WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of American Indians with Constitutional authority under the Act of June 18, 1934 and the Oklahoma Indian Welfare Act of June 26, 1936, (49 Stat. 1967); and WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in Tribal tradition, derived from a history of organized self- government since time immemorial, and recognized by treaties with the United States and in the Constitution of the United States; and WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution provides for a separation of powers of the Tribal government by the reservation and delegation of specific powers to other entities of the Tribal government; and, except for these specific limitations, all other general powers of government are embodied in the Legislature's authority "to enact legislation, transact business, and otherwise speak and act on behalf of the Citizen Potawatomi Nation in all matters on which the Nation is empowered to act now or in the future"; and WHEREAS, the Citizen Potawatomi Nation P.L. 102-477 Program (Employment and Training/Social Services) assists low income Native American households, who are otherwise ineligible for 477 program funds, with fuel costs through vouchers to FireLake Convenience store, or other emergency needs such as utility payments, or medical related needs; and RESOLUTION # 18-01-HHS PAGE # 2 CITIZEN POTAWATOMI NATION WHEREAS, if funded, the Citizen Potawatomi Nation will receive an estimated $157,000 in a Community Services Block Grant (CSBG) to deliver such assistance. WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of American Indians with Constitutional authority under the Act of June 18, 1934 and the Oklahoma Indian Welfare Act of June 26, 1936, (49 Stat. 1967); and WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in Tribal tradition, derived from a history of organized self-government since time immemorial, and recognized by treaties with the United States and in the Constitution of the United States; and WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution provides for a separation of powers of the Tribal government by the reservation and delegation of specific powers to other entities of the Tribal government; and, except for these specific limitations, all other general powers of government are embodied in the Legislature's authority "to enact legislation, transact business, and otherwise speak and act on behalf of the Citizen Potawatomi Nation in all matters on which the Nation is empowered to act now or in the future"; and WHEREAS, the Citizen Potawatomi Nation is making application to the Southern Plains Regional Office of the Bureau of Indian Affairs to request transfer of "fee- simple" title to the "United States of America in Trust for the Citizen Potawatomi Nation"; and WHEREAS, Section 5 of the Indian Reorganization Act of June 18, 1934 (48 Stat. 985; 25 USC 465) provides authority for the Fee-to-Trust acquisition; and WHEREAS, the property is ON-reservation or within the former reservation boundaries of the Citizen Potawatomi Nation and legally described in Attachment A; and listed in the Pottawatomie County Treasurer's records as parcel ID #0000- 01-009-003-0-027-00 (Hollis property) and RESOLUTION # 18-04-NR PAGE # 2 CITIZEN POTAWATOMI NATION WHEREAS, the Legislature believes that increasing the tribal land base furthers the pursuit of Tribal Self Determination and allows future generations of tribal leaders to have the flexibility to use the land for the health, welfare, and sovereignty of the Citizen Potawatomi Nation; and WHEREAS, the Citizen Potawatomi Nation owns the surface rights to the property in fee simple and the land is currently not under lease; and WHEREAS, the property was purchased with tribal funds for NON-gaming or gaming- related use; there are improvements with ingress and egress adequate for traffic and services; and WHEREAS, the current and proposed land use is for residential purposes; WHEREAS, the Citizen Potawatomi Nation agrees to indemnify and hold harmless the United States, its agents and employees, against any lawsuits, loss, expense, and claim potentially filed against the tribe for any damages relating to asbestos and lead-based paint, if any, associated with the improvements located on the property described in Attachment A; NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN POTAWATOMI NATION that a resolution supporting the Fee-to-Trust acquisition application to the Southern Plains Regional Office of the Bureau of Indian Affairs and trust acquisition of the Hollis Property, IS HEREBY APPROVED. WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of American Indians with Constitutional authority under the Act of June 18, 1934 and the Oklahoma Indian Welfare Act of June 26, 1936, (49 Stat. 1967); and WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in Tribal tradition, derived from a history of organized self-government since time immemorial, and recognized by treaties with the United States and in the Constitution of the United States; and WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution provides for a separation of powers of the Tribal government by the reservation and delegation of specific powers to other entities of the Tribal