A RESOLUTION APPROVING THE CITIZEN POTAWATOMI NATION'S
APPLICATION FOR FUNDING UNDER THE BUREAU OF INDIAN AFFAIRS'
(BIA) OFFICE OF INDIAN ENERGY AND ECONOMIC DEVELOPMENT'S
LIVING LANGUAGES GRANT PROGRAM.
WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of American
Indians with Constitutional authority under the Act of June 18, 1934 and
the Oklahoma Indian Welfare Act of June 26, 1936, (49 Stat. 1967); and
WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in
Tribal tradition, derived from a history of organized self-government since
time immemorial, and recognized by treaties with the United States and in
the Constitution of the United States; and
WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution provides
for a separation of powers of the Tribal government by the reservation and
delegation of specific powers to other entities of the Tribal government;
and, except for these specific limitations, all other general powers of
government are embodied in the Legislature's authority "to enact
legislation, transact business, and otherwise speak and act on behalf of the
Citizen Potawatomi Nation in all matters on which the Nation is empowered
to act now or in the future"; and
WHEREAS, CPN has a need for funding to support its language learning through
creating, illustrating and publishing children's books in Potawatomi to
achieve Potawatomi language education among school-age children; and,
WHEREAS, the Department of the Interior, Bureau of Indian Affairs is offering grants
for Tribes to fund Native language instruction and immersion programs up
to $200,000 with no tribal match required.

NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE
CITIZEN POTAWATOMI NATION that a resolution authorizing the Citizen
Potawatomi Nation's application for funding through the Bureau of Indian Affairs, Office
of Indian Energy and Economic Development's Living Language Grant Program IS
HEREBY APPROVED.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that by act of this resolution
and consistent with the separation of powers defined in the Constitution, if awarded, an
appropriation of federal funds up to $200,000 from the BIA Office of Indian Energy and
Economic Development Living Language Grant Program Fund for the implementation,
negotiation, operation, enforcement, procurement, settlement, and or completion of this
contract, compact, regulation or agreement by the Tribal Chairman or his designate IS
HEREBY AUTHORIZED.

A RESOLUTION APPROVING THE RESCHEDULING OF THE QUARTERLY
MEETING OF THE LEGISLATURE FROM
THURSDAY, AUGUST 27 TO TUESDAY, SEPTEMBER 15, 2020.
WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of
American Indians with Constitutional authority under the Act of June 18,
1934 and the Oklahoma Indian Welfare Act of June 26, 1936, (49 Stat.
1967); and
WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in
Tribal tradition, derived from a history of organized self-government since
time immemorial, and recognized by treaties with the United States and in
the Constitution of the United States; and
WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution

WHEREAS, in order to allow sufficient time to review and analyze the proposed
budgets for fy 2021 it is necessary to reschedule the summer quarterly
meeting of the tribal legislature.
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE
CITIZEN POTAWATOMI NATION, that a resolution rescheduling the summer
quarterly meeting of the Legislature from Thursday, August 27, 2019, to Tuesday,
September 15, 2020, IS HEREBY APPROVED.

WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution provides for a

limitations, all other general powers of government are embodied in the Legislature's

WHEREAS, the Citizen Potawatomi Nation is a Member of the Indian Government in Good Standing
of the National Congress of American Indians and meets all requirements for Tribal
membership, pursuant to Article II, Section IIA of the Constitution of the National
Congress of American Indians (NCAI); and
WHEREAS, based on the tribal citizenry, the Nation shall have 180 votes according to Article II,
Section 6C of the NCAI Constitution and By-Laws;

to become individual members in Good Standing in NCAI in order to fulfill their responsibilities as Official Delegates

FOR THE CITIZEN POTAWATOMI NATION

WHEREAS, the National Indian Gaming Association (NIGA) is a voluntary association of
Tribal Gaming entities representing federally recognized tribal governments
involved in gaming enterprises in Indian Country whose purpose is to promote a
cooperative relationship among the Tribes and their representatives; and
WHEREAS, NIGA also promotes regulatory standards, methods of operation, educational
seminars and the exchange of information and ideas for the mutual benefit of all
members and acts as a gaming regulatory advisory group; and

WHEREAS, as a member of NIGA, the Citizen Potawatomi Nation will receive all
publications, meeting notices and action alerts and discounted registration fees on
all meetings and seminars.
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN
POTAWATOMI NATION that a resolution approving membership in the National Indian
Gaming Association and authorizing payment of membership dues IS HEREBY APPROVED.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that by act of this resolution and
consistent with the separation of powers defined in the Constitution, an appropriation of $7,500
from the FireLake Entertainment Center and $17,500 from the Grand Casino, Hotel and Resort
account (or other applicable accounts) for the implementation, negotiation, operation,
enforcement, procurement, settlement, and or completion of this contract, compact, regulation or
agreement by the Tribal Chairman or his designate IS HEREBY AUTHORIZED.

