Performance Guarantee) acceptable to the Agency in the minimum amount
equal to the principal and interest installments due during the first 5 years
of the loan;

WHEREAS, Citizen Potawatomi Nation guarantees repayment of 100% of all principal

defined in the Loan Agreement.

mitigate, respond to, and recover from potential terrorist attacks and other
hazards; and

Central Oklahoma Emergency Communications Network (ECOECN), which

WHEREAS, expansion of the ECOECN will further enhance communication capabilities
sufficient to permit federal agencies to mobilize a Command, Control and
Communications post to coordinate a response in disaster events with
tribal, city and state emergency responders; and
WHEREAS, there is no non-Federal cash cost-share required by the Citizen Potawatomi
Nation
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN

During 2007-2009, the suicide rate for American Indians and Alaska
Natives was 1.6 times greater than the U.S. all-races rate; and
WHEREAS, the Zero Suicide program focuses on developing a system-wide approach to
improving care for individuals at risk of suicide who are currently utilizing
health and behavioral health systems. This award will support
implementation of the Zero Suicide model in order to raise awareness of
suicide, establish integrated system of care, and improve outcomes for such
individuals.
WHEREAS, the project period for the proposed Citizen Potawatomi Nation IHS Zero
Suicide Program project is up to three years, with a total project cost not to
exceed $400,000 per year with no matching funds required; and

equipment and a continuation and enhancement of the CPN Tribal Court; and
WHEREAS, the U.S. Department of Justice's (DOJ) Coordinated Tribal Assistance Solicitation
(CTAS) has announced the availability of grant funds to improve Tribal law enforcement
and justice systems with the stipulation that these funds are available for a variety of
specified purposes as outlined in ten "Purpose Areas"; and
WHEREAS, the Citizen Potawatomi Nation is eligible for and desires to apply for funding under the
two following three-year project Purpose Areas: Purpose Area 1, "Public Safety and
Community Policing;" Purpose Area 3, and "Tribal Justice Systems"; and

services provided by the CPN with a focus on court database software and legal

(RT 8151), Bridge 09619 (RT 9035) and Bridge 21178 (RT 8175) and request funds be
allocated to prepare plans, specifications, estimates (PS&E) and environmental
assessment for these projects from the Tribal Transportation Program Bridge Funding;
and
WHEREAS, the Citizen Potawatomi Nation has a Tribal Transportation Program Agreement with the
Federal Highway Administration and is authorized under this Agreement to complete
design and environmental assessment projects. The Nation also has a Direct
Implementation Agreement with the Federal Highway Administration to plan for
transportation improvements within the Nation's jurisdiction as afforded under the Tribal
Transportation Program; and

Citizen Potawatomi Nation to deploy community-scale energy generating systems
on Tribal Lands (DOE Topic Area 2); and

WHEREAS, the Citizen Potawatomi Nation's proposed project will install 4MW of distributed
generation powered by natural gas in order to offset rising energy costs, taking

year period of which $987,252 is the Federal share, and $987,252 is the non-
Federal share. The cost share via cash and in-kind services includes, but is not
limited to, equipment, installation, personnel, oversight of negotiations and
purchases, indirect costs and office supplies; and
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN

WHEREAS, the surface rights were purchased in fee simple with tribal funds for NON-gaming
use; and
WHEREAS, there are no improvements and the property has ingress and egress for adequate
traffic service; and

land use is agriculture and is necessary to facilitate tribal self-determination and
agriculture.

fiscal year 1998. The total cost to IHS for providing sanitation facilities to 50 eligible

strengthen their capacity to prevent, protect against, mitigate, respond to, and
recover from potential terrorist attacks and other hazards; and
WHEREAS, the CPN proposes to develop and implement phase three of the East-Central
Oklahoma Emergency Communications Network (ECOECN), which will allow
the CPN Police Department to collaborate with CPN Emergency Management to
develop a communications network and provide reliable communications capacity
to a consortium of local agencies; and

July 25, 2007 to assume historic preservation duties on Tribal lands that were previously
the responsibility of the State; and
WHEREAS, this will be the eleventh year for implementation of the Tribal Historic Preservation Office
whose duties include Section 106 review and compliance, survey and inventory of tribal
lands, and public education of historic preservation.

NOW, THEREFORE, BE IT FURTHER RESOLVED, that by act of this resolution and consistent with
the separation of powers defined in the Constitution, if awarded, an appropriation of approximately
$58,248 in Federal funds from the Tribal Historic Preservation Office Fund for the implementation,
negotiation, operation, enforcement, procurement, settlement, and or completion of this contract,
compact, regulation or agreement by the Tribal Chairman or his designate IS HEREBY AUTHORIZED.
CERTIFICATION
The Legislature of the Citizen Potawatomi Nation hereby certifies that the above is a true and
exact copy of Resolution POTT # 18-61-TC&A, as approved on the 31st day of May, 2018
with 16 voting for, 0 opposed, 0 absent and 0 abstaining.