government; and, except for these specific limitations, all other general powers of government are embodied in the Legislature's authority "to enact legislation, transact business, and otherwise speak and act on behalf of the Citizen Potawatomi Nation in all matters on which the Nation is empowered to act now or in the future"; and WHEREAS, the Department of Homeland Security (DHS) and Federal Emergency Management Association (FEMA), through their Tribal Homeland Security Grant Program, have announced availability of Fiscal Year 2017 funds to support the building, sustainment, and delivery of core capabilities to enable Tribes to strengthen their capacity to prevent, protect against, mitigate, respond to, and recover from potential terrorist attacks and other hazards; and WHEREAS, CPN proposes to develop and implement phase two of the East-Central Oklahoma Emergency Communications Network (ECOECN), which will allow the CPN Police and Fire Departments to collaborate with CPN RESOLUTION # 18-05-J&PS PAGE # 2 CITIZEN POTAWATOMI NATION Emergency Management to develop a communications network and provide reliable communications capacity to a consortium of local agencies; and WHEREAS, expansion of the ECOECN will further enhance communication capabilities sufficient to permit federal agencies to effectively mobilize a Command, Control and Communications post to coordinate a response in disaster events with tribal, city, county and state emergency responders; and WHEREAS, there is no non-Federal cash cost share requirement required by the Citizen Potawatomi Nation. WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of American Indians with Constitutional authority under the Act of June 18, 1934 and the Oklahoma Indian Welfare Act of June 26, 1936, (49 Stat. 1967); and WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in Tribal tradition, derived from a history of organized self- government since time immemorial, and recognized by treaties with the United States and in the Constitution of the United States; and WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution provides for a separation of powers of the Tribal government by the reservation and delegation of specific powers to other entities of the Tribal government; and, except for these specific limitations, all other general powers of government are embodied in the Legislature's authority "to enact legislation, transact business, and otherwise speak and act on behalf of the Citizen Potawatomi Nation in all matters on which the Nation is empowered to act now or in the future"; and WHEREAS, the Bureau of Indian Affairs is holding approximately $14,581.65 in funds in account PL#7476705 on behalf of the Citizen Potawatomi Nation; and WHEREAS, these funds are separate and distinct from the trust fund/judgment monies previously withdrawn from BIA management; and WHEREAS, the Citizen Potawatomi Nation is hereby requesting disbursement of the funds to be utilized by the Nation for trust property management. The future land use is agricultural and is necessary to facilitate tribal self-determination and agriculture. WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of American Indians with Constitutional authority under the Act of June 18, 1934 and the Oklahoma Indian Welfare Act of June 26, 1936, (49 Stat. 1967); and WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in Tribal tradition, derived from a history of organized self-government since time immemorial, and recognized by treaties with the United States and in the Constitution of the United States; and WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution provides for a separation of powers of the Tribal government by the reservation and delegation of specific powers to other entities of the Tribal government; and, except for these specific limitations, all other general powers of government are embodied in the Legislature's authority "to enact legislation, transact business, and otherwise speak and act on behalf of the Citizen Potawatomi Nation in all matters on which the Nation is empowered to act now or in the future"; and WHEREAS, death by suicide has been steadily increasing over the past fifteen years. During 2007-2009, the suicide rate for American Indians and Alaska Natives was 1.6 times greater than the U.S. all-races rate; and WHEREAS, the Zero Suicide program focuses on developing a system-wide approach to improving care for individuals at risk of suicide who are currently utilizing health and behavioral health systems. This award will support implementation of the Zero Suicide model in order to raise awareness of suicide, establish integrated system of care, and improve outcomes for such individuals. WHEREAS, the project period for the proposed Citizen Potawatomi Nation IHS Zero Suicide Program project is up to three years, with a total project cost not to exceed $400,000 per year with no matching funds required; and RESOLUTION # 18-33-HHS PAGE # 2 CITIZEN POTAWATOMI NATION NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN POTAWATOMI NATION that a resolution supporting the Zero Suicide Program funding request to the Indian Health Service IS HEREBY APPROVED. The future land use is residential and is necessary to facilitate tribal self- determination and residential.