A RESOLUTION APPROVING A FEE-TO-TRUST ACQUISITION APPLICATION TO

THE (NON-GAMING/ON RESERVATION) CHURCH OF GOD PROPERTY
WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of American Indians with

Act of June 26, 1936, (49 Stat. 1967); and
WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in Tribal tradition,

recognized by treaties with the United States and in the Constitution of the United States;
and
WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution provides for a

specific powers to other entities of the Tribal government; and, except for these specific
limitations, all other general powers of government are embodied in the Legislature's
authority "to enact legislation, transact business, and otherwise speak and act on behalf of

WHEREAS, the Citizen Potawatomi Nation is making application to the Southern Plains Regional
Office of the Bureau of Indian Affairs to request transfer of "fee-simple" title to the
"United States of America in Trust for the Citizen Potawatomi Nation"; and
WHEREAS, the Legislature believes that increasing the tribal land base furthers the pursuit of Tribal
Self Determination and allows future generations of tribal leaders to have the flexibility
to use the land for the health, welfare, and sovereignty of the Citizen Potawatomi Nation;
and
WHEREAS, Section 5 of the Indian Reorganization Act of June 18, 1934 (48 Stat. 985; 25 USC 465)
provides authority for the Fee-to-Trust acquisition; and

WHEREAS, the property is ON-reservation or within the former reservation boundaries of the Citizen
Potawatomi Nation, legally described in Attachment A; and listed in the Pottawatomie
County Treasurer's records as parcel ID
#0000-30-010-004-0-041-00 (Church of God Evening Light Saints tract);
#0000-30-010-004-0-038-00 (Church of God tract); and
#0000-30-010-004-0-042-00 (Trustees of Church of God tract); and
WHEREAS, the property was purchased with tribal funds for NON-gaming use and the land, to which
the Citizen Potawatomi Nation owns the surface rights in fee simple, is not currently
under lease; and
WHEREAS, there are improvements with ingress and egress for adequate traffic services; and
WHEREAS, the current and proposed land use is housing and Tribal Self-Determination; increasing the
tribal land base which furthers the pursuit of Tribal Self Determination and allows future
generations of tribal leaders to have the flexibility to use the land for the health, welfare,
and sovereignty of the Citizen Potawatomi Nation; and,
WHEREAS, the Citizen Potawatomi Nation agrees to indemnify and hold harmless the United States,
its agents and employees, against any lawsuits, loss, expense, and claim potentially filed
against the tribe for any damages relating to asbestos and lead-based paint, if any,
associated with the improvements located on the property described in Attachment A.

contributes to law and order; (6) removes isolation; (7) provides access to education and
cultural activities; (8) provides access to hospital facilities; (9) contributes to accident
prevention; and (10) provides emergency services; and

consolidate various Employment Training and related programs; and
WHEREAS, Public Law 102-477 permits the consolidation of funding received for these
programs and allows greater flexibility in the development, coordination and
operation of said programs; and

WHEREAS, the United States Congress has appropriated a sum of money to the Citizen
Potawatomi Nation under Title V and VI of the Coronavirus Aid, Relief, and
Economic Security Act ("CARES") Act (hereafter, CVRF); and
WHEREAS, the CARES Act and evolving guidance thereon promulgated by the United States
Department of the Treasury permit the Nation to administer its CVRF for all
appropriate purposes, and the Nation desires to do so, and has already done so and
in addition to continuing to operate existing programs now establishes further
programs for assistance and modifies certain existing programs to (i) allow verified
narrative statements as proof of need for awards of up to $500 for individual
COVID-19 related expenses; (ii) establish a program to fund up to $3,000 with
appropriate documentation to help prevent foreclosure and eviction; (iii) lower the
age limit for existing CVRF programs for elder assistance to age 60, while

maintaining CVRF established programs for food security for the elderly and the
disabled of $200 per month and housing security for elders of $500 per month for
up to three months; (iv) expand the scope of college prep reimbursement assistance

potential reimbursement of up to $100; (v) establish that students who are 3-19
years of age are eligible for non-post-secondary student assistance of $300 and the
non-post-secondary student technology assistance of $400; (vi) include part-time
students in the post-secondary technology and student support programs that
awards up to $1,150; and, consistent with other purposes appropriate to CVRF,
further has determined that the Nation may implement hazard pay for public
health/safety workers and upgrades to critical public health infrastructure; and,
WHEREAS, these programs and modifications will be included in the living document entitled
"Citizen Potawatomi Nation Regulations on Usage of CARES Act Corona Virus
Relief Fund".

WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution
provides for a separation of powers of the Tribal government by the
reservation and delegation of specific powers to other entities of the Tribal
government; and, except for these specific limitations, all other general
powers of government are embodied in the Legislature's authority "to
enact legislation, transact business, and otherwise speak and act on behalf
of the Citizen Potawatomi Nation in all matters on which the Nation is

WHEREAS, Article 14, Section 1, of the Constitution of the Citizen Potawatomi
Nation states that "the regular meetings of the Legislature shall be held the
last Thursday in February, May, August and November unless otherwise

WHEREAS, the U.S. Department of Health and Human Services (DHHS) Indian Health Service
Administration (IHS) Community Opioid Intervention Pilot Projects (COIPP)
grants program has announced the availability of grant funding to address the opioid
crisis in tribal communities by developing and expanding community education and

Native communities and reduce unmet treatment needs.

Program Behavioral Health expansion project; and
WHEREAS, the CPN health program proposes to expand the Behavioral Health facility using
Small Ambulatory Program (SAP) funds awarded by the Indian Health Service in
the amount of $2,000,000 and tribal funds, available and designated for the
proposed SAP project, in the amount of $275,000 for a total estimated project cost
of $2,275,000; and

WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of American
Indians with Constitutional authority under the Act of June 18, 1934 and
the Oklahoma Indian Welfare Act of June 26, 1936, (49 Stat. 1967); and
WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in
Tribal tradition, derived from a history of organized self-government since
time immemorial, and recognized by treaties with the United States and in
the Constitution of the United States; and
WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution provides
for a separation of powers of the Tribal government by the reservation and
delegation of specific powers to other entities of the Tribal government;
and, except for these specific limitations, all other general powers of
government are embodied in the Legislature's authority "to enact
legislation, transact business, and otherwise speak and act on behalf of the
Citizen Potawatomi Nation in all matters on which the Nation is empowered
to act now or in the future"; and
WHEREAS, the U.S. Department of Education's Office of Career, Technical, and Adult
Education has allocated FY 2021 funds and is soliciting grant applications
for its Native American Career and Technical Education Program
(NACTEP) to help create or expand opportunities for individuals to obtain
recognized postsecondary credentials in Science Technology, Engineering,
Mathematics, or Computer Science; and

WHEREAS, the Citizen Potawatomi Nation proposes submitting an application to fund
a coordinated effort to help create or expand opportunities for individuals
to obtain recognized postsecondary credentials in Science, Technology,
Engineering, Mathematics, or Computer Science; and
WHEREAS, the proposed project is for a five-year period with a total estimated cost of
up to $500,000 per year with no matching funds required.
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE
CITIZEN POTAWATOMI NATION that a resolution supporting the Citizen
Potawatomi Nation's application for funding to the U.S. Department of Education's Office
of Career, Technical, and Adult Education, FY 2021 Native American Career and
Technical Education Program (NACTEP) IS HEREBY APPROVED.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that by act of this resolution
and consistent with the separation of powers defined in the Constitution, if awarded, an

APPLICATION FOR SUPPLEMENTAL FUNDING UNDER THE CENTERS FOR
DISEASE CONTROL AND PREVENTION (CDC) CORONAVIRUS AID,
RELIEF, AND ECONOMIC SECURITY (CARES) ACT FUNDING.
WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of American
Indians with Constitutional authority under the Act of June 18, 1934 and
the Oklahoma Indian Welfare Act of June 26, 1936, (49 Stat. 1967); and
WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in

time immemorial, and recognized by treaties with the United States and in
the Constitution of the United States; and
WHEREAS, Article 4, Section 3 of the Citizen Potawatomi Nation Constitution provides

WHEREAS, the United States Congress appropriated funding to the Centers for Disease
Control and Prevention (CDC) under the Coronavirus Aid, Relief, and
Economic Security (CARES) Act to support tribal public health emergency
response to COVID-19 through a non-competitive grant - Supporting Tribal
Public Health Capacity in Coronavirus Preparedness and Response; and
WHEREAS, the Citizen Potawatomi Nation was awarded a total of $489,881 in 2020 by
the CDC under this non-competitive grant to carry out public health
emergency response activities in response to COVID-19; and

WHEREAS, the CDC has announced supplemental funds in the amount of $50,000 per
recipient, available to current recipients of the grant, to augment or expand
activities to support the tribal public health emergency response to COVID-
19, for a project period of just over one year, from April 12, 2021 through
June 9, 2022; and
WHEREAS, the original award was restricted to public health emergency response
activities and the Citizen Potawatomi Nation recognizes the need to
similarly use the supplemental funds of $50,000 to expand mitigation and
emergency response activities in response to COVID-19.
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE
CITIZEN POTAWATOMI NATION that a resolution supporting the Citizen
Potawatomi Nation's application for supplemental funding under the Centers for Disease

Emergency Rental and Utility Assistance Program for tribal members; and

improve Tribal law enforcement and justice systems with the stipulation
that these funds are available for a variety of specified purposes as outlined
in "Purpose Areas"; and

of vehicles, equipment and supplies for the Tribal Police department with
an estimated three-year project cost of up to $900,000; and

WHEREAS, the Legislature believes that increasing the tribal land base furthers the pursuit of Tribal
Self Determination and allows future generations of tribal leaders to have the flexibility
to use the land for the health, welfare, and sovereignty of the Citizen Potawatomi Nation;
and
WHEREAS, Section 5 of the Indian Reorganization Act of June 18, 1934 (48 Stat. 985; 25 USC 465)
provides authority for the Fee-to-Trust acquisition; and

WHEREAS, the property is ON-reservation or within the former reservation boundaries of the Citizen
Potawatomi Nation, legally described in Attachment A and listed in the Pottawatomie
County Treasurer's records as parcel ID #0000-30-010-004-007-00 and parcel ID #0000-
30-010-004-0-027-00 (Hardesty Grocery); and
WHEREAS, the property was purchased with tribal funds for NON-gaming use and the land, to which
the Citizen Potawatomi Nation owns the surface rights in fee simple, is not currently
under lease; and
WHEREAS, the current and proposed land use is economic development, Tribal Self-Determination and
increasing the tribal land base which furthers the pursuit of Tribal Self Determination and
allows future generations of tribal leaders to have the flexibility to use the land for the
health, welfare, and sovereignty of the Citizen Potawatomi Nation; and,
WHEREAS, there are improvements with ingress and egress for adequate traffic services; and
WHEREAS, the Citizen Potawatomi Nation agrees to indemnify and hold harmless the United States,
its agents and employees, against any lawsuits, loss, expense, and claim potentially filed
against the tribe for any damages relating to asbestos and lead-based paint, if any,
associated with the improvements located on the property described in Attachment A.

Scattered Locations" to the U.S. Indian Health Service (IHS) under the office of
Environmental Health Sanitation Facilities Construction Branch under the authority of
P.L. 86-121 for the construction of sanitation facilities; and
WHEREAS, the IHS will provide the funds and the Citizen Potawatomi Nation will design and
construct the facilities under the provisions of the Self-Governance Compact that became
effective in fiscal year 1998. The total cost to IHS for providing sanitation facilities to 38
eligible homes is $750,000; and

WHEREAS, the Citizen Potawatomi Nation fully supports the entire project for the construction of
sanitation facilities as provided by the provisions of its Self-Governance Compact with
IHS/DHHS that became effective in fiscal year 1998, and the Multi-year Funding
Agreement 2018-2022 (MFA) with the IHS/DHHS executed by these parties and
effective in April, 2018, in connection with said compact.
NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE CITIZEN
POTAWATOMI NATION, that a resolution supporting an increase in funding offered by the Indian
Health Services for the Citizen Potawatomi Nation's sanitation facilities construction program under P.L.

WHEREAS, the Citizen Potawatomi Nation is a federally recognized Tribe of

WHEREAS, the Citizen Potawatomi Nation has sovereign powers that are inherent in

WHEREAS, the Secretary of the Interior approved the transfer of trust fund
responsibility to the Citizen Potawatomi Nation and its wholly owned
enterprise, First National Bank & Trust Company; and
WHEREAS, the Secretary of the Interior approved a Trust Fund Management Plan for
First National Bank & Trust Co.; and

retain their original tax exempt characteristics; and

Facilities Construction Branch under the authority of P.L. 86-121 for the construction of
sanitation facilities; and
WHEREAS, the IHS will provide the funds and the Citizen Potawatomi Nation will design and
construct the facilities under the provisions of the Self-Governance Compact that became
effective in fiscal year 1998. The total cost to IHS for providing sanitation facilities to 42
eligible homes is $330,500 with a tribal contribution of $3500 for a total of $334,000;

in a Community Services Block Grant (CSBG) to deliver such assistance;

WHEREAS, DOJ plans to award formula funding based on Tribal population in support of
OVC's mission is to provide support to tribal communities to improve services for
victims of crime; and

NOW, THEREFORE BE IT RESOLVED BY THE LEGISLATURE OF THE
